Publisher’s RantWelcome to the March 2008 edition of the<strong>Connecticut</strong> Natural Pages ® .In the past two years, there has been growing acceptance that global warming isreal, that the environment is deteriorating, and that we must do something about it.It is more commonly acknowledged that our lifestyle choices have dire consequencesfor the planet, as well as our own physical and mental health.Global warming, deforestation, species extinction, air and water pollution, and thedramatic loss of biodiversity, along with the huge increase of obesity, diabetes, heartdisease, cancer, respiratory illnesses, depression, learning disabilities and more, aredegenerative conditions either caused or exacerbated by the choices we make.Looking for relief, hundreds of billions of dollars are spent each year to attack, treat, or"cure" these ailments, all the while failing to address the true cause.But what if we knew the cause(s)? Would we really do something about them? Howmuch are we willing to change?<strong>The</strong>re may be no one cause, but there is at least one thing that contributes to all theenvironmental and health concerns mentioned here, and a lot more. And that is sugar.Sugar (sucrose), the regular white granulated stuff (and high-fructose corn syrup) isperhaps the most dangerous food ingredient on the planet, and may be responsiblefor more environmental destruction than any other agricultural commodity. Sugarsuppresses the immune system, leaches the body of potassium and magnesium,increases the appetite, and is addicting. Plainly put, it is not fit for human consumption.Globally, we consume around 300,000,000,000 pounds of sugar annually, and eachyear this total increases by 6,000,000,000. Can you wrap your head around thesenumbers and imagine how many rainforests and tropical habitats have beendestroyed, and the land, air and water pollution caused by the burning fields andintensive use of chemicals in this process?With sugar consumption comes an increase in appetite. <strong>The</strong> standard portion size ofmany foods and beverages has increased 40% from just 20 years ago. In the averagethree meals, many people now eat the equivalent of 5-6 meals a day!It is no wonder obesity and diabetes are global epidemics. Over a billion people areoverweight, with about 150 million obese, and over 230 million with diabetes,compared to just 30 million in 1985.This is a staggering statistic, but with one action we can reduce global warming andour environmental impact, reduce world hunger, lose weight, reduce or eliminate theuse of many medications for diabetes, heart disease, and other sugar-related illnesses,save lots of money, and greatly increase personal and planetary health and well-being.That is simply to STOP (at least greatly reduce) eating and drinking sugar, includingmost artificial sweeteners and those foods that contain sugar additives. Supportgroups such as Food Addicts in Recovery (www.foodaddicts.org) are having greatsuccess and are there to help if needed. We are one strung out species, and it may bevery difficult to kick the habit as we struggle with our need for a sugar fix. This supports the viewthat when the world is ready for a paradigmshift, the shift is often rapid.With global warming waking up eventhose previously in deep denial aboutthe dire state of the environment, theembrace of wild law may be the nextparadigm shift. If that’s where we’reat, we’ve got to try something new.And it seems to me that attempting tobring ourselves into alignment withthe system of which we ARE partmust be a good start.”not occur without great effort by manyhumans. A paradigm shift is not somethingyou can just sit back and wait for,but requires that critical mass bereached. So in the case of wild law,many people need to help bring a wholenew way of looking at nature into mainstreamcultural acceptance.<strong>The</strong> Law of the WildWild law recognizes the rights of riversto flow instead of being dammed to thedetriment of their health, the rights ofmountains to remain intact instead ofhaving their tops blown off for coal mining,the rights of old growth forests toremain unlogged, and the rights of allhumans, animals, birds, insects, amphibians,reptiles, and other beings to a habitatthat supports their existence. Wildlaw requires that decisions made bycommunities, governing bodies, courts,or other social or cultural authorityadhere to, rather than violate, theserights. Wild law does not place humansabove every other component of nature,or the other members of “the Earthcommunity,” as visionary sage ThomasBerry terms it. Wild law is ecocentric(Earth-centered) rather than anthropocentric(human-centered). And if wemake the paradigm shift, we will enterwhat Berry dubs the “Ecozoic Era,” takingour rightful place in the Earth communityinstead of attempting to rule it.Wild law is a frameworkfor the reform ofour current approachto law and governance,which currentlyaccords corporationsthe right to pillage andplunder, destroy thehabitats