136 THOMAS M. COOLEY LAW REVIEW [Vol. 28:1This bill is not sufficient to eliminate accidents. Youcan still surf the web etc. This gives police an excuse topull you over if you’re looking down in your car forprobable cause. It should not be a primary offense and it’simpossible to enforce according to some police I havetalked to. You’re not even allowed to read a text messagein this bill yet you can do all manner of other things withyour phone. It’s inconsistent. 83The Bill was presented to Governor Jennifer Granholm on April 29,2010. 84 Granholm signed the Bill into law the next day in the DetroitRenaissance Center as part of a broadcast of The Oprah Winfrey Show. 85After fourteen months of analysis and debate by the Michigan Legislature,Michigan’s statute banning texting while driving reads as follows:(1) Except as otherwise provided in this section, aperson shall not read, manually type, or send a textmessage on a wireless 2-way communication device that islocated in the person’s hand or in the person’s lap, including a wireless telephone used in cellular telephoneservice or personal communication service, while operatinga motor vehicle that is moving on a highway or street inthis state. As used in this subsection, a wireless 2-waycommunication device does not include a globalpositioning or navigation system that is affixed to themotor vehicle.(2) Subsection (1) does not apply to an individual whois using a device described in subsection (1) to do any ofthe following:(a) Report a traffic accident, medical emergency, orserious road hazard.(b) Report a situation in which the person believes hisor her personal safety is in jeopardy.83.
