TASK ORDERS ISSUED UNDER CNS & TMSection B.1.B.Due to the variety of services required under thecontracts and the circumstances that affect theirduration and definition, task orders may be issued ona firm fixed price (FFP), cost-plus-award-fee (CPAF),cost-plus-fixed-fee (CPFF) completion, or cost-plusfixed-fee(CPFF) term basis at the ContractingOfficer's discretion based on the guidelines providedin Part 16 of the Federal Acquisition Regulations.Performance-based task orders will be used to themaximum extent practicable.28


<strong>DTRT57</strong>-<strong>08</strong>-R-<strong>20002</strong> - AWARD EXCLUSIONSSection L.2.B.‣If an Offeror is currently a prime contractor underthe existing <strong>Volpe</strong> <strong>Center</strong> Small Business Set-Aside CNS it cannot be awarded a prime contractunder the Full and Open CNS solicitation.‣Contractors may not act as both a Primecontractor and a subcontractor under this Full andOpen CNS solicitation. Proposals involving suchteaming arrangements will be excluded fromconsideration29

<strong>DTRT57</strong>-<strong>08</strong>-R-<strong>20002</strong> – Section M Evaluation(cont.)‣Combined Technical evaluation factors are moreimportant than evaluated cost for the purpose ofmaking award.‣However, the importance of Cost should not beminimized because as the Technical rankings ofOfferors become closer, Cost becomes a moreimportant factor.32


<strong>DTRT57</strong>-<strong>08</strong>-R-<strong>20002</strong> – Section M Evaluation(cont.)‣Only relevant past performance history will beconsidered. The Government will determinerelevance of past performance information based onthe similarity of the nature of the previous work to thecurrent requirement (i.e., Section C), the dollar valueof the previous efforts (i.e., equal to or greater than$1,000,000), and the currency of the prior work (i.e.,within the past three years).‣If the Offeror does not include past performancehistory or does not affirmatively state that no pastperformance history exists or can be obtained, theOfferor’s proposal will be rated Unacceptable.33
