(A-11) 70,- <strong>in</strong> exercise <strong>of</strong> <strong>the</strong> powers conferred by <strong>the</strong>proviso to article 309 <strong>of</strong> <strong>the</strong> constitution <strong>of</strong> India <strong>the</strong> governor <strong>of</strong> rajasthan makes<strong>the</strong> follow<strong>in</strong>g <strong>rules</strong> regulation <strong>the</strong> recruitment to posts <strong>in</strong> and <strong>the</strong> condition <strong>of</strong><strong>service</strong> <strong>of</strong> persons <strong>the</strong> appo<strong>in</strong>ted <strong>of</strong> <strong>the</strong> rajasthan technical education <strong>service</strong>,namely:THE RAJASTHAN TECHNICAL EDUCATION SERVICE RULES 1973PART – I General1 Short title and commencement – (1) These <strong>rules</strong> may be called <strong>the</strong> rajasthantechnical education <strong>service</strong> <strong>rules</strong> 1973(ii) They shall come <strong>in</strong>to force at once.2. Def<strong>in</strong>itions – <strong>in</strong> <strong>the</strong>se <strong>rules</strong>, unless <strong>the</strong> context o<strong>the</strong>r- wise requires:-(a) ‘’Appo<strong>in</strong>t<strong>in</strong>g Authority’’ means <strong>the</strong> government <strong>of</strong> rajasthan(b) “Commission” means <strong>the</strong> rajasthan public <strong>service</strong> commission(c) :Direct recruitment” means recruitment made accord<strong>in</strong>g to <strong>the</strong>Procedure prescribed <strong>in</strong> part IV <strong>of</strong> <strong>the</strong>se <strong>rules</strong>.(d) “Director” means <strong>the</strong> director <strong>of</strong> technical education rajasthan(e) “Government and state” means respectively <strong>the</strong> Government <strong>of</strong>rajasthan and <strong>the</strong> state <strong>of</strong> rajasthan,(f) “Member <strong>of</strong> <strong>the</strong> <strong>service</strong>” means a person appo<strong>in</strong>ted <strong>in</strong> a substantivecapacity to a post <strong>in</strong> <strong>the</strong> <strong>service</strong> under <strong>the</strong> provision <strong>of</strong> <strong>the</strong>se <strong>rules</strong> or<strong>the</strong> <strong>rules</strong> or orders superseded by <strong>the</strong>se <strong>rules</strong> and <strong>in</strong>cludes a probationer:(g) “Schedule” means a Schedule appended to <strong>the</strong>se <strong>rules</strong>:(h) “Service” means <strong>the</strong> rajasthan technical education <strong>service</strong> and(i) “Substantive Appo<strong>in</strong>tment” means an appo<strong>in</strong>tment made under <strong>the</strong>provisions <strong>of</strong> <strong>the</strong>se <strong>rules</strong> to a substantive vacancy after due selection bvy any <strong>of</strong><strong>the</strong> method <strong>of</strong> recruitment prescribed tender <strong>the</strong>se <strong>rules</strong> and <strong>in</strong>cludes anappo<strong>in</strong>tment on probation or as a probationer followed by confirmation on <strong>the</strong>completion <strong>of</strong> <strong>the</strong> probationary period.G.S.R. 67- AMENDMENTFor <strong>the</strong> exist<strong>in</strong>g clause to rule <strong>mentioned</strong> <strong>in</strong> <strong>column</strong> 3 aga<strong>in</strong>st <strong>each</strong> <strong>of</strong> <strong>the</strong> <strong>service</strong><strong>rules</strong> <strong>mentioned</strong> <strong>in</strong> <strong>column</strong>2, <strong>the</strong> follow<strong>in</strong>g shall be substituted, namely:-“<strong>service</strong>” <strong>of</strong> “Experience” wherever prescribed <strong>in</strong> <strong>the</strong>se <strong>rules</strong> as a condition forpromotion from one <strong>service</strong> to ano<strong>the</strong>r or with<strong>in</strong> <strong>the</strong> <strong>service</strong> from category toano<strong>the</strong>r or to senior posts ,<strong>in</strong> <strong>the</strong> case <strong>of</strong> a person hold<strong>in</strong>g a lower post eligible forpromotion to higher post shall <strong>in</strong>clude <strong>the</strong> period for which <strong>the</strong> person has


3PART II- Cadre4 Composition and strength <strong>of</strong> <strong>the</strong> <strong>service</strong> –(1) <strong>the</strong> nature <strong>of</strong> posts shallbe as specified <strong>in</strong> <strong>column</strong> 2 <strong>of</strong> <strong>the</strong> Schedule I(2) The strength <strong>of</strong> posts <strong>in</strong> <strong>the</strong> <strong>service</strong> shall be such as may be determ<strong>in</strong>edby <strong>the</strong> Government from time to time ,provided that <strong>the</strong> governmentmay(a) Create any post permanent or temporary , from time to time as may befound necessary and,(b) 1 The Government may create temporarily additional categories <strong>of</strong>posts <strong>in</strong> <strong>the</strong> <strong>service</strong> as specified <strong>in</strong> schedule –II appended to <strong>the</strong>se <strong>rules</strong>which shall rema<strong>in</strong> <strong>in</strong> force till such time such temporary posts <strong>in</strong> suchcategories are sanctioned2 The various conditions, pr<strong>in</strong>ciples and procedures conta<strong>in</strong>ed <strong>in</strong> <strong>the</strong>se<strong>rules</strong> except for substantive appo<strong>in</strong>tment s shall as for as mastitismutandisapplied to recruitment, appo<strong>in</strong>tment and <strong>in</strong> o<strong>the</strong>r matters tosuch temporary posts and subject to srch modifications as may bespecified <strong>in</strong> schedule II,3 Posts <strong>in</strong>cluded <strong>in</strong> schedule II shall be treated as an isolated and excadreposts and appo<strong>in</strong>tment <strong>the</strong>reto shall not confer any right on aperson for appo<strong>in</strong>tment confirmation, and seniority etc, for <strong>the</strong> posts<strong>in</strong>cluded <strong>in</strong> regular cadre posts <strong>of</strong> <strong>the</strong> schedule unless & until <strong>the</strong> postsare made3 permanent and categories are <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> permanentcadre,4 A holder <strong>of</strong> temporary post <strong>in</strong>cluded <strong>in</strong> schedule II shall also beeligible for promotion to higher temporary category <strong>of</strong> post <strong>in</strong>cluded <strong>in</strong>schedule II if he fulfills o<strong>the</strong>r conditions laid down <strong>in</strong> schedule,provided that <strong>in</strong> any <strong>service</strong> consist<strong>in</strong>g <strong>of</strong> sections or w<strong>in</strong>gs forpromotion, persons from outside <strong>the</strong> section or w<strong>in</strong>g shall not beconsidered for promotion unless o<strong>the</strong>r wise <strong>mentioned</strong> specifically.5 A member <strong>of</strong> <strong>service</strong> hall have precedence over a holder <strong>of</strong> temporarypost <strong>in</strong>cluded <strong>in</strong> schedule II where both are eligible.6 Provisions for determ<strong>in</strong>ation <strong>of</strong> seniority-<strong>in</strong>terse <strong>of</strong> holders <strong>of</strong> suchposts <strong>in</strong> schedule II shall, except for substantive appo<strong>in</strong>tment applymastitis-mutandis and a separate seniority shall be drawn for <strong>the</strong>m.


