These children’s diseasesin new customs procedures lasted shortly and were resolvedrather quickly. Beside such visible signs of change, it is not an easy››› andrea dokojelušićExecutive Directortask to sum up quickly what has changed in Croatia with the EU membership. Our Brusselsevent was a good moment for reminiscence: what actually happened in the past 3 months anddo we really feel more European?What has undoubtedly changed since July 1 is more inclusiveness for Croatia in the elite Europeanclub. The small celebration which we organized with our Brussels colleagues, offeredexcellent networking opportunities, but also a closer view to priorities for business and competitivenessin Europe and Croatia. The <strong>AmCham</strong> EU and Croatia were jointly surprised with theinterest and response of US companies which have their European government affairs officesin Brussels. It is rarely the case that you close registrations and inquiries for the event are stillcoming. Eagerly awaited, one of the first public speeches of Mr. Mimica in commissioner’s rolewas welcomed while Croatian MEPs showed their enhanced networking skills while answeringnumerous questions about Croatia. We were truly honored that H.E. Kenneth Merten, U.S.Ambassador to Croatia, joined us on that occasion and emphasized role of the trusted partnerwhich Croatia now has instead of country which needed support on its way to EU and NATO.The event confirmed that Croatia is perceived as interesting and welcome newcomer. However,what will happen after initial interest of companies interested in new markets, will dependon country’s competitive position relative to other countries. Competitiveness issues are thosewhich <strong>AmCham</strong> Croatia has been persistently addressing through its policy work. In this issuewe are informing you about recent meetings with key government officials based on severalpolicy initiatives: Croatian competitiveness in CEE with Deputy Prime Minister Grčić, meetingof <strong>AmCham</strong> and ACEA with representatives of Ministry of Environmental Protection and Natureregarding end of life vehicles, health care initiative for MEAT instead of lowest price criterion inpublic procurement and Labor law amendments. Chamber News›› The Environment andenergy Efficiencycommittee and ACEAMeeting with the Ministryof Environmental andnature ProtectionOn 18 July, the Environment and Energy EfficiencyCommittee and European AutomobileManufacturers Association (ACEA) helda meeting with Assistant Minister Obrdalj andDeputy Minister Dokoza to discuss the policyon the end-of-life vehicles (ELV).ACEA representatives presented experiencesfrom the European market and recommendedan individual model of ELV managementbased on market principles, since ELVsrepresent a highly valuable source of secondaryraw materials and thus have a highmarket value. The current fund model, whichinitially showed good results and reduced thenumber of improperly disposed ELVs, hasreached the stage where further developmentis needed as proposed in the new law.The Ministry has adopted a new law onwaste, which offers three models of wastemanagement: a fund, and collective and individualsystems. Representatives of the Ministryconfirmed that the manufacturer pays afee only once if it chooses the collective orfund system. Ministry representatives alsoannounced the drafting of an ordinance onspecial waste management within one yearof the adoption of the law. Manufacturershave suggested that in the meantime the feeis decreased from 0.85 to 0.45 kn/kg, due tolarge payments by the fund for incompletevehicles, which conflicts with the EU directiveon ELVs.<strong>AmCham</strong> and ACEA welcomed the Ministry’sdecision to include representatives ofthe <strong>AmCham</strong> Environmental Committee inthe working group for drafting the ordinanceon management of special categories ofwaste, and support the Ministry’s efforts tocooperate with other ministries in followingthe course of vehicles from first delivery tothe end of life. At the meeting, an exampleof a German certificate of destruction washanded to the Ministry’s representatives andit was suggested that such certification be introducedin Croatia.›› Supported event: “MBA Croatiaworkshop: NASA Experience – Teamleadership: Failure is not an Option”September 23Our member MBA Croatia has organized aworkshop ‘NASA: Failure is not an Option’ aboutcreating successful and efficient teams based on the experience gained intraining NASA astronauts by lecturer Dragos Bratasanu, an internationallyrenowned and award winning space scientist and consultant.This brief workshop presented the processes used by NASA to build itshighly successful technical teams and how other organizations in any otherindustry can implement this knowledge to trigger sustainable changeand increased performance in their teams. The information presentedhas boosted team performance in over 1,500 NASA project teams andFortune 500 companies, engineering teams, and management teams, includingthe people responsible for NASA’s most complex systems. Managingand improving the team social context is the key parameter thatdrives success or disaster in organizations.The participants learned how to improve engagement between divisionsby understanding their latent social signatures and by addressing theinterests in a way that can be easily accepted by other party and howto change the social context of relationships with important clients, toimprove performance and return.