Any lease or license should state that the local government bylaws andapplicable regulations must be adhered to.SUMMARY OF ISSUE(S)The applicants have applied to the province for tenure to construct a new private moorage on theforeshore of Pitt Lake.BACKGROUND:The application states that the applicants purchased a lakeshore property (Lot 3, Section 8, Township6, Range 4, Meridian 7, New Westminster District, Plan NWP37618, PID: 008-473-099 as shown onLocation Map in Appendix 1) on the east side of Pitt Lake in 1989. They jointly constructed a dockwith the owners of adjacent Lot 4, Don and Marla Harrison, in 2003. The dock was shared betweenLot 3 and 4 until the summer of 2012, when the Harrisons stated they wanted sole use of the dockand have themselves applied for a private moorage (Land File No. 2410802).The applicants are therefore applying for a private moorage for their own property at Lot 3 as there isno road access to the Lot (water access only) and they indicate a safe haven is needed in the bay dueto their year-round use of the property and the extreme weather on Pitt Lake. They have applied for aspecific permission tenure for an unspecified period of time for a 21m by 2m dock attached to a 20mby 3m float by a 12m by 1.2m ramp.


Land Use RegulationsPage 2Official Community PlanThe property is not included an Official Community Plan area.ZoningThe subject property is zoned Resort Residential 1 (RST-1) and the Crown Land where the applicantsare proposing the specific permission tenure for the moorage is zoned Rural 4 (R-4). The R-4 zonepermits moorage use, defined in Zoning Bylaw No. 559 (adopted July 28, 1993) as ``an installation onthe foreshore or the surface of water which provides moorage for watercraft, but excludes aResidential Use such as houseboats, float homes or any other watercraft being used as livingquarters.``The off-street parking section of the zoning bylaw specifies that the owner shall provide 1.1 off-streetvehicle parking space per 6.0 metre of moorage space. As the subject property is not accessible bymotorized vehicles, this provision is not relevant.Development Permit AreasNeither the applicant’s property and the Crown Land site of the proposed private moorage use arewithin any development permit areas.Building Bylaw No. 1188, <strong>2013</strong>According to Bylaw No. 1188 a Building Permit (BP) is not required for lands that are not accessibleby a road maintained by the Ministry of Transportation and Infrastructure. The property the applicantsown and the Crown Land where the specific permission tenure for moorage is proposed are onlyaccessible by boat. This means that a BP is not required for the private moorage.DISCUSSION:Given that the proposed use is permitted on the R-4 zoned Crown Land, staff recommends that theFVRD respond to the Crown Land Referral stating that the FVRD does not object to the provincegranting a lease or license for Land File No. 2410832 for a private moorage on the foreshore of PittLake.
