iii)iv)the vendor shall be responsible for taking back up of data and programsavailable in PC, before attending the fault and shall be also responsible forreloading the same. The back up copies are to be returned to the user, underacknowledgment.If the equipment is required to be transported to the vendor's / manufacturer'sservice workshop for repairs , the same shall be undertaken at the risk and costof the vendor.v) The replacement of components, sub assys and assys shall be as permanufacturers instructions and as per the decision of MPCDF.vi)Above can be carried out at site or at the vendor's works after attending thecomplaint by replacement method and the same shall be done within 7 days ofthe receipt of complaints. the replacement of components, sub assys andassys shall be free of charge.2.7 The contract shall initially be for a period of one year from the date ofacceptance of the order.2.8 The contract at any time can be terminated by either party after serving advancenotice of three months. The MPCDF shall have the right to terminate the contractwithout assigning any reason whatsoever to the firm.3. Security Deposit3.1 Security deposit amounting to 10% of the value of the total AMC charges (not lessthan Rs. 5000/-) in the form of bank guarantee / fixed deposit / demand draft (fromnationalised bank only) is to be submitted within 15 days from the date of finalisationof the contract. The said bank gurantee will be valid for 15 months from the date ofwork order. In case the vendor fails to render the satisfactory services the same shallbe presented to the bank for getting it revoked.4. Penalty4.1 If the vendor does not attend the complaint within 24 hours from the time of complaintregistered to the resident engineer deployed by the vendor or to the telephone no.(given by the firm for lodging complaints, the penalty @ Rs. 100/- per equipment shallbe levied.4.2 Penalty shall be levied at the rate of Rs. 100/- for each equipment for each day(excluding first 24 hours, if the equipment is not set right within 7 days.4.3 If the fault is set right by replacing the defective sub-assembly, and equipment, thesame should be re-installed after servicing within 7 days (if 7th day falls on holidaythen next working day). In case of default penalty shall be levied at the rate of Rs.100/- per day for the scheduled item.3
