THE LAW ON MUTUAL LEGAL ASSISTANCEIN CRIMINAL MATTERS(Official Gazette of M<strong>on</strong>tenegro, No. 04/08 dated 17.01.2008)I. GENERAL PROVISIONSArticle 1This Law shall regulate <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s and procedure for provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al<strong>legal</strong> <strong>assistance</strong> <strong>in</strong> crim<strong>in</strong>al <strong>matters</strong> (here<strong>in</strong>after referred to as <str<strong>on</strong>g>the</str<strong>on</strong>g> “<strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong><strong>assistance</strong>”).Article 2(1) Internati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> shall be provided <strong>in</strong> accordance with an <strong>in</strong>ternati<strong>on</strong>alagreement.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no <strong>in</strong>ternati<strong>on</strong>al agreement or if certa<strong>in</strong> issues are not regulated under an<strong>in</strong>ternati<strong>on</strong>al agreement, <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> shall be provided <strong>in</strong> accordancewith this Law, provided that <str<strong>on</strong>g>the</str<strong>on</strong>g>re is reciprocity or that it can be expected that <str<strong>on</strong>g>the</str<strong>on</strong>g>foreign state would execute <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g>domestic judicial authority.Article 3Internati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> shall <strong>in</strong>clude <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> accused and sentencedpers<strong>on</strong>s, transfer and assum<strong>in</strong>g of crim<strong>in</strong>al prosecuti<strong>on</strong>, enforcement of foreign crim<strong>in</strong>alverdicts, delivery of documents, written materials and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r cases relat<strong>in</strong>g to <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>alproceed<strong>in</strong>gs <strong>in</strong> a foreign state, as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> undertak<strong>in</strong>g of certa<strong>in</strong> procedural acti<strong>on</strong>s such as:hear<strong>in</strong>g of <str<strong>on</strong>g>the</str<strong>on</strong>g> accused, witnesses and experts, crime scene <strong>in</strong>vestigati<strong>on</strong>, search of premisesand pers<strong>on</strong>s and temporary seizure of items.Article 4(1) Domestic judicial authority shall forward letters rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong><strong>assistance</strong> to foreign judicial authorities and receive <str<strong>on</strong>g>the</str<strong>on</strong>g> letters rogatory for <strong>in</strong>ternati<strong>on</strong>al<strong>legal</strong> <strong>assistance</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign judicial authorities through <str<strong>on</strong>g>the</str<strong>on</strong>g> m<strong>in</strong>istry resp<strong>on</strong>sible for<str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary (here<strong>in</strong>after referred to as <str<strong>on</strong>g>the</str<strong>on</strong>g> “M<strong>in</strong>istry”).(2) In cases where <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no <strong>in</strong>ternati<strong>on</strong>al agreement or reciprocity, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry shalldeliver and receive letters rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> through diplomaticchannels.(3) In cases when this has been provided for under an <strong>in</strong>ternati<strong>on</strong>al agreement or where<str<strong>on</strong>g>the</str<strong>on</strong>g>re is reciprocity, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry shall deliver and receive letters rogatory for<strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> through <str<strong>on</strong>g>the</str<strong>on</strong>g> competent authority of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign state as acentral communicati<strong>on</strong> authority.(4) Without prejudice to <str<strong>on</strong>g>the</str<strong>on</strong>g> above, if provided for under an <strong>in</strong>ternati<strong>on</strong>al agreement,domestic judicial authority may deliver letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>to a foreign judicial authority directly and receive letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong>


<strong>assistance</strong> from a foreign judicial authority directly, while it shall be obliged to delivera copy of <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory to <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry.(5) In urgent cases, provided that <str<strong>on</strong>g>the</str<strong>on</strong>g>re is reciprocity, letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong><strong>assistance</strong> may be delivered and received through <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Central Bureau of <str<strong>on</strong>g>the</str<strong>on</strong>g>Interpol.(6) The courts and <str<strong>on</strong>g>the</str<strong>on</strong>g> state prosecutors’ offices shall be resp<strong>on</strong>sible for provisi<strong>on</strong> of<strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> <strong>in</strong> accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>law</str<strong>on</strong>g>.Article 5Internati<strong>on</strong>al crim<strong>in</strong>al <strong>assistance</strong> may be provided if <str<strong>on</strong>g>the</str<strong>on</strong>g> offence for which <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> is requested is a crim<strong>in</strong>al offence both under <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic <str<strong>on</strong>g>law</str<strong>on</strong>g>and under <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>law</str<strong>on</strong>g> of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign state <str<strong>on</strong>g>the</str<strong>on</strong>g> judicial authority of which presented <str<strong>on</strong>g>the</str<strong>on</strong>g> letterrogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>.Article 6(1) Unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise has been provided for by an <strong>in</strong>ternati<strong>on</strong>al agreement or this Law, <str<strong>on</strong>g>the</str<strong>on</strong>g>letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic or of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreignjudicial authority shall be accompanied with <str<strong>on</strong>g>the</str<strong>on</strong>g> translati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory <strong>in</strong>to<str<strong>on</strong>g>the</str<strong>on</strong>g> language of <str<strong>on</strong>g>the</str<strong>on</strong>g> requested state, or <strong>on</strong>e of <str<strong>on</strong>g>the</str<strong>on</strong>g> official languages of <str<strong>on</strong>g>the</str<strong>on</strong>g> Council ofEurope, if <str<strong>on</strong>g>the</str<strong>on</strong>g> requested state accepts it. The replies to <str<strong>on</strong>g>the</str<strong>on</strong>g> letters rogatory of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreignjudicial authorities do not need to be translated.(2) Domestic judicial authority shall also proceed up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory for <strong>in</strong>ternati<strong>on</strong>al<strong>legal</strong> <strong>assistance</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign judicial authority if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory has been presentedelectr<strong>on</strong>ically or by some o<str<strong>on</strong>g>the</str<strong>on</strong>g>r means of telecommunicati<strong>on</strong> provid<strong>in</strong>g delivery receipt,if it may verify its au<str<strong>on</strong>g>the</str<strong>on</strong>g>nticity and if <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign judicial authority is prepared to deliver<str<strong>on</strong>g>the</str<strong>on</strong>g> orig<strong>in</strong>al of <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory with<strong>in</strong> 15 days at latest.Article 7Unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise has been provided for by an <strong>in</strong>ternati<strong>on</strong>al agreement or this Law,signed and certified letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> shall c<strong>on</strong>ta<strong>in</strong>:1) <str<strong>on</strong>g>the</str<strong>on</strong>g> name and <str<strong>on</strong>g>the</str<strong>on</strong>g> seat of <str<strong>on</strong>g>the</str<strong>on</strong>g> authority mak<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> request;2) <str<strong>on</strong>g>the</str<strong>on</strong>g> name of <str<strong>on</strong>g>the</str<strong>on</strong>g> requested authority, and if its precise name is unknown, an<strong>in</strong>dicati<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory is be<strong>in</strong>g sent to <str<strong>on</strong>g>the</str<strong>on</strong>g> competent judicialauthority, and <str<strong>on</strong>g>the</str<strong>on</strong>g> name of <str<strong>on</strong>g>the</str<strong>on</strong>g> country;3) <strong>legal</strong> basis for <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>;4) <str<strong>on</strong>g>the</str<strong>on</strong>g> form of <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> requested and <str<strong>on</strong>g>the</str<strong>on</strong>g> reas<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g>letter rogatory;5) <strong>legal</strong> qualificati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence committed and <str<strong>on</strong>g>the</str<strong>on</strong>g> summary of <str<strong>on</strong>g>the</str<strong>on</strong>g>facts, except if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory refers to <str<strong>on</strong>g>the</str<strong>on</strong>g> service of court writs(applicati<strong>on</strong>s, documents and <str<strong>on</strong>g>the</str<strong>on</strong>g> like);6) nati<strong>on</strong>ality and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r pers<strong>on</strong>al details of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> regard<strong>in</strong>g which <str<strong>on</strong>g>the</str<strong>on</strong>g><strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> is requested and his status <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> proceed<strong>in</strong>gs;7) <strong>in</strong> case of service of court writs, <str<strong>on</strong>g>the</str<strong>on</strong>g>ir type.