4The above amendment shall be deemed to have come <strong>in</strong>to force with effectfrom 29/10/1973*7, Reservation <strong>of</strong> vacancies for <strong>the</strong> scheduled castes and <strong>the</strong> scheduledTribes :- Reservation <strong>of</strong> vacancies for <strong>the</strong> scheduled castes and <strong>the</strong> scheduledTribes shall be <strong>in</strong> accordance with <strong>the</strong> orders <strong>of</strong> <strong>the</strong> government for suchreservation <strong>in</strong> force at <strong>the</strong> time <strong>of</strong> recruitment i.e. by direct recruitment and bypromotion.2 The vacancies so reserved for promotion shall be filled <strong>in</strong> by + (meritalone).3 In fill<strong>in</strong>g <strong>the</strong> vacancies so reserved <strong>the</strong> eligible candidates who aremembers <strong>of</strong> <strong>the</strong> scheduled castes and <strong>the</strong> scheduled tribes shall be considered forappo<strong>in</strong>tment <strong>in</strong> <strong>the</strong> order <strong>in</strong> which <strong>the</strong>ir names appear <strong>in</strong> <strong>the</strong> list prepared fordirect recruitment by <strong>the</strong> commission for posts fall<strong>in</strong>g <strong>in</strong> its purview and by <strong>the</strong>appo<strong>in</strong>t<strong>in</strong>g authority <strong>in</strong> o<strong>the</strong>r cases and <strong>the</strong> departmental promotion committee or<strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority as <strong>the</strong> case may be <strong>in</strong> <strong>the</strong> case <strong>of</strong> promote irrespective <strong>of</strong><strong>the</strong>ir relative rank as compared with o<strong>the</strong>r cadidates.%4 Appo<strong>in</strong>tment shall be made strictly <strong>in</strong> accordance with <strong>the</strong> rostersprescribed separately for direct recruitment and promotion <strong>in</strong> <strong>the</strong> event <strong>of</strong> nonavailability <strong>of</strong> <strong>the</strong> eligible and suitable candidates amongst scheduled castes andscheduled tribes as <strong>the</strong> case may be <strong>in</strong> a particular year <strong>the</strong> vacancies so reservedfor <strong>the</strong>m shall be filled <strong>in</strong> accordance with <strong>the</strong> normal procedure and anequivalent <strong>number</strong> <strong>of</strong> additional vacancies shall be reserved <strong>in</strong> <strong>the</strong> subsequentyear such <strong>of</strong> <strong>the</strong> vacancies which rema<strong>in</strong> so unfilled shall be carried forward to<strong>the</strong> subsequent three recruitment years <strong>in</strong> total, and <strong>the</strong>re after such reservationwould lapseProvided that <strong>the</strong>re shall be no carry forward <strong>of</strong> <strong>the</strong> vacancies <strong>in</strong> posts orclass/category /group <strong>of</strong> post <strong>in</strong> any cadre <strong>of</strong> <strong>service</strong> to which promotions aremade on <strong>the</strong> basis <strong>of</strong> @(merit alone,) under <strong>the</strong>se <strong>rules</strong>.* substituted for rule 7 reservation <strong>of</strong> vacancies for <strong>the</strong> scheduled castesand <strong>the</strong> scheduled tribes ;-1 Reservation <strong>of</strong> vacancies for <strong>the</strong> scheduledcastes and <strong>the</strong> scheduled tribes shall be <strong>in</strong> accordance


5AMENDMENT1 <strong>Aga<strong>in</strong>st</strong> <strong>each</strong> <strong>of</strong> <strong>the</strong> <strong>service</strong> <strong>rules</strong> <strong>mentioned</strong> <strong>in</strong> <strong>column</strong> <strong>number</strong> 2 <strong>of</strong> <strong>the</strong>schedule appended hereto, <strong>the</strong> follow<strong>in</strong>g new rule as <strong>mentioned</strong> <strong>in</strong> <strong>column</strong><strong>number</strong> 3 shall be Added, namely:-Reservation <strong>of</strong> vacancies for women candidates :-Reservation <strong>of</strong> vacancies for woman candidates shall be 20% category wise, <strong>in</strong>direct recruitment. In <strong>the</strong> event <strong>of</strong> non availability <strong>of</strong> <strong>the</strong> eligible and suitablewoman candidates <strong>in</strong> a particular year, <strong>the</strong> vacancies so reserved for <strong>the</strong>m shall befilled <strong>in</strong> accordance with <strong>the</strong> normal procedure and such vacancies shall not becarried forward to <strong>the</strong> subsequent year and <strong>the</strong> reservation shall be treated ashorizontal reservation i.e. <strong>the</strong> reservation <strong>of</strong> woman candidates shall be adjustedproportionately In <strong>the</strong> respective category to which <strong>the</strong> woman candidates belong.2 In <strong>the</strong> rule <strong>mentioned</strong> <strong>in</strong> <strong>column</strong> no. 4 aga<strong>in</strong>st <strong>each</strong> <strong>of</strong> <strong>the</strong> <strong>service</strong> <strong>rules</strong><strong>mentioned</strong> In <strong>column</strong> no 2 <strong>of</strong> <strong>the</strong> schedule appended hereto, <strong>the</strong> figure and word“6 & 6A, 7 & 7A, 8 & 8A, 9 & 9A” as <strong>the</strong> case may be , <strong>the</strong> word and figure “6,6A & 6B, 7, 7A & 7B, 8, 8A & 8B, 9, 9A & 9B, as <strong>the</strong> case may be, shall besubstituted.S.No. Name <strong>of</strong> Service Rules No. <strong>of</strong> New No. <strong>of</strong>Rules Rule32 Raj.Tech. 7*8-A Not with stand<strong>in</strong>g anyth<strong>in</strong>g conta<strong>in</strong>ed <strong>in</strong> <strong>the</strong>se <strong>rules</strong> provisionsregard<strong>in</strong>g eligibility for recruitment to <strong>the</strong> <strong>service</strong> with regard tonationality, age limit and fee or o<strong>the</strong>r concessions to a person who maymigrate from o<strong>the</strong>r countries to India with <strong>the</strong> <strong>in</strong>tention <strong>of</strong> permanentlysettl<strong>in</strong>g <strong>in</strong> India shall be regulated by such orders or <strong>in</strong>structions as maybe issued by <strong>the</strong> state Government from time to time and <strong>the</strong> same shallbe regulated mutatis mutandis accord<strong>in</strong>g to <strong>the</strong> <strong>in</strong>structions issued on<strong>the</strong> subject by <strong>the</strong> Government <strong>of</strong> India.9% Determ<strong>in</strong>ation <strong>of</strong> vacancies – 1 Subject to <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se<strong>rules</strong>, <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority shall be determ<strong>in</strong>ed <strong>each</strong> year <strong>the</strong> <strong>number</strong><strong>of</strong> vacancies anticipated dur<strong>in</strong>g <strong>the</strong> follow<strong>in</strong>g twelve months and <strong>the</strong><strong>number</strong> <strong>of</strong> persons likely to be recruited by <strong>each</strong> method. Suchvacancies shall be determ<strong>in</strong>ed aga<strong>in</strong> before <strong>the</strong> expiry <strong>of</strong> twelve months<strong>of</strong> <strong>the</strong> last determ<strong>in</strong>ation lf such vacancies.2 In calculation <strong>the</strong> actual <strong>number</strong> to be filled by <strong>each</strong> method on <strong>the</strong>basis <strong>of</strong> <strong>the</strong> percentage prescribed <strong>in</strong> <strong>column</strong> 3 <strong>of</strong> <strong>the</strong> schedule Iappended with relevant <strong>service</strong> <strong>rules</strong> <strong>each</strong> appo<strong>in</strong>t<strong>in</strong>g authority shalladopt an appropriate cyclic order to correspond with <strong>the</strong> proportion laiddown <strong>in</strong> <strong>each</strong> <strong>of</strong> <strong>the</strong> <strong>service</strong> <strong>rules</strong> and by giv<strong>in</strong>g percentage to promotionquota over direct recruitment quota e.g. where <strong>the</strong> appo<strong>in</strong>tment by directrecruitment and promotions <strong>in</strong> <strong>the</strong> percentage <strong>of</strong> 75 and 25, respectively<strong>the</strong> cycle shall run as follows:-1 By Promotion,2 By direct recruitment3 By direct recruitment4 By direct recruitment5 By Promotion6 By direct recruitment7 By direct recruitment8 By direct recruitment9 By Promotion, and so on• Added vide Notification No. f. (4) dop (a-11)/76, dated 20-6-1977% substituted for <strong>rules</strong> - Determ<strong>in</strong>ation <strong>of</strong> vacancies – 1 Subject to <strong>the</strong>provisions <strong>of</strong> <strong>the</strong>se <strong>rules</strong> <strong>the</strong> government shall determ<strong>in</strong>e at <strong>the</strong>commencement <strong>of</strong> <strong>each</strong> calendar year <strong>the</strong> <strong>number</strong> <strong>of</strong> vacanciesanticipated dur<strong>in</strong>g <strong>the</strong> year and <strong>the</strong> <strong>number</strong> <strong>of</strong> person likely to berecruited by <strong>each</strong> method.Provided that such vacancies as rema<strong>in</strong> unfilled for non availability<strong>of</strong> suitable candidates or o<strong>the</strong>r wise shall be carried forward from yearto yrs.


