The Status of Internally Displaced Kurds in TurkeyAnnex 1 – Law 5233Law pertaining to compensation of damages resulting from terrorism or thestruggle to combat terrorismLaw no. 5233 date of acceptance: 17.7.2004AimArticle 1 – the aim of this law is to define the principles and procedures pertainingto the paying of compensation to persons suffering losses caused by terrorist actionsor activities carried out in the struggle against terrorism.ScopeArticle 2 – this law encompasses provisions concerning the principles and procedurespertaining to the peaceful paying of compensation to real persons and legal personssuffering losses as a result of actions within the context of articles 1, 2 and 3 of Anti-Terror Law no. 3713 or activities carried out in the struggle against terrorism.The following losses are excluded from the scope of this law:a) Losses met by the state through the allotment of land or house or by othermeans.b) Losses met in accordance with a court decision or articles 30 and 31 of Lawno. 4353 pertaining to certain amendments made to duties of the LegalConsultant’s Office of the Treasury, procedures of the pursuance of public casesand permanent positions in central and provincial government.c) Losses met by order of the European Court of Human Rights on the groundsthat article 41 or protocols of the Convention protecting Fundamental Rightshad been violated or compensation paid as a result of friendly settlementenvisaged by provisions of the Convention.d) Losses incurred as a result of economic or social causes other than terrorism51