›› Trade & Investment CommitteeMeeting with Minister MrsićOn 25 July, <strong>AmCham</strong>’s Executive Director Andrea Doko Jelušić, PresidentIvan Vidaković (Microsoft Hrvatska), and Committee representativesBoška Trbojević (Coca-Cola HBC Hrvatska) and Dženet Garibović(PricewaterhouseCoopers) met with Minister Mrsić to present our ‘PositionPaper on Necessary Amendments to the Labor Act’. <strong>AmCham</strong>’s suggestionswere well accepted and the Minister stated his willingness tocontinue cooperation with <strong>AmCham</strong> on this issue. There are three majorgroups of changes that will be implemented in the new Law:1. Simplified termination of employment procedures and shortening ofstatutory deadlines and possibly notice periods2. Cost reduction through re-arranging work schedules3. Flexibilisation of work from home, part-time employment and temporaryagency work.Other notable changes are that the definition of a salary will not be in thelaw but will be regulated by the Ministry of Finance, and salary compensationduring sick-leave days will be specifically regulated by the Ministryof Health and the Croatian Health Insurance Fund.Also, a Labor Inspectorate will be constituted as a separate inspectorate,and no longer part of the General State Inspectorate.A public debate on the amendments to the law will be held during Septemberand October, and the Minister confirmed that he will be a speaker at the<strong>AmCham</strong> breakfast in October. The aim of the forum was to encourage adebate about the extent and significance of contributionslarge companies provide with their successful andresponsible business operations to the economic andsocial prosperity of the community.Coca-Cola also wanted to draw attention to the importanceof preserving and strengthening production activitiesfor overall economic progress and to encouragethe further strengthening of cooperation between largeenterprises, the Government and civil society to ensurenot only the economic, but also the social progress ofthe country.On this occasion, it also presented the Study on the Socio-EconomicImpact of Coca-Cola in Croatia in 2012,which highlights the company’s importance for Croatia’seconomy and shows its impact on the country’soverall progress and the company’s contribution to thisprogress.According to the carried-out research, it is evident thatCoca-Cola contributes significantly to the Croatian economyand that it is more Croatian than we think.Thus the contribution of Coca-Cola’s entire businesssystem in Croatia, which includes Coca-Cola’s companiesas well as all suppliers, trade partners and theirsuppliers, amounted to HRK 2.164 billion in 2012, whichconstitutes 0.7% of domestic GDP. As a result of its businessoperations, Coca-Cola provided HRK 1.232 billionor 2% of Croatia’s total tax revenues and supported7,400 jobs or 0.5% of the total number of jobs in Croatia.According to study data, for every HRK 1 in direct contributions,Coca-Cola generates another HRK 9 in indirectcontributions to Croatian GDP, and every job at Coca-Cola provides another 12 jobs in the wider economy.Coca-Cola contributes the biggest value to the tradesector (catering, retail, wholesale) and to the businessservices and manufacturing sectors. Coca-Cola’s contributionto the trade sector amounts to HRK 813 million,which represents 38% of total contributions to that sector.Annual tax contributions grew from HRK 530 millionin 1995 to HRK 1.232 billion in 2012. To mark the occasion, <strong>AmCham</strong> EU and <strong>AmCham</strong>Croatia organized a reception at the <strong>AmCham</strong> EU offices in Brussels,which included a keynote address by Neven Mimica, EU Commissionerfor Consumer Policy. Guests included representatives of theCroatian Government in Brussels, Croatian Members of the EuropeanParliament, representatives of the US government in Brussels, representativesof US industry in Europe, representatives from Business Associationsand H.E. Kenneth H. Merten, US Ambassador to Croatia.The reception was preceded by an invitee only briefing sessionon the top business priorities in the EU. The session openedwith introductions of the work of both organizations followed by adiscussion on policy priorities for ensuring that Europe is stronger,more competitive and dynamic. We all have a reason to celebratethis year: Croatia entered the Union and the American Chambersof Commerce to the EU is celebrating its 50th anniversary! I would liketo congratulate our American friends for this achievement and alsothank them for organising this event and welcoming Croatia to the EU!In these 50 years of the presence of <strong>AmCham</strong> in