Article 8Unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise has been provided for by an <strong>in</strong>ternati<strong>on</strong>al agreement or this Law, <str<strong>on</strong>g>the</str<strong>on</strong>g>costs of provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>, under <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong> of reciprocity, shall beborne by <str<strong>on</strong>g>the</str<strong>on</strong>g> state to which <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> is sent.Article 9The expressi<strong>on</strong>s used <strong>in</strong> this Law shall have <str<strong>on</strong>g>the</str<strong>on</strong>g> follow<strong>in</strong>g mean<strong>in</strong>g:1) ‘domestic judicial authority’ shall mean court and state prosecutor designated by <str<strong>on</strong>g>law</str<strong>on</strong>g> toprovide <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>;2) ‘foreign judicial authority’ shall mean <str<strong>on</strong>g>the</str<strong>on</strong>g> state authority competent to provide<strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> under <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>law</str<strong>on</strong>g> of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign state;3) ‘request<strong>in</strong>g state’ shall mean foreign state <str<strong>on</strong>g>the</str<strong>on</strong>g> competent judicial authority of whichsent <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory for <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>;4) ‘requested state’ shall mean <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign state to which <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory for<strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> is sent;5) ‘letter rogatory’ shall mean a document request<strong>in</strong>g <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>;6) ‘domestic <str<strong>on</strong>g>law</str<strong>on</strong>g>’ shall mean <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>law</str<strong>on</strong>g> of M<strong>on</strong>tenegro.II. EXTRADITION OF ACCUSED AND SENTENCED PERSONSArticle 10The extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> accused or sentenced pers<strong>on</strong>s shall be requested and enforced <strong>in</strong>accordance with this Law unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise has been provided for under an <strong>in</strong>ternati<strong>on</strong>alagreement.Article 11(1) The c<strong>on</strong>diti<strong>on</strong>s for <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> request of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state shall be asfollows:1) that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed is not a nati<strong>on</strong>al of M<strong>on</strong>tenegro;2) that <str<strong>on</strong>g>the</str<strong>on</strong>g> offence for which extraditi<strong>on</strong> is requested was not committed <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> territory ofM<strong>on</strong>tenegro, aga<strong>in</strong>st M<strong>on</strong>tenegro or its nati<strong>on</strong>al;3) that <str<strong>on</strong>g>the</str<strong>on</strong>g> offence motivat<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> request for extraditi<strong>on</strong> is a crim<strong>in</strong>al offence both under <str<strong>on</strong>g>the</str<strong>on</strong>g>domestic <str<strong>on</strong>g>law</str<strong>on</strong>g> and under <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>law</str<strong>on</strong>g> of <str<strong>on</strong>g>the</str<strong>on</strong>g> country <strong>in</strong> which it was committed;4) that <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al prosecuti<strong>on</strong> or enforcement of crim<strong>in</strong>al sancti<strong>on</strong> has not been barred by<str<strong>on</strong>g>the</str<strong>on</strong>g> lapse of time under <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic <str<strong>on</strong>g>law</str<strong>on</strong>g> before <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed has been deta<strong>in</strong>ed orexam<strong>in</strong>ed as an accused;5) that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed has not been already c<strong>on</strong>victed by a domestic court for <str<strong>on</strong>g>the</str<strong>on</strong>g> sameoffence or he has not been acquitted of <str<strong>on</strong>g>the</str<strong>on</strong>g> same offence by <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic court <strong>in</strong> a f<strong>in</strong>aland <strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g manner, except if <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements prescribed by <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>alProcedure Code for retrial have been met; or crim<strong>in</strong>al proceed<strong>in</strong>gs have not been <strong>in</strong>stituted<strong>in</strong> M<strong>on</strong>tenegro for <str<strong>on</strong>g>the</str<strong>on</strong>g> same offence committed aga<strong>in</strong>st M<strong>on</strong>tenegro or a nati<strong>on</strong>al ofM<strong>on</strong>tenegro; or <str<strong>on</strong>g>the</str<strong>on</strong>g> security for <str<strong>on</strong>g>the</str<strong>on</strong>g> fulfilment of property <str<strong>on</strong>g>law</str<strong>on</strong>g> claim of <str<strong>on</strong>g>the</str<strong>on</strong>g> victim has beenprovided if <str<strong>on</strong>g>the</str<strong>on</strong>g> proceed<strong>in</strong>gs have been <strong>in</strong>stituted for <str<strong>on</strong>g>the</str<strong>on</strong>g> offence committed aga<strong>in</strong>st anati<strong>on</strong>al of M<strong>on</strong>tenegro;6) that <str<strong>on</strong>g>the</str<strong>on</strong>g> identity of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed has been established;


7) that <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state presented facts and sufficient evidence for a grounded suspici<strong>on</strong>that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed committed <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence or <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a f<strong>in</strong>al and <strong>legal</strong>lyb<strong>in</strong>d<strong>in</strong>g judicial decisi<strong>on</strong>;8) that it does not c<strong>on</strong>cern a m<strong>in</strong>or offence, <strong>in</strong> accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>al Code.Article 12(1) The extraditi<strong>on</strong> shall not be allowed for a political crim<strong>in</strong>al offence, an offencec<strong>on</strong>nected with a political crim<strong>in</strong>al offence or a military crim<strong>in</strong>al offence with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> mean<strong>in</strong>gof <str<strong>on</strong>g>the</str<strong>on</strong>g> European C<strong>on</strong>venti<strong>on</strong> of Extraditi<strong>on</strong> (here<strong>in</strong>after referred to as “political and militarycrim<strong>in</strong>al offences”).(2) Prohibiti<strong>on</strong> referred to <strong>in</strong> paragraph 1 above shall not apply to <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offencesof genocide, crime aga<strong>in</strong>st humanity, war crimes and terrorism.Article 13(1) The extraditi<strong>on</strong> shall not be granted for <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence punishable under <str<strong>on</strong>g>the</str<strong>on</strong>g>domestic <str<strong>on</strong>g>law</str<strong>on</strong>g> and <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>law</str<strong>on</strong>g> of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state by impris<strong>on</strong>ment for a term of up to sixm<strong>on</strong>ths or a f<strong>in</strong>e.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> sentenced pers<strong>on</strong> is requested to serve <str<strong>on</strong>g>the</str<strong>on</strong>g> sentence, hisextraditi<strong>on</strong> shall not be granted if <str<strong>on</strong>g>the</str<strong>on</strong>g> durati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> imposed impris<strong>on</strong>ment sentence or <str<strong>on</strong>g>the</str<strong>on</strong>g>rema<strong>in</strong><strong>in</strong>g porti<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>reof which is yet to be served does not exceed four m<strong>on</strong>ths.Article 14If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>law</str<strong>on</strong>g> of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state prescribes death penalty for <str<strong>on</strong>g>the</str<strong>on</strong>g> offence for which <str<strong>on</strong>g>the</str<strong>on</strong>g>extraditi<strong>on</strong> is requested, extraditi<strong>on</strong> may be granted <strong>on</strong>ly if that state gives assurance that <str<strong>on</strong>g>the</str<strong>on</strong>g>death-penalty will not be imposed or carried out.Article 15(1) The procedure for extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> accused or sentenced pers<strong>on</strong> shall be <strong>in</strong>itiatedup<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.(2) Letter rogatory for extraditi<strong>on</strong> shall be delivered to <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry.(3) The follow<strong>in</strong>g shall be enclosed to <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory:1) means required to establish <str<strong>on</strong>g>the</str<strong>on</strong>g> identity of <str<strong>on</strong>g>the</str<strong>on</strong>g> accused and/or of <str<strong>on</strong>g>the</str<strong>on</strong>g> sentencedpers<strong>on</strong> (accurate descripti<strong>on</strong>, photographs, f<strong>in</strong>gerpr<strong>in</strong>ts and <str<strong>on</strong>g>the</str<strong>on</strong>g> like);2) certificate or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r <strong>in</strong>formati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>ality of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed;3) <strong>in</strong>dictment, verdict or detenti<strong>on</strong> order, or any o<str<strong>on</strong>g>the</str<strong>on</strong>g>r document equivalent to<strong>in</strong>dictment, orig<strong>in</strong>al or notarized copy, which shall c<strong>on</strong>ta<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> forename and surnameof <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r <strong>in</strong>formati<strong>on</strong> necessary to establish his identity,descripti<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> offence, <strong>legal</strong> qualificati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> offence and evidence for agrounded suspici<strong>on</strong>;4) excerpt from <str<strong>on</strong>g>the</str<strong>on</strong>g> word<strong>in</strong>g of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al <str<strong>on</strong>g>law</str<strong>on</strong>g> of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g country whichis to be applied or which has been applied aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> accused for <str<strong>on</strong>g>the</str<strong>on</strong>g> offence for whichextraditi<strong>on</strong> is requested, and if <str<strong>on</strong>g>the</str<strong>on</strong>g> offence was committed <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> territory of a thirdcountry, <str<strong>on</strong>g>the</str<strong>on</strong>g> excerpt from <str<strong>on</strong>g>the</str<strong>on</strong>g> word<strong>in</strong>g of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al <str<strong>on</strong>g>law</str<strong>on</strong>g> of that country as well.(4) If <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>formati<strong>on</strong> and documents referred to <strong>in</strong> paragraph 3 above were submitted<strong>in</strong> a foreign language, <str<strong>on</strong>g>the</str<strong>on</strong>g>y shall be accompanied by a certified translati<strong>on</strong> <strong>in</strong>to <str<strong>on</strong>g>the</str<strong>on</strong>g>M<strong>on</strong>tenegr<strong>in</strong> language.


