Forewords | executive director’s reportMichael KerschbaumVoice of the Industry for 120 YearsThe Master Builders Tasmania will celebrate its 120th birthday on the 16th March 2011. The importance ofsuch an achievement cannot be underestimated and it is only when you put it into the context that theAssociation pre-dates Australian Federation by a decade that you realise what an achievement it really is.On the eve of such an important anniversary date, it seems appropriate to reflect on how the Associationhas evolved and where it has come from.The Association’s website states that:Since being established in 1891 Master Builders Tasmania, has been active in seeking to improve theconditions under which the building industry operates. It's a non-political and not-for-profit makingorganisation set up to safeguard and promote the interests of its members in their business of buildingand construction contracting, to assist them in the execution of their work and to encourage andpromote a high standard of workmanship and integrity in the building industry. The Association is aregistered Union of Employers under State and Federal laws and is able to provide for its members theadvantages of unity of action.I think that the above paragraph is a fair reflection of the values and beliefs that the Association holds andis a good summary of its role as the voice of industry. Master Builders Tasmania has a history of promotingexcellence in the industry as well as encouraging training and I believe it is these two items upon whichthe Association differentiates itself from other industry associations.When you look at the calibre of office bearers that the Association has been privileged to have you realisewhy it is held in high esteem by the public, other associations and Government. A cursory look at the pastPresidents list reads like a who’s who of the industry. It highlights a group of people who are committedto the industry and see the building industry as a career and a profession and not just a living. If theAssociation can keep attracting quality members, as it has in the past, I feel that it has a vibrant future forthe next 120 or so years.Every member is an ambassador of the Association and they have an obligation to respect the history ofthe Association and everything that it stands for. It is vitally important that the Association only recruitand retain quality members that embody the same values as those that have come before them. Toaccept everyone who operates within the industry as a member of the Association just to increase theAssociation’s membership would be disrespectful to past and present members who value the MasterBuilders brand and everything that it entails. Golf ClubLong-term Master Builders Tasmania memberand MBT Golf Club member, ross Cunninghamwas farewelled at a luncheon held at thederwent sailing squadron in January 2011.He and his wife Beth are retiring and relocating to Noosa where theirnew home is being constructed. A builder has been employed tobuild their home, which has been a most unusual experience for ross.ross and Beth decided to relocate to a warmer climate due to healthreasons. ross was the former owner of ronald Young & Co Builders PtyLtd, established in 1970 in Hobart. ross had been working on displayhomes as a third year apprentice when he was prompted to move intothe office in 1971. By 1993 ross had purchased the business from TedPowell. since being established, the company has built 1,472 homes.Paul Burnell is the proud new owner of the company.ross has been involved with the MBT Golf Club, including HornibrookTournaments, for many years and has been a member of the committeefor seven years. ross expressed that he would like to be involved infuture Hornibrook Tournaments and encourages all budding golfersamong the MBT members to get involved in the organised golf events.The events provide opportunities to network and enjoy friendlycompetition. ross’ achievements as a member of the committee thisyear included raising substantial funds through sponsorship for theHornibrook Tournament.rePorTs | MBA generAl newsMaster Builders TasmaniaGOLF CLUBAll Master Builders Tasmania members are reminded thatnow is the time to join the Golf Club for 2011. The Association appreciates the time that membersgive to sit on these Committees.This journal item focuses on the Housing Sector Committee.Myself and the Executive Director, Michael Kerschbaum (Convener)represent the Association on this Committee.The Chairman is Shane Davidson of SJ & I Davidson Pty Ltd. Shane haschaired the Committee since his appointment in August 2008. Hisconsiderable experience in the housing sector is evident in the way inwhich he runs the Committee and brings ideas and issues to the table.John Beswick of Craftsman Homes North West Tasmania (JW &TJ Beswick) is the Association’s representative on the NationalResidential Housing Council. John attends meetings when requiredand reports back to Master Builders Tasmania. National topics areoften reflective of issues or new legislation moving that affectsTasmanian residential builder members.The Housing Committee’s objectives are to lobby for positivechange to any issues of concern to the Housing Sector and identifyareas for future development and promotion of the Housing Sector.The Committee’s objectives are strongly supported by its memberswho continue to provide input on all matters concerning HousingContractors allowing the Association, through State Council, tolobby and monitor Government, address concerns across the Sectorand resolve issues.Some of the issues dealt with during 2010 include:• The Code of Practice for Induction training (White Card) –Mandatory induction to be introduced across all sectors ofthe building and construction industry – flyer developed formembers’ sub-contractors on legislative requirementsand compliance• Special Annexure developed to accompany the BO4 Contract ondisk – update to current requirements. All Master Builder Tasmaniacontacts, including the BO4 are also being updated to includenew legislative changes and changes to the current DisputeResolution clause• Delivery