Fees remain payableif Notice of Withdrawal has not been given in accordance with these conditions.Please note that although students may leave <strong>College</strong> after their examinationsin November or June, tuition and accommodation fees will not be reducedor refunded.Provision of tuitionIf a particular subject is under-subscribed, the <strong>College</strong> reserves the right toprovide a smaller number of hours’ tuition or private tuition for the same feeor by giving one terms written notice to either change or end the course.The <strong>College</strong> may give one term’s written notice to either change or enda course without refund in the event of any circumstance arising or occurringwhich the <strong>College</strong> at its reasonable discretion deems to necessitate such action.Scholarships and Other DiscountsPoor performance or attendance or a change of course can lead to withdrawalof a scholarship or other discounts.Academic criteriaStudents who do not perform satisfactorily in their coursework will not beentered for external public examinations by the <strong>College</strong>. Students who do notyet meet university criteria for English Language proficiency will be expectedto take an appropriate English Language course at the <strong>College</strong>.Students are accepted into the <strong>College</strong> on the strict understanding thatprogression through the course is conditional upon satisfactory and requiredattendance and successful attainment of prescribed performance targets.Students are formally assessed at least twice a year. The assessment willtake into consideration: Course work; internal college examination results;attendance; effort in class and in homework; public examination potential.Students who do not meet the attainment criteria will not be allowed toproceed with their original course but will be offered an alternative courseor invited to withdraw from the <strong>College</strong> without refund.Criteria for the one year A Level courseThe A Level course length is normally six terms (September start) or five terms(January or April start). Applications for the one year (three term) Septemberstart course are accepted only if:• Students have completed a year or more of study at degree level in theirhome country, or• Students are repeating the A Level course, or• Students can demonstrate an outstandingly high standard of work atHigh School level (to be assessed on a case-by-case basis by the principal).Students unsure of their qualifications should contact the AdmissionsDepartment for assessment. Students enrolled on a three term A Level courseare accepted on the strict understanding that their progress will be reviewedat key stages including the end of the first term. The <strong>College</strong> reserves theright to require a longer course or change of course in light of that review.Accident & medical insuranceIt is necessary that all students have appropriate accident and medicalinsurance. Students must either take out our own <strong>Study</strong>Care insurance policyor provide proof of adequate cover at enrolment. Cover under the <strong>Study</strong>Careinsurance policy does not commence until the insurance fees have been paidin full, which are non-refundable. Please ensure that you bring with you anyrelevant medical records, eg. immunisation records, that will assist localmedical staff when treating you for any medical condition.WithdrawalOnce a student has arrived in the UK, a minimum of one term’s notice (inwriting) is required, or payment in lieu, whether or not the student continuesto attend lessons. Students following the English Language Preparationcourses are automatically enrolled to progress on to an academic programme.The student must therefore give the standard term’s notice if they do notwish to progress further at the <strong>College</strong>. If withdrawal is due to refusal of avisa extension then less notice may be accepted (at the <strong>College</strong>’s discretion)as long as full written details are provided before a course recommences.Students should be aware of the legal implications of their visa statusshould they decide to leave the college before completion of their course.Where withdrawal is due to illness, if the student has taken out ourcomprehensive <strong>Study</strong>Care plan insurance scheme (details of which areavailable on request), subject to the terms of the scheme the student maybe able to claim a refund. Notice of withdrawal must be given in writing andis effective from the date it is received by the <strong>College</strong>.