Article 16(1) The M<strong>in</strong>istry shall deliver letter rogatory for <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>gjudge of <str<strong>on</strong>g>the</str<strong>on</strong>g> court with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> jurisdicti<strong>on</strong> of which <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed resides or with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>jurisdicti<strong>on</strong> of which <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed happens to be.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> domicile or residence of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed is unknown, his domicile orresidence shall be established through <str<strong>on</strong>g>the</str<strong>on</strong>g> state adm<strong>in</strong>istrati<strong>on</strong> authority competent for affairsrelat<strong>in</strong>g to domicile and residence.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory was submitted <strong>in</strong> accordance with Article 15 above, <str<strong>on</strong>g>the</str<strong>on</strong>g><strong>in</strong>vestigat<strong>in</strong>g judge shall issue <str<strong>on</strong>g>the</str<strong>on</strong>g> order to deta<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed, if <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a danger that<str<strong>on</strong>g>the</str<strong>on</strong>g> will avoid <str<strong>on</strong>g>the</str<strong>on</strong>g> procedure of extraditi<strong>on</strong>, or if o<str<strong>on</strong>g>the</str<strong>on</strong>g>r reas<strong>on</strong>s referred to <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>alProcedure Code exist, and/or he shall undertake o<str<strong>on</strong>g>the</str<strong>on</strong>g>r measures to ensure his presence, unlessit is obvious from <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory and delivered <strong>in</strong>formati<strong>on</strong> and documents that <str<strong>on</strong>g>the</str<strong>on</strong>g>c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong> have not been met.(4) Detenti<strong>on</strong> referred to <strong>in</strong> paragraph 3 above may last until <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> <strong>on</strong> extraditi<strong>on</strong>is enforced at latest but no l<strong>on</strong>ger than six m<strong>on</strong>ths.(5) Up<strong>on</strong> a reas<strong>on</strong>ed request of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state, <str<strong>on</strong>g>the</str<strong>on</strong>g> Chamber of <str<strong>on</strong>g>the</str<strong>on</strong>g> competent courtmay extend <str<strong>on</strong>g>the</str<strong>on</strong>g> durati<strong>on</strong> of detenti<strong>on</strong> referred to <strong>in</strong> paragraph 3 above <strong>in</strong> justified cases foradditi<strong>on</strong>al two m<strong>on</strong>ths.(6) The <strong>in</strong>vestigat<strong>in</strong>g judge shall, after he establishes <str<strong>on</strong>g>the</str<strong>on</strong>g> identity of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed,<strong>in</strong>form him without delay why and based <strong>on</strong> which evidence his extraditi<strong>on</strong> is requested and<str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>g judge shall ask him to present his defence.(7) The record shall be made of exam<strong>in</strong>ati<strong>on</strong> and present<strong>in</strong>g of defence. The<strong>in</strong>vestigat<strong>in</strong>g judge shall be obliged to <strong>in</strong>form <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed immediately that he mayengage a defence attorney, or that a defence attorney ex officio may be appo<strong>in</strong>ted for him if <str<strong>on</strong>g>the</str<strong>on</strong>g>defence is mandatory for <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence <strong>in</strong> questi<strong>on</strong> pursuant to <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>al ProcedureCode.Article 17(1) Detenti<strong>on</strong> aimed at extraditi<strong>on</strong> may be ordered under c<strong>on</strong>diti<strong>on</strong>s referred to <strong>in</strong>Article 15 of this Law even before <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state is received, ifrequested by it, or if <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a grounded suspici<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed committed <str<strong>on</strong>g>the</str<strong>on</strong>g>crim<strong>in</strong>al offence for which he can be extradited to <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.(2) Investigat<strong>in</strong>g judge shall release <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed when <str<strong>on</strong>g>the</str<strong>on</strong>g> reas<strong>on</strong>s for detenti<strong>on</strong>term<strong>in</strong>ate or if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory has not been submitted with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> period of time hedeterm<strong>in</strong>ed while tak<strong>in</strong>g <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> all circumstances, and which cannot exceed 40days from <str<strong>on</strong>g>the</str<strong>on</strong>g> date of detenti<strong>on</strong>. The detenti<strong>on</strong> ordered pursuant to paragraph 1 above may berevoked if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory has not been submitted with<strong>in</strong> 18 days from <str<strong>on</strong>g>the</str<strong>on</strong>g> date of deta<strong>in</strong><strong>in</strong>g<str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed.(3) The M<strong>in</strong>istry shall <strong>in</strong>form <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state about <str<strong>on</strong>g>the</str<strong>on</strong>g> deadl<strong>in</strong>es determ<strong>in</strong>ed by <str<strong>on</strong>g>the</str<strong>on</strong>g><strong>in</strong>vestigat<strong>in</strong>g judge without delay. Without prejudice to <str<strong>on</strong>g>the</str<strong>on</strong>g> above, if <str<strong>on</strong>g>the</str<strong>on</strong>g>re are justifiedreas<strong>on</strong>s, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>g judge may extend <str<strong>on</strong>g>the</str<strong>on</strong>g> durati<strong>on</strong> of detenti<strong>on</strong> for additi<strong>on</strong>al 30 days atmost, if requested by <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.


