He advised that the haulage business hadmoved to Dungannon. He reported that the proposal was for agricultural purposes <strong>and</strong>that the company was involved in the storage <strong>and</strong> distribution of fruit <strong>and</strong> had economicimplications for the area. He requested that the <strong>Council</strong> as a corporate body write toPlanning Service in support of the application.<strong>Council</strong>lor Irwin supported <strong>Council</strong>lor Campbell, confirming that the haulage businesshad been relocated <strong>and</strong> adding that the applicant came from a long established familywho had been growing apples in the area for a number of years.<strong>Council</strong>lor J Speers also supported the application adding that the proposal had beensubstantially reduced from that initially submitted. He suggested that the Officersdiscuss the contents of the <strong>Council</strong>’s letter with <strong>Council</strong>lor Campbell with a view toincluding the necessary details, facts <strong>and</strong> figures as supporting evidence for theapplication.<strong>Council</strong>lor Corrigan supported <strong>Council</strong>lor Campbell <strong>and</strong> the Morgan family.AGREED: that a letter of support for the Applicant be forwarded to Planning Servicein respect of the above application.3

Department was required to inform relevant interests of its view on the proposals. TheDepartment’s view on the proposal was that planning permission should be granted subjectto the conditions outlined.AGREED: that the <strong>Council</strong> adhere to its policy of objecting to such equipment.3.7 <strong>Armagh</strong> to Portadown Rail Line (31CT04)PREVIOUSLY CIRCULATED: letter dated 14 March 20<strong>08</strong> from Planning Serviceadvising that investigations relating to the <strong>Council</strong>s query had been initiated, however, dueto the Data Protection Act 1998 the Department was not currently in a position to providespecific details about the case. It was confirmed that the old railway line did not appear tohave any specific protection attached to it by the <strong>Armagh</strong> Area Plan.<strong>Council</strong>lor Mrs McRoberts expressed her concern that there was no Protection PreservationOrder on the old railway line as she had always believed this was the case <strong>and</strong> requestedthat a review of the early correspondence be undertaken. She explained that she had raisedthis issue from time to time over the past 10 years, always coming from the premise that theline was protected. She felt that the portion of the line that had been excavated may havelost the right to a Preservation Order. She believed that when the line was ab<strong>and</strong>oned GreatNorthern Railway had said that the railway bed would be maintained.Referring to the portion of the line which had been excavated, <strong>Council</strong>lor Mrs McRobertsfelt that it was important to take steps to ensure the preservation of the remainder. Shereported that Fermanagh <strong>District</strong> <strong>Council</strong> was looking at a strategy of engaging with theExecutive to re-open the current railway tracks <strong>and</strong> she felt that the <strong>Council</strong> should also bedoing this. She believed that <strong>Armagh</strong> had suffered because of the lack of rail link <strong>and</strong>coupled with the issues associated with too many cars, overuse of motorways etc she feltthat the <strong>Council</strong> should be bringing forward a campaign to have the railway re-opened.<strong>Council</strong>lor Mrs McRoberts proposed that the <strong>Council</strong> look towards bringing forward astrategy to have the railway between <strong>Armagh</strong> <strong>and</strong> Portadown re-opened.<strong>Council</strong>lor Irwin felt that if the railway line was to be preserved it should not have been soldoff, for very little, to farmers. He stated that there was a larger area behind the DobbinChurch which had been levelled off 15 years previous. He felt that it was sad that the l<strong>and</strong>had been practically given away <strong>and</strong> pointed out that there were buildings on the railwayline <strong>and</strong> nothing had been done to try <strong>and</strong> stop it.<strong>Council</strong>lor Mrs McRoberts stated that most of the rail bed between Portadown <strong>and</strong> <strong>Armagh</strong>was still there <strong>and</strong> not built up. She advised that about 10 years ago the University of Ulsterhad conducted a survey when only one house had been built quite close to the railway line.<strong>Council</strong>lor J Speers referred to a planning application some 15-20 years previous when ithad been proposed to build a house on the railway line in the vicinity of Crewcatt Road <strong>and</strong>that it had been turned down on the basis that the railway line was a protected route. Hesuggested that an investigation of the planning history would be prudent.In terms of <strong>Council</strong>lor Irwin’s comment regarding the area to the rear of the DobbinChurch, <strong>Council</strong>lor J Speers pointed out that part of the railway line tracks were still inexistence at this location.<strong>Council</strong>lor J Speers referred to the nature of the works carried out to the rear of StonebridgeFactory <strong>and</strong> felt that this had not caused an awful lot of damage to the railway line.6