the EU, boththe US and the EU have passed through remarkable social andeconomic changes embracing new opportunities and processesthat had transformed our way of living and thinking. We have alsorecently witnessed difficult times as economic and financial crisis hitboth sides of the Atlantic and we had to deal with similar challengesin order to bring stability back to our citizens and markets. Nevertheless,we succeeded and our transatlantic partnership is even strongerthan before, looking at some common goals in the future and buildingan alliance on common ground around some global economic andsocial issues.The European Union itself had grown from 6 to 28 members,built a strong single market and created Euro… What we now haveis Europe coloured by its diversities with different peoples and culturesco-existing peacefully but united under one roof of theEuropean Union. The path to reach this goal was sometimes harshand buried with difficulties, but Europe nevertheless has stand talland many countries still, like once Croatia, wait in the line to becomemembers. This shows the strength of the European Union and itsgood prospects for the future. As such, Europe is trustworthy partnerto the world and to its American friend.Croatia itself had gone under many reforms to achievethe membership in the EU; during negotiation process with the EUwe also had a strong support from our transatlantic friend thathas never ended. For this we are very grateful to our American partnersand I am sure our overall relations can only get better in the yearsto come. I am happy to learn that the Americans started to flow intoCroatia in big numbers: we have seen some 15 % rise of Americantourists last year. This way our two nations can get to know eachother better and this could serve to improving our joint economicoutlook as well.<strong>No</strong>w, when Croatia is part of the EU, I believe we can help tobring the Americans even closer to Europeans and vice-versa.8 ISSUE 3/<strong>2013</strong>


MARK YOUR CALENDARSI know you have discussed about the TransatlanticTrade and Investment Partnership (TTIP)Agreement during today’s working session. Indeed,this issue is of huge importance for all: when thesenegotiations are completed, the EU-US agreementwould be the biggest bilateral trade deal ever negotiated!These negotiations give us a great opportunity toconfirm our mutual commitment to key values and bestpractices, in order to create common market spacethat would benefit consumers as well as businessmenacross both Atlantic coasts.As the Commissioner for Consumer Policy Iam aware of the great significance of this transatlanticdeal, especially in maintenance of health and safetystandards. Strict safety rules are sometimes viewedas a burden but I think wrongly so. We need them tobring back the confidence of consumers into marketsand this way boost the consumer demand of theeconomy, and as well overcome more easily barriers intransatlantic trade.In this process the input from all stakeholders,especially consumers’ organisations is quite valuable,in order to reach the best results for all.The TTIP offers a great opportunity to opennew economic possibilities and help both sides in futurebusiness endeavours. Our transatlantic successstory could continue even in the era of globalisation,when other new global players come into the scene,and thus our transatlantic partnership becomes evenstronger.And here we are back to our starting point:consumer policy is an economic policy as well andconsumers should be regarded as drivers forcompetition, innovation and growth. That is a sizable jump and shows that thenation’s macroeconomic conditions are gradually improving. A great deal of workneeds to be done but Croatia’s consumption-led economy, with the nation’s percapita GDP of roughly $13,000, some ten times larger than India’s, remains a keyattraction of the nation.Another: the nation’s existing trade and investment ties with Germany andItaly, two of Europe’s largest economies. The economy should emerge from recessionin the near term.With the right polices, and now a member of the EU, Croatia could emergeas a strategic commercial bridge for US firms, linking American businesses with expandingopportunities in Central Europe, southern Europe and the Mediterranean.Joseph Quinlan is the managing director and chief market strategist at U.S.Trust — Bank of America Private Wealth Management.His research is frequently cited in such media venues as Barron’s, The WallStreet Journal, The New York Times and the Financial Times.With nearly 30 years of financial services experience, Mr. Quinlan most recentlyserved as a senior global economist/strategist for Morgan Stanley. News&ViewsJuicy DecadeBack in 2007, the CEE region was about to enter its tenth year ofstrong corporate and economic expansion. It was growing, from today’sperspective at an unbelievable 7.5 percent per year, almost thesame as emerging Asia. <strong>No</strong>t long after that, as the global crisis started,the whole region was pushed into a deep recession. In the periodfrom 1999 to mid-2008, CEE enjoyed a decade of fast growth, whileoutperforming other emerging regions. It was a strong performancewith only few sporadic slowdowns in some countries. Sales jumpedyear after year, new investments were drawn into the region and theeconomy loved it.