<strong>College</strong>s’ organisational policiesEach college has policies on admissions, bullying, child protection, curriculum,discipline, health & safety, promotion of good behaviour, sanctions in casesof bad behaviour, complaints and exclusions – these are available on requestfrom the Principal of each college.Accounts proceduresPaymentsPayment can be made to the <strong>College</strong> by cheque, Sterling bank draft,telegraphic transfer or credit card. Please ensure that the student’s name andcustomer reference are always included on the transfer document, indicatingthat the transfer is in respect of school fees. Bank charges and commission forboth the sending and receiving banks should be paid by the sender of funds orthey will be applied to the student’s account. Payment by credit card is subjectto a surcharge of 2%. There is a £1 surcharge for debit cards.Accounts communications will be sent both to the person responsible forpaying the fees and to the student unless written instructions are received tothe contrary. The company expects payment of all fees to be in sterling andencourages all customers to pay in £ sterling. Funds must be cleared throughthe college’s bank account before students can attend classes.Sundry ChargesAny incidental costs incurred on behalf of the student will be charged to theiraccount, for example taxi charges, fax costs, field trips, exam fees, text booksand vacation accommodation.RefundsRefunds will only be made to the person responsible for the fees unlesswritten authorisation is provided to the contrary from that person. Refundswill be made within 90 days of the end of the relevant term. Occupants of the rooms are jointly andseverally liable for the proper care of the room and the <strong>College</strong> reserves theright to recover costs for damage or exceptional cleaning from the student.AccommodationThe <strong>College</strong> includes fees within its accommodation charges to cover thesupport and service to students in Homestay and <strong>College</strong> accommodation.<strong>College</strong> homestay families are instructed not to accept any payment directlyor indirectly from any student. Similarly, students outside of the <strong>College</strong>’saccommodation service are prohibited from entering into any arrangementfor accommodation with a <strong>College</strong> homestay. Students who break this rulerender themselves subject to <strong>College</strong> discipline and charges will be leviedto the student’s account on the basis that the student had been in <strong>College</strong>accommodation for the relevant period.If you miss your course start date for any reason we reserve the right to changeyour accommodation. However, if you pay the residential accommodation fee,for the shorter of a term or the length of the course, not less than 28 days beforethe course start date, your bed will be secured for you. If college residentialaccommodation is booked, should you defer your course to a future coursestart date and then cancel your course, a full term’s accommodation charge willbe payable. If having reserved residential accommodation when booking yourcourse, you immediately on arrival wish to move to private accommodation,an accommodation fee will be payable by you. That fee will be the residentialaccommodation charge for the shorter of a term or the length of the course.Accommodation typeStudents who will be under 16 on commencement of their course will beplaced automatically with Homestay Plus families or in the appropriate<strong>College</strong> House accommodation and will be invoiced accordingly, for welfareand safety considerations.On enrolment, students are requested to indicate their accommodationpreference. While the <strong>College</strong> will use its reasonable endeavours to providethe accommodation requested, the <strong>College</strong> is not bound to provide aspecific type of accommodation and, if necessary, an alternative type ofaccommodation will be provided. Students will be invoiced for the type ofaccommodation requested on enrolment and if this subsequently proves tobe unavailable, an appropriate credit will be given or an extra charge will belevied. If you miss your start date for any reason, we reserve the right tochange your accommodation. Once the confirmation fee is paid, requestedaccommodation, if available, is reserved. If a term’s fees are not paid28 days before term starts reserved accommodation will be released.Changes of accommodationNo change to the type of accommodation arrangements will be madewithout the written permission of Student Services or the <strong>College</strong> Principal.This permission will only be given in exceptional circumstances. If a studentmakes a change to his/her accommodation arrangements or leavesaccommodation provided by the <strong>College</strong> without the prior consent of the<strong>College</strong> Principal, the student shall remain liable for the full accommodationpayments invoiced or reserved at the time of enrolment.One full term’s written notice must be given for students moving out of<strong>College</strong> accommodation by the student or their parent or guardian andwhere they are moving to private accommodation the parent or guardianmust complete a disclaimer to that effect (local variations may apply).Students will be charged for the one term’s notice period whether or not heor she stays in the accommodation. Two weeks’ notice is required for a movebetween host families. Further details on our Code of Practice are as printedin the “Student Handbook” given to the students upon commencement ofthe course (local variations may apply).Airport transfersWe will automatically arrange an airport transfer at the cost stated in the<strong>Prospectus</strong> for all students under the age of 18 unless specified otherwiseon the application form.Vacation accommodationThis is available to any student on request to the AccommodationDepartment. This is normally only available in Homestay families andthe appropriate fee