<strong>MTN</strong> <strong>Remote</strong> <strong>Access</strong>: <strong>ADSL</strong>Terms and ConditionsWords and phrases defined in the Service Description shall have the same meaning in thisService Order.1. Resale of Servicea. Unless Customer has entered into the <strong>MTN</strong> <strong>Business</strong> Reseller Agreement,resale of the Service is not permitted.2. Maintenancea. Scheduled maintenance on the <strong>MTN</strong> (IP) Network will be performed during astandard maintenance window on Saturdays and Sundays from 2am to 6amlocal time, as necessary. <strong>MTN</strong> <strong>Business</strong> reserves the right to change thesemaintenance times, where necessary, upon prior notice to the Customer.<strong>MTN</strong> <strong>Business</strong> also reserves the right to perform emergency maintenancewithout prior notice.3. Terminationa. Either party may terminate the Service on three (3) months notice to takeeffect on or at any time after expiry of the relevant Initial Service Term, and,in the case of termination by the Customer, such notice to be copied to thelocal <strong>MTN</strong> <strong>Business</strong> Customer Services department.4. Activation of Servicea. The Service Activation Date shall be (i) the date of delivery of the Ready forService Notification or, (ii) if earlier, or where no Ready for ServiceNotification is received by the Customer, the date IP packets can be passedbetween the Customer Site and the <strong>MTN</strong> IP Network and the Service can beused by the Customer.5. Domain Namea. The Customer is aware of the fact, that in order to register a domain name anagreement between the Customer and the relevant registrar (NetworkInformation Centre - NIC) has to be concluded. The Terms and Conditions ofthe relevant NIC will apply to such agreement. The Customer authorises <strong>MTN</strong><strong>Business</strong> to enter into the relevant agreement with the NIC on behalf of theCustomer.6. IP addressesa. If required, <strong>MTN</strong> <strong>Business</strong> will assign the Customer a suitable number of IPaddresses from <strong>MTN</strong> <strong>Business</strong>-allocated CIDR ("Classless Internet-DomainRouting") blocks obtained from the relevant registry. <strong>MTN</strong> <strong>Business</strong> will onlyassign Provider Aggregated addresses (PA-addresses). All assignments areInitials


subject to applicable registry guidelines and policies. All IP addresses mustbe returned to <strong>MTN</strong> <strong>Business</strong> forthwith upon termination of the Service. AnyIP address allocated by <strong>MTN</strong> <strong>Business</strong> to Customer remains property of <strong>MTN</strong><strong>Business</strong> and Customer will have a non-transferable licence to use suchaddresses. If Customer already has such an IP address area and such canbe used for the <strong>MTN</strong> <strong>Business</strong> connection, no additional registered IPaddress area is assigned. <strong>MTN</strong> <strong>Business</strong> cannot guarantee, however, thatother IP address areas previously assigned by other Internet providers canbe reused for the <strong>MTN</strong> <strong>Business</strong> connection as a result of supersedingguidelines.7. Pricinga. The Service is a usage based service and is billed on the amount of usage ofthe Customer.8. Accuracy of Customer Informationa. The Customer will provide <strong>MTN</strong> <strong>Business</strong> with accurate and up to dateinformation: (i) when completing the Service Order; and (ii) when Customercontacts <strong>MTN</strong> <strong>Business</strong> to report a suspected fault and is asked a standardset of structured questions. Failure to provide accurate information may delayinstallation and/or service repair and will discharge <strong>MTN</strong> <strong>Business</strong> of anyliability regarding such failure.9. Circuit Speed Availabilitya. Due to the technical characteristics of DSL, <strong>MTN</strong> <strong>Business</strong> cannot guaranteethe provision of the Circuit Speed. The Customer specifically acknowledgesand accepts that the Circuit Speed may not always be fully available becausethe burst rates may be reduced by modem rate adaptation, protocol overheadin the underlying ATM network, properties of transmitted IP traffic stream andby Customer Site distance from DSLAM.10. Disclaimera. <strong>MTN</strong> <strong>Business</strong> will in no event be liable for lost or interrupted data,messages, packets, or other information transmitted to or from third partynetworks, if the loss or interruption takes place outside of the IP Network.11. Services and/or features are not available in all countries, and may be procured fromin-country provider in select countries. Please consult your <strong>MTN</strong> <strong>Business</strong>representative for service availability.Initials
