Chapter 6 : <strong>Public</strong> <strong>Consultation</strong>6.3 THE EIA & EMPR REVIEW PROCESSReview is an integral part of the EIA process. Therefore the EIA and EMPR report are:• Made available to the all registered I&APs and the relevant authorities for review;• Made available on the <strong>Enviro</strong> <strong>Dynamics</strong> web site: http://www.envirod.com, withregistered stakeholders advised;• Made available in public libraries in Windhoek and Walvis Bay with stakeholders advisedthrough notices in the press, and• Provided to MET, MME and MFMR.The comments received on the draft EIA and EMPR are seen as critical in the evaluation of theproposed project.The received comments have been compiled into the Final EIA and EMPR, as an appendix, withthe raised matters appropriately integrated into the final report:• Made available on the <strong>Enviro</strong> <strong>Dynamics</strong> web site: http://www.envirod.com, withregistered stakeholders advised;• Made available in public libraries in Windhoek and Walvis Bay with stakeholders advisedthrough notices in the press, and• Provided to MET, MME and MFMR.ApprovalOn the completion of these processes the authorities will be in a position to advise the projectproponent of their decision.If the application is successful an <strong>Enviro</strong>nmental Contract will be established and co-signed by therelevant authorities and the proponent. The <strong>Enviro</strong>nmental Contract, a legally binding documentwill describe the conditions of approval.6.4 RIGHT OF APPEALSection 50 of the <strong>Enviro</strong>nmental Management Act (Act No 2007) allows for any person aggrievedby a decision of the <strong>Enviro</strong>nmental Commissioner to appeal to the Minister.Section 51 of the Act allows for any person aggrieved by a decision of the Minister, to appeal tothe High Court.Final Report<strong>Namibia</strong>n Marine Phosphate (Pty) Ltd.Page 6-6