Article 18(1) Up<strong>on</strong> hear<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> state prosecutor and <str<strong>on</strong>g>the</str<strong>on</strong>g> defence attorney, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>g judgeshall undertake o<str<strong>on</strong>g>the</str<strong>on</strong>g>r acti<strong>on</strong>s, if necessary, to determ<strong>in</strong>e if <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong> and/orsurrender of <str<strong>on</strong>g>the</str<strong>on</strong>g> items <strong>on</strong> which or by which <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence was committed, if <str<strong>on</strong>g>the</str<strong>on</strong>g>se hadbeen c<strong>on</strong>fiscated from <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed, are fulfilled.(2) After <str<strong>on</strong>g>the</str<strong>on</strong>g> acti<strong>on</strong>s referred to <strong>in</strong> paragraph 1 above have been completed, <str<strong>on</strong>g>the</str<strong>on</strong>g><strong>in</strong>vestigat<strong>in</strong>g judge shall deliver <str<strong>on</strong>g>the</str<strong>on</strong>g> case files to <str<strong>on</strong>g>the</str<strong>on</strong>g> competent Chamber al<strong>on</strong>g with hisop<strong>in</strong>i<strong>on</strong>.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs are underway before a domestic court aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>claimed for <str<strong>on</strong>g>the</str<strong>on</strong>g> same or ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r crim<strong>in</strong>al offence, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>g judge shall note that <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>case files.Article 19(1) If <str<strong>on</strong>g>the</str<strong>on</strong>g> Chamber of <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court f<strong>in</strong>ds that <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong>prescribed by this Law have not been met, it shall make a decisi<strong>on</strong> to reject <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatoryfor extraditi<strong>on</strong>.(2) The order referred to <strong>in</strong> paragraph 1 above shall be submitted by <str<strong>on</strong>g>the</str<strong>on</strong>g> court ex officiodirectly to <str<strong>on</strong>g>the</str<strong>on</strong>g> higher court which may c<strong>on</strong>firm, repeal or reverse <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> after it hears <str<strong>on</strong>g>the</str<strong>on</strong>g>state prosecutor.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed is held <strong>in</strong> detenti<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> Chamber of <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court maydecide that he rema<strong>in</strong> <strong>in</strong> detenti<strong>on</strong> until <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> reject<strong>in</strong>g his extraditi<strong>on</strong> becomes f<strong>in</strong>al and<strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g.(4) F<strong>in</strong>al and <strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g decisi<strong>on</strong> reject<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> shall be submitted to <str<strong>on</strong>g>the</str<strong>on</strong>g>M<strong>in</strong>istry which shall <strong>in</strong>form <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state <str<strong>on</strong>g>the</str<strong>on</strong>g>reof.Article 20(1) If <str<strong>on</strong>g>the</str<strong>on</strong>g> Chamber of <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court f<strong>in</strong>ds that <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong>prescribed by this Law are met, it shall c<strong>on</strong>firm this by pass<strong>in</strong>g a decisi<strong>on</strong>.(2) The pers<strong>on</strong> claimed shall have right to compla<strong>in</strong> aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> referred to <strong>in</strong>paragraph 1 above directly to <str<strong>on</strong>g>the</str<strong>on</strong>g> court of higher <strong>in</strong>stance with<strong>in</strong> three days after <str<strong>on</strong>g>the</str<strong>on</strong>g> receipt<str<strong>on</strong>g>the</str<strong>on</strong>g>reof.Article 21If <str<strong>on</strong>g>the</str<strong>on</strong>g> court of sec<strong>on</strong>d <strong>in</strong>stance c<strong>on</strong>firms <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> referred to <strong>in</strong> Article 20 above, orif <str<strong>on</strong>g>the</str<strong>on</strong>g> compla<strong>in</strong>t has not been lodged aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> court of first <strong>in</strong>stance, <str<strong>on</strong>g>the</str<strong>on</strong>g> caseshall be delivered to <str<strong>on</strong>g>the</str<strong>on</strong>g> m<strong>in</strong>ister competent for judiciary (here<strong>in</strong>after referred to as <str<strong>on</strong>g>the</str<strong>on</strong>g>M<strong>in</strong>ister), <strong>in</strong> order to make decisi<strong>on</strong> whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r to grant extraditi<strong>on</strong>.Article 22(1) In <str<strong>on</strong>g>the</str<strong>on</strong>g> event referred to <strong>in</strong> Article 21 above, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister shall pass <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> grant<strong>in</strong>g orrefus<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong>.(2) When he grants <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister may make a decisi<strong>on</strong> to postp<strong>on</strong>e <str<strong>on</strong>g>the</str<strong>on</strong>g>extraditi<strong>on</strong> because crim<strong>in</strong>al proceed<strong>in</strong>gs are underway before a domestic court for ano<str<strong>on</strong>g>the</str<strong>on</strong>g>rcrim<strong>in</strong>al offence aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed or because this pers<strong>on</strong> is serv<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g>impris<strong>on</strong>ment sentence <strong>in</strong> M<strong>on</strong>tenegro.


(3) The M<strong>in</strong>ister shall not grant <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> who enjoys <str<strong>on</strong>g>the</str<strong>on</strong>g> right of asylum <strong>in</strong>M<strong>on</strong>tenegro or where it can be reas<strong>on</strong>ably assumed that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed shall besubjected to prosecuti<strong>on</strong> or punishment because of his race, religi<strong>on</strong>, nati<strong>on</strong>ality, bel<strong>on</strong>g<strong>in</strong>gto a specific social group or for his political beliefs, or that his status would be made moredifficult for <strong>on</strong>e of <str<strong>on</strong>g>the</str<strong>on</strong>g>se reas<strong>on</strong>s.(4) The M<strong>in</strong>ister shall refuse <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> if <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed has not been given <str<strong>on</strong>g>the</str<strong>on</strong>g>possibility to have a defence attorney <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs preced<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g>extraditi<strong>on</strong>.Article 23(1) In <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> grant<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister shall state that without <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>sentof M<strong>on</strong>tenegro:1) <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed may not be prosecuted for ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r crim<strong>in</strong>al offence committed priorto <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong>;2) <str<strong>on</strong>g>the</str<strong>on</strong>g> punishment for ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r crim<strong>in</strong>al offence committed prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> cannotbe enforced aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed;3) a punishment more severe than <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>e to which he has been sentenced cannot beenforced aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed;4) <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed may not be extradited to a third state for prosecuti<strong>on</strong> for a crim<strong>in</strong>aloffence committed prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> which has been granted.(2) Additi<strong>on</strong>ally to <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s referred to <strong>in</strong> paragraph 1 above, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister may alsoimpose o<str<strong>on</strong>g>the</str<strong>on</strong>g>r c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong>.Article 24(1) The request<strong>in</strong>g state shall be notified of <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> c<strong>on</strong>cern<strong>in</strong>g extraditi<strong>on</strong> throughdiplomatic channels.(2) The decisi<strong>on</strong> grant<strong>in</strong>g extraditi<strong>on</strong> shall be submitted to <str<strong>on</strong>g>the</str<strong>on</strong>g> adm<strong>in</strong>istrati<strong>on</strong> authoritycompetent for police affairs which shall escort <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed to <str<strong>on</strong>g>the</str<strong>on</strong>g> bordercross<strong>in</strong>g where at an agreed place he will be surrendered to <str<strong>on</strong>g>the</str<strong>on</strong>g> authorities of <str<strong>on</strong>g>the</str<strong>on</strong>g>request<strong>in</strong>g state.Article 25(1) The request<strong>in</strong>g state shall take over <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of whom has beengranted with<strong>in</strong> 30 days as of <str<strong>on</strong>g>the</str<strong>on</strong>g> date of delivery of <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> <strong>on</strong> extraditi<strong>on</strong>.(2) The M<strong>in</strong>ister may extend <str<strong>on</strong>g>the</str<strong>on</strong>g> deadl<strong>in</strong>e referred to <strong>in</strong> paragraph 1 above for additi<strong>on</strong>al 15days up<strong>on</strong> reas<strong>on</strong>ed request of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of whom has been granted has not been taken over up<strong>on</strong><str<strong>on</strong>g>the</str<strong>on</strong>g> expiry of <str<strong>on</strong>g>the</str<strong>on</strong>g> deadl<strong>in</strong>e referred to <strong>in</strong> paragraphs 1 and 2 above, he shall beimmediately released, and <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister may refuse repeat extraditi<strong>on</strong> request for <str<strong>on</strong>g>the</str<strong>on</strong>g>same crim<strong>in</strong>al offence.Article 26If <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> same pers<strong>on</strong> is requested by more than <strong>on</strong>e country, ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r for<str<strong>on</strong>g>the</str<strong>on</strong>g> same offence or for different offences, <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> shall be taken hav<strong>in</strong>g regard toseriousness of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offences, <str<strong>on</strong>g>the</str<strong>on</strong>g> place of commissi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> respective dates of <str<strong>on</strong>g>the</str<strong>on</strong>g>