9above by more than three yrs <strong>the</strong>y shall be deemed to be with <strong>in</strong> <strong>the</strong>prescribed age limit.6 That <strong>the</strong> upper age limit <strong>mentioned</strong> above, shall be relaxed by 15 yrsfor <strong>the</strong> post <strong>of</strong> lecturers <strong>in</strong> <strong>the</strong> case <strong>of</strong> employees <strong>of</strong> <strong>the</strong> RajasthanTechnical Education sub ord<strong>in</strong>ary <strong>service</strong>7 Not with stand<strong>in</strong>g anyth<strong>in</strong>g conta<strong>in</strong>ed country <strong>in</strong> <strong>the</strong>se <strong>rules</strong> <strong>in</strong> <strong>the</strong>case <strong>of</strong> persons serv<strong>in</strong>g <strong>in</strong> connection with <strong>the</strong> affairs <strong>of</strong> <strong>the</strong> state <strong>in</strong>substantive capacity <strong>the</strong> upper age limit shall be 40 yrs. For directrecruitment to posts filled <strong>in</strong> by competitive exam<strong>in</strong>ation or <strong>in</strong> case<strong>of</strong> posts.• Inserted vide Notification No. f. 1(39) dop (a-11)/73, dated25/12/1974• Inserted vide Notification No. f. 28(30) edu./(Gr.-V)74, dated30/10/1974% <strong>in</strong>serted vide Notification No. f. 7(8) dop (a-11)/74, dated 31-12-1974Effective from 28/10/1974 corrigendum <strong>of</strong> even <strong>number</strong>dated25/7/1975Filled <strong>in</strong> through <strong>the</strong> commission by <strong>in</strong>terview this relaxation shall notapply to urgent temporary appo<strong>in</strong>tments@8 that <strong>the</strong> released emergency commissioned <strong>of</strong>ficers and short<strong>service</strong> commissioned <strong>of</strong>ficers after release from <strong>the</strong> army shall bedeemed to be with <strong>in</strong> <strong>the</strong> age limit even though <strong>the</strong>y gave crossed <strong>the</strong>age limit when <strong>the</strong>y appear before <strong>the</strong> commission had <strong>the</strong>y beeneligible as such at <strong>the</strong> time <strong>of</strong> <strong>the</strong>ir jo<strong>in</strong><strong>in</strong>g <strong>the</strong> commission <strong>in</strong> <strong>the</strong> army11 Academic and technical qualifications and experience a candidate fordirect recruitment to <strong>the</strong> posts enumerated <strong>in</strong> <strong>the</strong> schedule I shallpossess – 1 <strong>the</strong> qualifications and experience given <strong>in</strong> <strong>column</strong> 4 <strong>of</strong> <strong>the</strong>schedule and 2 work<strong>in</strong>g knowledge <strong>of</strong> H<strong>in</strong>di written <strong>in</strong> Devnagariscript and one <strong>of</strong> <strong>the</strong> Rajasthani dialects12 Character – <strong>the</strong> character <strong>of</strong> a candidate for direct recruitment to <strong>the</strong><strong>service</strong> must be such as will qualify him for employment <strong>in</strong> <strong>the</strong><strong>service</strong> hi must produce a certificate <strong>of</strong> good character from <strong>the</strong>pr<strong>in</strong>cipal academic <strong>of</strong>ficer <strong>of</strong> <strong>the</strong> university <strong>of</strong> college or school <strong>in</strong>which he was last educated and two such certificates written not morethan six months prior to <strong>the</strong> date <strong>of</strong> application, from two responsiblepersons not connected with his collage or university or school and notrelated to him.

Those who areconvicted <strong>of</strong> <strong>of</strong>fences not <strong>in</strong>volv<strong>in</strong>g moral turpitude shall be deemed tohave been completely reformed on <strong>the</strong> production <strong>of</strong> a report to thateffect from <strong>the</strong> Super<strong>in</strong>tendent. After care home or if <strong>the</strong>re are no suchhomes <strong>in</strong> a particulars district from <strong>the</strong> Super<strong>in</strong>tendent <strong>of</strong> police <strong>of</strong> thatdistrict.3 Those convicted <strong>of</strong> <strong>of</strong>fences <strong>in</strong>volves moral turpitude shall berequired to produce a certificate from <strong>the</strong> super<strong>in</strong>tendent. After carehome endorsed by <strong>the</strong> <strong>in</strong>spector General <strong>of</strong> prisons <strong>in</strong> <strong>the</strong> effect that <strong>the</strong>yare suitable for employment as <strong>the</strong>y have proved to.• Inserted vide Notification No. f. 7(2) dop (a-11)/75, dated 20/9/1975Be completely reformed by <strong>the</strong>ir discipl<strong>in</strong>ed life while <strong>in</strong> prison and by<strong>the</strong>ir subsequent goo conduct <strong>in</strong> an After care home.13 Physical Fitness:- A candidate for direct recruitment to <strong>the</strong> <strong>service</strong>must be <strong>in</strong> good mental and bodily health and free from any mental orphysical defect likely to <strong>in</strong>terfere with <strong>the</strong> efficient performance <strong>of</strong>his duties as a member <strong>of</strong> <strong>the</strong> <strong>service</strong> and <strong>of</strong> selected, must produce acertificate to that effect from a medical Authority notified by <strong>the</strong>Government for <strong>the</strong> <strong>the</strong> purpose.14 Employment by irregular or improper means –A candidate who is orhas been declared by <strong>the</strong> commission/Appo<strong>in</strong>t<strong>in</strong>g Authority as <strong>the</strong>case may be guilty <strong>of</strong> impersonation or <strong>of</strong> submitt<strong>in</strong>g fabricateddocument or documents which have been tampered with or <strong>of</strong> mak<strong>in</strong>gstatements which are <strong>in</strong>correct or false or <strong>of</strong> suppress<strong>in</strong>g material<strong>in</strong>formation or <strong>of</strong> us<strong>in</strong>g or attempt<strong>in</strong>g to use unfair means <strong>in</strong> <strong>the</strong>exam<strong>in</strong>ation or <strong>in</strong>terview or o<strong>the</strong>r wise resort<strong>in</strong>g to any o<strong>the</strong>rirregular or improper means for obta<strong>in</strong><strong>in</strong>g admission to <strong>the</strong>exam<strong>in</strong>ation or <strong>in</strong>terview may <strong>in</strong> addition to render<strong>in</strong>g him self liable


11to crim<strong>in</strong>al prosecution be debarred ei<strong>the</strong>r permanently or for aspecified period:-(a) by <strong>the</strong> commission from <strong>the</strong> admission to any exam<strong>in</strong>ation orappearance at any <strong>in</strong>terview held by <strong>the</strong> commission or <strong>the</strong>Government for selection <strong>of</strong> candidate and(b) By <strong>the</strong> Government from employment under <strong>the</strong> Government.15 Canvass<strong>in</strong>g: - No recommendation for recruitment ei<strong>the</strong>r written ororal o<strong>the</strong>r than that required under <strong>the</strong> <strong>rules</strong> shall be taken <strong>in</strong>toconsideration any attempt on <strong>the</strong> part <strong>of</strong> a candidate to enlist supportdirectly or <strong>in</strong>directly for his candidature by any means may disqualifyhim for recruitment.PART IV- Procedure for direct Recruitment.16 Invit<strong>in</strong>g <strong>of</strong> applications: - Applications for direct recruitment to posts<strong>in</strong> <strong>the</strong> <strong>service</strong> shall be <strong>in</strong>vited by commission by advertis<strong>in</strong>g <strong>the</strong>vacancies to be filled <strong>in</strong> <strong>the</strong> <strong>of</strong>ficial gazette or <strong>in</strong> such o<strong>the</strong>r manner asmay be deemed fit.17 Form <strong>of</strong> application <strong>the</strong> application shall be made <strong>in</strong> <strong>the</strong> formapproved b <strong>the</strong> commission and obta<strong>in</strong>able from <strong>the</strong> secretary to <strong>the</strong>commission on payment <strong>of</strong> such fee as <strong>the</strong> commission may fromtime fix18 Application fee- A candidate for direct recruitment to a post <strong>in</strong> <strong>the</strong><strong>service</strong> must pay <strong>the</strong> fee fixed by <strong>the</strong> commission <strong>in</strong> such manner asmay be <strong>in</strong>dicated by <strong>the</strong>m19 Scrut<strong>in</strong>y <strong>of</strong> application <strong>the</strong> commission shall scrut<strong>in</strong>ize <strong>the</strong>applications received by <strong>the</strong>m and require as many candidatesqualified for appo<strong>in</strong>tment under <strong>the</strong>se <strong>rules</strong> as seem to <strong>the</strong>m desirableto appear <strong>the</strong>m for <strong>in</strong>terview.Provided that <strong>the</strong> decision <strong>of</strong> <strong>the</strong> commission regard<strong>in</strong>g <strong>the</strong> eligibility oro<strong>the</strong>rwise <strong>of</strong> a candidate shall be f<strong>in</strong>al20. Recommendation <strong>of</strong> <strong>the</strong> commission <strong>the</strong> commission shall prepare alist <strong>of</strong> <strong>the</strong> candidates whom <strong>the</strong>y consider suitable for appo<strong>in</strong>tment to<strong>the</strong> posts concerned and arrange <strong>in</strong> <strong>the</strong> order <strong>of</strong> merit <strong>the</strong> commissionshall forward such list to <strong>the</strong> Government.Provided that <strong>the</strong> commission may to <strong>the</strong> extent <strong>of</strong> 50% <strong>of</strong> <strong>the</strong>advertised vacancies, keep names <strong>of</strong> suitable candidates on <strong>the</strong> reserve

The commission may on requisition, recommend <strong>the</strong> names <strong>of</strong> suchcandidates <strong>in</strong> order <strong>of</strong> merit to <strong>the</strong> Government.21. Disqualification for appo<strong>in</strong>tment – 1 No male candidates whohas more than one wife liv<strong>in</strong>g shall be eligible for appo<strong>in</strong>tment to <strong>the</strong><strong>service</strong> unless <strong>the</strong> Government after be<strong>in</strong>g satisfied that <strong>the</strong>re are specialgrounds for do<strong>in</strong>g so, exempt any candidates from <strong>the</strong> operation <strong>of</strong> this<strong>rules</strong>.(2) No. female candidates who is married to a person hav<strong>in</strong>g alreadya wife liv<strong>in</strong>g shall e eligible for appo<strong>in</strong>tment to <strong>the</strong> <strong>service</strong> unless <strong>the</strong>Government after be<strong>in</strong>g satisfied that <strong>the</strong>re are special grounds fordo<strong>in</strong>g so exempt any female candidates from <strong>the</strong> operation <strong>of</strong> this <strong>rules</strong>(3) Deleted(4) No. married candidates shall be eligible for appo<strong>in</strong>tment to <strong>the</strong><strong>service</strong> if he/she had at <strong>the</strong> time <strong>of</strong> his/her marriage accepted anydowry.Explanation:- For <strong>the</strong> purpose <strong>of</strong> this rule dowry has <strong>the</strong> samemean<strong>in</strong>g as In <strong>the</strong> dowry prohibition Act. 1961 (Central Act 28 <strong>of</strong> 1961)22 Selection by <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority: - Subject to <strong>the</strong> provision <strong>of</strong>rule 7 <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority shall select candidates who stand highest<strong>in</strong> <strong>the</strong> order <strong>of</strong> merit <strong>in</strong> <strong>the</strong> list prepared under rule 20provided that <strong>the</strong> <strong>in</strong>clusion <strong>of</strong> a candidates name <strong>in</strong> <strong>the</strong> <strong>in</strong> <strong>the</strong> listconfers no right to appo<strong>in</strong>tment unless <strong>the</strong> Government is satisfied aftersuch enquiry as may be considered necessary that such candidates aresuitable <strong>in</strong> all o<strong>the</strong>r respects for appo<strong>in</strong>tment to <strong>the</strong> posts concerned.PART V- Procedure for recruitment by promotion23 Eligibility and criteria for selection <strong>the</strong> persons enumerated <strong>in</strong><strong>column</strong> 5 <strong>of</strong> <strong>the</strong> schedule I shall be eligible on <strong>the</strong> basis <strong>of</strong> merit andseniority cum merit for promotion to such post specified <strong>in</strong> <strong>column</strong> 2 to<strong>the</strong> extent <strong>in</strong>dicated <strong>in</strong> <strong>column</strong> 3 subject to <strong>the</strong>ir possess<strong>in</strong>g m<strong>in</strong>imumqualifications and experience *(on <strong>the</strong> first day <strong>of</strong> <strong>the</strong> month <strong>of</strong> April <strong>of</strong><strong>the</strong> year <strong>of</strong> selection as specified <strong>in</strong> <strong>column</strong> 6 <strong>in</strong> <strong>the</strong> ratio <strong>of</strong> 1:2)%Explanation :- In case direct recruitment to a post has been madeearlier than regular selection for promotion <strong>in</strong> a particular yrs such <strong>of</strong><strong>the</strong> persons who are or were eligible for appo<strong>in</strong>tment to that post byboth <strong>the</strong> methods <strong>of</strong> recruitment and have been appo<strong>in</strong>ted by directrecruitment first, shall also be considered for promotion

No. <strong>of</strong>ficer shall be considered for promotion unless his issubstantively appo<strong>in</strong>ted and confirmed on <strong>the</strong> next lower post if no<strong>of</strong>ficer substantive <strong>in</strong> next lower post is eligible for promotion <strong>of</strong>ficerswho have been appo<strong>in</strong>ted on such post on <strong>of</strong>ficiat<strong>in</strong>g basis afterselection <strong>in</strong> accordance with one <strong>of</strong> <strong>the</strong> methods <strong>of</strong> recruitment <strong>of</strong> underany <strong>service</strong> <strong>rules</strong> promulgated under proviso to Article 309 <strong>of</strong> <strong>the</strong>constitution <strong>of</strong> India may be considered for promotion on <strong>of</strong>ficiat<strong>in</strong>gbasis only <strong>in</strong> <strong>the</strong> order <strong>of</strong> seniority <strong>in</strong> which <strong>the</strong>y would have been had<strong>the</strong>y been substantive on <strong>the</strong> said lower post24 Procedure for selection on <strong>the</strong> basis <strong>of</strong> seniority cum merit:-1 As soon as itis decided that a certa<strong>in</strong> <strong>number</strong> <strong>of</strong> posts shall be filled by promotion <strong>the</strong>secretary <strong>in</strong> education department shall prepare a correct and completelist conta<strong>in</strong><strong>in</strong>g names not exceed<strong>in</strong>g five times <strong>the</strong> <strong>number</strong> <strong>of</strong> vacanciesout <strong>of</strong> <strong>the</strong> senior most rersons who are qualified under <strong>the</strong> <strong>rules</strong> forpromotion to <strong>the</strong> class <strong>of</strong> post concerned .(2) (a) A committee consist<strong>in</strong>g <strong>of</strong> <strong>the</strong> chairman <strong>of</strong> <strong>the</strong> commission or amember <strong>the</strong>re <strong>of</strong> nom<strong>in</strong>ated by him <strong>the</strong> secretary to Government <strong>in</strong> <strong>the</strong>education department @ (or <strong>the</strong> special secretary concerned nom<strong>in</strong>atedby him). 14(d) The committee may co-opt suitable experts to assist <strong>the</strong>committee In select<strong>in</strong>g <strong>the</strong> candidates or <strong>the</strong> secretary educationshall act member secretary(3) The committee shall also prepare a separate list conta<strong>in</strong><strong>in</strong>g names<strong>of</strong> persons who may be selected to fill <strong>of</strong>ficiat<strong>in</strong>g vacancies alreadyexist<strong>in</strong>g or are lidely to occur till <strong>the</strong> next meet<strong>in</strong>g <strong>of</strong> <strong>the</strong> committee.(a) <strong>the</strong> list so prepared shall be reviewed and revised everyyear(b) <strong>the</strong> list shall ord<strong>in</strong>arily be <strong>in</strong> force until it is reviewed orrevised <strong>in</strong> accordance with clause (a) <strong>of</strong> sub rule (j)(4) The names <strong>of</strong> <strong>the</strong> candidates selected as suitable shall bearranged <strong>in</strong> <strong>the</strong> order <strong>of</strong> seniority.(5) The list prepared by <strong>the</strong> committee shall be sent to <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>gAuthority.(6) Where consultation with <strong>the</strong> commission is necessary <strong>the</strong> list sprepared <strong>in</strong> accordance with sub <strong>rules</strong> (2) and (3) shall be forwardedto <strong>the</strong> commission be <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g Authority along with (a) <strong>the</strong>confidential rolls and <strong>the</strong> personal files <strong>of</strong> all <strong>of</strong>ficers whose namesare <strong>in</strong>dicated <strong>in</strong> <strong>the</strong> lists (b) <strong>the</strong> confidential rolls and personal files<strong>of</strong> <strong>of</strong>ficers who are proposed to be superseded by <strong>the</strong>recommendations made by <strong>the</strong> committee .(7) The commission shall consider <strong>the</strong> list prepared by <strong>the</strong> committeealong with <strong>the</strong> o<strong>the</strong>r documents received from <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>gAuthority and unless <strong>the</strong>y consider it necessary to make any change<strong>in</strong> <strong>the</strong> list received from <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g Authority <strong>the</strong> commissionshall <strong>in</strong>form <strong>the</strong> a authority <strong>of</strong> <strong>the</strong> changes proposed and after talk<strong>in</strong>g<strong>in</strong>to account <strong>the</strong> comment <strong>of</strong> <strong>the</strong> commission if any <strong>the</strong> a authoritymay approve <strong>the</strong> list f<strong>in</strong>ally with such modifications as may <strong>in</strong> hisop<strong>in</strong>ion be just and proper.Rules 24- Provided that <strong>in</strong> case any member <strong>of</strong> member secretary as<strong>the</strong> case may be constitut<strong>in</strong>g <strong>the</strong> committee has not been a to <strong>the</strong> postfor <strong>the</strong> time be<strong>in</strong>g shall be <strong>the</strong> member <strong>of</strong> member secretary, as <strong>the</strong>case may be, <strong>of</strong> <strong>the</strong> committee.(Notification dated 21.2.78Effective from7.3.78)


15Rules 25 (3) No person shall be considered for first promotion <strong>in</strong> <strong>service</strong> unlesshe is substantively appo<strong>in</strong>ted and confirmed on <strong>the</strong> lowest post <strong>in</strong> <strong>the</strong> <strong>service</strong> afterfirst promotion <strong>in</strong> <strong>the</strong> <strong>service</strong> for subsequent promotions to higher posts <strong>in</strong> <strong>the</strong><strong>service</strong> a person shall be eligible if he has been appo<strong>in</strong>ted to such post fromwhich promotion is to be made after selection <strong>in</strong> accordance with one <strong>of</strong> <strong>the</strong>methods <strong>of</strong> recruitment under proviso to article 309 <strong>of</strong> <strong>the</strong> constitution <strong>of</strong> India.(Substituted vide Notification dated 20.7.79)Provided that for first promotion <strong>in</strong> <strong>the</strong> <strong>service</strong> if <strong>number</strong> <strong>of</strong> personssubstantively appo<strong>in</strong>ted and confirmed on <strong>the</strong> lowest post equal to <strong>the</strong> member <strong>of</strong>vacancies are not available than persons who have been appo<strong>in</strong>ted to <strong>the</strong> lowestpost <strong>in</strong> <strong>the</strong> <strong>service</strong> after selection <strong>in</strong> accordance with one <strong>of</strong> <strong>the</strong> methods <strong>of</strong>recruitment prescribed under <strong>the</strong>se <strong>rules</strong>, shall also be eligible if <strong>the</strong>y fulfill o<strong>the</strong>rconditions <strong>of</strong> eligibility.(Added vide Notification dated 13.5.80)@25 – Revised criteria Eligibility and procedure for promotion to junior,senior and o<strong>the</strong>r pots encadred <strong>in</strong> <strong>the</strong> <strong>service</strong> :-(1) As soon as <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g Authority determ<strong>in</strong>es <strong>the</strong> member <strong>of</strong> vacanciesunder rule regard<strong>in</strong>g determ<strong>in</strong>ation <strong>of</strong> vacancies <strong>of</strong> <strong>the</strong>se <strong>rules</strong> and decides thata certa<strong>in</strong> <strong>number</strong> <strong>of</strong> posts are required to be filled <strong>in</strong> by promotion it shallsubject to provisions <strong>of</strong> sub rule (9) prepare a correct and complete list <strong>of</strong> <strong>the</strong>senior most persons who are eligible and qualified under <strong>the</strong>se <strong>rules</strong> forpromotion on <strong>the</strong> basis <strong>of</strong> seniority cum merit or on <strong>the</strong> basis <strong>of</strong> merit to <strong>the</strong>class <strong>of</strong> posts concerned(2) Te persons enumerated <strong>in</strong> <strong>column</strong> 5 or <strong>the</strong> relevant <strong>column</strong> regard<strong>in</strong>g postfrom which promotion is to be made as <strong>the</strong> case may be <strong>of</strong> <strong>the</strong> relevantschedule I shall be eligible for promotion to posts specified aga<strong>in</strong>st <strong>the</strong>m <strong>in</strong><strong>column</strong> 2 <strong>the</strong>re <strong>of</strong> to <strong>the</strong> extent <strong>in</strong>dicated <strong>in</strong> <strong>column</strong> 3 subject to <strong>the</strong>irpossession m<strong>in</strong>imum qualifications and experience on <strong>the</strong> first day <strong>of</strong> <strong>the</strong>month <strong>of</strong> April <strong>of</strong> <strong>the</strong> yrs <strong>of</strong> selection as specified <strong>in</strong> <strong>column</strong> 6 or <strong>in</strong> <strong>the</strong>relevant <strong>column</strong> regard<strong>in</strong>g m<strong>in</strong>imum qualification and experience forpromotion as <strong>the</strong> case may be.(3) No person shall be considered for promotion unless he is substantivelyappo<strong>in</strong>ted and confirmed. <strong>the</strong> personswho are or sere eligible for appo<strong>in</strong>tment to that post by both <strong>the</strong> methods<strong>of</strong> recruitment and have been appo<strong>in</strong>ted by direct recruitment first shallalso be considered for promotion.