››› maja blaževićThe Plausible Perspective forCEE and CroatiaBy Maja Blažević, Head of Business development and Marketing, TPA Horwath d.o.o.reportObstacles to Faster GrowthThe CEE region is underperforming and this will be its sixth year inthe row. The EU went into a recession in relation to the debt crisis,lack of monetary and fiscal measures to stimulate growth as wellas the lack of corporate and household confidence. People turnedto less spending and more savings. As the largest part of the GDPin almost every CEE country is actually private spending, this significantlyreduces growth in a number of CEE markets. Bank lendingis weak and it is hard to see a recovery as many banks are still indeleveraging mode. The external debt burden is a major obstacle tofaster growth in the whole region. However, there are a few countries,such as Poland, Czech Republic and Turkey, whose economies havea better chance of bouncing back and should grow faster. Their externaldebt is below 70 percent of the GDP (when countries’ externaldebt comes close to or exceeds 70 percent of the GDP, they needexternal help) and they have better opportunities for improvement inthe next few years. As the majority of CEE countries are not in thatposition, it is no wonder that some global companies are thinking ofabandoning the region, which would be the worst thing they could doright now. It would be wiser to stay and build their brands and marketshares which will help them secure growth in the long run.Economic Outlook for CroatiaAccording to the Institute of Economics in Zagreb, most indicatorspoint to a continuation of negative economic trends and it appearsthat the downward trend should gradually wind down. A good touristicseason and optimism in Croatia regarding entering the EU couldbe the basis for changing the negative trend and a gradual recovery,that should most probably happen next year. However, this recoverywill be weak and unstable, primarily due to the existing economicimbalances and dependence on economic development in the EU.Statistics show that Croatia is still in recession. GDP fell by 1.5 percentin the first quarter of this year compared to the same period lastyear. A fall in personal consumption by 3 percent and a decline of 4.9percent in exports contributed to that situation the most. By the endof this year we can expect unemployment to rise to over 20 percentand to remain at this level next year, thanks to the weak labor demandfollowed by a continuous decline in economic activity. The good newsis that 2014 should bring us a weakening of the negative trends onthe labor market, stabilization of personal consumption, foreign traderecovery and further growth of investments. Even the current governmenthas embarked on some structural reforms, helped along by EUmembership requirements, and positive changes could be made alsoby advancement of our administration, cutting state expenditure anda change in the labor law. A smart move for Croatia would definitelybe to start electing chief executives of state-owned companies byinternational tenders instead of choosing politically appointed peoplewith questionable competencies.At LastHistory always repeats itself and the history of economics teachesus many things which should be taken into account when analyzingcurrent trends and trying to provide a forecast of the situation in CEEand Croatia. Excessive external debt levels and subsequent deleveragingalways impact business, which would still be a major burdenon growth of domestic demand in many CEE markets in the near future.We are heading towards 2014 and it is very likely that the regionwill not reach its growth potential, but it should slowly come out ofcontraction. Public debt will hopefully be back on a sustainable pathand the region should move forward with the necessary post-crisisstructural, institutional and macroeconomic adjustments.10 ISSUE 3/<strong>2013</strong>

However, over the past seven years, in only approximately25% of all antitrust infringement decisions that the European Commissionrendered did the injured parties turn to their national courtsto seek compensation. Moreover, it was mostly large companies whowere involved in such proceedings (and all of those in just seven EUmember states, primarily in the UK, Germany and the Netherlands),whereas small and medium enterprises and consumers rarely tookpart in the usually costly and demanding proceedings. The consequenceof such a lack of competition litigation is that individuals areleft without any form of compensation for the harm suffered, since thefines set by the competition authorities simply make an item on theincome side of the state budget.For all the above reasons, the European Commission hasbeen consulting on these issues for almost a decade, starting withthe Green Paper (2005), followed by the