(6) <strong>Dispute</strong> <strong>Resolution</strong> Mechanisms <strong>in</strong> <strong>Turkey</strong> International Projects which conta<strong>in</strong> a foreign element, mean<strong>in</strong>g: either a foreigncontractor alone or be<strong>in</strong>g the lead partner of a jo<strong>in</strong>t ventureor consortium, or the f<strong>in</strong>anc<strong>in</strong>g of a project is provided by aforeign fund<strong>in</strong>g <strong>in</strong>stitution, or a foreign-orig<strong>in</strong> orig<strong>in</strong> privateemployer do<strong>in</strong>g bus<strong>in</strong>ess <strong>in</strong> <strong>Turkey</strong>. Public Authorities can tender <strong>in</strong>ternational projects and aslong as the project is considered to have a foreign element,public authorities are not constra<strong>in</strong>ed by the PublicProcurement Law or the Public Procurement Contracts Law. They can use different procurement procedures andpr<strong>in</strong>ciples as def<strong>in</strong>ed <strong>in</strong> the f<strong>in</strong>ancial agreements by which theprojects are to be funded; and then can make and enter <strong>in</strong>tocontracts, such as <strong>FIDIC</strong> or other <strong>in</strong>ternational type contracts