(4) Selection for promotion <strong>in</strong> <strong>the</strong> regular l<strong>in</strong>e <strong>of</strong> promotion from <strong>the</strong> post/postsnot <strong>in</strong>cluded <strong>in</strong> <strong>service</strong> to <strong>the</strong> lowest post or category <strong>of</strong> post <strong>in</strong> <strong>the</strong> <strong>service</strong>shall be made strictly on <strong>the</strong> basis <strong>of</strong> merit and on <strong>the</strong> basis <strong>of</strong> seniority-commerit<strong>in</strong> <strong>the</strong> promotion <strong>of</strong> 50:50Provided that if <strong>the</strong> committee is satisfied that suitable person are notavailable for selection by promotion strictly on <strong>the</strong> basis <strong>of</strong> merit <strong>in</strong> aparticular yrs selection by promotion on <strong>the</strong> basis <strong>of</strong> seniority cum meritmay be made <strong>in</strong> <strong>the</strong> same manner as specified <strong>in</strong> <strong>the</strong>se <strong>rules</strong>(5) Subject to <strong>the</strong> provisions <strong>of</strong> sub rule (7) selection for promotion from <strong>the</strong>lowest post or category <strong>of</strong> post <strong>in</strong> <strong>the</strong> state <strong>service</strong> to <strong>the</strong> next higher post orcategory <strong>of</strong> post <strong>in</strong> <strong>the</strong> state <strong>service</strong> and for all posts <strong>in</strong> <strong>the</strong> subord<strong>in</strong>ate<strong>service</strong>s and <strong>in</strong> <strong>the</strong> m<strong>in</strong>isterial <strong>service</strong>s shall be made strictly on <strong>the</strong> basis <strong>of</strong>seniority cum merit from amongst <strong>the</strong> persons who have passed <strong>the</strong> qualify<strong>in</strong>gexam<strong>in</strong>ation if any prescribed under <strong>the</strong>se <strong>rules</strong> and have put <strong>in</strong> at least liveyrs <strong>service</strong> unless a different period is prescribed else where <strong>in</strong> <strong>the</strong>se <strong>rules</strong> on<strong>the</strong> first day <strong>of</strong> <strong>the</strong> month <strong>of</strong> April <strong>of</strong> <strong>the</strong> yrs <strong>of</strong> selection <strong>of</strong> <strong>the</strong> post orcategory <strong>of</strong> post from which selection is to be made.Provided that <strong>in</strong> <strong>the</strong> event <strong>of</strong> non availability <strong>of</strong> <strong>the</strong> persons with <strong>the</strong> requisiteperiod <strong>of</strong> <strong>service</strong> <strong>of</strong> five yrs <strong>the</strong> committee may consider <strong>the</strong> persons hav<strong>in</strong>gless than <strong>the</strong> prescribed period <strong>of</strong> <strong>service</strong> if <strong>the</strong>y fulfill <strong>the</strong> qualifications ando<strong>the</strong>r condition for promotion prescribed elsewhere <strong>in</strong> <strong>the</strong>se <strong>rules</strong> and arefound o<strong>the</strong>rwise suitable for promotion on <strong>the</strong> basis <strong>of</strong> seniority com merit(6) Selection for promotion to all o<strong>the</strong>r higher post or higher categories <strong>of</strong> post <strong>in</strong><strong>the</strong> state <strong>service</strong> shall be made on <strong>the</strong> basis <strong>of</strong> merit and on <strong>the</strong> basis <strong>of</strong>seniority cum merit <strong>in</strong> <strong>the</strong> proportion <strong>of</strong> 50:50Provided that if <strong>the</strong> committee is satisfied that suitable persons are notavailable for selection by promotion strictly on <strong>the</strong> basis <strong>of</strong> merit <strong>in</strong> aparticular yrs selection by promotion on <strong>the</strong> <strong>of</strong> seniority cum merit may bemade <strong>in</strong> <strong>the</strong> same manner as specified <strong>in</strong> <strong>the</strong>se <strong>rules</strong>.(7) Selection for promotion to <strong>the</strong> highest post/posts <strong>in</strong> <strong>the</strong> state <strong>service</strong> shallalways be made on <strong>the</strong> basis <strong>of</strong> merit aloneProvided that-(a) In a 17(b) In a <strong>service</strong> or groups or sections <strong>the</strong>re under where <strong>the</strong>re are three scalese.g. junior scale, senior scale and selection scale and <strong>the</strong>re are twopromotion <strong>the</strong>n promotion shall be as under:-(i) First promotion on <strong>the</strong> basis <strong>of</strong> seniority cum merit.(ii) Second promotion on <strong>the</strong> basis <strong>of</strong> seniority cum merit and merit <strong>in</strong> <strong>the</strong>promotion <strong>of</strong>50:50(c) In <strong>service</strong>s or groups or sections <strong>the</strong>re under where <strong>the</strong>re are more thantwo promotion <strong>the</strong>n first promotion shall be made on <strong>the</strong> basis <strong>of</strong> senioritycum merit alone and promotion to subsequent higher post shall be made on<strong>the</strong> basis <strong>of</strong> seniority cum merit and merit <strong>in</strong> <strong>the</strong> proportion <strong>of</strong> 50:50 exceptto <strong>the</strong> highest post* Substituted for “sub-<strong>rules</strong>” (7) selection for promotion to <strong>the</strong> highest post or highest categories <strong>of</strong>posts <strong>in</strong> <strong>the</strong> state <strong>service</strong> shall always be made on <strong>the</strong> basis <strong>of</strong> merit alone “vide Notification No. f.7(10) dop (a-11)/77, dated 12/5/1978(8) The persons hav<strong>in</strong>g been selected and appo<strong>in</strong>ted b promotion to a post orcategory <strong>of</strong> post on <strong>the</strong> basis <strong>of</strong> merit shall be eligible for promotion to <strong>the</strong>next higher post or category <strong>of</strong> post which is to be filled <strong>in</strong> by merit only when<strong>the</strong>y gave put <strong>in</strong> after regular selection at least five yrs <strong>service</strong> unless a higherperiod <strong>of</strong> <strong>service</strong> is prescribed else where <strong>in</strong> <strong>the</strong>se <strong>rules</strong> on <strong>the</strong> first day <strong>of</strong> <strong>the</strong>month <strong>of</strong> April <strong>of</strong> <strong>the</strong> yrs <strong>of</strong> selection on <strong>the</strong> post or category <strong>of</strong> post fromwhich selection is to be made.Provided that <strong>the</strong> condition <strong>of</strong> five yrs <strong>service</strong> shall not be applicable to aperson if any person junior to him is eligible for consideration for promotionon <strong>the</strong> basis <strong>of</strong> merit.Provided fur<strong>the</strong>r that <strong>in</strong> <strong>the</strong> event or non availability <strong>of</strong> persons equal to <strong>the</strong><strong>number</strong> <strong>of</strong> vacancies to be filled <strong>in</strong> eligible for promotion <strong>in</strong> <strong>the</strong> category <strong>of</strong>posts next <strong>the</strong> lower from which promotion is made <strong>the</strong> committee mayconsider <strong>the</strong> persons hav<strong>in</strong>g less than five yrs <strong>service</strong> if <strong>the</strong>y are foundo<strong>the</strong>rwise suitable for promotion on <strong>the</strong> basis <strong>of</strong> merit aloneExplanation: - If any doubt arises about <strong>the</strong> categorization <strong>of</strong> <strong>the</strong> post as <strong>the</strong>lowest, next higher or highest post <strong>in</strong> <strong>the</strong> <strong>service</strong> <strong>the</strong> matter shall be referred to<strong>the</strong> Government <strong>in</strong> <strong>the</strong> Department <strong>of</strong> personnel and Adm<strong>in</strong>istrative Reformswhose decision <strong>the</strong>reon shall be f<strong>in</strong>al.


