<strong>What</strong> <strong>is</strong> <strong>an</strong> <strong>air</strong> <strong>permit</strong> <strong>from</strong> <strong>the</strong> <strong>Utah</strong> Div<strong>is</strong>ion <strong>of</strong> <strong>Air</strong> <strong>Quality</strong> ?<strong>An</strong> <strong>air</strong> <strong>permit</strong> describes a method or process by which a business may d<strong>is</strong>charge polluted (dirty) <strong>air</strong> into <strong>the</strong>atmosphere. The <strong>permit</strong> also describes <strong>the</strong> <strong>air</strong> pollution control method required for <strong>the</strong> level <strong>of</strong> em<strong>is</strong>sionsbeing d<strong>is</strong>charged <strong>from</strong> <strong>the</strong> comp<strong>an</strong>y. The <strong>permit</strong>ting process c<strong>an</strong> have two parts; 1) A construction <strong>permit</strong>,2) <strong>An</strong> operating <strong>permit</strong>. Both <strong>of</strong> <strong>the</strong>se <strong>permit</strong>s are dependent on your em<strong>is</strong>sion levels <strong>an</strong>d <strong>the</strong> processesbeing controlled.Who needs <strong>an</strong> <strong>air</strong> <strong>permit</strong> ?A business with equipment or a process which d<strong>is</strong>charges polluted <strong>air</strong> to <strong>the</strong> atmosphere <strong>is</strong> governed by <strong>the</strong><strong>Utah</strong> <strong>Air</strong> Conservation Rules. Not all businesses which have a d<strong>is</strong>charge are required to have <strong>an</strong> <strong>air</strong> <strong>permit</strong>;very small d<strong>is</strong>chargers (use <strong>the</strong> table below to see what level <strong>of</strong> <strong>permit</strong>ting <strong>is</strong> required for your em<strong>is</strong>sions),may use <strong>the</strong> small source exemption option instead <strong>of</strong> getting <strong>an</strong> <strong>air</strong> <strong>permit</strong>. Businesses along <strong>the</strong> WasatchFront with small d<strong>is</strong>charges need to submit a small source exemption reg<strong>is</strong>tration. Note: Certain businesstypes (see attachment with <strong>the</strong> small source reg<strong>is</strong>tration) are excluded <strong>from</strong> using <strong>the</strong> small sourceexemption as a <strong>permit</strong>ting option.Before starting construction a business should contact <strong>the</strong> <strong>Utah</strong> Div<strong>is</strong>ion <strong>of</strong> <strong>Air</strong> <strong>Quality</strong> to find out how toestimate <strong>the</strong>ir em<strong>is</strong>sions <strong>an</strong>d <strong>the</strong> minimum <strong>air</strong> pollution control equipment requirements. Forms <strong>an</strong>dass<strong>is</strong>t<strong>an</strong>ce providers are available. If a business <strong>is</strong> already operating, contacting <strong>the</strong> Div<strong>is</strong>ion to get intocompli<strong>an</strong>ce will minimize <strong>an</strong>y complications with <strong>an</strong> <strong>air</strong> quality inspection. <strong>What</strong> information do I need to submit in a small source exemption reg<strong>is</strong>tration ?The small source exemption reg<strong>is</strong>tration shall include <strong>the</strong> following minimum information:Comp<strong>an</strong>y NameAddressTelephone numberName <strong>of</strong> pl<strong>an</strong>t site m<strong>an</strong>ager or point <strong>of</strong> contactLocation <strong>of</strong> sourceA description <strong>of</strong> <strong>the</strong> nature <strong>of</strong> <strong>the</strong> processes involved, equipment, <strong>an</strong>ticipated qu<strong>an</strong>tities <strong>of</strong> materials used,<strong>the</strong> type <strong>an</strong>d qu<strong>an</strong>tity <strong>of</strong> fuel employed <strong>an</strong>d nature <strong>an</strong>d qu<strong>an</strong>tity <strong>of</strong> <strong>the</strong> fin<strong>is</strong>hed product.Identification <strong>of</strong> expected em<strong>is</strong>sions <strong>an</strong>d <strong>an</strong> estimate <strong>of</strong> <strong>the</strong> <strong>an</strong>nual em<strong>is</strong>sion rates. Include <strong>an</strong>y <strong>air</strong> pollutioncontrol apparatus used <strong>an</strong>d <strong>the</strong> typical operating schedule.The <strong>Utah</strong> Div<strong>is</strong>ion <strong>of</strong> <strong>Air</strong> <strong>Quality</strong> has a form available that meets <strong>the</strong> above reg<strong>is</strong>tration requirements. TheDiv<strong>is</strong>ion also has forms available to help you estimate em<strong>is</strong>sions.