of humans aswell as other beings,and send species afterspecies into extinction.Our current frameworkgives humans the rightto exploit the naturalworld as we see fit,rather than acknowledge that we aremembers of a planetary community inwhich all beings and earth elements areequal. It would be bad enough to havehumans using and abusing the Earth, butwe have allowed corporations to gain“personhood,” meaning they can claimthe same rights as people. This enablesthem to override communities of actualpeople trying to stop the polluting oftheir air, soil, and water by a factoryfarm, for example. <strong>The</strong> corporation (whichwreaks destruction on a far greater scalethan that perpetrated by individualhumans) can claim that the attempt tokeep them out is a violation of their civilrights and the community is forced bycourts and state and federal governmentto comply. So, humans, too, have losttheir rights. Wild law restores theserights, along with those of all of nature.Thus wild law is far more than reform oflaw and governance; it is a fundamentalcultural transformation of how humansview their place in the world.Wild law is both new and old. It is a relativelynew movement seeking to restorethe age-old worldview and harmoniousrelationship with nature of indigenouspeoples around the globe. South Africanattorney, former anti-apartheid activist,and current wild law activist CormacCullinan coined the term “wild law” andauthored a book of the same name toserve as a text for the new movement.He explains the term: “I was looking forsomething sexier than ‘Earth jurisprudence’[Thomas Berry’s name for thephilosophy of law that recognizes therights of nature]. Initially I was castingaround for that, but after a while it didprove to be quite a rich phrase. Partiallybecause it’s incongruous for lawyers toput ‘wild’ and ‘law’ in the same sentencebecause law is seen as being veryCEJ’s mission is“to re-envision law andgovernance in ways thatsupport and protect thewell being of the entireEarth community.”much about stamping out wildness.Wildness is also synonymous with thevital natural forces that drive the evolutionof the universe and we also associateit with creativity and passion. Part ofthe problem is that that is exactly whatour systems try to stamp out and withthat we’ve lost soul, meaning, and asense of fulfillment.”Cullinan now travels the world as a legalconsultant, lecturer, and organizer forwild law. He cites Thomas Berry as theinspiration for the wild law concept.Berry had been calling for a “newjurisprudence” that would recognize therights of the Earth <strong>Community</strong>. Cullinanand others are in the process of developinghow to put this new jurisprudenceinto action throughout society. Whilesome object to the systemic change thiswill entail, Cullinan notes, “<strong>The</strong> feedbackwe’re getting from the planet is that theexisting system is not working. And it seems to methat attempting to bring ourselves intoalignment with the system of which weare part must be a good start.”As for what individuals can do towardthat realignment, Cullinan says, “As apersonal practice, renewing andstrengthening one’s personal contactwith the wider natural world, with otherspecies or plants or beautiful places, isvery important. And then the next thingto do is to be willing to stand up for it.In other words, both to try and changeone’s personal life to reflect one’sbelief, but also to go out in the worldand say, ‘I’m not willing anymore to bea party to gratuitous assault on therest of the planet.’”Here are four recent developments inthe field of wild law that give hope thatthe paradigm shift to Earth justice maybe closer than we think: the establishmentof a wild law center inside a U.S.law school, the first wild law conferencein the U.S., a web of wild law communitiesaround the world, and the first actualwild law enacted in the U.S.First Law Center,First ConferenceIn April 2007, the first wild law conferenceever held in the U.S. took place atthe first Earth justice law center in theU.S., the Center for Earth Jurisprudence(CEJ). CEJ, which opened in 2006, iscosponsored by two Catholic universities,Barry and St. Thomas, in MiamiGardens, Florida, and is the first Earthjurisprudence entity operating within alaw school. CEJ’s mission is “to re-envisionlaw and governance in ways thatsupport and protect the well being ofthe entire Earth community.” To that end,CEJ hosted a conference for law facultyand students, to introduce them to theconcepts of wild law. <strong>The</strong> official titlewas “Earth Jurisprudence: Defining theField and Claiming the Promise,” and thekeynote speakers were Cormac Cullinanand Thomas Linzey (see “A Landmark<strong>Legal</strong> Case”). <strong>The</strong> Gaia Foundation hadheld the first Earth jurisprudence conferencesin South Africa and the U.K. twoyears before, but the CEJ conferencewas a first in the U.S. More are likely tofollow, however, as Cullinan and Linzeyembarked after the conference on a 10-day tour to