If thesestates received federal funds proportional to those received by Hartford andSyracuse, it is probable that these states would not see the same increasesin crash claims.B. Enforcement ProblemsPerhaps the real problem is not drivers that are unaware of the newstatute or that texting while driving is dangerous, but drivers that simply donot believe that police will enforce the law. Or, as some have suggested,drivers may not believe that the law can be enforced. Two days before thelaw went into effect, Sheriff Mark Hackel of Macomb County, Michigan’sthird-most-populated county, said that not knowing whether drivers aretexting or dialing a number is the problem police will face when attemptingto enforce the new law. 1511. EnforceabilityToday, cellphones have multiple functions, making it extremelydifficult for a police officer to determine what function the driver was usingat the time the officer observed the driver using the phone. 152 What resultswhen a driver receives a text (but does not read it) while using anotherlegal function of the phone, and the driver still gets a ticket because thedriver’s phone records were obtained and show that a text was received atthe time of the traffic stop? Drivers should not be penalized for merelyreceiving a text message, nor should it be necessary for police to becomeglorified driving instructors simply to enforce the law as RepresentativeGonzales has suggested. 153151.
