For <strong>in</strong>stance, transparency and <strong>the</strong>Rule of Law are key issues <strong>for</strong> improv<strong>in</strong>g <strong>the</strong> bus<strong>in</strong>essclimate so we were very pleased when <strong>the</strong>Global President of Transparency International, Dr.Huguette Labelle agreed to be guest speaker atour AmCham lunch dur<strong>in</strong>g her high level visit to<strong>Croatia</strong>.AmCham’s partnership with <strong>the</strong> US Embassy is crucial to our success and achievements.On many occasions, US Ambassador James B. Foley has stated that <strong>the</strong>pr<strong>in</strong>cipal goal of his tenure as Ambassador is to improve <strong>the</strong> bus<strong>in</strong>ess climate andcreate economic opportunity <strong>for</strong> <strong>Croatia</strong>. In our second issue of News & Views <strong>for</strong>2010, we brought you an unabridged version of <strong>the</strong> most impactful and sought afterspeech <strong>in</strong> bus<strong>in</strong>ess, government and diplomatic circles. Namely, US AmbassadorJames Foley’s remarks on ‘<strong>Improv<strong>in</strong>g</strong> <strong>the</strong> <strong>Investment</strong> <strong>Climate</strong>’ delivered at <strong>the</strong>Zagreb School of Economics and Management, an AmCham member. You will f<strong>in</strong>d<strong>in</strong> this issue how our Trade and <strong>Investment</strong> Committee is engag<strong>in</strong>g <strong>the</strong> <strong>Croatia</strong>ngovernment at <strong>the</strong> highest levels <strong>in</strong> an ef<strong>for</strong>t to elim<strong>in</strong>ate obstacles to <strong>in</strong>vestment.Dur<strong>in</strong>g <strong>the</strong> recent Poslovni Dnevnik and Banka Conference <strong>for</strong> a New Model <strong>for</strong>Economic Growth attended by Prime M<strong>in</strong>ister Kosor, Ambassador Foley commentedthat <strong>the</strong> current economic model was not susta<strong>in</strong>able and needed to be moreconducive to <strong>for</strong>eign <strong>in</strong>vestment. He also announced a Conference <strong>for</strong> US<strong>Investment</strong> <strong>in</strong> <strong>Croatia</strong> which will be held <strong>in</strong> April 2011 <strong>in</strong> Dubrovnik commemorat<strong>in</strong>gSecretary of Commerce Ron Brown who was killed along with 34 o<strong>the</strong>rs <strong>in</strong> a planecrash near Dubrovnik <strong>in</strong> 1996. AmCham is liv<strong>in</strong>g <strong>the</strong> good old US say<strong>in</strong>g ‘Build itand <strong>the</strong>y will come’ as we try to improve <strong>the</strong> <strong>in</strong>vestment climate so that we will beable to showcase <strong>Croatia</strong>’s attractive <strong>in</strong>vestment opportunities and foster better tieswith <strong>the</strong>se potential US <strong>in</strong>vestors. It was <strong>for</strong>med with <strong>the</strong> goal of ga<strong>the</strong>r<strong>in</strong>g <strong>in</strong><strong>for</strong>mationand provid<strong>in</strong>g education <strong>in</strong> relation to <strong>Croatia</strong>’s accession to <strong>the</strong>EU, focus<strong>in</strong>g on <strong>the</strong> impact of EU accession, <strong>the</strong> legal and regulatorychanges that accession to <strong>the</strong> EU will br<strong>in</strong>g and <strong>the</strong> ability of<strong>Croatia</strong>n companies to apply <strong>for</strong> EU fund<strong>in</strong>g.This was <strong>the</strong> first power breakfast organized on <strong>the</strong> topic that presentedto <strong>the</strong> <strong>in</strong>terested members an overview of <strong>the</strong> precession/accession funds as well <strong>the</strong> responsible bodies. The CorruptionPerceptions Index (CPI) ranks countries accord<strong>in</strong>g to <strong>the</strong> perceptionof corruption <strong>in</strong> <strong>the</strong> public sector. The CPI is an aggregate <strong>in</strong>dicatorthat comb<strong>in</strong>es different sources of <strong>in</strong><strong>for</strong>mation about corruption, mak<strong>in</strong>git possible to compare countries.highest ever score of 4.4 be<strong>in</strong>g achieved <strong>in</strong> 2008. Hence, <strong>the</strong> many <strong>in</strong>dividualcorruption scandals that have surfaced <strong>in</strong><strong>Croatia</strong>n <strong>in</strong> <strong>the</strong> past 12 months prior have hada m<strong>in</strong>imal effect on this year’s Index.<strong>Croatia</strong> scored 4.1 on TransparencyInternational’s Corruption Perception Index <strong>for</strong>2010 on a scale of 0 (total corruption) to 10(absence of corruption) which is exactly <strong>the</strong>same score as <strong>for</strong> <strong>the</strong> previous year. <strong>Croatia</strong>also had this same score of 4.1 <strong>in</strong> 2007 with its ››› XXXX<strong>in</strong>comes of up to 4%. News&ViewsreportInnovation is <strong>the</strong> Key <strong>for</strong>by Mikael Hagström, Executive Vice President, Europe, Middle East, Africa and AsiaIn today’s speech, I will focus on <strong>the</strong> topic of <strong>in</strong>novation, more particularlysocial <strong>in</strong>novation.We have an important and critical event <strong>in</strong> front of us <strong>in</strong> <strong>Croatia</strong>,and that is <strong>the</strong> membership of <strong>the</strong> European Union which we supportthrough AmCham at <strong>the</strong> European level. I firmly believe that <strong>the</strong>re is a lotwe can do as companies and member companies, not only to help makethis happen, but more importantly, to prepare <strong>Croatia</strong> <strong>for</strong> access<strong>in</strong>g <strong>the</strong>EU community <strong>in</strong> a more competitive and stronger way.These are difficult times. The recession has had a strong gripon <strong>Croatia</strong> <strong>for</strong> some