speak at law schools acrossthe country. Meanwhile, CEJ’s first lawschool course in Earth jurisprudencecame to a close, with enthusiasticreviews from the 19 law students whocompleted it.Patricia A. Siemen, O.P., J.D., director ofCEJ, is a Dominican Sister and civil attorneywho came to Earth jurisprudencefrom a social justice background ofworking with the underrepresented oncivil rights, voting rights, and immigrantrights issues. Her own experience duringthat period led her to regard theembracing of wild law principles as acontinuum. Some, like Thomas Berry(she, too, found a mentor in him), are atone end of the continuum, with naysayersat the other end. Despite her rightsadvocacy, she was a naysayer. “In themidst of trying to get land and providehousing for immigrants in Florida,” shesays, “I remember being so annoyed atthe state EPA and the land-use policiesbecause we had to slow down our housingbecause we had a threatened jay. Iremember being so indignant, saying,‘My god, housing is more importantthan these birds!’ So I have a lot of compassionfor people who are at differentpoints on this continuum.” Whatchanged her view was listening to aThomas Berry tape. “He said, ‘I wouldhazard a guess that if the rest of thespecies had a right to vote, in an Earthdemocracy, they would vote the humans10Principles ofEarth DemocracyVandana Shiva, a longtime environmental and social justice activist from India, is aclose associate of the Gaia Foundation and has worked with them in evolving theprinciples and practice of Earth jurisprudence, which forms the basis for the 10Earth Democracy principles she proposes, as detailed in her book EarthDemocracy: Justice, Sustainability, and Peace (South End Press, 2005). <strong>The</strong> principlesof her Earth Democracy movement share the values of wild law.1. All peoples, cultures, and species have intrinsic worth.2. <strong>The</strong> earth community is a democracy of all life.3. Diversity in nature and culture must be defended.4. All beings have a natural right to sustenance.5. Earth Democracy is based on living economies & economic democracy.6. Living economies are based on local economies.7. Earth Democracy is a living democracy.8. Earth Democracy is based on living cultures.9. Living cultures are life nourishing.10. Earth Democracy globalizes peace, care, and compassion.off the planet.’ That was shocking tome,” she recalls. She suddenly realizedshe had been working all these yearsfor human justice and had neverconsidered the rights of other speciesand nature in general.That pivotal moment led Siemen tobegin serving what is the most underrepresentedcommunity today: Earth andnature. An eventual meeting with thepresidents of the two universities andthe deans of their two law schools topropose that they sponsor CEJ withintheir walls earned their immediate support.Siemen notes that the fact thatCEJ is founded within two faith-basedlaw schools is no accident, but reflectstheir common ground with the wild lawmovement of “recognition of the sacrednessof the natural world, the sacrednessof creation.”Ask the Knowledge HoldersLike Cormac Cullinan, Liz Hosken, thecofounder and director of the GaiaFoundation in London, is from SouthAfrica and was exiled due to her antiapartheidactivism. Also like Cullinan,she now travels the world on behalf ofwild law. <strong>The</strong> foundation “is committedto cultural and biological diversity, and aliving Earth democracy” (see above). Tothis end, Hosken and others workedwith indigenous communities in theAmazon to develop a model that couldbe applied to any community in theworld—a model based on the primarylaws of the Earth and aimed at restoringwild law and a recognition of the sacrednessof nature. <strong>The</strong> foundation then tooka group of Africans to experienceAmazon communities, as a living exampleof Earth jurisprudence in practice.Most recently, the foundation has beendeveloping this work with divergentcommunities in Sweden and along theThames River in the U.K.FEATURES8THE NATURAL PAGES ® 0 MARCH-AUGUST 20085 TELL THEM YOU FOUND THEM IN THE CONNECTICUT NATURAL PAGES!9


FEATURES B Wild LawAt the recent CEJ conference, Hoskenspoke on “Earth Jurisprudence: Lessonsfrom Indigenous Peoples.” To explain thelink between wild law and indigenouswisdom, she says, “Indigenous peoplesee themselves as part of a living whole.That’s their cosmology, that’s their worldview based on Earth lore. And of course,that’s what Earth jurisprudence is tryingto say, that the Earth is the primary giverof law, the primary text, and that humanbeings should regulatethemselvesaccording to that primarylaw, and thatlaw as it governs alllife systems.”