Thank you for electing me president for thisyear. We have gotten off to a great start at ourAnnual Assembly in Destin. We had nearly100 doctors there. This was, I think, the besteducational program we have had in 18 years. The Academy is doing well and we have abusy year in front of us.We will have representation at the AmericanAcademy Annual Assembly in September inWashington D.C. We will have one of ourpast presidents on the Healthcare ReformCommission for Louisiana. The Future ofFamily Medicine project continues to definewhere we need to go in the future, and ourLegislative & Membership Committee hasbeen busy with legislative issues. From the PresidentWe plan to have our LAFP Board & Clustermeetings around the state this year and to bepresent at family medicine graduations.Having said all these great things, we needyour help. We need to see you at our meetings. We need to hear from you to answerthe e-mails we send you, because we wantto know what you think. We will need yourhelp to work legislative issues, the Future ofFamily Medicine project and to helpreshape the health care delivery system inLouisiana and to help with Tar Wars. I hopeto see many of you at our functions. We willhave a great year.Bryan Anthony Picou, MDI would like to thank the membership of theAcademy for selecting me to serve as theorganization’s secretary, and I look forwardto the opportunity. It is truly a privilege torepresent a constituency that defines theforefront of health care.I was encouraged to see a high level of memberparticipation in the recent AnnualAssembly in Destin, Florida. Your Academystaff and planning committees are to be recognizedfor their tireless efforts in organizinga highly successful event that was enjoyed byall. There was a twofold increase in memberFrom the Secretaryregistrants at this year’s event compared tolast year, and enhanced participation in theactivities of the Academy can only serve tomake our organization stronger. The LAFP Officers and Board of Directorswelcome and encourage member input withrespect to the decisions and actions of theorganization. I encourage each of you torelate your needs and concerns to yourelected officers, so that we maintain forwardprogress on a local, state and nationallevel. Please let your voice be heard.James S. Campbell, MD7

Legislative Reportby Jo RoseThe 2006 Legislative Session may be over, but it is not tooearly to start thinking about issues you would like our state legislatorsto consider (or, in some cases, not to consider) duringthe upcoming legislative session. The 2007 Session is considered a “fiscal” session. The fiscaland/or local issues may not interest you this coming year, butthere will definitely be many issues during the 2008 regularsession (or any special session called by the governor) that willaffect you and your practice. It is also important to note that the governor, all statewideelected officials and every House and Senate member (unlessterm-limited) will be running for reelection in the fall. Many ofthe legislators are planning on qualifying for a higher (or, inseveral cases, lower) office. And, of course, there are a few whoare running for a statewide office. This is another reason that NOW is the time to talk with bothyour senator and representative to let him or her know thatthese issues are important to you and that you are one of theirconstituents. Get involved in his or her campaign and get acommitment to keep these issues on the front (or back) burner.Become a person that your legislator will call when he or shehas a question on a bill. By being a resource person and a supporter, you can make a big difference in what does or doesn’tbecome law. Each year, the Legislature slowly chips away at scope of practiceand quality-of-care issues. Also, the lifting or repealing ofthe medical malpractice cap is introduced in some form eachlegislative session by the trial lawyers. If we are not carefulabout whom we support for election, or if we do not getinvolved at all, there is a real possibility that it may go the sameway the “medical psychologist” or the “rural hospital development”issues did.In addition, because of all the money that is being funneled fromthe federal government through the state and into the coffers ofthe Louisiana Recovery District, any idea that would advance thedelivery of health care services in Louisiana should be proposedto either your legislator or Dr. Richard Streiffer, who is nowworking with Dr. Fred Cerise, secretary of DHH and theLouisiana Health Care Redesign Collaborative. The session convenes at noon on Monday, April 30, 2007 andadjourns not later than 6:00 p.m. on Thursday, June 28, 2007.Other information pertinent to the session:• It is limited to “measures to enact a general appropriationbill; enact the comprehensive capital budget; make anappropriation; levy or authorize a new tax; increase anexisting tax; levy, authorize, increase, decrease, or repeal afee; dedicate revenue; legislate with regard to tax exemptions, exclusions, deductions, reductions, repeals, or credits;or legislate with regard to the issuance of bonds.” Eachmember may, however, pre-file (no later than 5:00 p.m.,Friday, April 20, 2007) an unlimited number of local orspecial bills (those which are required to be and have beenadvertised) and may introduce up to five such bills thathave not been prefiled. These bills must be introduced nolater than 6:00 p.m., Wednesday, May 9, 2007. Late introductionsare not permitted.