time. One important step that needs to be taken is toimprove <strong>the</strong> <strong>in</strong>vestment environment, to make it more bus<strong>in</strong>ess friendly,efficient and transparent - <strong>in</strong> o<strong>the</strong>r words, to give <strong>Croatia</strong> <strong>the</strong> tools to attractmore <strong>for</strong>eign <strong>in</strong>vestments <strong>in</strong> general.I believe that <strong>Croatia</strong> has significant economic potential becauseof three ma<strong>in</strong> reasons. First, <strong>Croatia</strong> is a land of physical beauty andabundant natural resources. Second, a solid <strong>in</strong>frastructure is <strong>in</strong> place <strong>in</strong><strong>Croatia</strong>, and <strong>the</strong> scale of <strong>the</strong> <strong>in</strong>vestments <strong>in</strong> <strong>in</strong>frastructure is significant,<strong>in</strong>clud<strong>in</strong>g <strong>the</strong> work done with <strong>the</strong> digital <strong>in</strong>frastructure. Of equal importanceis <strong>the</strong> third reason, which is education. On a very high level, <strong>the</strong>current education stand<strong>in</strong>g has produced a talented and well-educatedwork <strong>for</strong>ce. I experience <strong>the</strong> need <strong>for</strong> talent on a daily basis, when wedo our own company projects that are <strong>in</strong>novative, such as <strong>in</strong> <strong>the</strong> area ofsocial network<strong>in</strong>g <strong>for</strong> <strong>in</strong>stance. It is very difficult to f<strong>in</strong>d specialists <strong>in</strong> thatarea, yet <strong>the</strong>y are certa<strong>in</strong>ly available <strong>in</strong> <strong>Croatia</strong>. I th<strong>in</strong>k <strong>the</strong> opportunity ishere, and it is here now. That is why I believe <strong>the</strong> topic of <strong>in</strong>novation isso important.Opportunity to <strong>in</strong>novateIn my m<strong>in</strong>d, <strong>in</strong>novation is about reus<strong>in</strong>g what has already been<strong>in</strong>vented but <strong>in</strong> new ways, and <strong>the</strong>n act<strong>in</strong>g on that opportunity. Most ofyou are familiar with new products from companies like Apple, to namejust one. Now, Apple did not come up with some major <strong>in</strong>vention but<strong>in</strong>stead did a fantastic work around f<strong>in</strong>d<strong>in</strong>g new uses <strong>for</strong> already exist<strong>in</strong>gtechnology. When we look at which companies have <strong>the</strong> strongest footpr<strong>in</strong>t<strong>in</strong> <strong>the</strong> digital <strong>in</strong>dustry, we notice that many of <strong>the</strong>se companies arebased <strong>in</strong> <strong>the</strong> US, especially when you look at <strong>the</strong> top 10 websites, <strong>the</strong> top10 e-commerce sites or <strong>the</strong> top 10 social network<strong>in</strong>g sites. But I believethat <strong>the</strong>re are many opportunities <strong>for</strong> European companies to follow <strong>in</strong><strong>the</strong>se footsteps, and <strong>Croatia</strong> has a natural role to play.When I th<strong>in</strong>k about <strong>the</strong> need <strong>for</strong> <strong>in</strong>novation, both <strong>the</strong> bus<strong>in</strong>essand public sector come to m<strong>in</strong>d. In our work with governments and organizationsaround <strong>the</strong> world, we have seen that <strong>the</strong>re response to <strong>the</strong>economic crisis to fall <strong>in</strong>to three basic categories. The first is what I call<strong>the</strong> “knee-jerk” reaction. When <strong>the</strong> pressure is <strong>in</strong>tense, quick actions -any actions - are taken, just to demonstrate that <strong>the</strong> government doesnot stay immobile. The second is <strong>the</strong> “wait and see” approach, tak<strong>in</strong>g noaction while hop<strong>in</strong>g that th<strong>in</strong>gs will improve on <strong>the</strong>ir own - most often thannot, <strong>in</strong> va<strong>in</strong>. The third option is strongly l<strong>in</strong>ked to tak<strong>in</strong>g actions based onknowledge, to create a vision of build<strong>in</strong>g a new future. This is what I wantto focus on - what we can do now to come out of <strong>the</strong> crisis not only stablebut significantly stronger, to build a future that is based on <strong>in</strong>novation.Innovation emergencyI believe that <strong>in</strong>novation is required to accelerate growth. Governmentsacross <strong>the</strong> world are battl<strong>in</strong>g with <strong>the</strong> same challenges, such asunemployment and various social and demographic issues like ag<strong>in</strong>g orurbanization. These current trends put pressure on social <strong>in</strong>frastructure.Now is <strong>the</strong> time to re<strong>for</strong>m, trans<strong>for</strong>m and modernize <strong>the</strong> way governmentsand countries are be<strong>in</strong>g run.The EU Commissioner <strong>for</strong> Research made some <strong>in</strong>terest<strong>in</strong>gremarks. For example, Europe has actually <strong>the</strong> largest pool of doctoralgraduates <strong>in</strong> <strong>the</strong> world. There<strong>for</strong>e, Europe and <strong>Croatia</strong> specifically canbenefit greatly from commercializ<strong>in</strong>g <strong>in</strong>novations. It is not surpris<strong>in</strong>g that<strong>the</strong> Organization <strong>for</strong> Economic Cooperation and Development (OECD)is focus<strong>in</strong>g very strongly on <strong>in</strong>vestments <strong>for</strong> <strong>in</strong>novation <strong>in</strong> Europe. Theywant to speed up and improve <strong>the</strong> competitiveness by <strong>in</strong>creas<strong>in</strong>g <strong>the</strong><strong>in</strong>vestments