18(8) The zone <strong>of</strong> consideration <strong>of</strong> persons eligible for promotion shall be as under:-1) Number <strong>of</strong> vacancies Number <strong>of</strong> eligible persons to beconsidereda) 1 to 5 vacancies 4 time <strong>of</strong> <strong>the</strong> <strong>number</strong> <strong>of</strong> vacanciesb) 6 to 10 vacancies 3 time, but at least 20 eligible persons to beconsideredc) Above 10 vacancies 2 time but at least 30 eligible persons to beconsidered(ii) For <strong>the</strong> highest post <strong>in</strong> a <strong>service</strong>:a) if promotion is from one category <strong>of</strong> post eligible person up to five <strong>in</strong><strong>number</strong> shall be considered for promotionb) If promotion is from different categories <strong>of</strong> post <strong>in</strong> <strong>the</strong> same pay scale ilpersons up to two <strong>in</strong> <strong>number</strong> from <strong>each</strong> category <strong>of</strong> post <strong>in</strong> <strong>the</strong> same payscale shall be considered for promotion .Rules 25 Add after 7 (c)Provided fur<strong>the</strong>r that if <strong>the</strong> committee is satisfied that suitable persons arenot available for selection by promotion to <strong>the</strong> highest post/posts strictly on <strong>the</strong>basis <strong>of</strong> seniority cum merit may be made <strong>in</strong> <strong>the</strong> same manner as specified <strong>in</strong><strong>the</strong>se <strong>rules</strong>.(Added by notification dated 31.3.1980)


19(c) if promotion is from different categories <strong>of</strong> posts carry<strong>in</strong>g different pay scaleseligible persons <strong>in</strong> <strong>the</strong> higher pay scaly shall be considered for promotion firstand if no suitable person is available for promotion on <strong>the</strong> basis <strong>of</strong> merit <strong>in</strong> <strong>the</strong>higher pay scale <strong>the</strong>n only <strong>the</strong> eligible persons <strong>of</strong> o<strong>the</strong>r categories <strong>of</strong> post <strong>in</strong>lower pay scales shall be considered for promotion and so on so ferth . Thezone <strong>of</strong> consideration for eligible <strong>in</strong> this case shall be limited to five seniormost eligible persons <strong>in</strong> all.10) Except as o<strong>the</strong>rwise expressly provided <strong>in</strong> this <strong>rules</strong> <strong>the</strong> conditions <strong>of</strong> eligiblefor promotion constitution <strong>of</strong> <strong>the</strong> committee and procedure for selection shall be<strong>the</strong> same as prescribed else where <strong>in</strong> <strong>the</strong>se <strong>rules</strong>.11) The committee shall consider <strong>the</strong> cases <strong>of</strong> all <strong>the</strong> senior most persons who areeligible and qualified for promotion to <strong>the</strong> class <strong>of</strong> posts concern under <strong>the</strong>se <strong>rules</strong>and shall prepare a list conta<strong>in</strong><strong>in</strong>g name <strong>of</strong> <strong>the</strong> suitable persons equal to <strong>the</strong><strong>number</strong> <strong>of</strong> exist<strong>in</strong>g vacancies and <strong>the</strong> vacancies anticipated to occur dur<strong>in</strong>g <strong>the</strong>next twelve months ater <strong>the</strong> determ<strong>in</strong>ation <strong>of</strong> vacancies <strong>the</strong> committee shall alsoprepare a separate list conta<strong>in</strong><strong>in</strong>g <strong>the</strong> names <strong>of</strong> persons equal to 50% <strong>of</strong> <strong>the</strong>persons selected <strong>in</strong> <strong>the</strong> aforesaid list or select one more person if <strong>the</strong> <strong>number</strong> <strong>of</strong>vacancies is one only who may be considered suitable to fill temporary orpermanent vacancies which may occur till <strong>the</strong> next meet<strong>in</strong>g <strong>of</strong> <strong>the</strong> committee on atemporary or <strong>of</strong>ficiat<strong>in</strong>g basis and <strong>the</strong> list so prepared shall be reviewed andrevised every year and shall rema<strong>in</strong> <strong>in</strong> force until it is so reviewed and revised <strong>the</strong>list so prepared on <strong>the</strong> basis <strong>of</strong> merit and on <strong>the</strong> basis <strong>of</strong> seniority cum merit shallbe arranged <strong>in</strong> <strong>the</strong> order <strong>of</strong> seniority on <strong>the</strong> category <strong>of</strong> post from which selectionis to be made such lists shall be sent to <strong>the</strong> concerned appo<strong>in</strong>t<strong>in</strong>g Authoritytoge<strong>the</strong>r with <strong>the</strong> annual confidential rolls and personal files <strong>of</strong> all <strong>the</strong> candidates<strong>in</strong>cluded <strong>in</strong> <strong>the</strong>m as also those not selected if any.Rules 25 (11) ExplanationFor purpose <strong>of</strong> selection for promotion basis <strong>of</strong> merit <strong>of</strong>ficers withoutstand<strong>in</strong>g consistently very good record shall selected and <strong>the</strong>ir names arranged<strong>in</strong> <strong>of</strong> seniority.25 A) Restriction <strong>of</strong> promotion <strong>of</strong> persons forego<strong>in</strong>g promotion :- In case aperson on his appo<strong>in</strong>tment by promotion to <strong>the</strong> next higher post ei<strong>the</strong>r on <strong>the</strong>basis <strong>of</strong> urgent temporary appo<strong>in</strong>tment or on regular basis on <strong>the</strong> recommendation<strong>of</strong> <strong>the</strong> departmental promotion committee forgoes such an appo<strong>in</strong>tment throughhis written request and if <strong>the</strong> concerned appo<strong>in</strong>t<strong>in</strong>g Authority accepts his/herrequest <strong>the</strong> person concerned shall be debarred from consideration for promotion(both on <strong>the</strong> basis or urgent temporary appo<strong>in</strong>tment ro on regular basis) forsubsequent two recruitment yrs for which <strong>the</strong> departmental promotion committeeis held and <strong>the</strong> name <strong>of</strong> such person who forgoes promotion shall not be <strong>in</strong>cluded<strong>in</strong> <strong>the</strong> seniority cum eligibility list to be placed before <strong>the</strong> departmental promotioncommittee for subsequent two recruitment yrs.

