Membership of minors(1) A person under the age of 18, but above the age of 16may be a member of a trade union subject to its rulesand the Code, and he or she enjoy all the rights of amember, execute all instruments and give allacquittances necessary to be executed or given under therules.(2) Despite subsection (1), a person under the age of 18, butabove the age of 16 shall not be a member of thecommittee of management, trustee or treasurer of a tradeunion.161. Improper election practices(1) A person shall not attempt to influence the outcome ofan election for any office in an organisation by fraud,threat, bribery or other improper means.(2) Upon an application to the High Court by a member of atrade union or employers' organisation, or by theRegistrar, claiming upon reasonable grounds a violationof subsection (1), the Court may—(a) declare that elections void;(b) determine a date for the holding of fresh elections;(c) make provision for the filling of the officesconcerned, pending the outcome of the freshelections; and96

Deposit and safeguard of funds(1) All funds received by or on behalf of a trade union or anemployers' organisation shall be deposited to the tradeunion or employers' organisation's bank account.(2) Every expenditure of funds by or on behalf of a tradeunion or employers' organisation shall be evidenced by awritten receipt or voucher, which shall be kept with thetrade union or employers' organisation's accounts.(3) The treasurer or the officer responsible for the custodyof the trade union or employers' organisation's funds andproperty, including its records, shall hand over suchfunds and property to the trade union or employers'organisation when he or she leaves office, or earlier ifdirected by the governing body of trade union oremployers' the organisation.(4) Upon the application by a member or officer of the tradeunion or employers' organisation to the High Court, theCourt may make such order as it deems necessary tosecure compliance with this section.163. Application for certificationA trade union claiming to have as its members in goodstanding a majority of the employees of an employer ina bargaining unit may, subject to the provisions of thisPart, make an application to the Labour Commissionerto be certified as the exclusive bargaining agent of theemployees in the unit.164. Application procedure(1) A trade union claiming to have as its members in goodstanding a majority of the employees in a bargainingunit may, subject to the provisions of this Part, submitan application to the Labour Commissioner to becertified as the exclusive bargaining agent of theemployees in the unit.(2) A trade union which was certified as the bargainingagent immediately before the commencement of this97