equests, <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>ality of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed, <str<strong>on</strong>g>the</str<strong>on</strong>g> possibility of subsequent extraditi<strong>on</strong> toano<str<strong>on</strong>g>the</str<strong>on</strong>g>r state, and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r circumstances.Article 27(1) If <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> is requested by a foreign state from ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r foreign state and <str<strong>on</strong>g>the</str<strong>on</strong>g>pers<strong>on</strong> claimed would have to be escorted through <str<strong>on</strong>g>the</str<strong>on</strong>g> territory of M<strong>on</strong>tenegro, transitmay be granted by <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory by <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state providedthat <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> c<strong>on</strong>cerned is not a nati<strong>on</strong>al of M<strong>on</strong>tenegro and that <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> is notenforced for political or military crim<strong>in</strong>al offence.(2) Letter rogatory for transit of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> through <str<strong>on</strong>g>the</str<strong>on</strong>g> territory of M<strong>on</strong>tenegro shallc<strong>on</strong>ta<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>formati<strong>on</strong> and documents referred to <strong>in</strong> Article 15 paragraph 3 of thisLaw.(3) In <str<strong>on</strong>g>the</str<strong>on</strong>g> case of transit of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> through <str<strong>on</strong>g>the</str<strong>on</strong>g> territory of M<strong>on</strong>tenegro by air transit, ifno land<strong>in</strong>g is expected, it shall not be necessary to obta<strong>in</strong> permit referred to <strong>in</strong>paragraph 1 above.(4) The request<strong>in</strong>g state shall notify <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry of transit referred to <strong>in</strong> paragraph 3 above.The notificati<strong>on</strong> shall c<strong>on</strong>ta<strong>in</strong> <strong>in</strong>formati<strong>on</strong> such as: <str<strong>on</strong>g>the</str<strong>on</strong>g> name of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> escortedthrough <str<strong>on</strong>g>the</str<strong>on</strong>g> territory of M<strong>on</strong>tenegro, <str<strong>on</strong>g>the</str<strong>on</strong>g> state to which <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> is extradited, <str<strong>on</strong>g>the</str<strong>on</strong>g>crim<strong>in</strong>al offence for which <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> is extradited, and <str<strong>on</strong>g>the</str<strong>on</strong>g> time of air transit.Article 28(1) At <str<strong>on</strong>g>the</str<strong>on</strong>g> request of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state, <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court shall seize and surrender, <strong>in</strong>accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic <str<strong>on</strong>g>law</str<strong>on</strong>g>, items which may serve as evidence materials or thatresulted from <str<strong>on</strong>g>the</str<strong>on</strong>g> commissi<strong>on</strong> of crim<strong>in</strong>al offence.(2) The items referred to <strong>in</strong> paragraph 1 above shall be surrendered even <strong>in</strong> case when analready approved extraditi<strong>on</strong> may not be enforced due to <str<strong>on</strong>g>the</str<strong>on</strong>g> death or escape of <str<strong>on</strong>g>the</str<strong>on</strong>g>pers<strong>on</strong> claimed.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> items referred to <strong>in</strong> paragraph 1 above are subject to seizure or c<strong>on</strong>fiscati<strong>on</strong> <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>territory of M<strong>on</strong>tenegro, <str<strong>on</strong>g>the</str<strong>on</strong>g>y may be temporarily reta<strong>in</strong>ed or surrendered provided that<str<strong>on</strong>g>the</str<strong>on</strong>g>y are returned <strong>in</strong> c<strong>on</strong>necti<strong>on</strong> with <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>go<strong>in</strong>g crim<strong>in</strong>al proceed<strong>in</strong>gs.(4) The items referred to <strong>in</strong> paragraph 1 above, to which M<strong>on</strong>tenegro and third pers<strong>on</strong>shave rights, shall be returned to M<strong>on</strong>tenegro as so<strong>on</strong> as possible after <str<strong>on</strong>g>the</str<strong>on</strong>g> hear<strong>in</strong>g iscompleted. The costs of return<strong>in</strong>g of items shall be borne by <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.Article 29(1) The pers<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of whom <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign state submitted <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory if<str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong> prescribed by this Law have been met may be extraditedwith<strong>in</strong> a summary procedure if <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed c<strong>on</strong>sented.(2) The c<strong>on</strong>sent referred to <strong>in</strong> paragraph 1 above shall be entered for <str<strong>on</strong>g>the</str<strong>on</strong>g> record before acompetent court <strong>in</strong> accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>al Procedure Code, <strong>in</strong> a way ensur<strong>in</strong>gthat <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>sent has been given voluntarily and that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed has been awareof all c<strong>on</strong>sequences of such c<strong>on</strong>sent when <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>sent was given. The c<strong>on</strong>sent <strong>on</strong>cegiven cannot be revoked.(3) The decisi<strong>on</strong> <strong>on</strong> extraditi<strong>on</strong> <strong>in</strong> a summary procedure shall be passed by a competentcourt.


(4) The court shall notify without delay <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry about <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> referred to <strong>in</strong>paragraph 3 of this Article, and <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry shall <strong>in</strong>form <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.(5) The extraditi<strong>on</strong> with<strong>in</strong> a summary procedure shall have <str<strong>on</strong>g>the</str<strong>on</strong>g> same force and effect as <str<strong>on</strong>g>the</str<strong>on</strong>g>extraditi<strong>on</strong> with<strong>in</strong> an ord<strong>in</strong>ary procedure.Article 30The costs of extraditi<strong>on</strong> <strong>in</strong>curred outside <str<strong>on</strong>g>the</str<strong>on</strong>g> territory of M<strong>on</strong>tenegro shall be <strong>in</strong>curredby <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.Article 31(1) If crim<strong>in</strong>al proceed<strong>in</strong>gs are underway <strong>in</strong> M<strong>on</strong>tenegro aga<strong>in</strong>st a pers<strong>on</strong> located <strong>in</strong> aforeign state or if <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> located <strong>in</strong> a foreign state has been sentenced by acompetent M<strong>on</strong>tenegr<strong>in</strong> court, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister may submit <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory forextraditi<strong>on</strong>.(2) The letter rogatory shall be submitted to <str<strong>on</strong>g>the</str<strong>on</strong>g> requested state through diplomaticchannels and it shall be accompanied by documents and <strong>in</strong>formati<strong>on</strong> referred to <strong>in</strong>Article 15 of this Law.Article 32(1) If <str<strong>on</strong>g>the</str<strong>on</strong>g>re is danger that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed will flee or hide, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister may request toorder to deta<strong>in</strong> that pers<strong>on</strong> temporarily or to undertake o<str<strong>on</strong>g>the</str<strong>on</strong>g>r measures required toprevent his escape even before <str<strong>on</strong>g>the</str<strong>on</strong>g> acti<strong>on</strong>s are taken <strong>in</strong> accordance with Article 31 ofthis Law.(2) The letter rogatory for temporary detenti<strong>on</strong> shall c<strong>on</strong>ta<strong>in</strong> specifically <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>formati<strong>on</strong> <strong>on</strong><str<strong>on</strong>g>the</str<strong>on</strong>g> identity of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed, <str<strong>on</strong>g>the</str<strong>on</strong>g> name of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence for which <str<strong>on</strong>g>the</str<strong>on</strong>g>extraditi<strong>on</strong> is requested, <strong>in</strong>dictment, verdict or detenti<strong>on</strong> order, date, place and name of<str<strong>on</strong>g>the</str<strong>on</strong>g> authority order<strong>in</strong>g detenti<strong>on</strong>, and/or <strong>in</strong>formati<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g> validity of verdict, aswell as <str<strong>on</strong>g>the</str<strong>on</strong>g> statement that <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> shall be requested through regular channels.Article 33(1) If <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed is extradited, he may be crim<strong>in</strong>ally prosecuted and/or <str<strong>on</strong>g>the</str<strong>on</strong>g>punishment may be enforced aga<strong>in</strong>st him <strong>on</strong>ly for <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence for which <str<strong>on</strong>g>the</str<strong>on</strong>g>extraditi<strong>on</strong> has been granted.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> referred to <strong>in</strong> paragraph 1 above has been c<strong>on</strong>victed f<strong>in</strong>ally and <strong>in</strong> a<strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g manner by <str<strong>on</strong>g>the</str<strong>on</strong>g> competent M<strong>on</strong>tenegr<strong>in</strong> court for o<str<strong>on</strong>g>the</str<strong>on</strong>g>r crim<strong>in</strong>aloffences committed prior to extraditi<strong>on</strong> with regard to which extraditi<strong>on</strong> is not allowed,<str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s of <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>al Procedure Code regulat<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> reversal of verdictwithout retrial shall apply mutatis mutandis.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> has been granted under certa<strong>in</strong> c<strong>on</strong>diti<strong>on</strong>s with respect to <str<strong>on</strong>g>the</str<strong>on</strong>g> type ordurati<strong>on</strong> of sancti<strong>on</strong> which may be imposed and/or enforced and if it has been acceptedunder such c<strong>on</strong>diti<strong>on</strong>s, <str<strong>on</strong>g>the</str<strong>on</strong>g> court shall be bound by such c<strong>on</strong>diti<strong>on</strong>s when pr<strong>on</strong>ounc<strong>in</strong>ga sentence; while if <str<strong>on</strong>g>the</str<strong>on</strong>g> enforcement of an already imposed sentence is <str<strong>on</strong>g>the</str<strong>on</strong>g> subject of<str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> court adjudicat<strong>in</strong>g <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> highest <strong>in</strong>stance shall reverse <str<strong>on</strong>g>the</str<strong>on</strong>g> verdictand impose <str<strong>on</strong>g>the</str<strong>on</strong>g> punishment <strong>in</strong> accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s of extraditi<strong>on</strong>.