and research <strong>in</strong> Europe. This desire is shared by <strong>the</strong> EuropeanCommission at <strong>the</strong> highest level, which underl<strong>in</strong>es <strong>the</strong> topic of <strong>the</strong>“<strong>in</strong>novation emergency,” or a need to view <strong>in</strong>novation as <strong>the</strong> urgent key tobuild<strong>in</strong>g susta<strong>in</strong>able growth <strong>in</strong> many areas.We can f<strong>in</strong>d examples <strong>in</strong> <strong>the</strong> issue of ag<strong>in</strong>g societies. Ag<strong>in</strong>g societiesare global phenomena. Most parts of Asia, with a few exceptionssuch as India, will soon be impacted. With health care costs ris<strong>in</strong>g, <strong>the</strong>reis a requirement to f<strong>in</strong>d a new way to ma<strong>in</strong>ta<strong>in</strong> service levels at <strong>the</strong> sameor even reduced costs. Meanwhile, citizens are expect<strong>in</strong>g better serviceand ways to <strong>in</strong>crease <strong>the</strong>ir quality of life, which is an area where <strong>in</strong>novationplays an important role. Innovat<strong>in</strong>g <strong>in</strong> <strong>the</strong> use of preventive medication<strong>in</strong>creases <strong>the</strong> quality of life. With <strong>the</strong> help of modern medical devices,people can live longer, healthier lives and can also enjoy reduced hospitalcare costs. The issue of preventive medication is a global topic, but <strong>the</strong>reare available solutions that are already <strong>in</strong>vented. They just need to becomb<strong>in</strong>ed and utilized <strong>in</strong> a new way.How do we get <strong>the</strong>re? Education, market<strong>in</strong>novation and better public-private partnershipsIf we look at <strong>the</strong> economic situation <strong>in</strong> <strong>Croatia</strong>, <strong>in</strong>novation willbe fundamental to quick-start <strong>the</strong> recovery. In order to get an <strong>in</strong>novationframework function<strong>in</strong>g, three areas are go<strong>in</strong>g to be extraord<strong>in</strong>arilyimportant.At <strong>the</strong> European level, <strong>the</strong> quality of education is critical. Today’steachers still write on blackboards and use <strong>the</strong> same teach<strong>in</strong>g pr<strong>in</strong>ciples10 ISSUE 4/2010

The opportunity <strong>for</strong><strong>Croatia</strong> <strong>in</strong> <strong>the</strong> ICT <strong>in</strong>dustry is <strong>in</strong> knowledge-based competencies <strong>in</strong> areassuch as creativity and adaptability.The next step is mak<strong>in</strong>g <strong>the</strong> market <strong>in</strong>novation-friendly and creat<strong>in</strong>ga strong capacity <strong>for</strong> <strong>in</strong>novation. That does not mean just creat<strong>in</strong>g <strong>the</strong>right environment around lead<strong>in</strong>g technological capabilities of research.It means also hav<strong>in</strong>g strong, solid and clear legal frameworks. Thirdly,<strong>the</strong> key is <strong>in</strong> <strong>the</strong> quality of public-private partnerships, work<strong>in</strong>g closelytoge<strong>the</strong>r to develop <strong>the</strong> right products and solutionsAt <strong>the</strong> AmCham EU level, we are work<strong>in</strong>g very actively on howwe can help modernize and trans<strong>for</strong>m <strong>the</strong> public sector, and policymakers<strong>in</strong> Europe are wak<strong>in</strong>g up to <strong>the</strong> potential of IT <strong>in</strong> this trans<strong>for</strong>mation.Today, healthcare fraud <strong>in</strong> Europe is 100 times <strong>the</strong> size of credit fraud. Butgovernments are <strong>in</strong>vest<strong>in</strong>g <strong>in</strong> <strong>the</strong> latest available <strong>in</strong>novative technologyto combat fraudsters and ensure that <strong>the</strong> money spent on healthcarebenefits people who need treatment.You will f<strong>in</strong>d a similar story if you look at <strong>the</strong> European Anti-FraudOffice (OLAF) which receives ten thousand suspicious cases and millionsof documents per year perta<strong>in</strong><strong>in</strong>g to <strong>the</strong> allocation of EU funds. In <strong>the</strong>past, <strong>the</strong>y could only hope that <strong>the</strong>y were look<strong>in</strong>g at <strong>the</strong> right documents.The example of <strong>in</strong>novative technologies here is <strong>the</strong> use of ‘text m<strong>in</strong><strong>in</strong>g’ toscan <strong>the</strong> documents and narrow down <strong>the</strong> search to <strong>the</strong> really suspectcases, or <strong>in</strong> o<strong>the</strong>r words, improv<strong>in</strong>g <strong>the</strong> hit rate.It would be a simple way to achieve <strong>the</strong> same objectives that areset out <strong>for</strong> OLAF <strong>in</strong> public-private companies. At <strong>the</strong> moment <strong>in</strong> EU <strong>the</strong>reis about one trillion Euro annually that disappears through healthcarefraud and this leads to lower healthcare quality. In <strong>the</strong> UK, <strong>the</strong> CounterFraud and Security Management Service was able to reduce loses by55% <strong>in</strong> <strong>the</strong> pilot study, not by employ<strong>in</strong>g more staff but by th<strong>in</strong>k<strong>in</strong>g <strong>in</strong>different ways. The benefit from <strong>the</strong> pilot study was 671 million sterl<strong>in</strong>g.The project paid <strong>for</strong> itself <strong>in</strong> weeks.Tax collection is ano<strong>the</strong>r area <strong>for</strong> improvement and faces differentchallenges. An <strong>in</strong>terest<strong>in</strong>g example can be found <strong>in</strong> Asia, where <strong>the</strong>Parliament of <strong>the</strong> Philipp<strong>in</strong>es