Addition/Deletion in Trades: Keeping in view the changing scenario and industry’srequirements, VVSKM may add or remove any trade from the above mentionedtrades within the approved cost <strong>of</strong> the project and with prior approval <strong>of</strong> D-SAG /TDD. The trades and the duration <strong>of</strong> training may change after the intervention <strong>of</strong>GTZ IS (German Technical Corporation International Services) for technical assistanceto the project.ARTICLE-5: TARGET GROUP FOR TRAININGVVSKM shall annually train at least 400 youth and 2000 youth over the project duration <strong>of</strong>5 years from the state <strong>of</strong> Gujarat. The trainees can be selected by VVSKM from all overGujarat. Out <strong>of</strong> the total candidates, 75% candidates must belong to Scheduled Tribe (ST)category. ARTICLE-6: INFRASTRUCTUREFollowing infrastructure shall be created and provided during entire project duration:1. Building & Infrastructure: VVSKM is allowed to construct following facilities in theinstitute: -a. Main training and administration building/Academic Block;b. Hostel having capacity <strong>of</strong> 100 residents; andc. Residential building for staff.2. Equipments: VVSKM is allowed to procure trade specific equipments under the projectwithin the approved cost viz. Rs. 5 Crores as mentioned in the proposal.3. Land: The land <strong>of</strong> 18000 square mtr. is owned by VVSKM. The Jantri price <strong>of</strong> land @Rs. 300/sq. mtr. i.e. Rs. 54,00,000.00 (Rs. Fifty Four Lakh Only) will be consideredtowards 25% capital contribution <strong>of</strong> VVSKM. Rest <strong>of</strong> contribution i.e. Rs. 71.00 Lakhshall be brought in as cash by VVSKM. During the project duration, the land shall betransferred or the ownership <strong>of</strong> the land shall be transferred to D-SAG through a legalmechanism mutually accepted between both the parties.ARTICLE-7: COST CEILING AND OTHER DETAILSThe cost ceiling for the project will be as follows:1. Capital Cost :The approved capital cost <strong>of</strong> the project is Rs. 5.00 Crores (approved by HPC inmeeting dated 21.12.2009). 2. Re-appropriation <strong>of</strong> capital cost: - Re-appropriation in capital cost ispermitted within the approved cost.3. The above mentioned capital cost is final and shall not be changed during thelater stages <strong>of</strong> implementation.2. Recurring Cost: Regarding recurring cost <strong>of</strong> the project, VVSKM shall submit adetailed proposal to D-SAG / TDD for every year. The proposal shall be submittedto D-SAG / TDD before two months in advance. The proposal shall include the list<strong>of</strong> trades in which the training is to be imparted and also the number <strong>of</strong> trainees. Theexpenses on boarding and lodging <strong>of</strong> the trainees shall be proposed in the proposalitself. The proposal shall be duly evaluated and approved by the TechnicalCommittee <strong>of</strong> D-SAG / TDD. The first installment for recurring cost shall be releasedto the Trust on lump sum basis for six months for conducting the trainingprogramme on pilot basis. The recurring cost shall be finalized after submission <strong>of</strong>detailed proposal from VVSKM after completion <strong>of</strong> the pilot phase. However, therecurring cost can be based on following terms and conditions: -a. D-SAG / TDD shall provide the recurring cost only for ST trainees.b. As this being a new project, some changes in the recurring cost can be allowedafter first full year <strong>of</strong> operations.c. Pro-rata reduction in recurring cost shall be done in case <strong>of</strong> shortfall <strong>of</strong> STtrainees.d. Recurring cost will be paid in advance for first two quarters and the nextinstallment shall be released in advance on utilization <strong>of</strong> previously disbursedfunds.ARTICLE-8: FUNDING FROM D-SAG:The capital cost shall be funded from the available Grants under Article-275 (1) <strong>of</strong> theConstitution, New Item for VTCs or any other available grant whereas the recurring costshall be funded from SCA to TSP grants receivable from GOI or from any other availablegrant, keeping in view the availability <strong>of</strong> grants.D-SAG will follow its Funds Release Framework for disbursements <strong>of</strong> funds to VVSKM.ARTICLE-9: NOTIFICATION OF PROJECT MANAGER:After signing this agreement, VVSKM shall notify a Project