Random drug test for LGU workers<strong>City</strong> Mayor Eric C. Codillaannounced that he will conductrandom drug test to Local<strong>Government</strong> Employees afterevery flag ceremony starting nextweek.At the flag ceremony Monday,Mayor Codilla said that he wantsthis endeavor to be implemented toensure that those LGU employeeswho are using drugs will beidentified. He said that he alreadyinitiated this activity in 2005 withat least one casual/plantilla workerswas discharged from service afterhe was found positive <strong>of</strong> using theillegal drugs. The mayor said thathe was hoping that the discharging<strong>of</strong> the said employee will serve asa warning to others. The randomtest will be conducted by drawingthe names <strong>of</strong> the employees. Tennames <strong>of</strong> employees will be drawnfrom the box to be done by thepersonnel <strong>of</strong> the Human ResourcesManagement Department underMs. Adelaida Biacolo and the <strong>City</strong>Administrator’s Office under Dr.Dennis Y.Capuyan. The drawnnames will be brought to a localdrug center were the actual drugtest will be done.Mayor Codilla also announcedthat a roll call will be done afterevery flag ceremony starting onthe same date that the randomdrug testing <strong>of</strong> workers will beconducted. Mayor Codilla said thathe noticed that while he is on hisway to attend the flag ceremonyat the New <strong>City</strong> Hall, he meetsseveral employees going out <strong>of</strong>the place without attending theflag ceremony. Mayor Codillasuspects that these employees willsign the attendance sheets but willleave without attending the flagceremony. Mayor Codilla stressedthat the signing <strong>of</strong> the attendancesheet is not the important thing butthe flag raising because the flagrepresents the government whichis their employer. They must payrespect to the flag because thissymbolizes the country and beinga public servant they are obligeto show their respect to it. MayorCodilla pointed out that thosecaught will be penalized based onCivil Service laws.<strong>City</strong> Health Department to create Dengue Brigade<strong>City</strong> Health Department chiefDr Nelita Navales disclosed that theSanitary Inspectors <strong>of</strong> the departmentwill lead the Dengue Brigade inevery barangay so the problem <strong>of</strong>the proliferation <strong>of</strong> dengue carryingmosquito will be eliminated orreduced.This according to Dr Navales isthe premise <strong>of</strong> Sanitary Inspector (SI)head Joy Obejas to lead the activity sothat the residents <strong>of</strong> every barangaywill help in the elimination <strong>of</strong> the<strong>of</strong> dengue in every community. TheSI’s according to Navales will lead athorough clean up in the communitytogether with the residents to driveaway the dengue carrying mosquitos.Navales said that this is a verysignificant activity because theprimary reason for the proliferation<strong>of</strong> dengue is the residents’ inaction incleaning up their surroundings.Navales said that the DengueBrigade will monitor the possiblebreeding areas <strong>of</strong> dengue carryingmosquito and lead the campaign cleanup in the surroundings. She said thisactivity will not only be conducted inthe city proper where most <strong>of</strong> the casesactually occurred but also in uplandbarangays because residents in thoseplaces are also victims <strong>of</strong> dengue. Shepointed out that the activity will startin the urban areas within the next fewdays.Navales on the other hand,disclosed that dengue situation in thecity is still manageable even if thenumber <strong>of</strong> cases throughout the cityis increasing. She said that as <strong>of</strong> Aug.16 157 cases <strong>of</strong> dengue were reportedwith 1 death. The death happenedlast March during the occurrence <strong>of</strong>typhoon when the parents <strong>of</strong> an 11year old boy failed to attend to theirson who was experiencing high feverbecause flood hit their home and itwas already stage 4when the victim wasbrought to the localhospital here. DrNavales disclosed thatlast year during thisperiod the numbers <strong>of</strong>dengue cases was only125.Navales believedthat the number <strong>of</strong>cases is expectedto increase furtherbecause based ontheir records the increase <strong>of</strong> denguecases in the city usually starts in themonth <strong>of</strong> July until October. The ceremony was held atthe Battalion Headquarters in Brgy.Aguiting, Kananga, Leyte on July 31with Col John Bonafos, 802nd BrigadeCommader as the guest <strong>of</strong> honor andthe presiding <strong>of</strong>ficer. The change <strong>of</strong>command was held in a very simpleceremony where LTC Jeffrey Cabansay,the battalion executive <strong>of</strong>ficer and theOfficer in Charge hand over