The study showed that Canadian patients believe stronger enforcement of existing privacy protection laws would reduce the number of privacy breaches. The most compelling part of the survey showed the negative consequences a patient experienced from being a victim of a breach. The most common situations noted were: �� victim became the subject of gossip in their social circle and/or workplace �� a sensitive medical issue was no longer private �� a significant amount of personal time was required to correct the situation �� private information was used against them in a lawsuit �� inaccurate medical information was added to their record. Patients have a lot to lose as a result of a privacy breach. A person’s privacy is very important and we all have the right to have it protected; this is enshrined in the Canadian Charter of Rights and Freedoms. As a physician, you also have a great deal to lose as a result of a privacy breach: Your patients’ trust, your community’s trust, your patients’ health outcomes and your reputation being just some of those things. What can you do to prevent this from happening? �� First understand the need to minimize risk �� Make sure staff are aware of the importance you place on patient privacy �� Develop a written privacy policy for your office and USE IT �� Talk about patient privacy with your staff at meetings �� Learn from the mistakes of others and take steps to ensure they don’t happen to you �� Talk openly with your patients about privacy and your office’s policies �� - �� at (306) 244-2196 or rhunt@sma.sk.ca 20 Spring 2012 SMA News Digest Charter: Section 8 [2] Reasonable Expectation of Privacy In fostering the underlying values of dignity, integrity and autonomy, it is fitting that s. 8 of the Charter should seek to protect a biographical core of personal information which individuals in a free and democratic society would wish to maintain and control from dissemination to the state. This would include information which tends to reveal intimate details of the lifestyle and personal choices of the individual. The computer records investigated in the case at bar while revealing the pattern of electricity consumption in the residence cannot reasonably be said to reveal intimate details of the appellant’s life since electricity consumption reveals very little about the personal lifestyle or private decisions of the occupant of the residence: R. v.