White Paper (2008) and theDraft Guidance Paper on Quantifying Harm (2011). The Commissionhas now decided to take the discussion to the next level and on 11Encouraging CompetitiBy Mario Krka, Senior Associate - Divjak, Topić & Bahtijarević Law firmEU competition law, as a vital tool for protecting and ensuringthe proper functioning of one of the greatest achievements of the EU– its single market, is one of the legal areas in which the community’sdimensions and harmonization play a significant role, and thereforeit is important for the Croatian lawyers and Croatian business in general.The evolution of EU competition law is still ongoing, and afterits quite successful harmonization from the public law perspective, itseems that the time has come to take steps to bring certain privatelaw institutes closer, in order to ensure that the level of protection ofthe rights of EU citizens is equal or at least comparable across theunion.Infringements of competition rules (cartels, abuses of a dominantposition etc.) in the vast majority of EU member states (Croatianot being an exception to the rule) are still regarded as the primarilyconcern of the state. Individuals usually show interest only if they arecompetitors of the infringer, since they have a strong incentive to fightagainst the forbidden practices the infringer is using to gain (unfair)advantage on the market. However, it is clear that the infringementscause not only harm to the competitors or to the market as an abstractterm, but a direct and, to a greater or lesser extent, measurableJune <strong>2013</strong> proposed a Directive aimed at removing the main obstaclesfor private enforcement in the EU (Proposal for a Directive of theEuropean Parliament and of the Council on certain rules governingactions for damages under national law for infringements of the competitionlaw provisions of the Member States and of the EuropeanUnion, COM(<strong>2013</strong>) 404), accompanied by several other documents(including the Commission Staff Working Document – Practical Guideon Quantifying Harm).It should not come as a surprise that it took almost 10 years forthe EU Commission to propose such a Directive, since harmonizing 28jurisdictions in private enforcement means touching on many nationallegal rules and standards, both substantial and procedural. For thisreason, we can expect many discussions on the proposal coming fromprobably all member states. A brief description of the main issues dealtwith in the Directive proposal, and the manner in which the EuropeanCommission proposes they be resolved, follows.First, it is important to ensure that the potential claimanthas sufficient time to prepare its case. The European Commissiontherefore proposes that the limitation period be set at the minimumof five years (with several rules on when it starts), but also that it be12 ISSUE 3/<strong>2013</strong>


News&Viewssuspended during the proceedings before the competition authority.However, even if there is enough time, it is impossible to prepare acase without sufficient evidence, and it is very demanding for claimantsto obtain the necessary data and information on competitioninfringements. The proposal is to oblige national courts to order disclosure,with certain limits and additional requirements. Furthermore,in many member states decisions by administrative bodies, includingcompetition authorities, are not mandatory for civil courts, meaningthat the claimants would potentially need to prove, again and on theirown, that the infringement existed. This is why the proposal is to makecourts bound by a final decision finding an infringement (made bya competition authority or review court, as the case may be). Twoother proposals significantly facilitating the position of claimants areto adopt a rebuttable presumption that the infringement caused harm,and to make all infringers jointly and severally liable. As for the typeof damages awarded, the Directive proposal is aiming at securing fullcompensation to the injured party, therefore also including lost profits.However, unlike in the US (which, due to the vast antitrust experience,still serves as a role model in this legal area), where private enforcementis also a punitive mechanism, the proposed model remainscloser to the European continental standards, leaving punishmentand, to a larger extent, deterrence to the competition authorities. Inorder not to allow for unjustified enrichment of claimants, the DirectiveIn parallel with the Directive proposal, the Commission hasadopted a recommendation encouraging introduction of collectiveredress mechanisms in cases of violations of EU law in general, includingcompetition rules. The recommendation goes hand-in-handwith the Directive proposal, but unlike the future Directive, it will notbecome mandatory for the EU member states. However, given thepractice of the European Commission on many different topics (suchas the one at hand) to start with non-binding documents, which leadto directives or even regulations, this might be just the first step inpromoting collective redress in the