almost abolished <strong>the</strong> national VAT systembecause it failed to br<strong>in</strong>g back any money to <strong>the</strong> state coffers. Us<strong>in</strong>g anSMS-based lottery system, citizens sent text messages to identify <strong>the</strong>store location and amount of purchase every time <strong>the</strong>y purchased someth<strong>in</strong>g.In <strong>the</strong> first year, $1.4 billion was identified <strong>in</strong> under- declarations.An added benefit was that it showedhow quickly <strong>the</strong> government could act,result<strong>in</strong>g <strong>in</strong> an improved confidencefactor <strong>in</strong> this country.The key is two-way dialogueand confidenceAno<strong>the</strong>r <strong>in</strong>terest<strong>in</strong>g examplecan be found <strong>in</strong> S<strong>in</strong>gapore, where <strong>the</strong>S<strong>in</strong>gapore People’s Association playsan important part <strong>in</strong> S<strong>in</strong>gapore’s nation-build<strong>in</strong>gef<strong>for</strong>ts. The Associationencourages people to take ownershipof <strong>the</strong>ir community and br<strong>in</strong>gs peopletoge<strong>the</strong>r to create a more cohesiveS<strong>in</strong>gapore. This project, based on <strong>the</strong>exploitation of exist<strong>in</strong>g data, leads to<strong>the</strong> on-time delivery of <strong>the</strong> right serviceto <strong>the</strong> right community to empowercitizens.But you can do even more by br<strong>in</strong>g<strong>in</strong>g toge<strong>the</strong>r data from differentgovernmental silos and allow<strong>in</strong>g this data to create real time communicationbetween governments and citizens. That two-way dialogue isbe<strong>in</strong>g implemented <strong>in</strong> Europe as well. The Belgian Federal Public Servicetook it one step fur<strong>the</strong>r and allowed citizens access to government databases.This two-way dialogue allows <strong>the</strong>m to come up with new ideasand to create more efficient ways <strong>for</strong> <strong>the</strong> 30,000 employees to collectdata across <strong>the</strong> departments. It is important to keep <strong>the</strong> <strong>in</strong><strong>for</strong>mation up todate, to work proactively and to get <strong>the</strong> opportunity to know more aboutop<strong>in</strong>ions of citizens. In that way, data-driven decision-mak<strong>in</strong>g through analyticscan significantly improve <strong>the</strong> quality of life of <strong>the</strong> citizens of <strong>Croatia</strong>and improve <strong>the</strong> competitiveness of this country as <strong>the</strong> world fully enters<strong>the</strong> digital economy. To sum up, I would say that <strong>the</strong> largest issue fac<strong>in</strong>g<strong>Croatia</strong> today is generat<strong>in</strong>g enough self-confidence to move <strong>for</strong>ward. Iam positive that apply<strong>in</strong>g <strong>the</strong> exist<strong>in</strong>g knowledge and skills <strong>in</strong> <strong>Croatia</strong>quickly and precisely will help raise <strong>the</strong> degree of confidence <strong>in</strong> thiscountry, and that foster<strong>in</strong>g <strong>in</strong>novation will help deal with <strong>the</strong> challengesfac<strong>in</strong>g this region. I also believe that if we share our knowledge throughconstructive and open dialogue, we can identify approaches and policiesthat can help <strong>Croatia</strong> reach all of its ambitious goals very fast. News&ViewsAfter significant decl<strong>in</strong>e <strong>in</strong> number of <strong>in</strong>dustrial property fil<strong>in</strong>gs<strong>in</strong> <strong>Croatia</strong> <strong>in</strong> 2009 <strong>in</strong> consequence of <strong>the</strong> global economic crisis,this year has shown some signs of recovery.TrademarksUntil December 1st 2010 <strong>the</strong>re were 2152 trade mark applicationsfiled directly be<strong>for</strong>e <strong>the</strong> State Intellectual Property Office of <strong>the</strong>Republic of <strong>Croatia</strong> (SIPO) this year. Fur<strong>the</strong>r 5003 requests were madevia <strong>the</strong> Madrid system <strong>for</strong> <strong>the</strong> <strong>in</strong>ternational trade marks registration,mak<strong>in</strong>g a total of 7155 requests <strong>for</strong> trade mark registration <strong>in</strong> <strong>Croatia</strong><strong>in</strong> 11 months of 2010. Compared with <strong>the</strong> number of trademark applicationsfiled <strong>in</strong> previous years, an <strong>in</strong>crease <strong>in</strong> <strong>the</strong> number of applicationsfiled directly be<strong>for</strong>e <strong>the</strong> SIPO is evident <strong>in</strong> comparison to <strong>the</strong> year2009 when only 2063 applications were filed. However, <strong>the</strong> numberof trade mark applications filed through <strong>the</strong> national route still hasn’treached <strong>the</strong> numbers of <strong>the</strong> years be<strong>for</strong>e <strong>the</strong> economic crisis (2821<strong>the</strong> residents of <strong>Croatia</strong> and natural persons. Fur<strong>the</strong>r 310 <strong>in</strong>dustrial designapplications were filed <strong>in</strong> 11 months of 2011 through <strong>the</strong> system of<strong>in</strong>ternational registration of <strong>in</strong>dustrial design established by <strong>the</strong> Hagueagreement. In 2009 <strong>the</strong>re were 346 such <strong>in</strong>ternational registrations designated<strong>for</strong> <strong>Croatia</strong>, which shows that <strong>the</strong> numbers <strong>in</strong> relation to <strong>the</strong><strong>in</strong>dustrial designs stayed pretty much <strong>the</strong> same dur<strong>in</strong>g <strong>the</strong> year 2009and 2010, but still lower when compared with 2007 and 