<strong>Water</strong> <strong>Quality</strong> <strong>Protection</strong> <strong>Policy</strong> <strong>and</strong> <strong>Action</strong> <strong>Plan</strong>NMED personnel involved with NPDES permit review <strong>and</strong> certification indicate that none of thesmaller MS4s <strong>and</strong> industrial stormwater dischargers in the Albuquerque metropolitan area arecovered by a small system general permit.2.6.2 Wastewater Discharges in the Middle Rio Gr<strong>and</strong>eTreated wastewater effluent is discharged at three locations in the Albuquerque metropolitanarea, including the Town of <strong>Bernalillo</strong>, the City of Rio Rancho, <strong>and</strong> the WUA SouthsideReclamation <strong>Plan</strong>t (Figures 2a <strong>and</strong> 2b [discharge points 18, 22, <strong>and</strong> 1, respectively],Appendix A, Table A-1). Each wastewater effluent discharge location is regulated under anNPDES permit, <strong>and</strong> annual reports of compliance monitoring are thus submitted to the U.S.EPA.As discussed in Section 2.5, wastewater discharge generally comprises only a small componentof total flow in the Rio Gr<strong>and</strong>e. However, a failure in the treatment process has the potential toresult in an exceedance of applicable water quality st<strong>and</strong>ards; therefore, wastewater dischargesare considered a low-level threat to surface water quality of the Rio Gr<strong>and</strong>e. Discharge oftreated wastewater effluent upstream from the intake to the WUA WTP is not necessarily athreat to the quality of drinking water because the drinking water treatment process is designedto remove pollutants that might be in upstream wastewater discharges.Violations of the CWA or the individual NPDES permit conditions are required to be reported tothe EPA. Table 3 summarizes individual NPDES permits that have current alleged significantviolations or have been the subject of enforcement action during the past five years.Enforcement actions have been issued to six of the permit holders for not meeting theircompliance schedule. Three of the permit holders—the Rio Rancho, Taos, <strong>and</strong> Chamawastewater treatment plants—have been issued effluent violations of their monthly averagelimits. Additional information on these violations can be found on the EPA website.2.6.3 Upstream DischargesIn addition to discharges occurring within the Albuquerque metropolitan area, all discharges tothe contributing watershed upstream can affect the quality of surface water in theAlbuquerque/<strong>Bernalillo</strong> <strong>County</strong> area. Several important discharges to the Rio Gr<strong>and</strong>e <strong>and</strong> itstributaries occur upstream from the Albuquerque/<strong>Bernalillo</strong> <strong>County</strong> area:• Municipal discharges, such as Alamosa, Colorado, <strong>and</strong> Española <strong>and</strong> Santa Fe, NewMexico18 Section 2