• There are exceptions to the five-bill limit: general appropriationbill, judicial branch appropriation, legislative branchappropriation, capital outlay bill, omnibus bond authorizationbill, supplemental appropriation bill, revenue sharingbill, and ancillary funds bill.• The deadline for third reading and final passage is 6:00p.m. of the second legislative day or the 57th calendar day, whichever occurs first, but the bill can be heard after thatdate if authorized by a two-thirds vote of both houses.• Effective date of the acts will be August 15, 2007, unlessthe bill specifically provides otherwise. The 2007 session is a good time to become more involved inthe legislative process. It will require a time commitment, butby taking a more active role, you can help determine what thepractice of medicine and, in particular, family medicine, willlook like. The legislators want to hear from you, and now, justprior to when they will really need your help (both politicallyand financially), is the perfect time to start.Call the LAFP office today and say you’d like to become a partof this important committee.8

Legislative & MembershipCommittee Reportby Wayne Gravois, MD, Committee ChairAfter two Special Legislative Sessions, the 2006Louisiana Regular Legislative Session ended onJune 19, 2006. It was a fairly eventful session, with most of the emphasis on the aftermathrecovery of Hurricanes Katrina and Rita. Allhealth-care-related bills can be viewed by goingto the LSMS Web site at www.lsms.org andclicking on “Legislative,” then “2006Legislative Summary.” The majority of thesebills fall under the heading EmergencyPreparedness and Liability. The next section, entitled Environmental Health, deals with twosignificant laws — House Bill 1010 and SenateBill 742 — prohibiting smoking in both a vehiclewith a child and in public places. In additionto our efforts, these bills were strongly supportedby the American Cancer Society, among others. They are felt to be bold steps forward inreducing secondhand smoke’s ill effects.10Difficulties in the enforcement of these lawswere debated during committee and flooraction, but the lobbying efforts by all the supporterssuccessfully argued that this law hadbeen implemented in at least 10 other stateswithout any problems. The next section, Healthcare, contains a verysignificant piece of legislation that should impactus as family physicians and the future of famiymedicine in our state. HB 106, by Rep. Durand, extends the “sunset” date of the Interagency TaskForce on the Future of Family Medicine toSeptember 1, 2008, and also provided that onFebruary 15 of each year, the Task Force will presenta report on its findings and recommendationsto the secretary of DHH and the Legislature.HB 106 became Act 331 of 2006, effective onAugust 15, 2006. The task force, created in 2004,was designed to “assist DHH and other healthand human-service organizations in studying anddeveloping strategies to eliminate the significantprimary health care shortage in rural and urbanunderserved areas.” Please make the time toreview our LAFP Web site at www.lafp.org, andclick on Louisiana Interagency Taskforce onthe Future of Family Medicine for updates. Aspecial thanks to all of those volunteers servingon the committee, especially Drs. Ed Martin andRick Streifer. Many long hours have been spenttowards bettering our specialty of family medicine, and we still have a long way to go. As policyand design are formulated, we ask for yourinput and support.Under the next few sections, one of the mostcontroversial bills passed was SB 570, bySen. Hines, which provides for the economicand monopolistic protection of rural hospitalsand requires “ethical referral practices” byphysicians. Both the LAFP and the LSMSstrongly opposed this bill. Quoting the LSMSWeb site: “SB 570 severely impedes investmentand construction of certain health carefacilities by physicians or any ‘proposingparty’ in rural areas in direct competition withrural hospitals in their primary service area, which is defined as either a 25-mile radius orthe number of postal ZIP codes in which 75percent of the rural hospital’s patients reside.”The LAFP joined in the last-minute fight andnearly helped turn the tide. The bill wassqueezed out of the committee by one vote.In addition to the lobbying effort by our lobbyist,Jo Rose, we had one of our own ruralfamily doctors, Dr. Zeb Stearns, testifyagainst the bill. In order for the LAFP to be aforce, we need more active participation ofour members in the legislative process in thefuture. We need to have physicians availablewho are willing to leave their busy practicesto testify. Having Jo Rose, our lobbyistdown at the legislature, certainly can help toexpedite things for those willing. This is OURacademy — YOURS and mine. We also needan updated Legislative Contact List ofphysicians so that we can quickly contactappropriate legislators. Please contactSonora or Linda Foster at OUR AcademyOffice with your contact information.Under the section Medical Malpractice, there were some rather ambiguous resolutionsthat were proposed. There was a “loser-pays”bill, SB 110, which appeared to be mostpromising but was opposed by LSMS andLAMMICO for fear that the physician defendantwould also be subject to penalty. I amstill waiting to understand that one. HB 412,by Rep. Johns, adds the donation of blood andblood products to the definitions of “patient,”“malpractice” and “health care” under privatemedical malpractice. LSMS opposed this, asthis expands the ever-increasing malpracticedefendant arena. As always, there was anunsuccessful attempt to “tinker” with ourmalpractice cap of $500,000. An importantbill that did not get much fanfare, but couldgreatly impact the present state of malpracticein our state, as we know it, is SB 406. We asphysicians need to understand this piece oflegislation before agreeing to this with yourinsurance company. SB 406, by Sen. Lentini, provides, at the option of the defendant, aone-year expedited medical-review-panelprocess to issue an opinion beginning withthe appointment of the attorney chairperson.SB 406 became Act 323 of 2006, effective onAugust 15, 2006. The first 90 percent of thebill sounds very favorable to physicians andorganized medicine, but the last section iswhat concerns me. I quote:“The report of the expert opinion reached bythe expedited medical-review-panel processpursuant to the provisions of this Subsectionshall not be admissible as evidence in any