23higher post or category <strong>of</strong> post which is to be filled <strong>in</strong> by merit, only when <strong>the</strong>yhave put <strong>in</strong> after regular selection at least live your’s <strong>service</strong>, unless a higherperiod --- <strong>service</strong> is prescribed elsewhere <strong>in</strong> <strong>the</strong>se <strong>rules</strong>, on <strong>the</strong> first day <strong>of</strong> <strong>the</strong>month <strong>of</strong> April <strong>of</strong> <strong>the</strong> year or selection on <strong>the</strong> post or category <strong>of</strong> post <strong>of</strong> postfrom which selection <strong>in</strong> to be made :Provided that <strong>the</strong> condition <strong>of</strong> five year <strong>service</strong> shall not be applicable to aperson if any person junior to him is eligible for consideration for promotion on<strong>the</strong> bases <strong>of</strong> merit :Provided fur<strong>the</strong>r that <strong>in</strong> <strong>the</strong> event <strong>of</strong> non-availability if persons, equal to <strong>the</strong><strong>number</strong> <strong>of</strong> vacancies to be filled <strong>in</strong> eligible for promotion <strong>in</strong> <strong>the</strong> category <strong>of</strong> postsnext lower from which promotion is made, <strong>the</strong> committee may consider <strong>the</strong>persons hav<strong>in</strong>g less than five years <strong>service</strong> if <strong>the</strong>y are found o<strong>the</strong>rwise eligibleand suitable fir promotion on <strong>the</strong> basis <strong>of</strong> merit alone:Explanation: - If any doubt arises about <strong>the</strong> categorization <strong>of</strong> <strong>the</strong>lowest. Next higher or highest post <strong>in</strong> <strong>the</strong> Service <strong>the</strong> matter shall be referred to<strong>the</strong> Department <strong>of</strong> personnel, whose decision <strong>the</strong>re con be file.The zone <strong>of</strong> eligibility for promotion shall be five time <strong>the</strong> <strong>number</strong> <strong>of</strong>vacancies to be filled <strong>in</strong> on <strong>the</strong> basis <strong>of</strong> seniority cum merit or merit as <strong>the</strong> casemay beProvided that <strong>in</strong> case <strong>of</strong> non availability <strong>of</strong> sufficient <strong>number</strong> <strong>of</strong> suitableperson for a location on <strong>the</strong> basis <strong>of</strong> merit <strong>the</strong> Committee may at its discretionconsider person <strong>of</strong> outstand<strong>in</strong>g merit outside <strong>the</strong> zone <strong>of</strong> eligibility but fall<strong>in</strong>gwith<strong>in</strong> six times <strong>the</strong> <strong>number</strong> <strong>of</strong> vacancies to be filled <strong>in</strong> on <strong>the</strong> basis <strong>of</strong> merit.Explanation :- The list <strong>of</strong> preference shall classify <strong>the</strong> <strong>of</strong>ficers <strong>in</strong> order asoutstand<strong>in</strong>g very good and good on <strong>the</strong> basis <strong>of</strong> merit In <strong>each</strong> class <strong>the</strong> <strong>of</strong>ficersshall ma<strong>in</strong>ta<strong>in</strong> <strong>the</strong>ir <strong>in</strong>terse seniority <strong>of</strong> <strong>the</strong> next below grade.9) Where consultation with <strong>the</strong> commission is necessary <strong>the</strong> lists procured by <strong>the</strong>committee shall be forwarded to <strong>the</strong> to <strong>the</strong> commission by <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>gauthority along with <strong>the</strong> personal files and annual confidential rolls <strong>of</strong> all <strong>the</strong>persons whose names have been considered by committee.10) The commission shall consider <strong>the</strong> lists prepared by <strong>the</strong> committee along witho<strong>the</strong>r relevant documents received from <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority and unless anychange is considered necessary shall approve <strong>the</strong> lists In case <strong>the</strong> commissionconsider it necessary to make any change <strong>in</strong> <strong>the</strong> lists received from <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>gauthority it shall <strong>in</strong>form <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority <strong>of</strong> <strong>the</strong> <strong>of</strong> <strong>the</strong> changes proposedby it after tak<strong>in</strong>g <strong>in</strong>to account <strong>the</strong> comments <strong>of</strong> <strong>the</strong> commission if any <strong>the</strong>appo<strong>in</strong>t<strong>in</strong>g authority may approve <strong>the</strong> lists f<strong>in</strong>ally with such modifications as any<strong>in</strong> its op<strong>in</strong>ion be just and proper and when <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority is an sutboritysubord<strong>in</strong>ation to <strong>the</strong> Govt <strong>the</strong> lists approved by <strong>the</strong> commission should bedisturbed only with <strong>the</strong> approval <strong>of</strong> <strong>the</strong> Govt,


2411) Appo<strong>in</strong>tments shall be made by <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority tak<strong>in</strong>g persons out <strong>of</strong><strong>the</strong> lists f<strong>in</strong>ally approved under <strong>the</strong> preced<strong>in</strong>g sub rule (10) <strong>in</strong> <strong>the</strong> order <strong>in</strong> which<strong>the</strong>y have been placed <strong>in</strong> <strong>the</strong> list, till such lists are exhausted or reviewed andreviewed, as <strong>the</strong> case may be11 A) Government may issue <strong>in</strong>structions for provisionally deal<strong>in</strong>g withpromotion, appo<strong>in</strong>tments or o<strong>the</strong>r ancillary matters <strong>in</strong> an equitable and fairmanner <strong>of</strong> persons who may be under suspension or aga<strong>in</strong>st whom departmentalproceed<strong>in</strong>gs is under progress at <strong>the</strong> time promotion are considered to a post towhich <strong>the</strong>y are eligibility or would have been eligibility but for such suspensionor pendoney <strong>of</strong> such enquiry or proceed<strong>in</strong>gs12) The provisions <strong>of</strong> this rule shall have effect not with stand<strong>in</strong>g anyth<strong>in</strong>g to <strong>the</strong>contrary conta<strong>in</strong>ed <strong>in</strong> any provision <strong>of</strong> <strong>the</strong>se <strong>rules</strong> vide notification no. 30confirmation shall be deemed to have been waived <strong>in</strong> case <strong>of</strong> death orretirement.+ 30 (A) Not with stand<strong>in</strong>g anyth<strong>in</strong>g conta<strong>in</strong>ed <strong>in</strong> <strong>the</strong> rule if no order <strong>of</strong>countermotion is issued by <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority a period <strong>of</strong> sixmonths an employee appo<strong>in</strong>ted on temporary or <strong>of</strong>ficiat<strong>in</strong>g basis whohas after <strong>the</strong> date <strong>of</strong> his regular recruitment by onner method orrecruitment completed a period <strong>of</strong> two year <strong>service</strong> or less <strong>in</strong> <strong>the</strong> case <strong>of</strong>those appo<strong>in</strong>ted by promotion where <strong>the</strong> period <strong>of</strong> promotion prescribedis less on <strong>the</strong> post or a higher post under <strong>the</strong> same appo<strong>in</strong>t<strong>in</strong>g authorityor would have so would but for his deputation or tra<strong>in</strong><strong>in</strong>g shall on <strong>the</strong>occurrence <strong>of</strong> permanent vacancies be entitled to be treated asconfirmed it <strong>the</strong> same conditions as are prescribed under <strong>the</strong> <strong>rules</strong> for<strong>the</strong> confirmation <strong>of</strong> a probationer are fulfilled subject to <strong>the</strong> quotaprescribed under <strong>the</strong> <strong>rules</strong> and <strong>in</strong> accordance with his seniority.Provided that if <strong>the</strong> employee has failed to give satisfaction or hasnot fulfilled any <strong>of</strong> <strong>the</strong> conditions prescribed for confirmation such aspass<strong>in</strong>g <strong>of</strong> departmental Exam<strong>in</strong>ation tra<strong>in</strong><strong>in</strong>g or promotion cadrecourse etc. <strong>the</strong> aforesaid period may be extended as prescribed for <strong>the</strong>probation or under <strong>the</strong> Rajasthan civil <strong>rules</strong> or by one yrs whichever islonger. MathurSpecial secretary to <strong>the</strong> GovernmentRules 39 Power to Relax RulesIn exceptional cases where <strong>the</strong> adm<strong>in</strong>istrative department <strong>of</strong><strong>the</strong> Govt. is satisfied that <strong>the</strong> operation <strong>of</strong> <strong>the</strong> <strong>rules</strong> relat<strong>in</strong>g to age orregard<strong>in</strong>g requirement <strong>of</strong> experience for recruitment causes unduehardship <strong>in</strong> any particular cases or where <strong>the</strong> Govt is <strong>of</strong> <strong>the</strong> op<strong>in</strong>ion thatit is necessary for expedient to relax any <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se <strong>rules</strong>with respect <strong>of</strong> age, or experience <strong>of</strong> any persons it may with <strong>the</strong>concurrence <strong>of</strong> <strong>the</strong> department <strong>of</strong> personnel and adm<strong>in</strong>istrative reformsand <strong>in</strong> consultation with <strong>the</strong> commission by orders dispense with forrelax any subject to such conditions as it may consider necessary fordeal<strong>in</strong>g with <strong>the</strong> case <strong>in</strong> a just and equitable manner, provided that suchrelaxation shall be less favorable than <strong>the</strong> provision already conta<strong>in</strong>ed <strong>in</strong><strong>the</strong>se <strong>rules</strong>. Such cases <strong>of</strong> relaxation shall be referred to <strong>the</strong> Rajasthanpublic <strong>service</strong> commission by <strong>the</strong> department <strong>of</strong> personnel &adm<strong>in</strong>istrative reforms (Deptt.
