Point of ViewNo Justice forSamson and EpicBy Sharon Nataline and Jessica M. TorrenceAround 3 pm on August 12, 2010, two Great Danesslipped out of their caretakers yard when a family memberaccidentally left the gate open at the Marion County homeof Holli Tencza. Less than one mile from their home,Samson and Epic were shot.Epic was pronounced dead on the scene as Samson, gasping for air, continued to fight for his life. The GreatDane died later that night in the care of emergencyveterinarians. The tragedy began when Chris Monteiro called 911 toreport the two animals, claiming they tried to attack himwhile he was working inside his garage. The 911 operatorinstructed Monteiro that the best course of action was tostay inside his home and someone would be sent out tohelp. Instead, Monteiro went outside a second time, armed with his Glock 9mm pistol. He said he saw the dogschasing children down the street and shot the two GreatDanes when they ran toward him as he stood in his yard.Witnesses told Kray, Tencza‟s lawyer, that the dogsweren‟t in Monteiro‟s yard, but that Monteiro was in theroad. Witness statements also state that there were nochildren outside playing and the dogs were nowhere nearhim. They were running toward a field, not at Monteiro.Kray said that by Monteiro‟s defying the 911 operator‟s“We speak for those who have no voice”See us at Petsmartin Gainesville onArcher Rd. every Sat.11:30 am to 4 pm.Adoptions held at the Humane Society on Fridays 10:30 - 2Be sure to visit us at our indoor/outdoor yard saleevery Thursday, Friday, & Saturday from 10:30 - 2!HAILEY is a 3-monthold, rescued CatahoulaLeopard Hound whodoesn't understand whyher family abandonedher. The “Stand Your Ground” bill, nowF.S. 776.013, states, “a person…has no duty to retreat…and [can] meet force with force,” and this law caused theissue to be legally convoluted. The State Attorney announced on September 21 thathe would not be charging the shooter of Samson andEpic, in part because the shooter says he was in fear forhis life and that they couldn‟t prove criminal activity. But Monteiro is not innocent. He admitted he killed thefamily pets. He was not prosecuted because Floridaallows people to protect themselves from a perceivedthreat without backing down. Now, that law has been usedto protect a man who left the safety of his home to shoottwo dogs that could not have pursued him. He did not“stand his ground,” but instead re-entered the situationafter placing the 911 call.It is obvious someone lobbied to protect people frompeople. Who will lobby to protect animals from people? This is not justice. They were dogs! Not burglars, notmurderers, not rapists trespassing on land, breaking intohomes. Animals are different and deserve different laws.We need to lobby for laws that protect our pets and wildlifefrom their greatest threat, people.Today, Tencza can take some solace in the fact thatthe investigation was re-opened, and the State Attorneymoved quickly to investigate the situation. Visit “Justicewanted for Epic and Samson” on Facebook for moreinformation and to show your support. Please contact the Fifth Judicial Circuit, Brad King,State Attorney, 19 NW Pine Av., Ocala, FL 34475,352.620-3800, to let Marion County officials know thatMonteiro should not go unpunished. Please contact yourFlorida Congressman and let them know laws need to bechanged. Together we can work to insure our belovedpets will be protected in the future.PAGE 4 • CRITTER MAGAZINE • OCTOBER 2010

Mistofelees - Adopting a cat is a difficult matter. It isn't just one of your holidaygames. T.S. Eliot wrote that…well at least it was something that sounded like that.He also wrote that there never was a cat so clever as Magical Mr. Mistofelees, andnow that we've met him in person, the Micanopy Animal Hospital staff can definitelyvouch for that. From the minute he appeared out of thin air in a parking lot and spokehis magic words to one of the technicians, he's had a spell firmly cast over everyonewho's met him. Unfortunately, Mistofelees has also had an evil spell cast on him: FelineImmunodeficiency Virus, also known as feline AIDS. Despite this evil spell, he shouldbe able to live with other cats, provided they get along with each other, but he shouldstay indoors. Although Mistofelees doesn't prefer to perform his magic tricks for dogs,he can coexist with them if they don't bother him too much, and he absolutely LOVESto perform for people of all ages. Come be dazzled and amazed by him! He's waitingfor a new stage!Reed - Step right up and meet the most amazing doggy acrobat ever!Reed has performed around the world....okay, mostly just around Micanopy, but still he's amazing! You've never seen a doggy who jumped so high, ran so fast, orcuddled so many kittens! Reed can run long distances and jump through firey hoops! Okay, so maybe he's a little afraid of the firey hoops, but there was one thing hewasn't afraid of: heartworms! Reed has vanquished heartworms and is now ready to come do his tricks for you! Reed is a gentle boy, he loves adults and children, dogs and cats, and is never ever mean.
