TAX ISSUESIn your planning, do not overlook tax issues. There are several different kinds of taxes that maybe imposed—gift and estate taxes, inheritance taxes, income taxes and capital gains taxes. Inyour planning, consult your attorney or a tax accountant regarding these issues.SELECTING AN ATTORNEYIn selecting an attorney to assist you with these legal documents,select one that is familiar with:• Wills• Special Needs Trusts, other trust options and taximplications• Public benefits: SSI, SSA, Medicaid and Medicare• Other sources of income (e.g. pensions, survivorbenefits, annuities)• Guardianship and other alternatives• Health Insurance• Life Insurance• The capabilities and needs of your family member with a disability, and a generalawareness of community service options for people with disabilitiesOTHER HELPFUL TIPSFinancial planning usually involves developing ways to achieve your financial goals. A financialplanner may be an accountant, broker, or insurance agent who can offer comprehensivefinancial planning services. Select one with the same expectations you have for selecting anattorney.Not everyone will need a financial planner, but whether you do or not, be sure to compile andbe familiar with your own individual financial situation. You will need to review your total financialpicture and develop income goals that are most advantageous to you.Organize your important papers so they can be easily found. Be sure to include:• Birth certificates, marriage certificates, divorce papers, child support orders• Naturalization papers• Any other legal agreements• Stocks, bonds, CDs, IRAs, other investments• Deeds• Insurance Policies• Income tax returns• Financial records• Guardianship papers46Chapter 9, Making an Estate Plan
