warranty obligations is to be extended, the Performance Securityshall correspondingly be extended for the extended period.63. AuthenticityofperformanceSecurity63.1 The Procuring Entity shall verify the authenticity of thePerformance Security submitted by the successful <strong>Tender</strong>er bysending a written request to the branch of the bank issuing the PayOrder, Bank Draft or irrevocable Bank Guarantee in specifiedformat.63.2 If the Performance Security submitted under ITT Sub Clause 60.2is not found to be authentic, the Procuring Entity shall proceed totake measures against the <strong>Tender</strong>er in accordance with Section64 of the Act and pursuant to Rule 127 of the Public ProcurementRules 2008.64. ContractSigning64.1 At the same time as the Procuring Entity issues the Notification ofAward, the Procuring Entity shall send the draft Contract Agreementand all documents forming the Contract pursuant to Rule 102 of thePublic Procurement Rules 2008, to the successful <strong>Tender</strong>er.64.2 Within twenty-eight (28) days of the issuance of Notification of Award,the successful <strong>Tender</strong>er and the Procuring Entity shall sign thecontract provided that the Performance Security submitted by the<strong>Tender</strong>er is found to be genuine.64.3 If the successful <strong>Tender</strong>er fails to provide the requiredPerformance Security, as stated under ITT Clause 60 or to signthe Contract, as stated under ITT Sub-Clause 64.2, ProcuringEntity shall proceed to award the Contract to the next lowestevaluated <strong>Tender</strong>er, and so on, by order of ranking pursuant toRule 102 of the Public Procurement Rules 2008.65. Publication ofNotification ofAward ofContract65.1 Notification of Awards for Contracts of Taka 10 (ten) million andabove shall be notified by the Procuring Entity to the CentralProcurement Technical Unit within 7 (seven) days of issuanceof the NOA for publication in their website, and that notice shallbe kept posted for not less than a month pursuant to Rule 37 ofthe Public Procurement Rules 2008.65.2 Notification of Award for Contracts below Taka 10 (ten) million,shall be published by the Procuring Entity on its Notice Boardand where applicable on the website of the Procuring Entity andthat notice shall be kept posted for not less than a monthpursuant to Rule 37 of the Public Procurement Rules 2008.66. Debriefing of<strong>Tender</strong>ers66.1 Debriefing of <strong>Tender</strong>ers by Procuring Entity shall outline therelative status and weakness only of his or her <strong>Tender</strong>requesting to be informed of the grounds for not accepting the<strong>Tender</strong> submitted by him or her pursuant to Rule 37 of thePublic Procurement Rules 2008, without disclosing informationabout any other <strong>Tender</strong>er.66.2 In the case of debriefing confidentiality of the evaluationprocess shall be maintained.67. Right toComplain67.1 Any <strong>Tender</strong>er has the right to complain if it has suffered or likely tosuffer loss or damage due to a failure of a duty imposed on theProcuring Entity to fulfil its obligations in accordance with Section 29of the Public Procurement Act 2006 and pursuant to Part 12 ofChapter Three of the Public Procurement Rules 2008.67.2 Circumstances in which a formal complaint may be lodged insequence by a potential <strong>Tender</strong>er against a Procuring Entity pursuantto Rule 56 of the Public Procurement Rules 2008, and the complaints,if any, be also processed pursuant to Rule 57 of the PublicProcurement Rules 2008.67.3 The potential <strong>Tender</strong>er shall submit his or her complaint in writingwithin seven (7) calendar days of becoming aware of thePG3/ EEE/ <strong>KUET</strong>/ HVLK 30