(4) If <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> extradited had been held <strong>in</strong> detenti<strong>on</strong> <strong>in</strong> a foreign country for <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>aloffence for which he has been extradited, <str<strong>on</strong>g>the</str<strong>on</strong>g> time spent <strong>in</strong> detenti<strong>on</strong> shall beaccounted for <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> impris<strong>on</strong>ment sentence.III. TRANSFER AND ASSUMING OF CRIMINAL PROSECUTIONArticle 34(1) If a foreigner whose place of residence is <strong>in</strong> a foreign state committed a crim<strong>in</strong>aloffence <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> territory of M<strong>on</strong>tenegro, that state can be surrendered <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al filesfor <str<strong>on</strong>g>the</str<strong>on</strong>g> purpose of crim<strong>in</strong>al prosecuti<strong>on</strong> and trial if <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign state does not object to it,without prejudice to <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s referred to <strong>in</strong> Article 11 of this Law.(2) Before pass<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> to c<strong>on</strong>duct <strong>in</strong>vestigati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> to transfer crim<strong>in</strong>alprosecuti<strong>on</strong> shall be taken by <str<strong>on</strong>g>the</str<strong>on</strong>g> competent state prosecutor; and if <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> waspassed prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> commencement of <str<strong>on</strong>g>the</str<strong>on</strong>g> ma<strong>in</strong> hear<strong>in</strong>g, <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> to transfer crim<strong>in</strong>alprosecuti<strong>on</strong> shall be taken by <str<strong>on</strong>g>the</str<strong>on</strong>g> Chamber of <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court composed of threejudges.(3) The decisi<strong>on</strong> to transfer crim<strong>in</strong>al prosecuti<strong>on</strong> may be taken for <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offencespunishable by impris<strong>on</strong>ment for a term of up to ten years and for <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offencesof jeopardis<strong>in</strong>g public traffic.(4) If <str<strong>on</strong>g>the</str<strong>on</strong>g> victim is a nati<strong>on</strong>al of M<strong>on</strong>tenegro, <str<strong>on</strong>g>the</str<strong>on</strong>g> transfer of crim<strong>in</strong>al prosecuti<strong>on</strong> shall notbe allowed if <str<strong>on</strong>g>the</str<strong>on</strong>g> victim opposes to it, unless a security for <str<strong>on</strong>g>the</str<strong>on</strong>g> settlement of hisproperty <str<strong>on</strong>g>law</str<strong>on</strong>g> claim has been provided.(5) If <str<strong>on</strong>g>the</str<strong>on</strong>g> accused is held <strong>in</strong> detenti<strong>on</strong>, it shall be requested from <str<strong>on</strong>g>the</str<strong>on</strong>g> requested state through<str<strong>on</strong>g>the</str<strong>on</strong>g> shortest possible means to <strong>in</strong>form <str<strong>on</strong>g>the</str<strong>on</strong>g> competent M<strong>on</strong>tenegr<strong>in</strong> authority with<strong>in</strong>fifteen days at latest whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r it shall assume <str<strong>on</strong>g>the</str<strong>on</strong>g> prosecuti<strong>on</strong>.Article 35The competent court or <str<strong>on</strong>g>the</str<strong>on</strong>g> state prosecutor shall deliver <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory for <str<strong>on</strong>g>the</str<strong>on</strong>g>transfer of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al prosecuti<strong>on</strong> accompanied with <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> transfer of crim<strong>in</strong>alprosecuti<strong>on</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> case files to <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>istry.The M<strong>in</strong>istry shall deliver <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory for <str<strong>on</strong>g>the</str<strong>on</strong>g> transfer of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al prosecuti<strong>on</strong>to <str<strong>on</strong>g>the</str<strong>on</strong>g> competent authority of <str<strong>on</strong>g>the</str<strong>on</strong>g> requested state, <strong>in</strong> accordance with Article 4 of this Law.Article 36(1) The request of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state for M<strong>on</strong>tenegro to assume <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>alprosecuti<strong>on</strong> of a nati<strong>on</strong>al of M<strong>on</strong>tenegro or a pers<strong>on</strong> whose residence is <strong>in</strong> M<strong>on</strong>tenegro for <str<strong>on</strong>g>the</str<strong>on</strong>g>crim<strong>in</strong>al offence committed <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state, shall be delivered toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with <str<strong>on</strong>g>the</str<strong>on</strong>g> files to<str<strong>on</strong>g>the</str<strong>on</strong>g> competent state prosecutor with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> jurisdicti<strong>on</strong> of whom that pers<strong>on</strong> resides.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> property <str<strong>on</strong>g>law</str<strong>on</strong>g> claim has been lodged with <str<strong>on</strong>g>the</str<strong>on</strong>g> competent authority of <str<strong>on</strong>g>the</str<strong>on</strong>g>request<strong>in</strong>g state, acti<strong>on</strong> shall be undertaken as if it were presented to <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court.(3) The request<strong>in</strong>g state shall be <strong>in</strong>formed of <str<strong>on</strong>g>the</str<strong>on</strong>g> refusal to assume crim<strong>in</strong>al prosecuti<strong>on</strong>as well as of <str<strong>on</strong>g>the</str<strong>on</strong>g> f<strong>in</strong>al and <strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g decisi<strong>on</strong> passed with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs, <strong>in</strong>accordance with Article 4 of this Law.


