Further, <strong>in</strong> relation to education, themission was told that class numbers are very high (up to 90 <strong>in</strong> some schools) whichhas a detrimental effect on the standard <strong>of</strong> education received <strong>in</strong> the affected areas.In spite <strong>of</strong> all these hardships, <strong>of</strong> course, not all IDPs want to return to their villages.IDPs <strong>in</strong> south-east <strong>Turkey</strong> can generally be divided <strong>in</strong>to three groups – those whowant to stay <strong>in</strong> the city, those who want to return to their villages permanentlyand those who want to return just <strong>in</strong> the summer, due to harsh w<strong>in</strong>ter weatherconditions.In light <strong>of</strong> the above, it was clear to the mission that severe action needs to be taken– both domestically and <strong>in</strong>ternationally – to improve the plight <strong>of</strong> <strong>Turkey</strong>’s IDPs.Although the Turkish authorities have <strong>in</strong>stituted some mechanisms which aimto provide redress to its victims <strong>of</strong> <strong>in</strong>ternal displacement, the mission found thatthese fail to meet the requisite standards, as will be expla<strong>in</strong>ed and elaborated <strong>in</strong> thefollow<strong>in</strong>g sections.In addition to <strong>Turkey</strong>’s commitments under EU Accession standards, <strong>Turkey</strong> isparty to many <strong>in</strong>ternational declarations, conventions and treaties, the majority <strong>of</strong>which are legally b<strong>in</strong>d<strong>in</strong>g. <strong>The</strong> most significant obligations regard<strong>in</strong>g the rights toenjoyment <strong>of</strong> property, home and freedom <strong>of</strong> person, as well as safety <strong>of</strong> persons<strong>in</strong> armed conflict, are the Universal Declaration <strong>of</strong> <strong>Human</strong> Rights (UDHR), theInternational Covenant on Civil and Political Rights (ICCPR), the United NationsGuid<strong>in</strong>g Pr<strong>in</strong>ciples on Internal Displacement, and the European Convention for theProtection <strong>of</strong> <strong>Human</strong> Rights and Fundamental Freedoms (ECHR).1. Universal Declaration <strong>of</strong> <strong>Human</strong> Rights<strong>The</strong> General Assembly <strong>of</strong> the United Nations (UNGA) adopted the UniversalDeclaration <strong>of</strong> <strong>Human</strong> Rights (UDHR) on December 10, 1948. <strong>Turkey</strong> acceptedthe UDHR <strong>in</strong> 1949. One <strong>of</strong> the objectives <strong>of</strong> the Declaration was to protect humanrights by the rule <strong>of</strong> law so that man is not ‘compelled to have recourse, as a lastresort, to rebellion aga<strong>in</strong>st tyranny and oppression.’ Some <strong>of</strong> the articles <strong>in</strong> theUDHR that perta<strong>in</strong> to the <strong>in</strong>ternal displacement <strong>of</strong> the <strong>Kurds</strong> from the Southeast<strong>in</strong>clude Article 2: which seeks to prevent discrim<strong>in</strong>ation on any grounds; Article 3:the right to life; Article 7: equality before the law; Article 8: the right to an effectiveremedy; Article 12: right to privacy, family and home life; and Article 17: right toproperty.5 Universal Declaration <strong>of</strong> <strong>Human</strong> Rights.
