3 OFFICER-IN-CHARGEOIC-MAYOR as distinguished from ACTING MAYORActing Mayor is governed by Section 46 (a) of the LocalGovernment Code, while OIC Mayor is governed by section 46(c) of the same Code.When the City Mayor is temporarily incapacitated to perform hisduties for physical or legal reasons, such as but not limited to,leave of absence, travel abroad <strong>and</strong> suspension from office,the City Vice-Mayor shall automatically exercise the powers <strong>and</strong>perform the duties <strong>and</strong> functions of the Local Chief Executiveconcerned, except the power to appoint, suspend, or dismissemployees which can only be exercised if the period of temporaryincapacity exceed thirty (30) working days.In this case, the automatic assumption by the Vice-Mayor, evenon the first day of incapacity of the City Mayor, is automatic<strong>and</strong> as such, he is properly defined as Acting City Mayor. AsActing City Mayor, he can perform all the functions, power <strong>and</strong>duties of the City Mayor except the limitations provided for incases of appointment, suspension or dismissal of employees.On the other h<strong>and</strong>, Section 46 (c) of the Code provides thatwhen the City Mayor is travelling within the country but outsidehis territorial jurisdiction for a period of not exceeding three (3)60