2008.PatentsIn 11 months of 2010 a total of 267 patent applications werefiled with <strong>the</strong> SIPO, out of which 16 are <strong>the</strong> <strong>in</strong>ternational (PCT) applicationsthat entered <strong>the</strong> national phase of <strong>the</strong> procedure. In comparisonto <strong>the</strong> previous year, fur<strong>the</strong>r slight decrease <strong>in</strong> <strong>the</strong> number of applicationscan be seen as <strong>in</strong> 2009 a total of 318 applications were filed.The share of <strong>the</strong> PCT applications that entered <strong>the</strong> national phase <strong>in</strong><strong>Croatia</strong> <strong>in</strong> year 2009 was 52.reportCURRENT TRENDS IN INTELLECTUALPROPERTY FILINGS IN CROATIABy State Intellectual Property Office of <strong>the</strong> Republic of <strong>Croatia</strong><strong>in</strong> <strong>the</strong> year 2008, <strong>for</strong> example). The share of non-resident applicants<strong>in</strong> <strong>the</strong> number of trademark applications filed directly at <strong>the</strong> SIPO iscont<strong>in</strong>uously decreas<strong>in</strong>g. By now more <strong>the</strong>n 60% of all trademark applicationsfiled be<strong>for</strong>e <strong>the</strong> SIPO are made by <strong>Croatia</strong>n residents. Thenumber of <strong>in</strong>ternational registrations designat<strong>in</strong>g <strong>Croatia</strong> still showsa trend of decrease that started <strong>in</strong> 2009. While <strong>the</strong>re were 7424 <strong>in</strong>ternationalregistration designat<strong>in</strong>g <strong>Croatia</strong> <strong>in</strong> 2008, only 6058 weremade <strong>in</strong> 2009 and 5003 <strong>in</strong> 11 months of 2010. The largest number of<strong>in</strong>ternational trade mark registrations designat<strong>in</strong>g <strong>Croatia</strong> is requiredby applicants from Germany and <strong>the</strong> applicants who base <strong>the</strong>ir <strong>in</strong>ternationalregistrations on <strong>the</strong> Community Trade Mark System. Internationaltrademark registrations from <strong>Croatia</strong> are also still decreas<strong>in</strong>g- until December 2010 <strong>the</strong>re where 108 <strong>in</strong>ternational applications filed<strong>for</strong> which <strong>the</strong> office of orig<strong>in</strong> is <strong>Croatia</strong> <strong>in</strong> comparison with <strong>the</strong> year2009 where <strong>the</strong>re were 213 of such applications.Industrial DesignsThere were 251 <strong>in</strong>dustrial design applications filed directly be<strong>for</strong>e<strong>the</strong> SIPO <strong>in</strong> 11 months of 2010. This number is similar to <strong>the</strong> year2009 when 271 <strong>in</strong>dustrial design applications were filed. S<strong>in</strong>ce <strong>the</strong> <strong>Croatia</strong>nIndustrial Design Act allows multiple applications, <strong>the</strong> 251 <strong>in</strong>dustrialdesign applications actually comprise <strong>the</strong> requests <strong>for</strong> registrationof 698 <strong>in</strong>dustrial designs. The largest number of applicants still makeDecl<strong>in</strong><strong>in</strong>g number of patent applications filed with <strong>the</strong> SIPOcan still be partly attributed to <strong>the</strong> fact that <strong>Croatia</strong> became a full memberof European Patent Organization ra<strong>the</strong>r recently (<strong>in</strong> 2008), andmost of <strong>the</strong> <strong>for</strong>eign applicants are now <strong>in</strong>stead choos<strong>in</strong>g to file <strong>the</strong>European patent application <strong>in</strong> which <strong>Croatia</strong> is designated.The number of <strong>the</strong> <strong>in</strong>ternational (PCT) applications from <strong>Croatia</strong>filed at SIPO shows slight recovery - <strong>in</strong> 11 months of this year38 applications were filed, compar<strong>in</strong>g to <strong>the</strong> 35 applications <strong>in</strong> year2009.As <strong>for</strong> <strong>the</strong> number of patents granted <strong>in</strong> <strong>Croatia</strong>, <strong>in</strong> 11 monthsof 2010 a total of 192 patents were granted <strong>in</strong> SIPO procedures, 115of <strong>the</strong>m as consensual patents (without substantive exam<strong>in</strong>ation). In<strong>the</strong> same period 396 European patents entered <strong>the</strong> SIPO patent register,thus mak<strong>in</strong>g a total of 588 patents granted <strong>in</strong> <strong>Croatia</strong>. Compar<strong>in</strong>gwith <strong>the</strong> year 2009, when a total of 268 patents were granted <strong>in</strong> SIPOprocedures and fur<strong>the</strong>r 378 European patents entered <strong>the</strong> register,a decrease <strong>in</strong> number of patents granted <strong>in</strong> <strong>Croatia</strong> this year can benoticed.With <strong>the</strong> patents granted <strong>in</strong> 11 months of 2010, a total of 2510(2121 patents and 389 consensual patents) is currently <strong>in</strong> <strong>for</strong>ce <strong>in</strong> <strong>Croatia</strong>.By technical field, a majority of <strong>the</strong> patents <strong>in</strong> <strong>for</strong>ce are <strong>in</strong> <strong>the</strong> fieldof organic chemistry (IPC class C07) and <strong>in</strong> preparations <strong>for</strong> medical,dental, or toilet purposes (IPC class A61).18 ISSUE 4/2010