Manager, who will be the nodalperson, responsible for entering into correspondence with D-SAG / TDD, GTZ IS, ProjectAdministrator, Valsad and other stakeholders <strong>of</strong> the project.ARTICLE-10: SEPARATE BANK ACCOUNT FOR THE PROJECTVVSKM shall open a separate bank account for this project and notify the details to D-SAG/ TDD and mark a copy to Project Administrator, Valsad. ARTICLE-11: PLACEMENT GUARANTEE & PENALTYVVSKM shall follow the following points regarding placement <strong>of</strong> trainees: -1. Out <strong>of</strong> all trained candidates, VVSKM shall place at least 75% <strong>of</strong> candidates. Failingwhich, appropriate penalties will be charged as per the conditions mentioned in theOutcome Guarantee Framework <strong>of</strong> D-SAG and change in the same from time to timeshall be applicable to VVSKM.2. VVSKM shall constitute a placement committee at the VTC level that will ensure theplacement <strong>of</strong> the trainees. The committee shall ensure the campus placement <strong>of</strong> thetrainees at the VTC only.3. The placement committee thus formed shall look after following thingsa. Placement <strong>of</strong> candidates through organizing campus placement;b. Self employment <strong>of</strong> candidates – In case, any trained candidate is willing tostart his own enterprise then this committee shall arrange for setting up <strong>of</strong>enterprise, bank linkages for sanctioning <strong>of</strong> loan for purchase <strong>of</strong> machineries,purchase <strong>of</strong> equipments and working capital requirements and effectivemarket linkages for sale <strong>of</strong> goods / services;c. The committee shall ensure at least one year <strong>of</strong> hand holding for the placedcandidates.4. VVSKM shall engage the services <strong>of</strong> visiting faculties from renowned Indian /Overseas Institutes <strong>of</strong> cognate / related field at the VTC for lectures etc. Thehonorarium paid to the faculties will be paid by D-SAG / TDD and VVSKM canincorporate these expenses in the recurring cost proposal.ARTICLE-12: FRAMEWORKS MANUALVVSKM will follow all six Frameworks <strong>of</strong> D-SAG (specifically outcome guarantees) asamended from time to time, will be applicable to the <strong>agency</strong>. The Framework document isavailable on following website: http://vanbandhukalyanyojana.<strong>gujarat</strong>.gov.in/ARTICLE-13: OWNERSHIP OF ASSETSThe land and the assets created under this project shall initially belong to D-SAG / TDD forthe project duration.ARTICLE- 14: TRANSFER OF ASSETS INCLUDING LANDAlthough Government Resolution passed for this purpose specifies that if theorganization’s performance is satisfactory then land and other assets will be handed over tothe implementing <strong>agency</strong> after five years. D-SAG/ TDD may transfer the assets to VVSKMif it follows all terms and conditions and the performance remains satisfactory across theentire project duration. The transfer <strong>of</strong> land and other assets will be done as per prevailingnorms <strong>of</strong> Govt. at that time. ARTICLE-15: APPOINTMENT OF CONTRACTORVVSKM will plan the overall construction <strong>of</strong> VTC project. VVSKM shall construct the civilinfrastructure by selecting a qualified contractor through open tender to supervise the workand maintain the facilities for entire project duration.ARTICLE-16: SUPERVISION AND MAINTENANCE OF ALL ASSETSVVSKM will supervise the work and maintain the facilities for entire project duration.ARTICLE-17: TRAINING RELATED IMPORTANT ASPECTSVVSKM will develop the course module (in English as well as Gujarati languages), inductthe trainers and other <strong>support</strong> staff including placement cum marketing <strong>of</strong>ficer, obtain anacceptable certification for the course, select the candidates, train the candidates, arrangeplacement for them as per the guaranteed commitment and do handholding <strong>of</strong> thecandidates for at least one year. VVSKM shall take necessary accreditation <strong>of</strong> courses froma reputed organization. VVSKM shall make the course modules in regional language i.e. inGujarati that can be easily understood by the ST candidates.ARTICLE-18: SUBMISSION OF MONTHLY PROGRESS REPORTSVVSKM shall send timely Monthly Progress Reports (MPR) to D-SAG / TDD and mark acopy to the PA, Valsad in the format prescribed for this purpose (Copy enclosed). Futurepayments