<strong>Council</strong>lor Irwin stated that if there were no houses on the actual line there were severalwithin feet of it. He believed that if there was any intention to re-open the railway line thel<strong>and</strong> should not have been given away.AGREED: on the proposal of <strong>Council</strong>lor Mrs McRoberts, seconded by <strong>Council</strong>lor J Speersthat the <strong>Council</strong> spearhead a campaign to get railway line to <strong>Armagh</strong> re-opened.ALSO AGREED: that Planning Service be requested to provide details of the planninghistory for the length of the former railway line.In conclusion, <strong>Council</strong>lor J Speers pointed out that the railway line shut in 1956 <strong>and</strong> thatthere was a significant amount of time between that <strong>and</strong> the planning application refusedsome 15-20 years ago.3.8 Validation of Planning Applications (21PL09)PREVIOUSLY CIRCULATED: letter dated 27 March 20<strong>08</strong> from Planning ServiceHeadquarters advising that the <strong>Council</strong>’s correspondence to the Minister of the Environmenthad been forwarded to the Modernising the Planning Process Team for consideration <strong>and</strong>response. A copy of the response would be sent to the Minister’s office for information.NOTED.3.9 Planning Office Meetings (21PL09)NOTED: that the Planning Office Meetings would be held on Friday 25 April 20<strong>08</strong>.4.0 ANY OTHER RELEVANT BUSINESS4.1 Statement by <strong>Council</strong>lor N Sheridan, Deputy Mayor (11CM01)<strong>Council</strong>lor Sheridan made the following statement:“Colleagues, I as Deputy Mayor of this <strong>Council</strong> wish to place on record my Party’s anger<strong>and</strong> disgust as to the conduct of certain <strong>Council</strong>lors at the Executive Meeting held on the 3of April past.During the course of this meeting the Chairperson on the day of the Executive Meeting,<strong>Council</strong>lor Mary Doyle was subjected to a series of verbal assaults by two senior<strong>Council</strong>lors.These <strong>Council</strong>lors called into question <strong>Council</strong>lor Doyle’s integrity, the legitimacy of herposition on the <strong>Council</strong> <strong>and</strong> subjected her to, in my view, personal abuse of a sexist nature.Furthermore it was also suggested to her, in a sinister fashion that she was, <strong>and</strong> I quote“becoming a problem”.<strong>Council</strong>lor Doyle was at all times in the course of the meeting acting in the best interests ofthe ratepayers as is her function. My Party <strong>and</strong> I have considered these events verycarefully <strong>and</strong> we wish to make a number of points we believe to be of relevance to the<strong>Council</strong> as a whole.The function of this <strong>Council</strong> is to ensure that the ratepayers see value for their money.<strong>Council</strong>lor Doyle was upholding that function. This it appears was not to the liking of two7


4.3 Residents’ Parking – Gaol Square (21RD03)<strong>Council</strong>lor Miss Bratton reported that she had been approached by the residents of GaolSquare regarding the possibility of introducing a residents’ parking scheme <strong>and</strong> had raisedthe matter with Roads Service which had advised that the area in question was in theownership of the <strong>Council</strong>. She explained that the parking was particularly difficult for theresidents when large events were on eg International Road Race <strong>and</strong> requested that officersconsider her request.AGREED ACCORDINGLY.4.4 Proposed Closure of Rural Post Offices (31CT05)<strong>Council</strong>lor McNally referred to the proposed closure of rural Post Offices <strong>and</strong> thedetrimental impact this would have on the social <strong>and</strong> economic well-being of the ruralcommunity.