…the fact that CEJ isfounded within two<strong>The</strong> methodologythat the GaiaFoundation, theAmazonians, andthe Africans havedeveloped is basedon tapping into thewisdom of the eldersor “knowledgeholders” in anycommunity, thosewho know the workingsof the primary law in their particularecosystem, with the goal of reconnectingthe whole community to that naturalworld. <strong>The</strong> first step is to identify theknowledge holders and hold communitymeetings to stimulate community dialogueand create a map of the community’secosystem. Hosken describes thiseco-mapping as “a very interesting powerfultool for bringing out the knowledgeof the wisdom holders and engagingothers in connecting with their place andunderstanding how it works.” In theprocess, community members connectwith each other in a new way, and cohesionis re-established as a basis for goodgovernance. <strong>The</strong> young gain new respectfor their elders and the traditions of theirpeople, their heritage, and their identity.Excitingly, Hosken and her colleagueshave discovered that the methodologyworks as well in communities in developedcountries as it does in the Amazonand Africa.Restoring wild law at a grass-roots level,in individual communities, and linkingthose communities in a region, throughouta country, and internationally is howwild law will become the law of theland. Hosken notes that the Amazonianstalk about sacred sites as critical placeswhere the Earth needs to rest and beprotected andthat these sitesused to all belinked. “Of allthe things weneed to do—thedestruction is sohuge, but wehave to beginsomewhere—they say to usthat sacred sitesare the placeswe really needto prioritize inany ecosystem,”she says. “<strong>The</strong>vision they haveis that we workwith these little small nodes of interestedpeople in different countries and tryto get this process going, and try andget it to spread and to link up into aglobal alliance. <strong>The</strong> interlinkage is a reallyimportant part of building up the criticalmass for change.” And it is theknowledge keepers in your communitywho know where the sacred sites are inyour ecosystem.faith-based law schools isno accident, but reflectstheir common groundwith the wild lawmovement of “recognitionof the sacredness ofthe natural world, thesacredness of creation.”A Landmark Law PassesRecent events in Pennsylvania highlightAmerican communities that are takingback control of their own ecosystemsand restoring nature’s stolen rights. OnSeptember 19, 2006, the TamaquaBorough Council in Pennsylvaniabecame the first municipality in the U.S.to strip corporations of rights and recognizethe rights of nature, thus becomingthe first in the country to enact wild law.<strong>The</strong> council passed an ordinance prohibitingcorporations from applyingsewage sludge in the borough. (Landappliedsewage sludge is a known hazardto the health of humans and theenvironment.) Four other communities inthe state have since passed similar ordinancesdenying corporations personhoodand recognizing nature instead.<strong>The</strong> municipalities were able to do thiswith the assistance of the <strong>Community</strong><strong>Environmental</strong> <strong>Legal</strong> <strong>Defense</strong> <strong>Fund</strong>(CELDF), a nonprofit law firm inChambersburg, Pennsylvania, that provideslegal services to groups and localgovernments seeking to protect theircommunity’s quality of life and naturalenvironment. CELDF’s cofounder andexecutive director, attorney ThomasLinzey, now receives calls from all overthe country from communities facingunwanted incursions by corporations.<strong>The</strong> first thing he helps them figure outis how to regain control of their local governmentif they don’t already have it, or ifthey do, what ordinances they need topass to keep the toxic waste incinerator,sewage sludge, factory farm, cell phonetower, or other environmental hazard outof their community.CELDF’s project director, Ben Price, saidof the landmark Tamaqua ordinance, thatthe council took “an extraordinary—butlogical—step. Since this nation’s founding—andfor thousands of yearsbefore—‘law’ in the Western world hastreated rivers, mountains, forests, andother natural systems as ‘property’ withno rights that governments or corporationsmust respect. This has resulted inthe destruction of ecosystems and naturalcommunities, backed by law, publicpolicy, and the power of government.<strong>The</strong> people of Tamaqua have changedhow the law regards Nature, and haveacted in the grand tradition of theAbolitionists, who launched a people’smovement in the 1830s to end the legalbut immoral treatment of slaves as prop-erty and to establish forever their rightsas people entitled to fundamental andinalienable human rights.” With these“new-generation ordinances,” as Linzeycalls them, Nature’s inalienable rights arebeginning to be restored, and the fivePennsylvania communities are likely thestart of a movement.