An application <strong>f<strong>or</strong></strong> such a <strong>Certificate</strong> is sometimes appropriate in cases involvingproposed intensification <strong>of</strong> use <strong>or</strong> where the precise nature <strong>of</strong> the existing use isdifficult to describe because there is m<strong>or</strong>e than one use.In<strong>f<strong>or</strong></strong>mation To Be Provided With Application5. You must provide a location plan to identify clearly the site which is the subject<strong>of</strong> the application. This should be at a scale <strong>of</strong> 1:1250 <strong>or</strong> 1:2500 (<strong>or</strong> larger),showing the position <strong>of</strong> the site in relation to at least two named roads andsurrounding buildings and a n<strong>or</strong>th point shown. The site must be edged clearlywith a red line.6. The questions seek confirmation on a number <strong>of</strong> matters and all questions mustbe answered. However, you will need to provide additional in<strong>f<strong>or</strong></strong>mation anddocumentary evidence to supp<strong>or</strong>t your application.7. You must explain in your own w<strong>or</strong>ds why you consider a <strong>Certificate</strong> <strong>of</strong> <strong>Lawfulness</strong>should be granted. You should always remember that it is <strong>f<strong>or</strong></strong> you, the applicant,to provide sufficient evidence to satisfy the planning auth<strong>or</strong>ity that a <strong>Certificate</strong>must be issued. The evidence submitted should there<strong>f<strong>or</strong></strong>e be clear andconvincing.8. If any questions <strong>of</strong> fact are involved, the planning auth<strong>or</strong>ity may acceptstatements from persons who have a direct knowledge <strong>of</strong> those facts. It isn<strong>or</strong>mal to require such statements in the <strong>f<strong>or</strong></strong>m <strong>of</strong> an affidavit and you shouldthere<strong>f<strong>or</strong></strong>e seek advice from a Solicit<strong>or</strong> <strong>or</strong> Planning Agent. In some cases letters<strong>or</strong> unsw<strong>or</strong>n statements may be acceptable to provide collab<strong>or</strong>ative documentaryevidence.9. What The Planning Auth<strong>or</strong>ity Will Consider10. The onus is on the applicant to provide enough evidence to satisfy the planningauth<strong>or</strong>ity that planning permission is not needed <strong>f<strong>or</strong></strong> the proposals. Mereassertion on these points is not sufficient. If the planning auth<strong>or</strong>ity hasevidence, <strong>or</strong> reasonable grounds to believe that an assertion by the applicant isnot c<strong>or</strong>rect, it may refuse a <strong>Certificate</strong>.11. A <strong>Certificate</strong> <strong>of</strong> <strong>Lawfulness</strong> <strong>f<strong>or</strong></strong> a <strong>Proposed</strong> <strong>Use</strong> <strong>or</strong> <strong>Development</strong> is founded onlegal facts about the lawfulness <strong>of</strong> the proposed use <strong>or</strong> development. Theplanning merits <strong>of</strong> the use, operation <strong>or</strong> w<strong>or</strong>ks referred to in the application arenot relevant and will not be considered.What A <strong>Certificate</strong> Of <strong>Lawfulness</strong> Does12. Please note - the <strong>Certificate</strong> is not a planning permission. Section 151 <strong>of</strong>The Town and Country Planning (Scotland) Act 1997 sets out the detailedprovisions.13. A <strong>Certificate</strong> granted <strong>f<strong>or</strong></strong> a proposed use <strong>or</strong> operation will specify (by reference toa plan <strong>or</strong> drawing) the area <strong>of</strong> land included in the certificate and describe theprecise nature <strong>of</strong> the use, operation <strong>or</strong> activity which would be lawful if instituted<strong>or</strong> begun at the time <strong>of</strong> the application. The certificate will give the reason <strong>f<strong>or</strong></strong>determining the use <strong>or</strong> operation to be lawful and specify the date <strong>of</strong> theapplication <strong>f<strong>or</strong></strong> the certificate.14. A <strong>Certificate</strong> will protect you from en<strong>f<strong>or</strong></strong>cement action by the planning auth<strong>or</strong>ityunless you do not make a start to the proposed use <strong>or</strong> operations and there issome material change in circumstances. Also you may not subsequently changethe specified use “materially” without making a planning application <strong>f<strong>or</strong></strong> it. (F<strong>or</strong>example, a certificate may specify that a haulage contract<strong>or</strong>’s site may be usedlawfully <strong>f<strong>or</strong></strong> the st<strong>or</strong>age <strong>of</strong> goods as well as <strong>f<strong>or</strong></strong> parking <strong>of</strong> a defined number <strong>of</strong>heavy goods vehicles on a specified area <strong>of</strong> the site).NB: <strong>Certificate</strong>s <strong>of</strong> <strong>Lawfulness</strong> are not relevant to situations where breaches <strong>of</strong>listed building <strong>or</strong> conservation area controls may be alleged.WARNING: Section 153 <strong>of</strong> the 1997 Act provides that it is an <strong>of</strong>fence t<strong>of</strong>urnish false <strong>or</strong> misleading in<strong>f<strong>or</strong></strong>mation <strong>or</strong> to withhold materialin<strong>f<strong>or</strong></strong>mation with intent to deceive.
