JULY 2012IMMIGRATIONMATTERS:NEW CHANGES INEFFECTContributed by: S<strong>and</strong>raSu<strong>the</strong>rl<strong>and</strong>, RCICIn <strong>the</strong> April 2012 issue <strong>of</strong> <strong>the</strong>Insight, I reported that <strong>the</strong>government vowed to wipe outapproximately 300,000 pendingapplications (presumably from<strong>the</strong> federal skilled workersprogram) by discontinuing <strong>the</strong>irprocessing after years <strong>of</strong> sittingin <strong>the</strong> processing queue. It wasannounced in <strong>the</strong> Federal Budgetthat a backlog <strong>of</strong> about 284,000non-Canadians (representingapplicants, <strong>the</strong>ir spouses <strong>and</strong>dependents) would have lost <strong>the</strong>irplace in <strong>the</strong> queue <strong>and</strong> have toreapply again under new policies<strong>and</strong> procedures because <strong>the</strong>ywould not be processed.Many applicants, along with <strong>the</strong>irrepresentatives, were shocked<strong>and</strong> deeply troubled by thisdecision. Consequently, peoplestarted to speak out against thisinjustice. But, individually eachvoice cannot even amount to awhisper in <strong>the</strong> ears <strong>of</strong> JasonKenney, <strong>the</strong> Minister <strong>of</strong>Citizenship, Immigration <strong>and</strong>Multiculturalism. When joinedtoge<strong>the</strong>r with hundreds orthous<strong>and</strong>s <strong>of</strong> o<strong>the</strong>r voices, <strong>the</strong>iroutcries st<strong>and</strong>s a better chance <strong>of</strong>reaching <strong>the</strong> ears <strong>of</strong> <strong>the</strong>authorities.In addition to being a member <strong>of</strong><strong>the</strong> Immigration Consultants <strong>of</strong>Canada Regulatory Council(ICCRC), I am also a member <strong>of</strong><strong>the</strong> Canadian <strong>Association</strong> <strong>of</strong>Pr<strong>of</strong>essional ImmigrationConsultants (CAPIC). CAPIC isa non-pr<strong>of</strong>it pr<strong>of</strong>essionalassociation which is founded onfour pillars: Lobbying,Education, Information, <strong>and</strong>Recognition. Members <strong>of</strong> CAPIC<strong>and</strong> o<strong>the</strong>r lobby groups joinedforces <strong>and</strong> sought to defy <strong>the</strong>government’s decision regardingwiping out <strong>the</strong> backlog <strong>of</strong>unprocessed Federal SkilledWorker Program (FSWP)applications.CAPIC’s lobbying effort werefruitful. Court actions werelaunched against CIC <strong>and</strong> amoratorium on <strong>the</strong> plannedbacklog clearance was granted to<strong>the</strong> approximately 900 litigantswho took CIC to court over <strong>the</strong>unjust stoppage <strong>of</strong> <strong>the</strong> processing<strong>of</strong> <strong>the</strong>ir applications under <strong>the</strong>FSWP. So, during <strong>the</strong> next 90days or so none <strong>of</strong> <strong>the</strong> litigants’unprocessed files should bereturned to <strong>the</strong>n. The governmentcontinues to strive forward withachieving <strong>the</strong>ir goals <strong>and</strong> has yetano<strong>the</strong>r bill in waiting. TheFederal Court <strong>of</strong> Canada had tobe asked to enforce this rulingagainst CIC so that <strong>the</strong>processing <strong>of</strong> <strong>the</strong> applicants’cases can be resumed. Thegovernment launched Bill C-38,which is expected circumvent <strong>the</strong>temporary pause to <strong>the</strong>backlogged FSWP applications<strong>and</strong> move ahead with <strong>the</strong>irintended process <strong>of</strong> refunds <strong>and</strong>backlog eliminations.Much more has been happeningwith CIC <strong>and</strong> prospectiveimmigrants. June 29, 2012 wasslated to be <strong>the</strong> last business dayfor certain prospective applicantsto get <strong>the</strong>ir completed applicationpackages in to CIC <strong>of</strong>fices. Many<strong>of</strong> us immigration representativeshave been working exorbitanthours in efforts to ensure that ourclients’ cases could be submittedto CIC <strong>of</strong>fices before thisanticipated cut<strong>of</strong>f date.On June 28, 2012, <strong>the</strong> Ministerannounced that effective <strong>July</strong> 1,2012, as a part Canada’sEconomic Action Plan 2012, CICwill place a temporary pause onnew applications to <strong>the</strong> FSWP<strong>and</strong> federal Immigrant InvestorProgram (IIP). Applications in<strong>the</strong> FSWP received after <strong>July</strong> 1 stwill not be processed unless <strong>the</strong>applicant has secured arrangedemployment or is applying under<strong>the</strong> PhD eligibility stream.On June 29, 2012, CICannounced on <strong>the</strong>ir website that<strong>the</strong> Protecting Canada’sImmigration System Act (BillC-31) received Royal Assent onJune 28, 2012. According to <strong>the</strong>Immigration <strong>and</strong> Refugee Board<strong>of</strong> Canada’s (<strong>the</strong> IRB) website itwas slated for June 29, 2012.Continue on page 6.PAGE 5

