MONTSERRATLABOUR CODE, <strong>2012</strong>No. 20 <strong>of</strong> <strong>2012</strong>(b) obtain or prepare, as may be prescribed, anunexpired chemical safety data sheet for allhazardous chemicals present in the workplace;(c) ensure that the identification required by paragraph(a) and chemical safety data sheets required byparagraph (b) are available in English and otherlanguages as may be prescribed;(d) ensure that when a hazardous chemical istransferred into another container or equipment, thecontainer or equipment is labelled in a mannerwhich will make known to an employee, its identity,any hazards associated with its use, and any safetyprecautions to be observed; and(e) ensure that information is provided on the handlingand disposal <strong>of</strong> hazardous chemicals which are nolonger required and containers which have beenemptied but which may contain residues <strong>of</strong>hazardous chemicals, so that the risk to safety andhealth and to the environment is eliminated orminimized.(2) The operator <strong>of</strong> a workplace shall ensure that ahazardous chemical is not used, handled or stored in theworkplace unless the prescribed requirementsconcerning identification, chemical safety data sheetsand worker instruction and training are met.(3) The operator <strong>of</strong> a workplace shall advise the <strong>Labour</strong>Commissioner in writing if the operator, after makingreasonable efforts, is unable to obtain a label orchemical safety data sheet required by subsection (1).(4) A copy <strong>of</strong> the most recent version <strong>of</strong> the inventory and<strong>of</strong> every unexpired chemical safety data sheet requiredby this Part in respect <strong>of</strong> hazardous chemicals in aworkplace shall be—(a) made available by the operator in such a manner asto allow examination by the employees;(b) furnished by the operator to a representative <strong>of</strong> thehealth and safety committee, to a representative <strong>of</strong>68
