Introduction• Dur<strong>in</strong>g socialism the Designer, Contractor<strong>and</strong> Employer were the parties <strong>in</strong> the<strong>in</strong>vestment process, all state ownedcompanies.• In 1989 socialism collapsed <strong>and</strong>privatisation started. State ownedcompanies could not survive <strong>in</strong> the newmarket• Private property required new rules <strong>in</strong> the<strong>in</strong>vestment process, but <strong>in</strong> the first 15 yearsmore was ru<strong>in</strong>ed, less improved• <strong>Bulgaria</strong> is EU Member from 2007<strong>Claims</strong> <strong>and</strong> <strong>Disputes</strong> <strong>under</strong> <strong>FIDIC</strong> <strong>Contracts</strong> <strong>in</strong> <strong>Bulgaria</strong> 2

<strong>Claims</strong> <strong>under</strong> <strong>FIDIC</strong> <strong>Contracts</strong>• In the small EC funded Works <strong>Contracts</strong>the Contractors were <strong>Bulgaria</strong>n companiesused to agree with the <strong>Bulgaria</strong>n Employerthe additional costs <strong>and</strong> Time Extensionfollow<strong>in</strong>g the pr<strong>in</strong>ciple: “If you claim, I shallnever order you any work <strong>in</strong> future”• When the bigger <strong>in</strong>frastructure projectsstarted, the M<strong>in</strong>istries were not preparedfor claims management <strong>and</strong> they did notknow how to mitigate the risks, besidesbe<strong>in</strong>g frustrated with <strong>FIDIC</strong>. Usual Reasons for <strong>Claims</strong>• Late Access to Site – usually somenational procedures are not fulfilled <strong>in</strong>time• Unforeseeable Physical Conditions –geology <strong>and</strong> hydrogeology conditions <strong>in</strong>most cases differ from those <strong>in</strong> TS• Delay <strong>in</strong> the design <strong>and</strong> /or designerrors• Additional f<strong>in</strong>anc<strong>in</strong>g for variationsimplicat<strong>in</strong>g cost <strong>in</strong>crease cannot beprovidedAdriana Spassova: <strong>Claims</strong> <strong>and</strong> <strong>Disputes</strong> <strong>under</strong> <strong>FIDIC</strong> <strong>Contracts</strong> <strong>in</strong> <strong>Bulgaria</strong> 8