EU. The recommendation shouldbe interesting also to the Croatian lawmakers, since collective redresshas already been introduced into our legal system, but so far hasbeen used in a very modest number of cases.Since the first Croatian Competition Act in 1995, Croatia hascome a long way in understanding the concept of competition, developingthe competences of the competition agency and makingentrepreneurs aware of their obligations and liabilities when actingon the market. The Directive proposal announces an exciting new erain competition law development, not only in the EU in general, butalso specifically in Croatia. If and when adopted, the Directive shouldencourage currently non-existing competition litigation, resulting in avery challenging task for the judicial system, as competition cases willrequire well trained judges, possibly specialized in hearing only thosereporton Litigation in the EUproposal allows for passing-on defense. Finally, the proposal tries toencourage consensual dispute resolution, which in many cases maybe the best solution for all parties.cases. News&ViewsAs you probably all know, Croatia became the 28th member ofthe EU on 1 July <strong>2013</strong>, which placed it in the group of countries that arequalified to apply for a significant amount of EU funds (CF, ERDF, ESF,EAFRD, EMFF) that can be used to co-finance strategic projects to helpCroatia strengthen its knowledge, research, innovation, and economy,improve cohesion and strengthen underdeveloped rural areas, minimizeunemployment, while working towards the accomplishment of the EU2020 strategy. The timing of Croatia joining the EU was not perfect asit happened in the last six months of the 2007-<strong>2013</strong> programing period,which had implications for various activities in managing and operationalstructures within governmental and local authority institutions. This hasled to the need for preparation of the National Strategic Framework(NSF), Operational Programs (OP) and other relevant documents andstructures, performance of system audits and various other activities justfor the six month period, which I believe has taken some precious timethat should have been used for preparation for the programing period2014-2020, where a significant amount of EU funds (around 10 billionEuros) should be available to Croatia. The EU has noted that funds distributedto countries in the 2007-<strong>2013</strong> programing period were not used indefine the sectors, industries and niches that Croatia will work on and theareas offering opportunities to co-finance projects with EU funds. Preparationof these documents requires utmost strategic thinking and vision as towhere Croatia would like to be in the 2020, and also requires understandingof Croatia’s strengths and competitive advantages, where we couldadditionally benefit from reinforcement. In my opinion, in the past therewere no appropriate documents that would strategically emphasize wherewe see Croatia in the future, what the areas are where we believe we maybe recognized as a regional/global leader (e.g. ICT, Nanotechno logy, Biomedicine,Eco Agriculture,) and clear action steps and projects that willhelp us achieve the vision and strategy. Also, in my opinion, coope rationwithin science/education, government (local and central) and industry wasnot at the expected level, which prevents Croatia from achieving its maximumpotential. In addition, given certain changes in funding (e.g. establishmentof the Horizon 2020, the rule that at least 5% of the ERDF shouldbe spent on urban development, etc.), all of them should be taken intoconsideration when preparing strategic documents. In the end, I wouldlike to emphasize the things I believe are crucial for Croatia’s success inthe future and for the successful utilization of EU funds:reportEU funds for Croatia- Just a Pipe Dream or a Pleasant Reality?By Ivica Perica, Director in Business Advisory Services, Deloitte savjetodavne usluge d.o.o.the best possible way and that many projects co-financed with EU fundswere actually not strategically supporting the accomplishment of the EU2020 strategy. In that sense, the EU has required from each member stateto undertake more robust preparation of NSF and OP, and to developa Smart Specialization Strategy (S3) which should emphasize the areaswhere each country has strengths and capabilities, and describe howthey can be further developed to achieve the EU 2020 strategy. Recently,the EU approved Croatian NSF which followed the priorities set in the IPA(Instrument for Pre Accession) period, with 450 million euro of the EUfunds available for the last 6 months. The funds will cover projects thatshould be completed in the period of three years from its approval (N+3rule). The distribution among the areas will be:• Transport – 120 mil EUR• Environment – 150 mil EUR• Regional development – 108 mil EUR• Human Resources – 60 mil EURThe majority of these funds have already been predefined forthe water/wastewater and railways development project, however thereshould be soon, in October, calls published for SMEs in the areas of theinnovation and infrastructure development, as well as for human resourcesdevelopment.Coming back to the Smart Specialization Strategy that is currentlyin preparation and the preparation of the OP and budget breakdown withingiven priorities for the programing period 2014-2020, I would like to mentionthat these documents are of key importance for Croatia as they will• Involvement of all relevant stakeholders (science, education, government,industry, municipalities, …) in preparing the Smart SpecializationStrategy in order to prepare documents that will allow us to establishprograming documents to make an impact on the strategicdevelopment of Croatia.