will be added to the student’s account.Personal propertyIf our <strong>Study</strong>Care insurance is taken out, any loss or damage to personalproperty which may occur while the student is living with a homestayfamily or at the <strong>College</strong> is covered within the terms of the policy.PublicityStudents and their parents or guardians agree that the students’ imagesand sound, details and achievements may be used for promotionalpurposes without written consent or notification.Effectiveness of the <strong>College</strong> CoursesInformation about your performance in each of your end-of-yearassessments during your undergraduate studies will be collected by the<strong>College</strong> from the university at which you study to be used by the <strong>College</strong>to analyse the long term effectiveness of its own courses. All informationcollected by the <strong>College</strong> from universities at which you subsequentlystudy will only be used in accordance with UK data protection law.Data protectionAny information provided to <strong>Bellerbys</strong> <strong>College</strong> (the “<strong>College</strong>”) may be heldon computer and shall be used by the <strong>College</strong> in accordance with UK DataProtection law. Information provided to the <strong>College</strong> is held and processedfor the purpose of administering your application and we may share yourinformation with our offices around the world. This information may becarried forward to your official student record, which holds data in electronicand paper form on your personal details, academic and administrativehistory and on relevant financial transactions. Once you progress to a degreeprogramme, the University is required to provide information to UK agenciesincluding the Higher Education Statistics Agency. After you leave, the partsof your student record which the University needs to retain will be archived.Some information will also be processed for the purpose of managing ourrelationship with you as an alumnus. Other information will be destroyed.Throughout, your personal data will be held in accordance with currentUK data protection law.LiabilityAny reference in these terms to liability of students shall also infer liability onthe parents or guardian of the student, and such liability is joint and several.VariationNo variation to these conditions is valid unless agreed in writing by thePrincipal provided always that the <strong>College</strong> reserves the right to make anyaddition, amendment or alteration to these conditions upon giving oneterm’s written notice of such change to all affected parents guardiansand students.UK government bodiesThe <strong>College</strong> is obliged to report on request visa status, attendance recordsand UK contact details to relevant UK government bodies.CommunicationPlease supply the <strong>College</strong> with personal email addresses and mobiletelephone numbers prior to arrival, in order that communication, to includetransmission of student reports, may be maintained at all times. Please alsoadvise of any changes as they occur. These are mandatory requirements ofthe UK visa authorities.GeneralStudents who transfer to the <strong>College</strong> from other parts of <strong>Study</strong> <strong>Group</strong> must beaware that these Terms and Conditions automatically apply. These Terms andConditions apply to all bookings now made for courses commencing in or afterJanuary <strong>2013</strong> and supersede all previously published Terms and Conditions.Acceptance and IndemnityAcceptance by the student, and also by his/her parent or legal guardian ifthe student is under eighteen years of age, of a place to study at the <strong>College</strong>indicates that you:• Give permission for the administration of first aid and appropriatenon-prescription medication to students, and to seek medical, dentalor optical treatment when required, and have given full details of anymedicines currently being taken or any ongoing medical condition.• Agree to the following indemnity:‘In consideration of the principal/head teacher/director of the <strong>College</strong>agreeing to make arrangements for and to authorise members of the staffof the <strong>College</strong> to take the student from time to time on expeditions outsidethe premises of the <strong>College</strong> students/parents/legal guardians herebyundertake to indemnify the principal/head teacher/director and suchmembers of the staff against:a) any claims, damages or costs which they or any of them may be orbecome liable to pay in consequence of any injury or damage to orillness of the student occurring during or as a result of any of thesaid expeditions.b) any claims by any third party which may be made against them or anyof them in consequence of any act or default of the student during oras a result of any of the said expeditions.c) any other costs and expenses reasonably incurred by them or any of themon behalf of the student during or as a result of any of the said expeditions.Provided that the indemnity herein shall not extend to any claims, damages,costs or expenses in respect of and to the extent to which the <strong>College</strong> andmember(s) of the staff or any of them shall be entitled to be indemnifiedunder any policy of insurance.Without this
