OFFICE OF THE DIRECTOR GENERAL & INSPECTOR GENERAL OF POLICEMEGHALAYA :: SHILLONGCIRCULAR NO. 1/89Subject :-Proper treatment <strong>of</strong> persons in police custody and others who come incontact with <strong>Police</strong>A few allegations <strong>of</strong> assault and ill-treatment <strong>of</strong> persons in police custody havebeen brought to my attention. In one instance, the affected person was a woman who wasarrested in connection with a case. Government have viewed with concern allegations <strong>of</strong> suchexcuses and a few instances have even been raised on the floor <strong>of</strong> the Legislative Assembly.Use <strong>of</strong> third degree methods by police on a person who is in custody, is an<strong>of</strong>fence under Section 29 <strong>of</strong> the <strong>Police</strong> Act and can even come under the purview <strong>of</strong> theIndian Penal Code. Un-becoming behaviour towards any person by <strong>Police</strong> Officer can alsobe dealt with under Section 7 <strong>of</strong> the same Act read with Rule 65 <strong>of</strong> APM Part III. Any <strong>Police</strong>Officer found to have committed such excess or mis-behaviour with public should beseverely dealt with by invoking law or rules. Whenever allegations <strong>of</strong> <strong>Police</strong> excess arereceived, Superintendent <strong>of</strong> <strong>Police</strong> should personally ensure that proper enquiry is institutedimmediately, and if the allegations are substantiated, appropriate disciplinary action shouldbe initiated.It should always be borne in mind that <strong>Police</strong> can function effectively onlywith the cooperation <strong>of</strong> the public. The need for a cordial <strong>Police</strong>-Public relation should beinsisted upon at all levels <strong>of</strong> the organization.The contents <strong>of</strong> this Circular should be read out and discussed during allQuarterly Crime Conferences and it should be ensured that legal powers available to <strong>Police</strong>are not exceeded under any circumstances. It should also be read out and explained duringRoll Calls at least once a month. The need for correct, courteous behaviour towards allmembers <strong>of</strong> the public and proper conduct towards a person in custody, especially womenand children should be emphasized and insisted upon.Sd/- (M.I.S.