<strong>The</strong> wild law heroes described here andthe many others working in a variety ofways toward the goal of restoring therights of Nature cannot alone bringabout the paradigm shift from our currentanthropocentrism to a worldview ofourselves as members of an Earth communitythat includes all beings and naturalelements. Let's say no right nowto vague and misleading labeling andonly buy cleaning products that fully disclosewhat they contain and prove themselvesgreen. As a start, look forspecifics such as “no phosphates,” “solvent-free,”or “no petroleum-basedingredients.” Seventh Generation and Dr.Bronner's are two product lines that providesafer, greener cleaning options. Oryou can avoid the whole cleaning productdilemma and make your own fromsimple and readily available ingredientssuch as baking soda, vinegar, borax, salt,and lemon juice. Again, with commercialor homemade green alternativesavailable, there is no reason to foolaround with products that tell youstraight out—DANGER.Disinfectants<strong>The</strong>se are the cleaning products that killbacteria. <strong>The</strong>y typically contain chlorinebleach (see Laundry, p. 30), ammoniaconjugates, phenols, and/or triclosan, allof which can cause health problems. <strong>The</strong><strong>Environmental</strong> Protection Agency (EPA)classifies disinfectants as pesticides.Hmm, what does this tell you? In thecase of triclosan, which is found in manyhand soaps, it closely resembles thechemical structures of an herbicide aswell as the most toxic form of dioxin; itis also a suspected hormone disrupter.Two common phenols (phenol, coveredunder Poisons, is chemically the simplestof these compounds) used in disinfectantsare chlorophenols, which aretoxic water pollutants, and phenylphenols,suspected carcinogens. As forammonia, it is a respiratory irritant andits conjugates found in cleaning productscan cause asthma. Cleaning your house…in the greenfrenzy now upon us,consumers maynot be getting theenvironmentally soundproduct they thinkthey are.regularly with natural products, washingyour hands frequently with natural soap,and keeping your immune systemstrong are better defenses againstgerms than poisoning your family andyourself with toxic disinfectants. Although manystates banned phosphates from laundrydetergents, which may be why manufacturersremoved it from their products, itis not illegal nationwide. To be safe, lookfor the phosphate-free notice. As withhousehold cleaning products, the ingredientsof laundry detergents are not usuallylisted on the label, so to avoid thesetoxins, you're best off going with amanufacturer that fully discloses ingredientsand has a proven green reputation,such as Seventh Generation, Ecover,or Life Tree.Fabric Softeners/Dryer Sheets<strong>The</strong> chemicals in fabric softeners anddryer sheets have been linked to cancerand may damage the respiratory andnervous systems. Symptoms that canresult from use of these products<strong>The</strong>re is no reason on Earth to beusing conventional cleaning products,and every reason to stop.include headaches, fatigue, breathingproblems, decreased memory and concentration,dizziness, faintness, upsetstomach, nervousness, and even muscularcontrol difficulties. When you use adryer sheet, you not only pollute yourhouse, you send the toxic fumes intoyour neighborhood. After laundering withfabric softener, you breathe the fumesfrom your clothes and force others tobreathe them as well. Fabric softenerfragrance persists in clothes and linenseven after rewashing with a naturaldetergent—a clear sign of toxic chemicals.Neither fabric softeners nor dryersheets are necessary for doing laundry,so why not do the planet and yourself afavor and give up both?Chlorine BleachChlorine bleach is a highly corrosive substancethat is irritating and harmful tothe respiratory tract, eyes, and skin. Itproduces toxic gas when combined withcertain other substances, notably ammonia.Chlorine is categorized as a “hazardousair pollutant” and its manufactureproduces dioxin. Chlorine is used forwhitening laundry and also in cleaningproducts and automatic dishwasherdetergent. All of this ends up on your dishesand cookware. Rinsing does notremove all of the soap film, so when youeat food cooked in the pans and servedon the dishes, you ingest trace amountsof the detergent. In addition, the detergentyou wash down the drain sendsthose chemicals into circulation in theworld's water. Why add to your chemicalload and that of the planet when it iscompletely avoidable by using naturaldishwashing liquid instead?Automatic Dishwasher DetergentsUnlike laundry detergents, automaticdishwasher detergents often containphosphates (see Laundry); despite manufacturers'claims to the contrary, theinclusion of phosphates is unnecessary(enzymes are one alternative). Other states can adopt thestandards afterward, and the states thatwere lined up to do so comprise morethan half of the nation’s car-buying public.<strong>The</strong> EPA denied the request on thepremise that it would lead to a “confusingpatchwork of state laws” as opposedto a unified national policy.Action at the state level may be the bestway forward to combat global warming.<strong>The</strong> federal government has repeatedlyshown its lack of resolve on the matter,failing to adopt the Kyoto protocol andderailing worldwide caps on carbonemissions.Both <strong>Connecticut</strong> Governor M.
