<strong>Bankruptcy</strong><strong>in</strong> <strong>the</strong><strong>New</strong> <strong>Millennium</strong>FR IDAY, FEBRUARY 12, 2010The recent f<strong>in</strong>ancial crisis has led to vast and numerousbankruptcies and brought renewed focus on bankruptcy <strong>in</strong>general and its role <strong>in</strong> society. Accord<strong>in</strong>g to <strong>the</strong> Adm<strong>in</strong>istrativeOffice of <strong>the</strong> U.S. Courts, 1,117,771 bankruptcy cases were filed<strong>in</strong> calendar year 2008. For <strong>the</strong> twelve month period end<strong>in</strong>g June30, 2009, total bankruptcy fil<strong>in</strong>gs were 1,306,315 and Chapter11 fil<strong>in</strong>gs rose 91 percent. Indeed, <strong>the</strong> ten largest bankruptcies<strong>in</strong> history have been filed s<strong>in</strong>ce 2001, and six of those ten – withassets total<strong>in</strong>g <strong>in</strong> excess of $1 trillion – have been filed <strong>in</strong> <strong>the</strong> lasttwo years.Given <strong>the</strong> extraord<strong>in</strong>ary f<strong>in</strong>ancial turmoil that still exists and<strong>the</strong> record number of bankruptcy fil<strong>in</strong>gs, an understand<strong>in</strong>g ofthis issue is important, s<strong>in</strong>ce bankruptcy plays such an importantrole <strong>in</strong> reshap<strong>in</strong>g <strong>the</strong> American economy. No longer viewed as arefuge of last resort, bankruptcy is now seen as a process that maybe useful <strong>in</strong> resolv<strong>in</strong>g a number of problems that bus<strong>in</strong>esses and<strong>in</strong>dividuals encounter. Hence, attorneys, lenders, consumers,policy-makers, accountants, and o<strong>the</strong>rs will benefit from a greaterawareness and understand<strong>in</strong>g of this far-reach<strong>in</strong>g law.This symposium, <strong>Bankruptcy</strong> <strong>in</strong> <strong>the</strong> <strong>New</strong> <strong>Millennium</strong>, br<strong>in</strong>gstoge<strong>the</strong>r judges, practitioners and scholars at <strong>the</strong> forefront ofbankruptcy who will explore four areas of change andimportance: <strong>in</strong>ternational bankruptcies follow<strong>in</strong>g <strong>the</strong> addition of<strong>Bankruptcy</strong> Code Chapter 15, which was <strong>in</strong>tended to expedite <strong>the</strong>adm<strong>in</strong>istration of foreign-owned assets located <strong>in</strong> <strong>the</strong> UnitedStates; debtor-<strong>in</strong>-possession f<strong>in</strong>anc<strong>in</strong>g <strong>in</strong> so-called mega-cases,<strong>in</strong>clud<strong>in</strong>g concerns of bonded <strong>in</strong>debtedness, executivecompensation, negotiations with secured creditors and creditors'committees, and <strong>the</strong> impact of congressional <strong>in</strong>tervention <strong>in</strong> <strong>the</strong>reorganization process; <strong>in</strong>tellectual property issues that occur <strong>in</strong>enterta<strong>in</strong>ment-<strong>in</strong>dustry bankruptcies, as well as attendantconstitutional questions; and <strong>the</strong> Supreme Court's grant ofcertiorari <strong>in</strong> four cases that raise consumer bankruptcy issues –United States Aid Funds, Inc. v. Esp<strong>in</strong>osa, United States v.Milavetz, Schwab v. Reilly, and Hamilton v.
