T2 (W) APPLICATION FORMneed to be regulated by <strong>the</strong> OISC, unless <strong>the</strong>yare authorised to practice by a designatedlegal professional body or fall within a categoryof persons specified in an order made by TheSecretary of State under subsection 84(4) (d)of <strong>the</strong> Immigration and Asylum Act 1999.The representative should indicate whe<strong>the</strong>rhe/she is regulated by <strong>the</strong> OISC, or <strong>the</strong> basison which he/she is o<strong>the</strong>rwise authorised toact in this capacity on <strong>the</strong> migrant’s behalf.An advisor could be committing a criminaloffence if he/she acts on your behalfwithout being OISC regulated, or o<strong>the</strong>rwiseauthorised in accordance with Section 84 of<strong>the</strong> Immigration and Asylum Act 1999.K13-K15 If <strong>the</strong> representative is regulatedby a designated legal professional body,listed below, or if he/she works under <strong>the</strong>supervision of such a person, <strong>the</strong>y will not berequired to be regulated by <strong>the</strong> OISC.Designated bodies are:• The Law Society;K16-K19 The representative shouldindicate whe<strong>the</strong>r he/she is registered with orauthorised by an EEA body responsible for<strong>the</strong> regulation of <strong>the</strong> provision of legal advicein that EEA state, or employed or supervisedby <strong>the</strong> person regulated as defined in Section84(2) (c) (d), and (e) of <strong>the</strong> Immigration andAsylum Act 1999.If a representative makes an <strong>application</strong>on behalf of an applicant, and thatrepresentative is not permitted to provideadvice and immigration services (by section84 of <strong>the</strong> Immigration and Asylum Act1999), <strong>the</strong> <strong>Home</strong> <strong>Office</strong> will in<strong>form</strong> both<strong>the</strong> representative and applicant of <strong>the</strong>requirements of <strong>the</strong> Act, and send fur<strong>the</strong>rletters (if applicable) directly to <strong>the</strong> applicantstated on <strong>the</strong> <strong>application</strong>.Section 5 You should complete <strong>the</strong> summarysheet before submitting your <strong>application</strong>.You should also ensure that you list all<strong>the</strong> supporting documentation you havesubmitted with your <strong>application</strong>.• The Law Society of Scotland;• The Law Society of Nor<strong>the</strong>rn Ireland;• The Institute of Legal Executives;• The General Council of <strong>the</strong> Bar;• The Faculty of Advocates;• The General Council of <strong>the</strong> Bar of Nor<strong>the</strong>rnIreland.The representative should indicate of whichorganisation he/she is a member. Therepresentative should indicate whe<strong>the</strong>rhe/she is personally a member of thisorganisation or whe<strong>the</strong>r he/she is workingunder <strong>the</strong> authorisation of ano<strong>the</strong>r registeredmember.Where <strong>the</strong> representative is not a directregistration holder and is working under <strong>the</strong>supervision of ano<strong>the</strong>r registered person, <strong>the</strong>representative should name <strong>the</strong> registeredsupervisor under whom he/she is working.T2 (W) Application Form (Version 12/14) - page 42 of 42