The Trade & <strong>Investment</strong> Committee compiledand sent <strong>the</strong> <strong>in</strong>puts abd suggested AmCham’s participation <strong>in</strong> <strong>the</strong> M<strong>in</strong>istry’sWork<strong>in</strong>g Group. AmCham believes that it is both possible and necessaryto re<strong>for</strong>m <strong>the</strong> bus<strong>in</strong>ess environment <strong>in</strong> a way that benefits domestic and<strong>for</strong>eign bus<strong>in</strong>ess <strong>in</strong> <strong>Croatia</strong>, <strong>the</strong> state, customers and consumers alike.In order to <strong>in</strong>crease competitiveness and improve bus<strong>in</strong>ess climate<strong>in</strong> <strong>Croatia</strong> AmCham proposed <strong>the</strong> implementation of several imperatives:• reduce state spend<strong>in</strong>g• <strong>in</strong>crease state <strong>in</strong>centives to bus<strong>in</strong>ess and private sectors, <strong>in</strong> order topromote cont<strong>in</strong>ued production and value-added activities from <strong>the</strong>• permanent establishments of <strong>for</strong>eign entrepreneurs have to registerat least a branch office <strong>in</strong> <strong>Croatia</strong> to be able to comply with CorporateTax Act (and pay tax on projects <strong>in</strong> <strong>Croatia</strong>) which is unnecessaryadm<strong>in</strong>istrative burden• <strong>in</strong>ternational transfers of <strong>for</strong>eign <strong>in</strong>dividuals to work <strong>in</strong> <strong>Croatia</strong> areheavily burdened with personal <strong>in</strong>come taxes• uncerta<strong>in</strong>ty <strong>in</strong> apply<strong>in</strong>g transfer pric<strong>in</strong>g rules• bilateral agreements on avoidance of double taxation help lower<strong>in</strong>gadm<strong>in</strong>istrative and tax burden• time consum<strong>in</strong>g tax dispute procedures• illiquidity problems due to VAT calculation basis.4/2010 ISSUE 19


News&ViewsIn 2009 <strong>Croatia</strong> witnessed <strong>the</strong> worst of First phase of RealEstate development <strong>in</strong> New Economy while 2010 proves to be ano<strong>the</strong>ryear of major setback. <strong>Investment</strong> activity <strong>in</strong> 2008 had playedimportant role <strong>in</strong> economy growth, <strong>in</strong>vestments <strong>in</strong> 2009 and 2010have recorded considerable decrease and overall level of <strong>in</strong>vestmentshad put strong pressure on <strong>the</strong> decrease of <strong>the</strong> GDP. Consumerpessimism about <strong>the</strong> future economic situation rose toge<strong>the</strong>rwith unfavorable trends on <strong>the</strong> employment market. Considerableestate segment, alongside with immense amount of adm<strong>in</strong>istrativered tape, very slow and unreliable zon<strong>in</strong>g and permitt<strong>in</strong>g proceduresand lack of clarity and <strong>in</strong>consistencies <strong>in</strong> application of tax laws <strong>for</strong><strong>in</strong>ternational money flows. Know<strong>in</strong>g all this, or better to say – liv<strong>in</strong>gthat reality, more than few <strong>for</strong>eign <strong>in</strong>vestors and developers not onlyentered <strong>Croatia</strong>n market with<strong>in</strong> <strong>the</strong>se few bad years but choose tofight all <strong>the</strong> obstacles and <strong>in</strong>vest <strong>in</strong> real estate projects <strong>in</strong> <strong>Croatia</strong>.In <strong>the</strong> light of <strong>the</strong> EU accession, liberalization of <strong>the</strong> tradeand competitiveness of <strong>Croatia</strong>n economy, on major obstacles <strong>for</strong><strong>in</strong>vest<strong>in</strong>g <strong>in</strong> <strong>Croatia</strong>, but also on <strong>the</strong> topic of positive reasons to <strong>in</strong>vest<strong>in</strong> our market, I spoke to three currently active <strong>in</strong>vestors anddevelopers <strong>in</strong> <strong>Croatia</strong> who have spent not only few years here butare locals represent<strong>in</strong>g <strong>in</strong>ternational <strong>in</strong>vestment funds and developmentcompanies.<strong>Croatia</strong> stands <strong>for</strong> unorganized andsmall <strong>in</strong>vestment marketThere is no mystery that every <strong>for</strong>eign <strong>in</strong>vestor <strong>in</strong> <strong>Croatia</strong>, especially<strong>in</strong> real estate development will put emphasis primary on lack of anysubstantial government activities <strong>in</strong> promot<strong>in</strong>g, facilitat<strong>in</strong>g and focus<strong>in</strong>gFDI what actually leaves <strong>in</strong>vestors on <strong>the</strong>ir own to identify andcreate <strong>in</strong>vestment opportunities, as well as to resolve adm<strong>in</strong>istrative,legal and tax barriers to do<strong>in</strong>g bus<strong>in</strong>ess <strong>in</strong> <strong>Croatia</strong>.Mr. Igor Hržić, Manag<strong>in</strong>g director of Bluehouse <strong>in</strong>vestmentfund <strong>in</strong> <strong>Croatia</strong> says: “Slow, <strong>in</strong>efficient and unreliable judiciary systemdramatically <strong>in</strong>creases execution risk of any <strong>in</strong>vestments. Assuch, it makes legal system useless <strong>for</strong> timely resolution of bus<strong>in</strong>essissues and <strong>for</strong>ces <strong>in</strong>stitutional <strong>in</strong>vestors <strong>in</strong>to unwanted compromisesthat fur<strong>the</strong>r <strong>in</strong>crease <strong>in</strong>vestment costs and reduces attractivenessof <strong>the</strong> market.”In addition to that, what decreases fur<strong>the</strong>r <strong>the</strong> attractivenessof <strong>the</strong> market is <strong>the</strong> fact that <strong>Croatia</strong> is a country of only 4,5 million <strong>in</strong>habitantsand relatively small <strong>in</strong>vestment absorption capacity <strong>in</strong> realLegal issues“Many <strong>for</strong>eign <strong>in</strong>vestors <strong>in</strong> <strong>Croatia</strong> lost not only time and money butpatience and good will to struggle local obstacles. In addition tothat, an overall picture of <strong>Croatia</strong> as an <strong>in</strong>vestor-friendly environmentis questioned when we hear and read about long last<strong>in</strong>g