Application No O/2007/0233/O in the Name of Mr J DonaldsonFollowing representations from <strong>Council</strong>lor J Speers, <strong>Council</strong>lor E Speers brieflyexplained the background to the above application <strong>and</strong> advised that the Agent had beenpresent prior to the meeting but had since left. He would be contacting Planning Servicethe following day.Mr Stoops confirmed that she had spoken to the Agent, he had undertaken to contactPlanning Service the following day <strong>and</strong> a meeting would be arranged. <strong>Council</strong>lor ESpeers would be invited to the meeting.NOTED.Application No O/2006/05<strong>22</strong>/O in the Name of Mr M QuinnThe Agent sought clarification regarding the Minister’s statement which referred to thedate applications were received rather than the date they were validated. He pointed outthat the above application was received by Planning Service on 10 March 2006.Mrs Stoops confirmed that Planning Service had received a letter from Mr Lindsay <strong>and</strong>a formal response would be issued before the end of the week. She pointed out that, interms of the legislation, it was a submission until it was validated <strong>and</strong> only then did itbecome an application. The application under consideration when initially submittedfell sort in terms of the fee <strong>and</strong> then the red line had been reduced with the result that itfell under the provisions of dPPS 14.Mr Lindsay felt that the process was unfair as it wasn’t issued throughout all ofNorthern Irel<strong>and</strong> as it was only issued in Ballymena, Craigavon <strong>and</strong> Belfast PlanningOffices.<strong>Council</strong>lor J Speers stated that in the past the <strong>Council</strong> had accepted the PlanningService’s explanation on the assumption that it was a policy applicable across the boardbut that it now transpired it was not <strong>and</strong> was specific only to some planning areas. Headded that the <strong>Council</strong> had previously considered applications that had missed thedeadline by just one day. He felt that clarity should be sought as to whether or not thepolicy was a Departmental Policy; where it was issued to; was it issued at the same time<strong>and</strong> was it introduced at the same time.<strong>Council</strong>lor Berry fully sympathised with the Agent, believing it to be a genuine case.He agreed with <strong>Council</strong>lor J Speers <strong>and</strong> felt that the issue should be raised directly withthe Minister <strong>and</strong> clarity sought in order to ensure that constituents were notdiscriminated against.<strong>Council</strong>lor Miss Haughey concurred with all that had been said in relation to this veryimportant issue. She referred to a number of applications, of which the <strong>Council</strong> wasaware, that had been sent back for matters of detail. In referring to the policy, whichreferred to applications ‘received’ she queried why the validation date was accepted.She felt that this case should be fought.<strong>Council</strong>lor Wilson believed that valid points had been made <strong>and</strong> supported clarificationbeing sought.Mrs Stoops referred to previous cases where representations had been made to theDepartment <strong>and</strong> to the response issued. She pointed out that the statement was from the3


Minister <strong>and</strong> that it was the legislation that determined what constituted a validapplication. In the case under consideration there had been a short-fall in the fee. This had been painted over by someone toobliterate the original painting, however, it had since been repainted. He requested that the<strong>Council</strong> write to Chief Inspector Mawhinney asking that attention be given to this area <strong>and</strong>to Roads Service asking for the painting to be removed before the matter becamecontentious. He reported that there was good cross community relations in this area.7