• Clearly communicate agreed strategic priorities to all relevant stakeholders,so they take them into consideration when preparing theirown strategies and projects (government, counties, municipalities,cities, industry, science, education, etc.).• Mandatory preparation of strategies by all the above mentionedstakeholders.• Establishment of the appropriate organizational structures at governmentlevel (managing authorities’ intermediary bodies) that will satisfyall requirements set by the EU, but that will also not create unnecessarycomplicated processes and controls. This can be achieved byunification of processes and forms (as far as possible) for all OP andthe establishment of e-cohesion through online forms and good MISat the government level.• Strengthening of government human resources at the operationallevel and improvement of its competencies will increase the chancesfor success.• Education of the beneficiaries on how documents (CBA, applications,…)for EU projects should be prepared and how projects shouldbe managed and administered, reduces the great risk later in theprocess that in the case of nonconformity funds have to be returned.16 ISSUE 3/<strong>2013</strong>

News&ViewsCastles of Hrvatsko ZagorjeA tour of the western part of Zagreb goes through a gentle landscapeof green hills with numerous vineyards, small churches and castlesupon its summits. Hrvatsko Zagorje boasts more than 50 castles, someof which have their own preserved parks. Wooden children’s toys arerecognizable traditional products of Hrvatsko Zagorje with a long historyand also listed on the UNESCO list of intangible cultural heritage.Trakošćan is one of the most famous castles. Sitting on a hilltop,with its thirteenth-century citadel it was rebuilt in a neo-Gothic stylein 1850s. According to legend, Trakošćan was named after the Thracianfortress (ARX Thacorum) which allegedly existed in antiquity. Anotherpreserved legend says it is named after the knights Drachensteinwho ruled the region in the early Middle Ages.Toponym was first mentioned in written records in year 1334.Lords of the fort in the first centuries are not known, but at the end ofthe 14th century owners were Counts of Celje, which at the same timeruled in the entire Zagorje County. The family soon became extinctand Trakošćan shared the fate of their other towns and estates thatwere divided and changing owners. In this division Trakošćan, such aunique property, at first belonged to warlord Jan Vitovac then to IvanišKorvin who gave it to his deputy John Gyulay. The family kept thecastle for three generations and after they became extinct in 1566 theestate was taken over by the state. For services rendered, king Maximiliangave the estate to Juraj Drašković (1525-1587), first personally,then as the family heritage, so finally from 1584 Trakošćan belongedto Drašković family.In the boom years of castles building in Croatian Zagorje, inthe second half of the 18th century, Trakošćan was abandoned. Neglected,it deteriorated rapidly, and only in the second half of the 19thcentury the family showed renewed interest in its estate in the spirit of››› Trakošćanthe new era of romantic return to nature and family traditions. In thisspirit, marshal Juraj V. Drašković transformed the surrounding parkinto a romantic garden. The next generations occasionally stayed inTrakošćan until 1944 when they immigrated to Austria soon after thecastle was nationalized. In 1954 the museum was established with apermanent exhibition and today the castle is owned by the Republicof Croatia.The immediate vicinity of the castle is designed as a landscapedpark where the lake, meadows, trees and shrubs form aharmonious horticultural whole. The park is partly developed fromindigenous forests of oak and hornbeam. There are various exoticspecies of trees that, especially in autumn, give color and dynamics.The presence of coniferous trees (especially fir) at this altitude (250m), prove vegetation reversal - the presence of significant species ofhigher altitudes and vice versa, on the higher slopes there are deciduousspecies characteristic of lower altitudes. Special and recognizablefeature of Trakošćan is a large artificial lake, about mile and ahalf long, covering area of about 17 hectares and 2.5 meters deep.The water is warm in summer - up to 22° C while in winter the surfaceof the lake freezes and ice remains for about three months.
