These changes are necessary as the result <strong>of</strong> the Govern<str<strong>on</strong>g>or</str<strong>on</strong>g> signing 2011House Bill 650 (the “Castle Doctrine”) and the need to modify the language in our<str<strong>on</strong>g>or</str<strong>on</strong>g>dinances to comply with state law.I am including a copy <strong>of</strong> my full rep<str<strong>on</strong>g>or</str<strong>on</strong>g>t to Mr. Watkins <strong>on</strong> <strong>this</strong> matter f<str<strong>on</strong>g>or</str<strong>on</strong>g> your review.In sh<str<strong>on</strong>g>or</str<strong>on</strong>g>t, we are asking f<str<strong>on</strong>g>or</str<strong>on</strong>g> you to c<strong>on</strong>sider the following changes to the <str<strong>on</strong>g>or</str<strong>on</strong>g>dinances:TOG Ordinance §18-1:- Eliminate language in subsecti<strong>on</strong> (a) that is redundant to language later in thesame <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance;- Amend the language in subsecti<strong>on</strong> (c) to reflect the change in name f<str<strong>on</strong>g>or</str<strong>on</strong>g> the Parks,Recreati<strong>on</strong> and Cultural Arts Department;- Amend the language in subsecti<strong>on</strong> (d) to m<str<strong>on</strong>g>or</str<strong>on</strong>g>e clearly define who is c<strong>on</strong>sidered a“lawful <strong>of</strong>ficer” f<str<strong>on</strong>g>or</str<strong>on</strong>g> the purposes <strong>of</strong> discharging a firearm in the line <strong>of</strong> duty; and- Amend the language in subsecti<strong>on</strong> (d) to remove the reference auth<str<strong>on</strong>g>or</str<strong>on</strong>g>izing theuse <strong>of</strong> a firearm to protect <strong>property</strong> and to have the <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance use new languageintroduced in N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina General Statute (NCGS) as <strong>of</strong> December 1, 2011.Page 2


TOG Ordinance §18-2:- The title <strong>of</strong> the <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance should be amended to add a specific reference t<strong>of</strong>irearms; because the NCGS differentiates between firearms and <str<strong>on</strong>g>other</str<strong>on</strong>g> <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>,we also should f<str<strong>on</strong>g>or</str<strong>on</strong>g> c<strong>on</strong>sistency;- §18-2 (a) should be amended by dividing it into four secti<strong>on</strong>s, <strong>on</strong>e dealing withany possessi<strong>on</strong> <strong>of</strong> firearms in Town buildings, <strong>on</strong>e dealing with possessi<strong>on</strong> <strong>of</strong>firearms in Town parks, <strong>on</strong>e dealing with c<strong>on</strong>cealed carry <strong>of</strong> handguns atrecreati<strong>on</strong>al facilities and <strong>on</strong>e dealing with <str<strong>on</strong>g>other</str<strong>on</strong>g> <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> as defined in NCGS.This change is necessary because <strong>of</strong> the change in NCGS that removes ourauth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity to prohibit the carrying <strong>of</strong> c<strong>on</strong>cealed handguns in Town Parks;- §18-2 (b) should be amended to include Wake County Animal C<strong>on</strong>trol Officersal<strong>on</strong>g with Town <strong>of</strong> Garner Animal C<strong>on</strong>trol Officers as either could potentially usea dart gun in the perf<str<strong>on</strong>g>or</str<strong>on</strong>g>mance <strong>of</strong> their duties;- §18-2 (c) should be amended to clarify the language necessary f<str<strong>on</strong>g>or</str<strong>on</strong>g> differentfacilities covered in the revised <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance. This is also related to the change inNCGS that limits our ability to restrict c<strong>on</strong>cealed carry <strong>of</strong> handguns <strong>on</strong>ly to athleticfacilities, athletic fields and playgrounds inside parks;- §18-2 (e) should be amended to add a specific reference to handguns. Thischange will create greater c<strong>on</strong>sistency with NCGS; and- A subsecti<strong>on</strong> should be added to clarify that the st<str<strong>on</strong>g>or</str<strong>on</strong>g>age <strong>of</strong> a firearm