of industry discussions statewide on 5 Star EnergyEfficiency requirements. This was anexcellent opportunity to promote our association to the wider public and to encourage themto choose a ‘Master Builder’.Organisers were delighted with the result andhave confirmed they will be back at the DerwentEntertainment Centre in November 2011 with anadditional event planned in August at the Silverdomein Launceston.Cunic Constructions took advantage of the invitationto partner Master Builders Tasmania and their amazingeffort contributed to the success of the venture.Bill Wedd from Cunic Constructions had this to say,“From a company perspective I thought it was anexcellent opportunity to support Master BuildersTasmania, showcase some of our products to thepublic, (with a great response) and have plenty ofleads to follow up. We look forward to next year’shome expo, and will certainly be involved in someform to promote MBT and our business”.Cunic also involved a carpenter and 1st, 2nd and 3rdyear apprentices over the weekend to participatein hands on displays for the public to be involvedin. Thecontract is the written intention of the parties clearly stating thebargain negotiated.A contract can be broken down into the following parts:• Scope of work – What is to be delivered• Schedule – Time for performance• Terms of Payment – what and how you are to be paid• Assurances of Performance – What each party is to do.• Insurance – to protect the parties from loss• Indemnity – clarification of liabilities• Changes – how the contract many be varied• Disputes – how disputes are to be resolved• Warranty – Quality of work• Termination and Suspension – Ending the contract• Assignment – power to assign contract• Venue and Applicable law – jurisdiction the contract falls intoAll contracts you deal with should contain clauses dealing with theabove items. If a contract does not contain all of the above seekfurther advice before signing.Contracts may be classified in many ways but for simplicity sakethe easiest starting point is major and minor works. Major workscontracts are for large expensive projects generally over $100,000. Aminor work is generally below that amount.Secondly, is the project being supervised by an architect? If so thenthe contract will need to have provisions detailing this. This is whereyou would likely use an ABIC contract. If not using a supervisingarchitect then you can use a MBA standard contract.Is the work for a project you have control of where you want to usesubcontractors? If so then you will use either a MBA standard singleor multiuse subcontractor’s contract.Thirdly is the work prior to a client committing to a build thenyou would look at using a pre-contract or preliminary agreement.Following is a table outlining the use of certain ABIC contracts.14 | master builders tasmania

One way to ensure you are using the rightcontract for your state is to use your local MBA standard contracts.If you are building a residential building with a fixed price you woulduse the MBA BO4 Owner/Builder. If it is not a fixed price you woulduse the MBA Cost Plus Contract.If you are doing a commercial build where you are the principal andunsupervised you would use Major Works Contract. Often you willfind that the owner has a specific contract drafted by their lawyer.If the work is to be supervised then you would use an ABICcontract. The fee maybe a lump sum or a percentage of the cost of the work. FF/C does notallow for GST, so must be used with caution to deal with GST exclusiveamounts only, with GST added according to law when payments are madeto the contractor. FF/C may be suitable for housing projects, subject tolegislative provisions in the relevant state or territory. For example, it maynot be used without amendment where arbitration is disallowed - namelyVictoria, New South Wales and Queensland. Feature | Lexus ShowroomThe NewLexus ShowroomScenport Constructions were awarded the construction of thenew ‘Lexus of Hobart’ Premium Car Dealership Showroom onthe old Coop Used Cars Site in Argyle Street. Previously a ServiceStation, the site presented a few hurdles, including the carefulmanagement and removal of old fuel tanks in compliance withenvironmental regulation.The Architect was required to follow a strict standard, referred toas the ‘Lexus Manual’, which meant that the ScenportConstructions team were met with challenging guidelines uponarrival onsite in late March 2010. In addition, the team had a tightcontractual obligation of 120 working days, as the new Lexusmodel was due to be launched in conjunction with the openingof the new showroom.The commencement of deep excavations close to Brisbane andArgyle Streets required a careful strategy to ensure surroundingroads and infrastructure remained intact. This was furthercomplicated by the discovery of two further fuel tanks, which hadnot been removed during previous site works.Logistical challenges then arose for the precast panel erection,as the crane and the panel delivery trucks could achieve onlylimited access into the basement footprint. The final precast panelworks had to be conducted at night, as traffic lanes were closed toprovide safe working areas.Due to delays caused by complications with the basement works,preparation of the suspended stressed slab had to occur withina tight timeframe. This stage of work had to be conducted ina highly efficient manner in order to meet the required date ofcompletion on the construction program.Once the suspended slab was completed, project works thenconsisted of structural steel erection, roofing and a detailedshopfront system comprising of Alutri fascias and large areasof feature glazing.Internally, glass partitions to the sales and administrative officeswere installed, including Symonite cladding to the front facadecolumns, plaster feature ceilings, electrical fittings, tiling andcarpet – all of which had to be installed in accordance with the‘Lexus Manual’.Despite a number of contract variations, the final product was ofthe highest quality and opened in time for the new Lexus modellaunch. Space for an art gallery was required andthe