JULY 2012CONSTITUTION REVIEWCOMPLETEDThe members <strong>of</strong> <strong>the</strong> <strong>St</strong>. <strong>Vincent</strong> <strong>and</strong> <strong>Grenadines</strong><strong>Association</strong> have finally completed <strong>the</strong> arduoustask <strong>of</strong> reviewing <strong>and</strong> making changes to <strong>the</strong>current constitution. This exercise began in 2008<strong>and</strong> was completed on May 27, 2012. Once <strong>the</strong>new constitution is vetted by a legal counsel <strong>and</strong>approved by <strong>the</strong> provincial government, it willbring <strong>the</strong> organization into <strong>the</strong> 21st Century.Some major changes to <strong>the</strong> document willinclude <strong>the</strong> inclusion <strong>of</strong> a separate Board <strong>of</strong>Trustees. This new document will also provide arole for <strong>the</strong> Past Presidents Council. Term <strong>of</strong><strong>of</strong>fice will be increased from one year to two.Elections will no longer take place at <strong>the</strong> AnnualGeneral Meeting in January.Once <strong>the</strong> new document is in place,election <strong>of</strong> <strong>of</strong>ficers will now be held in Novemberwhich will allow for a smooth transition at <strong>the</strong>AGM in January. The new document will also seechanges in <strong>the</strong> st<strong>and</strong>ing committees <strong>of</strong> <strong>the</strong>organization. Three new st<strong>and</strong>ing committeeshave been added, Youth, Seniors <strong>and</strong> Relief. JULY 2012SVGAT’s Adopted Children Pass Common Entrance ExamsDonlee Su<strong>the</strong>rl<strong>and</strong> <strong>and</strong> Kadesha Nichols, twostudents in <strong>the</strong> SVGAT’s Adpot-A-Child Programwere successful in <strong>the</strong> Common Entrance Exams in<strong>St</strong>. <strong>Vincent</strong> <strong>and</strong> <strong>the</strong> <strong>Grenadines</strong>. In 2007 <strong>the</strong> <strong>St</strong>.<strong>Vincent</strong> <strong>and</strong> <strong>the</strong> <strong>Grenadines</strong> <strong>Association</strong> <strong>of</strong> Torontoaccepted to venture into a program to assist primaryschool children in <strong>St</strong>. <strong>Vincent</strong> <strong>and</strong> <strong>the</strong> <strong>Grenadines</strong>to help <strong>the</strong>m financially to build a foundation toprepare <strong>the</strong>m for <strong>the</strong> education <strong>and</strong> life afterprimary school.The program was being advertised in <strong>the</strong><strong>Association</strong>’s newsletter for many years prior butnothing was really done about it until that timewhen it was decided that <strong>the</strong> <strong>Association</strong> shouldtake <strong>the</strong> plunge. The <strong>the</strong>n Relief Committee <strong>of</strong> <strong>the</strong><strong>Association</strong> presented a program that was acceptedby <strong>the</strong> membership to choose one child as a start<strong>and</strong> provide <strong>the</strong> support starting with $600.00 in <strong>the</strong>first year with <strong>the</strong> amount increasing by $120.00each year for <strong>the</strong> next 4 years to make a totalcontribution <strong>of</strong> Cdn$4,200.00. It was decided <strong>the</strong>nthat <strong>the</strong> funds should be sent at <strong>the</strong> beginning <strong>of</strong>each year, starting January 2008.The names <strong>of</strong> all SVG government primary schoolswere put into a hat <strong>and</strong> <strong>the</strong> Spring VillageMethodist School was chosen from which a studentwas to be selected to begin <strong>the</strong> program. Theschool <strong>and</strong> <strong>the</strong> Ministry <strong>of</strong> Education werecontacted <strong>and</strong> a local committee from SpringVillage chose Master Donlee Su<strong>the</strong>rl<strong>and</strong>, a grade 2student to be <strong>the</strong> recipient <strong>of</strong> this assistance.Immediately as this was announced to ourcommunity, Mr. Allan John who resides in London,Ontario contacted <strong>the</strong> <strong>the</strong>n president <strong>of</strong> <strong>the</strong><strong>Association</strong> stating how pleased he was to learn <strong>of</strong><strong>the</strong> program <strong>and</strong> he <strong>of</strong>fered to sponsor a childthrough <strong>the</strong> <strong>Association</strong>.
