Consideration was given to the fact Mr. Lohss cooperated during theinvestigation; corrective action was taken; there was no previous history ofsimilar nature; no potential for damage; a good faith effort to comply and norestricted use pesticides were involved.2012/1126 Disposition: John Huiner was cited for violation of section 65(6) of the IndianaPesticide Use and Application Law, specifically 355 IAC 4-2-3, for failure to
supervise a non-licensed employee. A civil penalty in the amount of $125.00 wasassessed for this violation.2012/1257 Disposition: Royce Simpkins was cited for fifty-two (52) counts of violation ofsection 65(6) of the Indiana Pesticide Use and Application Law for failure toproperly supervise a non-licensed employee.