court trials.Investors usually seek fast track procedures and professionalcompetencies without which it is not possible to improve <strong>the</strong> proceduresaccord<strong>in</strong>g to which courts work and better align <strong>the</strong> <strong>in</strong>centivesof all <strong>in</strong>terested parties <strong>for</strong> faster disposition of cases. At <strong>the</strong>same time, fur<strong>the</strong>r ef<strong>for</strong>ts are needed to establish specialized /realestate, hi-tech, <strong>in</strong>tellectual property, small claims/ courts as well asout-of-court mechanisms, which could help alleviate <strong>the</strong> burden of<strong>the</strong> judiciary and provide simpler and cheaper options <strong>for</strong> disputeresolution.” – said Mr. Erik Mohorović, Manag<strong>in</strong>g director, on behalfof Verdispar International <strong>in</strong> <strong>Croatia</strong>.There<strong>for</strong>e, <strong>the</strong> reduction and elim<strong>in</strong>ation of adm<strong>in</strong>istrativeobstacles to <strong>in</strong>vestments <strong>in</strong>to <strong>Croatia</strong> along with faster proceduresof commercial disputes are not only a must, but primary prerequisiteof re-position<strong>in</strong>g <strong>Croatia</strong> on <strong>in</strong>vestment map of <strong>the</strong> Europe.Based on five year long experience of Tulipan Group <strong>in</strong><strong>Croatia</strong>, Gelo puts ma<strong>in</strong> emphasis on lack of coord<strong>in</strong>ation among<strong>in</strong>stitutions and bodies on <strong>the</strong> local and central level. „State <strong>in</strong>stitutionsand <strong>the</strong>ir bodies are very often not coord<strong>in</strong>ated with local level,that is <strong>the</strong>y do not have <strong>the</strong> same work<strong>in</strong>g dynamic which is confus<strong>in</strong>gfactor <strong>for</strong> <strong>in</strong>vestors. In order to br<strong>in</strong>g decisions <strong>the</strong>y very oftenneed to identify <strong>the</strong>ir common <strong>in</strong>terests.“ On <strong>the</strong> slow and <strong>in</strong>efficientdecision mak<strong>in</strong>g processes, Mohorović advises „Clearly def<strong>in</strong>edstrategy and its implementation dynamics on all levels of decisionmak<strong>in</strong>g process <strong>in</strong> <strong>the</strong> public adm<strong>in</strong>istration would enable <strong>in</strong>vestorsto have <strong>the</strong>ir own goals and expectations along with risk exposureadjusted accord<strong>in</strong>gly”.20 ISSUE 4/2010


News&Views<strong>Croatia</strong> is a beautiful country of beautiful people. Of course,nobody is perfect. It is a young nation that was grow<strong>in</strong>g up <strong>in</strong> difficultcircumstances. The nation has changed different types of governmentand different rulers. It all left mark, if not a scar. The results are visibleto <strong>for</strong>eign and domestic <strong>in</strong>vestors. They created some obstacles to <strong>the</strong><strong>in</strong>vestors <strong>in</strong> <strong>the</strong>ir way to realize this beauty. Two ma<strong>in</strong> obstacles (and <strong>the</strong>yare often mentioned by <strong>in</strong>vestors) are:• Frequently chang<strong>in</strong>g legislation; and• Unmotivated civil servants/judiciary.We will briefly describe <strong>in</strong> this article <strong>the</strong>se two issues.Frequently chang<strong>in</strong>g legislationFrequently chang<strong>in</strong>g legislation is ma<strong>in</strong>ly a result of transition where <strong>for</strong>different reasons some of <strong>the</strong> basic laws had to be passed with greathaste creat<strong>in</strong>g loopholes <strong>in</strong> <strong>in</strong>terpretation. These loopholes resulted <strong>in</strong>fur<strong>the</strong>r changes sometimes creat<strong>in</strong>g fur<strong>the</strong>r chaos.In addition, frequent changes are result of <strong>the</strong> attitude that it iseasier to change <strong>the</strong> laws than people. The frequent changes will comemore <strong>in</strong>to focus as <strong>Croatia</strong> approaches <strong>the</strong> EU and more and more regulationshave to be <strong>in</strong> l<strong>in</strong>e with <strong>the</strong> EU regulations and directives.Frequently chang<strong>in</strong>g legislation creates uncerta<strong>in</strong>ty (<strong>in</strong>vestorsare not sure if <strong>the</strong> same rules of <strong>the</strong> game will apply at <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g andat <strong>the</strong> end of <strong>the</strong>ir project) and creates problem <strong>in</strong> implementation <strong>for</strong><strong>the</strong> civil servants/judiciary and common people alike. And where shall we belook<strong>in</strong>g <strong>for</strong> solutions – <strong>in</strong> free markets, <strong>in</strong> technology or with<strong>in</strong> ourselvesand our system of values and beliefs that guide our life-styles? Can wehave growth and <strong>the</strong> green<strong>in</strong>g of our economies at <strong>the</strong> same time? Be<strong>for</strong>ewe try to give a tentative answer to <strong>the</strong>se questions, let’s look at what weconf<strong>in</strong>ed to a niche. All <strong>the</strong>se suggest that this recovery is not likely tobe substantially “greener” than any <strong>in</strong> <strong>the</strong> past. What should happen sothat we “change course” from unsusta<strong>in</strong>able to susta<strong>in</strong>able patterns ofproduction and consumption? My research and that of o<strong>the</strong>r suggest thatmarkets and technological change will not suffice. Instead, we shouldfirstly change our worldview – that dom<strong>in</strong>ant set of values and beliefswhich def<strong>in</strong>e our overall attitude towards life and our natural environment.These values and