Article 37(1) If <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al prosecuti<strong>on</strong> has been assumed at <str<strong>on</strong>g>the</str<strong>on</strong>g> letter of request referred to <strong>in</strong>Article 36 of this Law, domestic <str<strong>on</strong>g>law</str<strong>on</strong>g> shall apply.(2) The <str<strong>on</strong>g>law</str<strong>on</strong>g> of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign state shall apply <strong>in</strong> case when it is more favourable for <str<strong>on</strong>g>the</str<strong>on</strong>g>accused.IV. ENFORCEMENT OF FOREIGN CRIMINAL VERDICTArticle 38(1) Competent M<strong>on</strong>tenegr<strong>in</strong> court shall enforce f<strong>in</strong>al and <strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g crim<strong>in</strong>alverdict of a foreign court if this has been prescribed under an <strong>in</strong>ternati<strong>on</strong>al agreement or if<str<strong>on</strong>g>the</str<strong>on</strong>g>re is reciprocity and if it imposes <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al sancti<strong>on</strong> <strong>in</strong> accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic <str<strong>on</strong>g>law</str<strong>on</strong>g>.(2) In <str<strong>on</strong>g>the</str<strong>on</strong>g> case referred to <strong>in</strong> paragraph 1 above, <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court shall pass <str<strong>on</strong>g>the</str<strong>on</strong>g>decisi<strong>on</strong> with<strong>in</strong> a Chamber composed of three judges without presence of <str<strong>on</strong>g>the</str<strong>on</strong>g> parties.(3) Territorial jurisdicti<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> court shall be def<strong>in</strong>ed accord<strong>in</strong>g to <str<strong>on</strong>g>the</str<strong>on</strong>g> last place ofresidence of <str<strong>on</strong>g>the</str<strong>on</strong>g> sentenced pers<strong>on</strong> <strong>in</strong> M<strong>on</strong>tenegro and if <str<strong>on</strong>g>the</str<strong>on</strong>g> sentenced pers<strong>on</strong> has neverreported his place of residence <strong>in</strong> M<strong>on</strong>tenegro – accord<strong>in</strong>g to <str<strong>on</strong>g>the</str<strong>on</strong>g> place of birth. If <str<strong>on</strong>g>the</str<strong>on</strong>g> sentencedpers<strong>on</strong> nei<str<strong>on</strong>g>the</str<strong>on</strong>g>r has had his place of residence nor was born <strong>in</strong> M<strong>on</strong>tenegro, <str<strong>on</strong>g>the</str<strong>on</strong>g> Supreme Courtof M<strong>on</strong>tenegro shall identify <strong>on</strong>e of <str<strong>on</strong>g>the</str<strong>on</strong>g> courts hav<strong>in</strong>g subject-matter jurisdicti<strong>on</strong> before which<str<strong>on</strong>g>the</str<strong>on</strong>g> proceed<strong>in</strong>gs shall be c<strong>on</strong>ducted.(4) In <str<strong>on</strong>g>the</str<strong>on</strong>g> operative part of <str<strong>on</strong>g>the</str<strong>on</strong>g> verdict referred to <strong>in</strong> paragraph 2 of this Article, <str<strong>on</strong>g>the</str<strong>on</strong>g>court shall <strong>in</strong>sert full word<strong>in</strong>g of <str<strong>on</strong>g>the</str<strong>on</strong>g> operative part and <str<strong>on</strong>g>the</str<strong>on</strong>g> name of <str<strong>on</strong>g>the</str<strong>on</strong>g> court from <str<strong>on</strong>g>the</str<strong>on</strong>g> verdictof <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign court and it shall pr<strong>on</strong>ounce <str<strong>on</strong>g>the</str<strong>on</strong>g> sentence. In <str<strong>on</strong>g>the</str<strong>on</strong>g> particulars of judgement, <str<strong>on</strong>g>the</str<strong>on</strong>g>court shall state reas<strong>on</strong>s it took <strong>in</strong>to account <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> pr<strong>on</strong>ouncement of <str<strong>on</strong>g>the</str<strong>on</strong>g> sancti<strong>on</strong> and refer to<str<strong>on</strong>g>the</str<strong>on</strong>g> reas<strong>on</strong>s of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign court <str<strong>on</strong>g>the</str<strong>on</strong>g> verdict of which is enforced.(5) State prosecutor and <str<strong>on</strong>g>the</str<strong>on</strong>g> sentenced pers<strong>on</strong> or his defence attorney may lodge acompla<strong>in</strong>t aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> verdict.Article 39(1) If <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign court pr<strong>on</strong>ounced crim<strong>in</strong>al sancti<strong>on</strong> which is not prescribed by <str<strong>on</strong>g>the</str<strong>on</strong>g>domestic <str<strong>on</strong>g>law</str<strong>on</strong>g>, <str<strong>on</strong>g>the</str<strong>on</strong>g> competent M<strong>on</strong>tenegr<strong>in</strong> court shall pr<strong>on</strong>ounce a crim<strong>in</strong>al sancti<strong>on</strong>which is most similar to <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al sancti<strong>on</strong> imposed by a foreign court by type andseverity.(2) In <str<strong>on</strong>g>the</str<strong>on</strong>g> event referred to <strong>in</strong> paragraph 1 above, <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al sancti<strong>on</strong> may not be moresevere than <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al sancti<strong>on</strong> pr<strong>on</strong>ounced by a foreign court.Article 40The provisi<strong>on</strong>s of <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic <str<strong>on</strong>g>law</str<strong>on</strong>g> regulat<strong>in</strong>g pard<strong>on</strong>, amnesty and c<strong>on</strong>diti<strong>on</strong>al releaseshall also apply to <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>s c<strong>on</strong>victed by foreign crim<strong>in</strong>al verdicts enforced <strong>in</strong> M<strong>on</strong>tenegro.Article 41(1) A crim<strong>in</strong>al verdict of a M<strong>on</strong>tenegr<strong>in</strong> court may be enforced <strong>in</strong> a foreign state if this hasbeen prescribed under an <strong>in</strong>ternati<strong>on</strong>al agreement or if <str<strong>on</strong>g>the</str<strong>on</strong>g>re is reciprocity.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign nati<strong>on</strong>al c<strong>on</strong>victed <strong>in</strong> M<strong>on</strong>tenegro or if a competent authority authorizedby an <strong>in</strong>ternati<strong>on</strong>al agreement submits a request to <str<strong>on</strong>g>the</str<strong>on</strong>g> competent M<strong>on</strong>tenegr<strong>in</strong> court for


<str<strong>on</strong>g>the</str<strong>on</strong>g> sentenced pers<strong>on</strong> to serve <str<strong>on</strong>g>the</str<strong>on</strong>g> sentence <strong>in</strong> his country, <str<strong>on</strong>g>the</str<strong>on</strong>g> court shall proceedpursuant to <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>ternati<strong>on</strong>al agreement.V. OTHER FORMS OF INTERNATIONAL LEGAL ASSISTANCEArticle 42O<str<strong>on</strong>g>the</str<strong>on</strong>g>r forms of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> shall be: submitt<strong>in</strong>g documents, writtenmaterials and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r cases related to <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g country; <strong>mutual</strong>exchange of <strong>in</strong>formati<strong>on</strong>, as well as undertak<strong>in</strong>g of <strong>in</strong>dividual procedural acti<strong>on</strong>s; hear<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g>accused, witness and expert, <strong>in</strong>clud<strong>in</strong>g hear<strong>in</strong>g through video and teleph<strong>on</strong>e c<strong>on</strong>ference, crimescene <strong>in</strong>vestigati<strong>on</strong>, search of premises and pers<strong>on</strong>s, temporary seizure of items, secretsurveillance measures, DNA analysis, temporary surrender of a pers<strong>on</strong> deprived of liberty <strong>in</strong>order to give testim<strong>on</strong>y, deliver<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> from penal records and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r proceduralacti<strong>on</strong>s.Article 43(1) The M<strong>in</strong>istry shall deliver and receive letters rogatory for <str<strong>on</strong>g>the</str<strong>on</strong>g> forms of <strong>in</strong>ternati<strong>on</strong>al<strong>legal</strong> <strong>assistance</strong> referred to <strong>in</strong> Article 42 of this Law <strong>in</strong> accordance with Article 4 ofthis Law.(2) The permissibility and <str<strong>on</strong>g>the</str<strong>on</strong>g> method of enforcement of <str<strong>on</strong>g>the</str<strong>on</strong>g> acti<strong>on</strong> which is <str<strong>on</strong>g>the</str<strong>on</strong>g> subjectmatter of <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign judicial authority shall be decided by <str<strong>on</strong>g>the</str<strong>on</strong>g>court <strong>in</strong> accordance with domestic <str<strong>on</strong>g>law</str<strong>on</strong>g> and <strong>in</strong>ternati<strong>on</strong>al agreement.Article 44(1) At <str<strong>on</strong>g>the</str<strong>on</strong>g> letter of request of <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign judicial authority, domestic judicial authority mayapprove <str<strong>on</strong>g>the</str<strong>on</strong>g> presence of a foreign official pers<strong>on</strong> and pers<strong>on</strong> hav<strong>in</strong>g <strong>legal</strong> <strong>in</strong>terest <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>enforcement of <str<strong>on</strong>g>the</str<strong>on</strong>g> acti<strong>on</strong> requested by <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory.(2) In case <str<strong>on</strong>g>the</str<strong>on</strong>g> presence at <str<strong>on</strong>g>the</str<strong>on</strong>g> letter of request referred to <strong>in</strong> paragraph 1 above isapproved, domestic judicial authority shall send notice to <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign judicial authorityof <str<strong>on</strong>g>the</str<strong>on</strong>g> place and time of enforcement of <str<strong>on</strong>g>the</str<strong>on</strong>g> acti<strong>on</strong> requested by <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory.Article 45Procedural acti<strong>on</strong> undertaken by <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign judicial authority <strong>in</strong> accordance with its<str<strong>on</strong>g>law</str<strong>on</strong>g> shall be deemed equal to <str<strong>on</strong>g>the</str<strong>on</strong>g> relevant procedural acti<strong>on</strong> undertaken by a domestic judicialauthority with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs, unless this is c<strong>on</strong>trary to <str<strong>on</strong>g>the</str<strong>on</strong>g> pr<strong>in</strong>ciples of <str<strong>on</strong>g>the</str<strong>on</strong>g>domestic judicial system and generally accepted pr<strong>in</strong>ciples of <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>ternati<strong>on</strong>al <str<strong>on</strong>g>law</str<strong>on</strong>g>.Article 46Internati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> shall not be provided if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory c<strong>on</strong>cernsmilitary crim<strong>in</strong>al offence.Article 47Internati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> referred to <strong>in</strong> Article 42 of this Law may be refused:1) if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state c<strong>on</strong>cerns political crim<strong>in</strong>al offences;2) if <str<strong>on</strong>g>the</str<strong>on</strong>g> executi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state is likely to prejudice <str<strong>on</strong>g>the</str<strong>on</strong>g>sovereignty, c<strong>on</strong>stituti<strong>on</strong>al order, security or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r essential <strong>in</strong>terests of M<strong>on</strong>tenegro.