symbolicflag to the incoming unit commander.During his visit to HonorableMayor Eric Codilla at the <strong>City</strong> Mayor’sOffice, LTC Francis Cabugon wasaccompanied by his wife Marit andstaff 1LT Malinche Tomarong. DejonThe Commission on Electionen banc on its decision dated July20, 2011 affirmed the decision <strong>of</strong> theComelec First Division disqualifyingBrgy. Sumangga Chairman DionesioVasquez Dalumpines from running forthe position <strong>of</strong> Barangay Chairman forbeing non resident in the October 2010barangay election.The affirmation came from thecomplaint <strong>of</strong> Mario Albur, the formerchairman <strong>of</strong> Brgy. Sumangga wh<strong>of</strong>iled complaint at the Comelec for nonresidency against Dalumpines. Alburin his petition dated Nov. 24, 2010seeks disqualification <strong>of</strong> <strong>of</strong> Dalumpinesfrom running as Barangay Chairman<strong>of</strong> Brgy. Sumangga, <strong>Ormoc</strong> <strong>City</strong> onthe ground that he committed materialmisrepresentation when he indicated inhis Certificate <strong>of</strong> Candidacy that he isa resident <strong>of</strong> Brgy. Sumangga, <strong>Ormoc</strong><strong>City</strong> when in truth and in fact, he is aresident <strong>of</strong> Brgy. Bantigue.After a thorough review <strong>of</strong> thegrounds <strong>of</strong> the case, the COMELECFirst Division in a resolution dated Jan.5, 2011 granted such petition whichstate, to wit:“WHEREFORE, the premisesconsidered, the CommissionRESOLVED, as it hereby RESOLVESto GRANT the instant petition.Respondent DIONESIO VASQUEZDALUMPINES is hereby declaredDISQUALIFIED from running for theposition <strong>of</strong> Barangay Chairmam <strong>of</strong>Barangay Sumangga, <strong>Ormoc</strong> <strong>City</strong>.”Dalumpines in his motion arguedthat the Comelec First Divisioncommitted an error when he wasdisqualified to run from public <strong>of</strong>ficeadding that he did not commit anymaterial misrepresentation in his COCand that he did not commit any crime.Also Dalumpines further claimed thatthe tax declaration cannot serve asconclusive pro<strong>of</strong> <strong>of</strong> the location <strong>of</strong> theproperty as this is base on the declaration<strong>of</strong> the owner and is for taxation purposesonly. According to Dalumpines it cannotbe the basis <strong>of</strong> ownership <strong>of</strong> the property,with much reason that it canno be usedas basis to identify the true location <strong>of</strong>the property.But the en banc denied Dalumpines’Motion for Reconsideration. The enbanc in its decision said that in case <strong>of</strong>motion for reconsideration the pertinentrule is Sec. 7 <strong>of</strong> Comelec Resolution No.9048, which states that a motion forreconsideration <strong>of</strong> a decision, resolution,order or ruling <strong>of</strong> a Division shall be filedwithin (3) days from a promulgationthere<strong>of</strong>. Moreover, the en banc pointedout that Rule 19 <strong>of</strong> the Comelec Rules<strong>of</strong> Procedure states that the motionshall be verified and shall point outspecifically the findings or conclusion <strong>of</strong>the decision, resolution, order or rulingwhich are not supported by the evidenceor which are contrary to law.The en banc decision stressed thatDalumpines motion was not verifiedand that it was filed only on January28, 2011 (the date it was filed throughregistered mail) or TWENTY THREEDAYS (23) after the promulgation <strong>of</strong>the assailed promulgation.The Comelec en banc also believesthat Dalumpines want to mislead thembecause records hsow that he submittednot only the Tax Declaration but also theTransfer Certificate Title (TCT) <strong>of</strong> theparcel <strong>of</strong> land wherein Dalumpines housewas erected. The en banc added thatDalumpines have misread the assailedResoluiton because what was mentionedwas not the tax declaration but the TCT<strong>of</strong> the property and the Comelec (FirstDivision) based on its findings on thedeclaration <strong>of</strong> the Supreme Court <strong>of</strong>title is conclusive pro<strong>of</strong> not only <strong>of</strong> theownership but also its location.The en banc resolve to deny theinstant petition and affirmed in totothe resolution <strong>of</strong> the First Divisionand annulled the proclamation <strong>of</strong>Dalumpines. And pursuant to theprovision <strong>of</strong> Sec. 44 <strong>of</strong> RA7160otherwise known as the Local<strong>Government</strong> Code <strong>of</strong> 1991, the Firstranking Sanggunian Barangay Memberis hereby directed to assumed <strong>of</strong>fice asPunong Barangay <strong>of</strong> Brgy. Andthat it was due to the national, localand barangay elections last year thatthe consultative assembly was onlydone this time.
