A new conta<strong>in</strong>er term<strong>in</strong>al <strong>for</strong> the <strong>21st</strong> century should not be sited adjacent toa congested city centre like <strong>Mumbai</strong>, especially given that the city’s conta<strong>in</strong>er trafficneeds are already met by JNPT which is only 10 miles from <strong>Mumbai</strong>.02. <strong>The</strong> evacuation of conta<strong>in</strong>ers is achieved economically by rail, sea, and roadfrom JNPT, whereas the evacuation of conta<strong>in</strong>ers from <strong>Mumbai</strong> port will <strong>in</strong>crease thetraffic congestion <strong>in</strong> <strong>Mumbai</strong> to <strong>in</strong>tolerable and environmentally unacceptable levels(up to about 11,700 daily truck movements through the city and suburbs).dredg<strong>in</strong>g03. <strong>The</strong> natural depth of the seabed at the site chosen by MbPT is -5.3m chart datum. Thiscannot be deepened economically to -13.5m <strong>in</strong> the channel, and to -16.0m <strong>in</strong> the berths. Evenif the dredg<strong>in</strong>g <strong>in</strong> silt, clay and rock is successfully accomplished, the rates of re-siltation willbe extremely high due to the mud banks at Sewri only one mile away, and due to the strongcurrents and high turbidity <strong>in</strong> the tidal stream. <strong>The</strong> re-siltation is a major consideration and avery significant risk, yet the details of any study have not been made public by MbPT.04. Over the years MbPT has been unable to ma<strong>in</strong>ta<strong>in</strong> the design depth of 10.9 m <strong>in</strong> the port’sma<strong>in</strong> channel, even though the surround<strong>in</strong>g waters are at 8m to 9m depth. It is there<strong>for</strong>e highlyunlikely that MbPT can create and ma<strong>in</strong>ta<strong>in</strong> the OCT berths at -15m <strong>in</strong> an area where the naturaldepth is -5.3m. A contractual undertak<strong>in</strong>g by MbPT to a private operator as per the BOOTAgreement, to ma<strong>in</strong>ta<strong>in</strong> -15m at the berths will lead to enormous demurrage claims from theterm<strong>in</strong>al operator. A case study by the Plann<strong>in</strong>g Commission of poor safeguards and regulation <strong>in</strong>the Concession Agreements highlights the risks to ports of manipulation by Private operators.05. Repeated calls <strong>for</strong> bids from 13 major dredg<strong>in</strong>g co.s failed. After several tender postponements,three tender bids were received of which two were unresponsive/non-compliant tenders. <strong>The</strong> s<strong>in</strong>glesurviv<strong>in</strong>g tender bid was well over budget. <strong>The</strong> Contract was placed by obta<strong>in</strong><strong>in</strong>g a waiver dur<strong>in</strong>gthe pendency of the model code of conduct of the Elections 2009. <strong>The</strong>re are several clauses <strong>in</strong> thedredg<strong>in</strong>g contract which will almost certa<strong>in</strong>ly lead to disputes to the f<strong>in</strong>ancial detriment of the MbPT.conta<strong>in</strong>er stack<strong>in</strong>g area & fill<strong>in</strong>g-up of the docks06. <strong>The</strong>re is no land available to stack the conta<strong>in</strong>ers landed from the OCT. <strong>The</strong>re<strong>for</strong>e MbPT <strong>in</strong>tendsto fill up the Pr<strong>in</strong>ce’s & Victoria Docks to provide a land area of about 55 hectares (about 135 acres).Fill<strong>in</strong>g up docks which are be<strong>in</strong>g used by the coastal fleet is a diabolical idea. Users <strong>in</strong>clude offshoresupply vessels, Coast Guard vessels, ocean go<strong>in</strong>g tugs, and anchor handl<strong>in</strong>g vessels, <strong>in</strong>clud<strong>in</strong>gships belong<strong>in</strong>g to ONGC, SCI , Great Offshore, and 5 other lead<strong>in</strong>g shipp<strong>in</strong>g companies.07. Fill<strong>in</strong>g up of P & V Docks requires 2.5 million cu m of sand. MbPT <strong>in</strong>tends to obta<strong>in</strong> this sandfrom a shoal off Mandwa. This shoal area is protect<strong>in</strong>g Mandwa jetty and the removal of the shoalmay well make Mandwa Jetty unsafe <strong>for</strong> public use. It will also cause siltation <strong>in</strong> Dharamtar creeka busy waterway <strong>for</strong> import of iron ore to a steel plant and coal <strong>for</strong> thermal power plants.08. Furthermore, this sand-w<strong>in</strong>n<strong>in</strong>g area is perilously close to the ONGC’s undersea pipe l<strong>in</strong>e which br<strong>in</strong>gsthe entire output of gas and oil ashore from the Bombay High field. Incredibly, the survey<strong>in</strong>g agency hasalready drilled 6 trial bore holes <strong>in</strong>side the prohibited hazard zone, a zone which has been shown on allcharts issued s<strong>in</strong>ce 1968 by the Chief Hydrographer to the Government of India. This cognizable offencehas occurred <strong>in</strong>side <strong>Mumbai</strong> port, yet the MbPT appears to have taken no action aga<strong>in</strong>st those responsible.434 / 14 14 / 435


09. Fill<strong>in</strong>g up of Pr<strong>in</strong>ce’s and Victoria Docks will also result <strong>in</strong> permanent closure of theMerewether Dry Dock, the only commercial dry-dock <strong>in</strong> Maharashtra <strong>for</strong> repairs and mandatory<strong>in</strong>spections on ships of upto 150m. 140 vessels of the Indian coastal fleet depend onthe Merewether Dry Dock <strong>for</strong> periodic mandatory underwater hull ma<strong>in</strong>tenance.green<strong>in</strong>g of the docks10. Provision of recreation spaces <strong>for</strong> <strong>Mumbai</strong> city was a precondition <strong>in</strong> the clearance given <strong>in</strong> 1980by the Prime M<strong>in</strong>ister to MbPT <strong>for</strong> sett<strong>in</strong>g up JNPT. It was also a precondition <strong>in</strong> the EnvironmentalClearance by the MOEF <strong>in</strong> 1988. OM J-11013/21/88-IA dated 16 Sep 1988 of the M<strong>in</strong>istry ofShipp<strong>in</strong>g <strong>in</strong>cludes a visionary directive from Prime M<strong>in</strong>ister Indira Gandhi which stated“..as a measure of decongestion of Bombay <strong>Port</strong>, the traffic <strong>in</strong>Bombay <strong>Port</strong> must be gradually reduced to…6.5 million tones….”“.. the MOST and MbPT must take action to gradually make the land of Bombay <strong>Port</strong>, whichis not required <strong>for</strong> operational purposes of the port, available <strong>for</strong> green<strong>in</strong>g and recreation ….”Between 1988 and 2008, the MbPT has blatantly defied the Prime M<strong>in</strong>ister’s edict,and has blatantly defied the conditions of the legally b<strong>in</strong>d<strong>in</strong>g Environmental Clearance.the alternative11. <strong>The</strong> Pr<strong>in</strong>ce’s & Victoria Docks are heritage structures built <strong>in</strong> 1888, and they deserve to bepreserved <strong>in</strong> their own right without hav<strong>in</strong>g to lean on economic, technical or social compulsions.<strong>The</strong> Alternative to the OCT is <strong>for</strong> <strong>Mumbai</strong> <strong>Port</strong> to regenerate the Pr<strong>in</strong>ce’s & Victoria Docks as follows:• Mar<strong>in</strong>as.• Parks, waterfront promenades, and other ‘green’ areas.• Passenger ferry term<strong>in</strong>al.• A centre <strong>for</strong> the per<strong>for</strong>m<strong>in</strong>g-arts.• Tourist facilitiesconclusion12. MbPT should <strong>in</strong>deed thrive and thrive gloriously <strong>for</strong> another few centuries, but it willnot do so by pursu<strong>in</strong>g the outdated and environmentally outrageous OCT project.13. <strong>The</strong> MbPT should have no regrets about cancel<strong>in</strong>g the OCT project. <strong>The</strong> cost of cancellationwill be far less than the penal depletion of its resources due to a flawed OCT project.14. On the other hand the direct and <strong>in</strong>direct <strong>in</strong>come flow<strong>in</strong>g from the socially andenvironmentally appropriate tourism and leisure activities <strong>in</strong> a bustl<strong>in</strong>g metropolis will be worthfar more to the MbPT and to the city than a conta<strong>in</strong>er term<strong>in</strong>al which will be a dra<strong>in</strong> on itsresources <strong>in</strong> terms of both capital expenditure and ongo<strong>in</strong>g operat<strong>in</strong>g expenses.15. Dur<strong>in</strong>g her recent visit to <strong>Mumbai</strong> to <strong>in</strong>augurate the Sea L<strong>in</strong>k project, Mrs Sonia Gandhipromised to make <strong>Mumbai</strong> “the f<strong>in</strong>ancial capital of India”.
