27Paragraph (2) provides that the Indian Reorganization Act of1934 shall apply to the Yurok Tribe.Subsection (b) provides for the creation of an Interim Council forthe Yurok Tribe of five members to represent the Yurok Tribe inthe implementation of the Act and to act as the tribal governingbody until a tribal council is elected under the constitution to beadopted pursuant to this section.Subsection (c), paragraph (l), provides that the Secretary, within30 days of the deadline for election of options, shall prepare a listof all adults on the Settlement Roll who elected the Yurok Membershipoption who will constitute the eligible voters of the tribefor organizational purposes. The Secretary must send them noticeof date, time, purpose, and order of procedure of the general councilmeeting to be scheduled pursuant to paragraph (2).Paragraph (2) provides that, within a set time after such notice,the Secretary shall convene a general council meeting of the YurokTribe on or near the Yurok Reservation. The business of suchmeeting is to (1) adopt a resolution waiving any claims the tribemay have against the United States arising out of this Act and (2)to nominate candidates for election to the Interim Council. Onlypersons on the list prepared under paragraph (1) are eligible fornomination.Paragraph (3) provides that, within 45 days after the generalcouncil meeting, the Secretary shall conduct an election for the InterimCouncil from among the persons nominated. Absentee ballotingand write-in voting is to be permitted. The Secretary must giveeligible voters adequate notice of the election.Paragraph (4) requires the Secretary to certify the results of theelection and to convene an organizational meeting of the newlyelected Interim Council.Paragraph (5) provides that vacancies on the Council shall befilled by a vote of the other members.Subsection (d), paragraph (l), provides that the Interim Councilshall have no powers except those conferred by this Act.Paragraph (2) provides that the Council shall have full aut,horityto secure the benefits of Federal programs for the tribe and itsmembers, including those administered by the Secretary of the Interiorand the Secretar of Health and Human Services.Paragraph (3) provi dr es that the Council shall have such otherpowers as the Secretary normally recognizes in an Indian tribalgoverning body, except that it may not legally or contractuallybind the tribe for a period in excess of two years from the date ofelection.Paragraph (4) provides that the Interim Council shall appoint adrafting committee which shall be responsible for the developmentof draft constitution for submission to the Secretary.Paragraph (5) provides that the Interim Council shall be dissolvedupon election of the initial governing body under such constitutionwhen adopted or at the end of two years after their installation,whichever occurs first.Subsection (el provides that the Secretary, upon the request ofthe Interim Council and the submission of the draft constitution,shall take all steps necessary under the provisions of the IndianReorganization Act for the adoption of a tribal constitution and the