beliefs shape our <strong>in</strong>stitutional framework – <strong>the</strong> way weorganize our societies <strong>in</strong> all important aspects that concern political andeconomic life. In Germany, it was 57 €. Organic food <strong>in</strong> <strong>Croatia</strong> is priced30-50% more than conventional food. In Germany, it is priced up to 15%more. <strong>Croatia</strong>n market is not educated enough to differentiate healthyfrom organic. <strong>Croatia</strong>ns love <strong>the</strong>ir local food and th<strong>in</strong>k that it is still healthyenough not to pay that price premium <strong>for</strong> organic certificate. On <strong>the</strong> o<strong>the</strong>rside, <strong>the</strong> shelf space of mass retailers <strong>for</strong> healthy/organic food is grow<strong>in</strong>g.Consumers <strong>in</strong> recession are switch<strong>in</strong>g <strong>the</strong>ir priorities and trad<strong>in</strong>g luxurieslike ski<strong>in</strong>g holidays <strong>for</strong> better quality higher-priced food, which becomesaf<strong>for</strong>dable luxury. Our Cro-organic phase is still about to come.In <strong>the</strong> context of <strong>the</strong> EU markets, it is challeng<strong>in</strong>g <strong>for</strong> <strong>Croatia</strong>nproducts to become and stay competitive consider<strong>in</strong>g higher prices dueto <strong>the</strong> lack of economy of scale. Organic products are premium pricedand consumers are will<strong>in</strong>g to pay more <strong>for</strong> trusted source of food. <strong>Croatia</strong>has high quality resources and high potential <strong>for</strong> organic farm<strong>in</strong>g andprocess<strong>in</strong>g. Better focus on organic sector could <strong>in</strong>crease <strong>Croatia</strong>’s competitivenesswith<strong>in</strong> EU markets.Many areas need improvement <strong>in</strong> order to become that trustedsource of great food <strong>for</strong> EU consumers. Less than 0,1% of all farms <strong>in</strong><strong>Croatia</strong> are organic and only 0,2% of all agriculture land is used <strong>for</strong>organic. But farmers are not to blame. Certificates are very expensive becauseof traceability requirements, quantities of produce on <strong>in</strong>dividual basismostly <strong>in</strong>sufficient to supply mass retail, knowledge of <strong>the</strong> organic stilllow, and distribution channels unaccessible. If farmers don’t get an outsideregulatory, educational, f<strong>in</strong>ancial and operational support it will became almostimpossible <strong>for</strong> <strong>the</strong>m to survive by choos<strong>in</strong>g an organic path.In order to motivate manufacturers <strong>for</strong> more organic productsand brands <strong>Croatia</strong>n Government bodies should first focus on improv<strong>in</strong>gregulatory environment. Certification process should be leaner and <strong>the</strong>reshould be one po<strong>in</strong>t of <strong>in</strong><strong>for</strong>mation where potential manufacturers couldobta<strong>in</strong> all documentation and <strong>in</strong><strong>for</strong>mation about requirements. Regulations<strong>for</strong> obta<strong>in</strong><strong>in</strong>g <strong>the</strong> certificate should be revised and adjusted to Europeancertification requirements.The confidence and credibility of <strong>Croatia</strong>n “eko” label should be<strong>in</strong>creased and promotion f<strong>in</strong>anced from <strong>the</strong> Government side. Marketshould be educated what it really stands <strong>for</strong> and common vocabularyshould be implemented. There are still misunderstand<strong>in</strong>gs and confusion,is it <strong>the</strong> same to have organic, bio or eko product. <strong>Croatia</strong>ns don’ttrust enough <strong>the</strong>ir own label. The visual identity of <strong>Croatia</strong>n label shouldbe improved, too. In <strong>the</strong> meantime,however, situation has dramatically changed, mostly due to morerestrictive US import and consumer protection policies.European countries can export only heat treated (commercially sterilecanned products), purely pork products to <strong>the</strong> USA. No beef<strong>in</strong>gredients are allowed.After <strong>the</strong> long and exhaust<strong>in</strong>g application process, Gavrilović f<strong>in</strong>allyobta<strong>in</strong>ed <strong>the</strong> label approval and <strong>the</strong> first export to <strong>the</strong> USA <strong>in</strong> <strong>the</strong>recent company’s history took place <strong>in</strong> November 2005. Prior tothat, <strong>in</strong> February 2004, Gavrilović had been added to <strong>the</strong> approvedexport establishments list. S<strong>in</strong>ce <strong>the</strong> <strong>in</strong>itial USDA/FSIS audit, <strong>the</strong>company has received acceptable rat<strong>in</strong>gs <strong>in</strong> regular annual auditsand rema<strong>in</strong>ed listed.Gavrilović received label approvals <strong>for</strong> 12 different products like luncheonloaves, pork liver patés, and ready-to-serve meals. However,only 5 items are regularly exported and <strong>the</strong> rest are still pend<strong>in</strong>g.This year Gavrilović has launched a production of poultry meat patéand beef luncheon meat on <strong>the</strong> American soil.From <strong>the</strong> very beg<strong>in</strong>n<strong>in</strong>g, Gavrilović has worked with <strong>the</strong> same partnerand distributor through whom <strong>the</strong>y export <strong>the</strong>ir products to Canada,as well. Tak<strong>in</strong>g <strong>in</strong>to consideration numerous restrictions and <strong>the</strong>market situation, where domestic American products are <strong>the</strong> biggestcompetitors, Gavrilović can sell <strong>the</strong>ir products almost solely to <strong>the</strong><strong>Croatia</strong>n ethnic groups.
