(“Lowel”)warrants that its products (other than thoseproducts, which by their nature, areconsumed), under normal use, in accordancewith operating instructions, willperform to the specifications published byLowel at the time of purchase, for thefollowing periods, from the date of purchaseby the consumer.Five Years: with respect to stands andpoles.Two Years: with respect to lighting fixturesonly.One Year: with respect to all other products(other than those products which bytheir nature are consumed).Lowel warrants that those products, whichby their nature are consumed, such as gelsand Gaffer-tape, under normal use, inaccordance with instructions for use, willperform to the specifications published byLowel at the time of purchase.In the event of a defect reported by theconsumer within the applicable time period,if any, Lowel will, at its option, replace orrepair the defective merchandise at nocharge to the consumer for either parts orlabor.The consumer should be aware that Loweldoes not manufacture lamps and thereforemakes no warranty with respect to theseproducts. However, the warranty of themanufacturer of such products, if any, shallbe assigned to consumer if permitted bysuch manufacturer.Repairs andReplacement PartsIf Lowel shall, upon the request of theconsumer, install, alter, modify or repair anyLowel product, or component thereof, thenLowel shall warrant such product, orcomponent, from the date of installation,alteration, modification, or repair, inaccordance with the specifications publishedby Lowel for the applicable time period, ifany, for such period or component, andunder the conditions, limitations, andprocedures set forth in this warranty. Lowelwill not be responsible for any loss, damage,or expense of any kind resulting from theinstallation, alteration, modification, or repairof any Lowel product by any entity otherthan Lowel.ProcedureIn order to make a claim under the abovewarranty, the consumer must, within theapplicable time period, if any, bring or send,postage paid, the defective product andproof of purchase (or, if applicable, proof ofinstallation, alteration, modification, or repairby Lowel) to the consumer’s Lowel dealer orto the Lowel factory in Huppauge, N.Y.Warranty ExclusionsTHE WARRANTY SET FORTH ABOVE ISTHE ONLY WARRANTY MADE BY LOWELWITH RESPECT TO LOWEL PRODUCTSAND LOWEL DISCLAIMS ALLWARRANTIES OF MERCHANTABILITY ANDFITNESS FOR A PARTICULAR PURPOSEAND ANY LIABILITY WITH RESPECT TOSAME WHETHER IN CONTRACT, TORT OROTHERWISE.