<strong>What</strong> <strong>is</strong> <strong>the</strong> process to receive <strong>an</strong> <strong>air</strong> <strong>permit</strong>, approval order ?The process <strong>of</strong> receiving <strong>an</strong> "<strong>air</strong> <strong>permit</strong>", or <strong>an</strong> Approval Order / Operating Permit, starts when <strong>the</strong> Div<strong>is</strong>ionreceives a "letter" called a Notice <strong>of</strong> Intent <strong>from</strong> a business. The Notice <strong>of</strong> Intent describes all <strong>the</strong> <strong>air</strong>d<strong>is</strong>charges <strong>from</strong> a business.If a <strong>permit</strong> <strong>is</strong> required <strong>an</strong> engineer will write <strong>an</strong> engineering review <strong>an</strong>d develop <strong>the</strong> conditions for <strong>the</strong> <strong>air</strong><strong>permit</strong>. The conditions state how <strong>the</strong> comp<strong>an</strong>y will d<strong>is</strong>charge to <strong>the</strong> <strong>air</strong>. When <strong>the</strong> review <strong>is</strong> complete, it <strong>is</strong>sent to <strong>the</strong> applic<strong>an</strong>t for <strong>the</strong>ir review <strong>an</strong>d comments. The Div<strong>is</strong>ion <strong>an</strong>d <strong>the</strong> applic<strong>an</strong>t d<strong>is</strong>cuss <strong>the</strong> engineeringreview <strong>an</strong>d <strong>the</strong> conditions <strong>of</strong> <strong>the</strong> <strong>permit</strong>. Conditions c<strong>an</strong> include operating control equipment as designed<strong>an</strong>d fuel type used for electric generation. When agreement <strong>is</strong> reached <strong>the</strong> em<strong>is</strong>sion levels are publ<strong>is</strong>hed in<strong>the</strong> applic<strong>an</strong>t's local newspaper for a 30 day public comment period. If <strong>the</strong>re are no comments <strong>the</strong> <strong>air</strong><strong>permit</strong>, Approval Order, <strong>is</strong> <strong>is</strong>sued based on <strong>the</strong> engineering review <strong>an</strong>d <strong>the</strong> agreed conditions.The last step <strong>of</strong> <strong>an</strong> <strong>air</strong> <strong>permit</strong> <strong>is</strong> <strong>an</strong> Operating Permit. The Operating Permit <strong>is</strong> a new program which mayaffect some small businesses in <strong>the</strong> future. Small businesses, if <strong>permit</strong>ted by th<strong>is</strong> program, will most likelybe <strong>permit</strong>ted through general <strong>permit</strong>s, st<strong>an</strong>dardized forms, phased in through <strong>the</strong> year 2000. <strong>An</strong> OperatingPermit, if required, <strong>is</strong> necessary only after <strong>the</strong> business begins operation. The Div<strong>is</strong>ion c<strong>an</strong> tell you if <strong>an</strong>Operating Permit will be required. <strong>An</strong> Operating Permit will typically have more reporting requirements th<strong>an</strong>a Approval Order.<strong>What</strong> do I need to tell <strong>the</strong> Div<strong>is</strong>ion to receive <strong>an</strong> <strong>air</strong> <strong>permit</strong> ?The comp<strong>an</strong>y sends <strong>the</strong> Div<strong>is</strong>ion a letter (Notice <strong>of</strong> Intent) with <strong>the</strong> following information:Comp<strong>an</strong>y NameAddressPl<strong>an</strong>t ContactPhone <strong>an</strong>d FAX NumberA complete description <strong>of</strong> <strong>the</strong> proposed process, including <strong>the</strong> following information:1. A l<strong>is</strong>t <strong>of</strong> <strong>the</strong> all process <strong>an</strong>d pollution control equipment d<strong>is</strong>charging to <strong>the</strong> <strong>air</strong> <strong>an</strong>d <strong>air</strong> contamin<strong>an</strong>ts whichcould be emitted to <strong>the</strong> atmosphere. Include <strong>air</strong> volumes being moved, space heating, hours <strong>of</strong> operationfor equipment, <strong>an</strong>d m<strong>an</strong>ufacturers= specifications if available; <strong>the</strong> flow rate <strong>from</strong> <strong>the</strong> exhaust <strong>an</strong>d <strong>the</strong>concentration in <strong>the</strong> exhaust <strong>of</strong> <strong>the</strong> <strong>air</strong> contamin<strong>an</strong>ts. Th<strong>is</strong> l<strong>is</strong>t should include <strong>the</strong> <strong>air</strong> contamin<strong>an</strong>ts whichcould be emitted as a result <strong>of</strong> equipment failure in <strong>the</strong> process or failure <strong>of</strong> pollution control equipment.3. Pollution control equipment has been determined for m<strong>an</strong>y processes <strong>an</strong>d c<strong>an</strong> be given to you by simplycalling <strong>the</strong> New Source Review Section. A filing fee <strong>is</strong> also charged, $500 for <strong>an</strong>ew minor source <strong>permit</strong> <strong>an</strong>d $250 for a small source exemption reg<strong>is</strong>tration. Permits have noexpiration, however as a business ch<strong>an</strong>ges, <strong>the</strong> em<strong>is</strong>sions <strong>from</strong> <strong>the</strong> business may also ch<strong>an</strong>ge, whichmay require updating <strong>the</strong> <strong>permit</strong>. <strong>An</strong> Operating Permit has a term <strong>of</strong> 5 years <strong>an</strong>d a fee <strong>is</strong> collectedyearly.
