ELIGIBILITY OF NONRESIDENT STUDENTS1. PurposeSC 501, 5022. AuthoritySC 1301SC 1302Title 22Sec. 11.19The Board shall operate district schools for the benefit <strong>of</strong> students resident in thisdistrict who are eligible for attendance.It shall be the policy <strong>of</strong> the Board not to permit the admission <strong>of</strong> nonresident studentsexcept as set forth herein.The Board shall require that appropriate legal documentation showing dependency orguardianship or a sworn statement <strong>of</strong> residential support be filed with the BoardSecretary before an eligible nonresident student may be accepted as a student in thedistrict schools. The Board may require a resident to submit additional reasonableinformation to substantiate a sworn statement, in accordance with guidelines issued bythe Department <strong>of</strong> Education.The Board reserves the right to verify claims <strong>of</strong> residency, dependency andguardianship and to remove from school attendance a nonresident student whose claimis invalid.SC 1302Pol. 906If information contained in the sworn statement <strong>of</strong> residential support is found to befalse, the student shall be removed from school, after notice is given <strong>of</strong> an opportunityto appeal the student's removal, in accordance with Board Policy 906, PublicComplaints.The Board shall not be responsible for transportation to or from school for any studentresiding outside school district boundaries.SC 1316,2561Tuition rates shall be determined in accordance with statute. Tuition shall be chargedmonthly, in advance <strong>of</strong> attendance.3. Guidelines <strong>Nonresident</strong> Children Placed In The DistrictSC 1305Any child placed in the home <strong>of</strong> a district resident by a court or government agencyshall be admitted to the schools and shall receive the same benefits and be subject tothe same duties as resident children.Page 1 <strong>of</strong> 3

ELIGIBILITY OF NONRESIDENT STUDENTS - Pg. 2Inmates Of InstitutionsSC 1306-1309Title 22Sec. 11.18SC 1309A child who is an inmate <strong>of</strong> an institution for the care or training <strong>of</strong> children locatedwithin this district is not a legal resident <strong>of</strong> the district by such placement; but s/heshall be admitted to district schools, and a charge shall be made for tuition inaccordance with statute.Future ResidentsSC 1316A student eligible for attendance whose parent/guardian has executed a contract to buy,build or rent a residence in this district for occupancy within 60 days may be enrolledwithout payment <strong>of</strong> tuition.Parents/Guardians <strong>of</strong> students who claim admission on the basis <strong>of</strong> future residencyshall be required to demonstrate pro<strong>of</strong> <strong>of</strong> the anticipated residency.Former ResidentsSC 1316Upon Board approval, regularly enrolled students whose parents/guardians have movedout <strong>of</strong> the school district after the commencement <strong>of</strong> the school year, may be permittedto finish the school year without payment <strong>of</strong> tuition when the student is completing thesenior year and is on course to graduate at the end <strong>of</strong> the year.Other <strong>Nonresident</strong> <strong>Students</strong>SC 1302Title 22Sec. 11.194. Delegation <strong>of</strong>ResponsibilityA nonresident student may be admitted to district schools without payment <strong>of</strong> tuitionwhere attendance is justified on the grounds that the student lives full-time and not justfor the school year with district residents who have assumed legal dependency orguardianship or residential support <strong>of</strong> the student.The Superintendent or designee shall develop procedures for the enrollment <strong>of</strong>nonresident children which:• Admit such students only on proper application and submission <strong>of</strong> requireddocumentation by the parent/guardian.• Verify claims <strong>of</strong> residency.Pol. 103 • Do not exclude any eligible student on the basis <strong>of</strong> race, creed, color, gender,sexual orientation, national origin, ancestry, or handicap/disability.• Deny admission where the educational facilities or program maintained fordistrict students is inadequate to meet the needs <strong>of</strong> the applicant.Page 2 <strong>of</strong> 3
