Terms and Conditions. The Terms and Conditions are included in, and are a subset of, the entireAgreement.Non-Covered Repairs are any and all repairs (materials and associated labor charges) that occur onparts or materials not explicitly stated as a Covered Repair under the PLAN(S).Party or Parties shall mean either Home Service or You, the person that has entered into this Agreement(together referred to as the “Parties”).Eligibility for Coverage:You must own the single-family detached residence within which or to which the Covered Service(s) isattached. Your Covered Service(s) must be in working order and free of leaks, blocks, breaks damageor existing malfunction prior to enrolling in this program. Mobile homes and multi-family homes, includingbut not limited to condominiums, duplexes and apartment houses, and any facility used for commercialpurposes are not eligible for coverage under this Agreement.Administrators Rights:We reserve the right to change the fee for the PLAN(S) upon giving You thirty (30) days’ written notice.We also reserve the right to modify this program upon thirty (30) days’ written notice to You. Ourobligations are limited in the event Your property was not eligible for coverage under the PLAN(S). If theAdministrator determines Your property was not eligible, then Our sole obligation under the PLAN(S) is torefund the payments made by You. When this refund is paid, the PLAN(S) will be void as of the date ofthe original Enrollment Date.YOUR PLAN(S) IS NOT AN INSURANCE CONTRACT, AND IS NOT TRANSFERABLE. YOUR PLAN(S)PROVIDES REPAIR OR REPLACEMENT SERVICE FOR COVERED REPAIRS REQUIRED DUE TONORMAL WEAR AND TEAR INCLUDING INHERENT DEFECTS IN MATERIAL.WE SHALL NOT BE LIABLE FOR DAMAGES, INCLUDING ANY INDIRECT, INCIDENTAL ORCONSEQUENTIAL DAMAGES, THAT ARISE FROM (1) ANY DEFECTS IN MATERIALS USEDTO MAINTAIN COVERED REPAIRS; OR (2) DEFECTS IN WORKMANSHIP PROVIDED UNDERYOUR PLAN(S). THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, WARRANTIES OFMERCHANTABILITY, OR WARRANTIES OF FITNESS FOR A SPECIFIC PURPOSE OFFERED WITHYOUR PLAN(S). OUR LIABILITY FOR DEFECTIVE MATERIALS OR WORKMANSHIP IS LIMITED TOREPAIR OR REPLACEMENT OF THE DEFECTIVE MATERIAL AND/OR A CORRECTIVE SERVICEVISIT.WE SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR INCIDENTAL OR CONSEQUENTIALDAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS OR ANY OTHER EXPENSES,LOSS OR DAMAGE DIRECTLY OR INDIRECTLY ARISING FROM THE PERFORMANCE ORNONPERFORMANCE OF YOUR PLAN(S) OR ANY COVERED SERVICE(S) UNDER YOUR PLAN(S)OR THE USE OR INABILITY TO USE THE COVERED SERVICE(S) TO WHICH YOUR PLAN(S)APPLIES.6
