It also clarifies that whatconstitutes a kitchen and bath will be determined based on a checklist of utilities as listed on theaccessory apartment application form.Finally, it provides for an amnesty period within which accessory apartments created without azoning permit or Special Permit may apply and be qualified under zoning. There may be a number ofthese apartments in the town, which if approved under zoning would be more likely to remain aspart of the town’s moderate-cost housing supply. Zoning approval removes the prospect of a zoningviolation citation and possible fines and offers the apartment owner greater advertising and rentersolicitation options.714 ACCESSORY APARTMENT714.1 ACCESSORY APARTMENT – STATEMENT OF PURPOSEThe purpose of this regulation is to broaden the options for housing opportunities in theTown of <strong>Salisbury</strong> by permitting an accessory apartment associated with a single-family owneroccupiedDWELLING. The Planning and Zoning Commission finds that accessory apartmentsprovide an expeditious option for the creation of low-impact, much-needed, moderate-costhousing units that can be dispersed within the community, often requiring modest constructionmodifications and in a manner that will blend with existing residential neighborhoods.Allowing accessory apartments to be built in accessory structures, such as garages and barns,expands the options for creating these housing units while permitting a landowner to do sowithout having to make alterations to existing houses.714.2 GENERALIn a Residential Zoning District an accessory apartment may be permitted within a singlefamilydwelling subject to Site Plan approval only, provided it meets the following requirements.In a Residential Zoning District an accessory apartment within an approved accessory buildingassociated with a single-family dwelling may be permitted subject to approval of a Special Permitsubject to all the General Standards and requirements of this section and the followingadditional standards and requirements.An accessory apartment may be permitted where the Site Plan and proposed improvements aredesigned to maintain residential appearance and character on the lot.One accessory apartment shall be permitted on a lot.86