kitchen, bathrooms and laundry needed to be remodelled withpracticality in mind.The results speak for themselves upon entering this light filled home!Tasmanian Oak overlay to the foyer radiates a sense of opulence, atone carried throughout the home through integrated use of timberin flooring and joinery. Clerestory windows, strategically placed abovethe connecting stairway, allow bands of sunlight to illuminate thelower level without encroaching on artworks.The second level demonstrates Architect, Maria Gigney’s carefulconsideration of the original architect’s aesthetic and it is impossibleto tell where the original stops and the new starts. A Tasmanian Oakmezzanine floor warms the area with rustic tones and neutralises theabundance of light gushing through the enormous windows.Custom joinery in the kitchen, bathroom and laundry features EssaStone benchtops and Hames Oak Buff cabinetry. The bathroomspresent a lustrous appearance with polished porcelain tiles andsophisticated fittings.In2construction are incredibly proud to have achieved such acontemporary result, considering the level of difficulty involved inadapting a 1960’s home, built with modest tolerances and accuracy.It was completed within budget and the set timeframe and boastsa 6 Star energy rating. Key sustainability features include:• Concrete slab floor to second level, resulting in a large thermal mass• Solid block walls with ‘reverse veneer’ construction to createinsulated heat banks• Maximum roof insulation• Double glazing to the east and north• Spaces designed with flow-through ventilation in mindLike all major renovations, a number of challenges were facedduring the design and construction stages. One such challenge wasencountered during the installation of the curved glass windowsto a tight radius and without structural fins. However, the outcomeachieved proved that no problem was too great. The client wasmost impressed, and commented, “I would like to thank the team atIn2construction for building our wonderful house. We particularlyappreciate their input into sourcing quality materials, such as ourcurved windows, Huon Pine doors and celery top beams. Feature | interiors“The benefits of using plasterboard far outweighheavier forms of construction such as bricks,blocks and concrete.”Steel Stud FramingThinner gauge steel studs such as 0.5mm Base Metal Thickness (BMT) and 0.55mm BMT are prone to twisting and bending when fixingplasterboard sheets. This can produce a slight step between the plasterboard sheets, especially when the sheets are fixed vertically.When a high ‘Level of Finish’ is required and where possible glancing light conditions may exist, the use of heavier gauge studs and thickerplasterboard sheets is recommended. This will limit stepping between sheets.• Fix plasterboard sheets in the correct sequence as shown infigure 1.• Always sheet from the open side of the steel stud first. Whenfixing from the open side, the flange will deflect but shouldstraighten as the screw is driven into the plasterboard sheet. Referfigure 4 for the correct sequence of fixing plasterboard sheets.• Vertically fix plasterboard sheets on thin gauge studs with caution.Either use heavier gauge studs and/or thicker plasterboard sheetsto minimize the sheet stepping.• Do not fix plasterboard sheets from the closed side of the studfirst. Refer figures 2 and 3.• Fix plasterboard sheets horizontally where possible to reduce thechance of sheet stepping. Refer figures 2 and 3 for examplesof sheet stepping.• Use noggings in the steel stud frame to help increase framestiffness to resist stud twisting.• Support the stud to reduce twisting while fixing theplasterboard sheets.• Use a drill with high enough RPM to drive the screw inwithout pushing too hard on the stud, causing stud twistor flange bending.• Use Needle Point (NP) screws for 0.5mm to 0.75mm BMTsteel studs.• Use Drill Point (DP) screws for heavier gauge steel studs,0.8mm BMT and above.• Do not expect the best finish whilst vertically fixing thinplasterboard sheets to the thinnest gauge steel studs.Article by Ben Wright, Lafarge Plasterboard’s Technical division. It is mandatory that yourapprentices be introduced to all safety regulations, especiallyoccupational health and safety training at the workplace.6. Find the balance between being fun and authoritative.It’s generally a good idea to show your funny side (as far as itexists) and joke around with your apprentices but sometimesit’s better to wait for that time after work. Once at the workplaceyou should be professional and exercise your authority to ensureeverybody works in a similar professional manner.7. Practice what you preach and set a good example.Arrive at work on time, do a good job and don’t get distracted bypersonal problems.8. Find the right apprentices for your company.Now that the Australian industry is again facing massive skillshortages finding an apprentice that suits to the job and yourcompany is a crucial challenge. Foster good working relationships with other colleagues!Make sure that new apprentices are introduced to and welcomedby staff. Give effective supervision and assign a mentor!Apprentices need appropriate levels of supervision. Nominatea workplace supervisor and assign a mentor to the apprentice.The mentor should have a vested interest in the development ofthe apprentice, should be able to communicate well, but aboveall, needs to be a strong role model. It is also important that youshow ongoing interest in your apprentices’ training efforts!4. Be a motivator!Being a good boss means you are able to motivate yourapprentices. There are plenty of ways like rewards, incentives andformal recognition. Keep in mind that everybody reacts differentlyon criticism and praises, but a good rule of thumb to follow is thatpraises should be done in public while it is better to keep criticismin private.5. Have an open ear and be a communicator!Communication is always a two way process and an importantpart of supporting your apprentices is listening, addressing andreacting to their problems and questions. You too should beopen to their feedback and criticism.