by the D-SAG/TDD will be released on the basis <strong>of</strong> such reports and FundsRelease framework. Once the work is completed, VVSKM will furnish completioncertificate to the D-SAG.The report will be classified in four parts as per following:1. The first part will cover the physical progress <strong>of</strong> the ongoing trainees enrolled invarious courses, undergoing training, drop outs, failures, placed in employment,undergoing placement, enrolled for further up-gradation;2. The second part <strong>of</strong> the report will cover details about placement <strong>of</strong> the candidates;3. The third part will cover the physical progress <strong>of</strong> construction related activities; and4. The fourth part will cover financial progress <strong>of</strong> the project indicating receipts andexpenses <strong>of</strong> funds.ARTICLE-19: MANAGEMENT CONTROLVVSKM will have full management control <strong>of</strong> the VTC; therefore, it would enable todevelop industry friendly courses as per the existing requirements. VVSKM can also have tie-ups with any Indian & / or overseas partners for obtainingtechnical <strong>support</strong>. VVSKM shall also make efforts to involve capable national andinternational level institutions in developing the course modules and other aspects relatedto training.ARTICLE-21: CONSTITUTION OF PROGRAMME STEERING COMMITTEEThere will be a programme steering committee at the VTC level <strong>of</strong> VVSKM in which therepresentatives <strong>of</strong> leading industries’ sector should be involved which will ensure lateremployability <strong>of</strong> trainees and course improvements;ARTICLE-22: FUNDING FOR VARIOUS AMENITIES IN THE INSTITUTEVarious amenities in the institute such as rainwater harvesting unit, sewage treatmentplant, drip irrigation system which can be funded from Gujarat Pattern State Funds or anyother grant head through the Project Administrator, Valsad or any other authority. VVSKMshall formulate separate proposals for each amenity and send the same to the approvingauthority and mark the copy <strong>of</strong> the same to D-SAG / TDD. VVSKM shall ensure thereremains no duplication <strong>of</strong> funds. VVSKM shall send a copy <strong>of</strong> the grant / fund releaseorder to D-SAG / TDD.ARTICLE-23: INTEREST INCOMEThe interest earned from the grant will belong to D-SAG; hence it shall be deposited to D-SAG. The interest earned in the bank account can be utilized for the project only after priorapproval <strong>of</strong> D-SAG.ARTICLE-24: PAYMENT TERMS & PROCESS OF RELEASING FUNDSFunds from D-SAG & Process <strong>of</strong> releasing funds from D-SAG: During the constructionstage, VVSKM will submit a physical and financial report to D-SAG and ProjectAdministrator, Valsad along with all financial details, fund utilization certificate and copies<strong>of</strong> bank statement and pass book and other documents as mentioned in Article-25 <strong>of</strong> thisorder. Once a request is received from VVSKM for release <strong>of</strong> funds, Project Administrator,Valsad will visit the site and verify the audited expenditure statement and architect’scertificate on the extent <strong>of</strong> completion <strong>of</strong> the civil work. Thereafter, funds will be released asper the quarterly estimates furnished by the VVSKM. D-SAG will follow its funds releaseframework for release <strong>of</strong> funds to VVSKM.ARTICLE-25: SUBMISSION OF DOCUMENTS FOR RELEASING FUNDSWhile releasing funds, D-SAG shall follow its fund release protocol and also seek the reportfrom Project Administrator, Valsad along with current photographs <strong>of</strong> the site andcertificate from Architect about extent <strong>of</strong> work completed and audited accounts <strong>of</strong>expenditure incurred.1. a) Articles and byelaws <strong>of</strong> the organization and audited reports <strong>of</strong> last two financialyears;b) Inception report showing compliance with conditionality and signed MOU orsanction orders;c) Projected fund requirements for first quarter <strong>of</strong> the project;d) Request for release <strong>of</strong> first installment <strong>of</strong> funds, including physical and financialplans for the first quarter;e) List <strong>of</strong> key project personnel and name and contact details <strong>of</strong> the dealingperson/coordinator;f) Gantt Chart for the first quarter activities (Format attached);g) Indemnity Bond/Bank Guarantee and Pre Stamp Receipt (Format available inFrameworks Manual uploaded on VKY website);h) Photographs and progress report <strong>of</strong> the work done from organization’s contribution;i) Progress report from Project Administrator and Architect regarding the work doneby the <strong>agency</strong>.j) Bank Account number and name, in favor <strong>of</strong> whom the funds should be released;andk) Any other document asked by D-SAG.2. Documents to be furnished by VVSKM for the release <strong>of</strong> subsequent installments:a) Projected fund requirements for next quarter;b) Statement <strong>of</strong> Expenditure for previous quarter;c) Request for release <strong>of</strong> next installment <strong>of</strong> funds, including physical and financialplans for the first quarter;d) Gantt Chart for the next quarter activities;e) Audited accounts for the previous year, if funds are sought after 30 September;f) Progress report from Project Administrator and Architect regarding the work doneby the <strong>agency</strong> along with photograph <strong>of</strong> the work done in a CD;g) Photographs and progress report <strong>of</strong> the work done from organization’s contribution(Kindly submit a statement about the contribution <strong>of</strong> the organization along with allrelevant payment vouchers and bank statements);h) Indemnity Bond/Bank Guarantee and Pre Stamp Receipt;i) Copy <strong>of</strong> Latest bank statement; andj) Any other document asked by D-SAG / Project Administrator.3. Justification <strong>of</strong> funds sought: The amount <strong>of</strong> funds requested from D-SAG / TDDshould be justified in a manner that the funds can be completely utilized in time.ARTICLE-27: APPOINTMENT OF NODAL OFFICER FROM D-SAG/TDDThe Project Administrator, Valsad will be the nodal <strong>of</strong>ficer from D-SAG / TDD.ARTICLE-28: CONCURRENT MONITORING & EVALUATIONConcurrent monitoring and evaluation (CME) exercises will be carried out by VVSKM byengaging external organization(s) in order to assess the quality <strong>of</strong> interventions andpossible pitfalls in the future and taking immediate remedial measures. VVSKM shall conduct evaluation exercises for the project at the end <strong>of</strong> every 3 years by anyexternal <strong>agency</strong>. Expenses on this account should be part <strong>of</strong> the project and handleddirectly by VVSKM.VVSKM will make all the data entry in the CPMS (Computerized Project ManagementSystem) s<strong>of</strong>tware which is available online at www.tribal.guj.nic.inARTICLE-29: PROPERTY INSURANCEVVSKM shall take property insurance for the newly constructed buildings and theequipments purchased for imparting the training.ARTICLE-30: INSTALLATION OF PROJECT MANAGEMENT SOFTWAREVVSKM will install project management s<strong>of</strong>tware for monitoring the project through PERTand CPM (Project Evaluation and Review Technique & Critical Path Method respectively).The charges for the same shall be borne by VVSKM.ARTICLE-31: PROCUREMENT OF FURNITURE & EQUIPMENTSTo the extent possible, VVSKM shall procure furniture and equipments through opentenders. In rare cases, where procurement <strong>of</strong> specialized items or proprietary items isrequired, VVSKM will give proper justifications to D-SAG with prior intimation about thesame.ARTICLE-32: ACTIVITIES DURING CONSTRUCTION PHASEWhile physical construction activities continue, parallel tasks including <strong>development</strong> <strong>of</strong>course curriculum, devising strategy for identification <strong>of</strong> appropriate faculty, preparation<strong>of</strong> detailed framework and operational manuals, etc. can be taken up by VVSKM.ARTICLE-33: OUTSOURCINGVVSKM shall take prior approval from D-SAG / TDD before outsourcing any trainingrelated activity. Before outsourcing any activity, VVSKM shall ensure that the quality <strong>of</strong>outsourced services will not be inferior in comparison to the services proposed.ARTICLE-34: MAINTENANCE OF ACCOUNTSVVSKM will maintain records as per the accounting standards laid down by the Institute <strong>of</strong>Chartered Accountants <strong>of</strong> India and will ensure that procurement procedures and other<strong>of</strong>fice procedures will be well laid down. A separate balance sheet and Pr<strong>of</strong>it and Lossaccount shall be prepared for this project.