Article 48(1) Domestic judicial authority may delay provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>referred to <strong>in</strong> Article 42 of this Law if this is necessary for crim<strong>in</strong>al prosecuti<strong>on</strong> orc<strong>on</strong>duct of crim<strong>in</strong>al proceed<strong>in</strong>gs which is pend<strong>in</strong>g before domestic judicial authorities,and which is related to <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory delivered.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic judicial authority delays <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>,<strong>in</strong> accordance with paragraph 1 above, it shall notify <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state <str<strong>on</strong>g>the</str<strong>on</strong>g>reof andstate reas<strong>on</strong>s for delay.Article 49(1) Pers<strong>on</strong> deprived of liberty <strong>in</strong> M<strong>on</strong>tenegro may be temporarily transferred to <str<strong>on</strong>g>the</str<strong>on</strong>g>request<strong>in</strong>g state at <str<strong>on</strong>g>the</str<strong>on</strong>g> letter of request of its competent judicial authority as a witness for<str<strong>on</strong>g>the</str<strong>on</strong>g> purpose of hear<strong>in</strong>g, c<strong>on</strong>fr<strong>on</strong>tati<strong>on</strong> or crime scene <strong>in</strong>vestigati<strong>on</strong>, for <str<strong>on</strong>g>the</str<strong>on</strong>g> proceed<strong>in</strong>gs<strong>in</strong>itiated <strong>in</strong> that state, provided that:1) <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> gave a statement for <str<strong>on</strong>g>the</str<strong>on</strong>g> record of <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court that he c<strong>on</strong>sents totemporary transfer;2) <str<strong>on</strong>g>the</str<strong>on</strong>g> period of temporary transfer will not prol<strong>on</strong>g his detenti<strong>on</strong> and jeopardize <str<strong>on</strong>g>the</str<strong>on</strong>g>crim<strong>in</strong>al proceed<strong>in</strong>gs underway aga<strong>in</strong>st him <strong>in</strong> M<strong>on</strong>tenegro;3) a pers<strong>on</strong> shall not be punished or ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r sancti<strong>on</strong> imposed <strong>on</strong> him dur<strong>in</strong>g temporarytransfer;4) it has been ensured that <str<strong>on</strong>g>the</str<strong>on</strong>g> transferred pers<strong>on</strong> shall be sent back to M<strong>on</strong>tenegroimmediately after <str<strong>on</strong>g>the</str<strong>on</strong>g> procedural acti<strong>on</strong> has been completed.(2) The request<strong>in</strong>g state shall be obliged to send back <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> referred <strong>in</strong> paragraph 1above to M<strong>on</strong>tenegro, without delay, immediately after <str<strong>on</strong>g>the</str<strong>on</strong>g> procedural acti<strong>on</strong> has beencompleted, with<strong>in</strong> 60 days at latest.(3) The decisi<strong>on</strong> <strong>on</strong> transfer shall be passed by <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court with<strong>in</strong> a Chambercomposed of three judges and it shall be enforced <strong>in</strong> a manner prescribed by Article 24paragraph 2 of this Law.(4) The pers<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> transfer of whom is requested shall have <str<strong>on</strong>g>the</str<strong>on</strong>g> right to lodge acompla<strong>in</strong>t aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> referred to <strong>in</strong> paragraph 3 above to <str<strong>on</strong>g>the</str<strong>on</strong>g> competent courtwith<strong>in</strong> three days as of <str<strong>on</strong>g>the</str<strong>on</strong>g> receipt of decisi<strong>on</strong>.Article 50As regards <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offences of mak<strong>in</strong>g and putt<strong>in</strong>g <strong>in</strong>to circulati<strong>on</strong> counterfeit m<strong>on</strong>ey,m<strong>on</strong>ey-launder<strong>in</strong>g, unauthorized producti<strong>on</strong>, process<strong>in</strong>g and sale of narcotic drugs and pois<strong>on</strong>s,traffick<strong>in</strong>g <strong>in</strong> human be<strong>in</strong>gs, as well as o<str<strong>on</strong>g>the</str<strong>on</strong>g>r crim<strong>in</strong>al offences with respect to which <str<strong>on</strong>g>the</str<strong>on</strong>g>centralizati<strong>on</strong> of data is prescribed under <strong>in</strong>ternati<strong>on</strong>al agreements, <str<strong>on</strong>g>the</str<strong>on</strong>g> authority before which<str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs are c<strong>on</strong>ducted shall be obliged to deliver to <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al CentralBureau of <str<strong>on</strong>g>the</str<strong>on</strong>g> INTERPOL, without delay, data <strong>on</strong> crim<strong>in</strong>al offences and <str<strong>on</strong>g>the</str<strong>on</strong>g> perpetrator, while<str<strong>on</strong>g>the</str<strong>on</strong>g> court of first <strong>in</strong>stance shall be fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r obliged to submit a f<strong>in</strong>al and <strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g verdict.


Article 51(1) The M<strong>in</strong>istry shall, at <str<strong>on</strong>g>the</str<strong>on</strong>g> request of domestic judicial authorities, obta<strong>in</strong> from <str<strong>on</strong>g>the</str<strong>on</strong>g>competent foreign judicial authorities texts of legislati<strong>on</strong> which are applicable or wereapplicable <strong>in</strong> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r countries, and, if necessary, notificati<strong>on</strong>s regard<strong>in</strong>g certa<strong>in</strong> <strong>legal</strong> issue.(2) The M<strong>in</strong>istry shall, at <str<strong>on</strong>g>the</str<strong>on</strong>g> request of foreign judicial authorities, deliver texts ofdomestic legislati<strong>on</strong> or notificati<strong>on</strong>s <strong>on</strong> certa<strong>in</strong> <strong>legal</strong> issue.Article 52(1) Internati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> referred to <strong>in</strong> Article 42 of this Law shall also be providedto <str<strong>on</strong>g>the</str<strong>on</strong>g> European Court of Human Rights and European Court of Justice, <strong>in</strong> accordancewith this Law.(2) Provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> Internati<strong>on</strong>al Crim<strong>in</strong>al Court shall beprescribed under a separate <str<strong>on</strong>g>law</str<strong>on</strong>g>.Article 53The costs <strong>in</strong>curred <strong>in</strong> relati<strong>on</strong> to expert exam<strong>in</strong>ati<strong>on</strong>, and <str<strong>on</strong>g>the</str<strong>on</strong>g> costs of temporary transferof <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> deprived of liberty for <str<strong>on</strong>g>the</str<strong>on</strong>g> purpose of hear<strong>in</strong>g <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state shall beborne by <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.VI. TRANSITIONAL AND FINAL PROVISIONSArticle 54Unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise has been provided for under this Law, <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s of <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>alProcedure Code shall apply mutatis mutandis to <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong>.Article 55The procedures for provisi<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al <strong>legal</strong> <strong>assistance</strong> underway <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> date ofentry <strong>in</strong>to force of this Law shall be f<strong>in</strong>alized <strong>in</strong> accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s of ChapterXXX and XXXI of <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>al Procedure Code (‘Official Gazette of SFRY’, Nos. 4/77,14/85, 74/87, 57/89 and 3/90, and ‘Official Gazette of FRY’, Nos. 27/92 and 24/94).Article 56The provisi<strong>on</strong>s of Chapter XXX and XXXI of <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>al Procedure Code (‘OfficialGazette of SFRY’, Nos. 4/77, 14/85, 74/87, 57/89 and 3/90, and ‘Official Gazette of FRY’,Nos. 27/92 and 24/94) shall cease to be valid by entry <strong>in</strong>to force of this Law.Article 57This Law shall enter <strong>in</strong>to force eight days after <str<strong>on</strong>g>the</str<strong>on</strong>g> date of its publicati<strong>on</strong> <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> OfficialGazette of M<strong>on</strong>tenegro.
