For the purposes <strong>of</strong> this chapter, the notification obligations enumerated in Article406.2 may be met by providing notification to the Working Group with respect to theproposed measure.Article 905: Right to Establish Technical Measures1. For greater certainty, in adopting or maintaining any technical measure a Party mayestablish the level <strong>of</strong> protection it considers appropriate in the circumstances to achieve alegitimate objective.2. For greater certainty, each Party sh<strong>all</strong>, in ensuring that any technical measure that itadopts or maintains is not more trade restrictive than necessary to achieve a legitimateobjective, take <strong>into</strong> account the risks that non-fulfillment <strong>of</strong> that legitimate objective wouldcreate and ensure proportionality between the trade restrictiveness <strong>of</strong> the technicalmeasures and those risks.3. Each Party sh<strong>all</strong> ensure that any technical measure adopted or maintained for alegitimate objective does not arbitrarily or unjustifiably discriminate between or amongParties, including between that Party and other Parties, where identical or similar conditionsprevail.4. No Party sh<strong>all</strong> adopt or apply a technical measure in a manner that would constitutea disguised restriction on internal trade.5. Each Party sh<strong>all</strong>, where appropriate and to the extent practicable, specify itstechnical measures in terms <strong>of</strong> results, performance or competence.6. Each Party sh<strong>all</strong> ensure that its technical measures have a scientific, factual or otherreasonable basis and that where appropriate, such technical measures are based on anassessment <strong>of</strong> risk.Article 906: Consultations and Dispute ResolutionChapter Seventeen sh<strong>all</strong> apply to consultations and the resolution <strong>of</strong> disputes arisingout <strong>of</strong> this chapter.Article 907: DefinitionsIn this Chapter:agricultural good means:
