T2 (W) APPLICATION FORMRehabilitation of Offenders Act 1974Crimes against humanityThe Rehabilitation of Offenders Act 1974enables criminal convictions to become ‘spent’or ignored after a ‘rehabilitation period’. Thelength of the rehabilitation period depends onthe sentence given. For a custodial (prison)sentence the rehabilitation period is decidedby the original sentence, not the time served.Prison sentences of more than two and a halfyears can never become spent and shouldalways be disclosed. The fulldefinitions of war crimes, crimes againsthumanity and genocide can be found inSchedule 8 of the International CriminalCourt Act 2001 at www.opsi.gov.uk/acts/acts2001/20010017.htm or purchased fromThe Stationery Office (telephone 0870 6005522). It is the applicant’s responsibility tosatisfy him/herself that he/she is familiar withthe definitions and can answer the questionsaccurately.War crimesGrave breaches of the Geneva Conventionscommitted during an armed conflict. Thisincludes an internal armed conflict and aninternational armed conflict. The types of actsthat may constitute a war crime include wilfulkilling, torture, extensive destruction of propertynot justified by military necessity, unlawfuldeportation, the intentional targeting of civiliansand the taking of hostages.Acts committed at any time (not just duringarmed conflict) as part of a widespread orsystematic attack, directed against any civilianpopulation with knowledge of the attack. Thiswould include offences such as murder, torture,rape, severe deprivation of liberty in violationof fundamental rules of international law andenforced disappearance of persons.GenocideActs committed with intent to destroy, in wholeor in part, a national, ethnical, racial or religiousgroup.Terrorist activitiesAny act committed, or the threat of action,designed to influence a government orintimidate the public and made for thepurposes of advancing a political, religious orideological cause and that involves seriousviolence against a person; that may endangeranother person’s life; creates a serious riskto the health or safety of the public; involvesserious damage to property; is designed toseriously disrupt or interfere with an electronicsystem.Organisations concerned with terrorismAn organisation is concerned with terrorism ifit commits or participates in acts of terrorism;prepares for terrorism; promotes or encouragesterrorism (including the unlawful glorificationof terrorism); or is otherwise concerned interrorism.T2 (W) Application Form (Version 12/14) - page 23 of 42
