Lighting a fire in a Fire Protected AreaIn accordance with legislation, a permit is needed from theDepartment of Sustainability and Environment during theProhibited Period (see Fire danger terms, page 15, and theGlossary, page 57) to light a fi re in Fire Protected Areas.Fire Protected Areas are parks and forests managed by theDepartment of Sustainability and Environment and someland within 1.5 km of this public land (see Glossary,page 56).However, a permit is not usually required for such activitiesas campfi res and barbeques if they meet the requirementsoutlined in the relevant regulations. Burning rubbish in the Fire Danger PeriodIn accordance with legislation, a fi re can only be lit in anincinerator during the Fire Danger Period without a permit if:• the fi re is restricted to the incinerator;• the air movement is no stronger than 10 kph;• the area 3 m around and above the incinerator is clearedof fl ammable material;• a supply of water suffi cient to extinguish the fi re isavailable; and• a person is in attendance at all times while the fi re isalight. CFA Act 1958, s38A(b), 39Before burning rubbish at any time of the year, check thatthere are no local council requirements or restrictions andconsider whether there are better alternatives, such asrecycling or disposal at a registered landfi ll.
