extremisms grow and flourish, the number of threats, obscene teleph<strong>on</strong>e calls and other acts ofintimidati<strong>on</strong> is growing. The fact that there are <strong>on</strong>ly a handful of pers<strong>on</strong>s who are ‘out’ and areable to represent the views of the community in public arenas is also shaped by this high level ofthreat and intimidati<strong>on</strong>.23. There is a history of hate speech against lesbians, since June 2000, when the Press Councilexpressed its support for a letter published in the Island, a local daily, urging that c<strong>on</strong>victedrapists should be unleashed at a proposed c<strong>on</strong>ference <strong>on</strong> lesbian issues. 4 The decisi<strong>on</strong> stated that“…lesbianism itself is an act of sadism, and salacious publicati<strong>on</strong> of any opini<strong>on</strong> against suchactivities does not amount to a promoti<strong>on</strong> of sadism or salacity, but any publicati<strong>on</strong> whichsupports such c<strong>on</strong>duct is an obvious promoti<strong>on</strong> of such violence, sadism and salacity”. 5 The manwho had filed the complaint was fined.24.At the Nati<strong>on</strong>al C<strong>on</strong>sultati<strong>on</strong> meeting <strong>on</strong> HIV/AIDS and Human Rights, held in Colombo, <strong>Sri</strong><strong>Lanka</strong> in December 2004, Minister for Health Care and Nutriti<strong>on</strong>, Nimal Siripala de Silvadeclared that same sex behaviour is ‘unnatural’ and said that <strong>Sri</strong> <strong>Lanka</strong> would never repeal itslaw <strong>on</strong> same sex sexual relati<strong>on</strong>s. The same Minister, speaking at ICAAP in August 2007,reiterated his positi<strong>on</strong> <strong>on</strong> this, saying “I d<strong>on</strong>’t want people to think I brought all of these peoplehere (for the c<strong>on</strong>gress) to promote lesbianism and homosexuality.” 6Impunity, stigma, discriminati<strong>on</strong> and police harassment25. Prejudice and social stigma that are a part of the daily experience of sex workers, lesbian, gayand transgender pers<strong>on</strong>s, people living with HIV/AIDS and even of single and unmarried womenoften compel them to suffer violence and violati<strong>on</strong>s in silence. This in turn strengthens theimpunity which the Police and members of the community enjoy when it comes to sexualitybaiting.26. If a crime that is based <strong>on</strong> homophobia or prejudice is reported to the police, the victimsoften try to hide their identity due to fear of exposure, and further stigmatizati<strong>on</strong> anddiscriminati<strong>on</strong>. When the identity is revealed inadvertedly, their complaint is often ignored,laughed, trivialized.27. Secti<strong>on</strong> 356 of the penal Code is used to persecute and intimidate gay men in particular,although no prosecuti<strong>on</strong> under this law is recorded in recent years. Members of the Police use thefact that sodomy, oral sex and other sexual acts could be defined as ‘against the order of nature’in order to threaten gay men, extort m<strong>on</strong>ey from them and subject them to forced sex. Althoughall the acts of violence and abuse against gay men could be prosecuted under different secti<strong>on</strong>s ofthe Penal Code, since almost all the gay men who are thus persecuted are terrified of being4 P.