action subsequently brought by the claimantin a court of law. Neither party shall havethe right to call any member of the medicalreview panel as a witness. A panelist shallhave absolute immunity from civil liabilityfor all communications, findings, opinions, and conclusions made in the course andscope of duties prescribed by this Part.”I repeat: “The medical review opinion willnot be admissible in court.”In speaking with LAMMICO staff memberswho helped introduce the bill and the LSMSwho supported LAMMICO, it was theirunderstanding that the medical review opinionwas never supposed to be admissible when themedical review process was first formulatedback in the mid-’70s. I have not been able tocontact Dr. Donald Palmisano, who was aleader in the medical malpractice reform backin the ’70s, to verify this. I only know thatwith more than 85 percent of the review panelsfinding in favor of the defendant, unanimousfavorable decisions can mean somethingif the case goes to trial. I would be veryinterested in others’ opinions on this topic. There was a VICTORY for the uninsuredpatient this year that may have gone unnoticed.HB 1396 (originally HB 896) passedand was signed into law by the governor. This bill “Provides for physician discountsfor rendered health care services to theuninsured.” For much too long, we havebeen forced to charge all patients, bothinsured as well as the uninsured, the samefee for services rendered, while only receivingthe discounted fee from the insurer.MONROE FAMILY PRACTICEFOR SALEWell established, lucrative family practice located inGarden District of Monroe, Louisiana.Office equipment, medical equipment, waiting roomfurniture — everything needed to step in and beginpracticing immediately — is included in the sale.• Reason for sale:• Seller Finance:• Practice:RetiringMPOver 5,000 patientsPlease contact Brenda at (318) 322-1417 forinformation on this great opportunity in Monroe.Perfect Places & Properties7254cI would like to take this opportunity to thankeveryone for their help this last year — in particular, those on the Membership and LegislativeCommittee; the Executive Committee, led by Dr.Kim LeBlanc; Sonora and Linda, with the academyoffice; and a VERY SPECIAL THANKS toJo Rose, for her serious contribution to the cause.Lastly, if you would be interested in serving onthe Legislative and Membership Committee, please contact the LAFP office at www.lafp.orgor me at wgravois@lanermc.org. I wouldlike to thank Dr. Mark Walker, Dr. KirkDantin and Dr. Mike Watkins of HoumaFamily Practice for allowing me to rotatewith them in the month of August. The educationalexperience was wonderful! In June 2006, we celebrated our 10th graduatingclass. The event was spectacular! Theweekend event began on Friday night as currentand former faculty and staff gathered atWalk On’s restaurant. Our Saturday nightevent was held at the LSU Faculty Club. U.S.Rep. Bobby Jindal was our guest speaker atthe event, and he provided us with an entertainingand motivational speech on the importanceof physicians in our state — not only ashealth care providers, but also as leaders in thecommunity. Dr. Richard Streiffer, chair ofthe Department of Family Medicine at TulaneUniversity and the first program director at theBaton Rouge General Family MedicineResidency Program, reminisced about our pastand challenged our current faculty and residentson the importance of family medicineand our role as physicians. gram has now graduated 37 physicians, 23 ofwhom are practicing in Louisiana. Our programowes its success to the dedication andhard work of our administrative and medicalstaff as well as community support, and weall owe them our thanks! Our new intern class has settled in to thepace and life in Lake Charles, and haveproved themselves to be energetic, drivenand eager to learn. To welcome them,Louisiana AHEC sponsored our yearly “Docon the Block,” which was a chance to socializewith and get to know the incoming class,as well as learn about practice opportunitiesin the surrounding area. Since then, theyhave hit the ground running and have blendedwell into our program. In community service news, we were recentlyinvolved in our annual high-school sportsphysicals, in which we processed and sawapproximately 600 high-school athletes thelast weekend of July. Many thanks to all ofthe residents who gave up their Saturdaymorning to help out. Many of our secondandthird-year residents have continued toparticipate in McNeese State University athleticphysicals under the direction of Dr.Bryan Barootes, our very own “in-house”sports medicine diplomat. Thanks to his commitment, the sports medicine program hascontinued to thrive and grow in numbers. Also in community service news, we are veryhappy to announce the “LSU at LCMHREADING FOR HEALTH” program, whichwas the brainchild of Dr. SherriStringfellow.