does notc<strong>on</strong>stitute a violati<strong>on</strong> <strong>of</strong> <strong>this</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance. This change also makes our <str<strong>on</strong>g>or</str<strong>on</strong>g>dinancec<strong>on</strong>sistent with NCGS.The proposed amended <str<strong>on</strong>g>or</str<strong>on</strong>g>dinances are included in the full packet included with <strong>this</strong>mem<str<strong>on</strong>g>or</str<strong>on</strong>g>andum. Thepassing <strong>of</strong> <strong>this</strong> law and the incident in June <strong>on</strong> Nellane Drive involving the discharge <strong>of</strong> a firearm inpublic led me to have Lieutenant Shambaugh c<strong>on</strong>duct a review <strong>of</strong> the current Town <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance toevaluate whether any changes were required due to changes in the N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina General Statutesand c<strong>on</strong>cerns with the language <strong>of</strong> the current <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance.As the result <strong>of</strong> Lieutenant Shambaugh’s rep<str<strong>on</strong>g>or</str<strong>on</strong>g>t, my review <strong>of</strong> the issue, c<strong>on</strong>sultati<strong>on</strong> with Mrs. S<strong>on</strong>yaShaw and c<strong>on</strong>sultati<strong>on</strong> with the UNC School <strong>of</strong> Government we are recommending the followingchanges:1) Modificati<strong>on</strong> to the language in §18-1 (Discharge <strong>of</strong> firearms; seizure <strong>of</strong> firearms; applicability <strong>of</strong>secti<strong>on</strong>)2) Modificati<strong>on</strong> to the language in §18-2 (Weap<strong>on</strong>s prohibited <strong>on</strong> <strong>town</strong> <strong>property</strong>) <strong>of</strong> the TownOrdinance3) Revisi<strong>on</strong>s to our current procedures f<str<strong>on</strong>g>or</str<strong>on</strong>g> posting signage related to prohibiting <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> <strong>on</strong> <strong>town</strong><strong>property</strong>.(Note – any reference to c<strong>on</strong>cealed carry <strong>of</strong> a handgun in <strong>this</strong> mem<str<strong>on</strong>g>or</str<strong>on</strong>g>andum is intended to refer<strong>on</strong>ly to lawful c<strong>on</strong>cealed carry based <strong>on</strong> a valid permit issued by N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina <str<strong>on</strong>g>or</str<strong>on</strong>g> an<str<strong>on</strong>g>other</str<strong>on</strong>g> statein acc<str<strong>on</strong>g>or</str<strong>on</strong>g>dance with NCGS §14-269 and §14-415.24).Page 4Page 1 <strong>of</strong> 23


Recommended Revisi<strong>on</strong> to Town Firearms Ordinance September 2011TOG Ordinance §18-1 (Discharge <strong>of</strong> firearms; seizure <strong>of</strong> firearms; applicability <strong>of</strong> secti<strong>on</strong>):The language in the sec<strong>on</strong>d half <strong>of</strong> sub-secti<strong>on</strong> (a) which exempts law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficers from theprohibiti<strong>on</strong> <strong>on</strong> discharging a firearm can be removed as <strong>this</strong> issue is addressed in sub-secti<strong>on</strong> (d) <strong>of</strong><strong>this</strong> same <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance.The language in sub-secti<strong>on</strong> (c) <strong>of</strong> <strong>this</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance should be amended to reflect the name change f<str<strong>on</strong>g>or</str<strong>on</strong>g>the Parks, Recreati<strong>on</strong> and Cultural Resources Department.The current language in sub-secti<strong>on</strong> (d) <strong>of</strong> <strong>this</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance reads “The provisi<strong>on</strong>s <strong>of</strong> <strong>this</strong> secti<strong>on</strong> shallnot be c<strong>on</strong>strued to prohibit the lawful discharge <strong>of</strong> a firearm by any lawful <strong>of</strong>ficer in the discharge <strong>of</strong>his duty <str<strong>on</strong>g>or</str<strong>on</strong>g> by any pers<strong>on</strong> in the lawful defense <strong>of</strong> pers<strong>on</strong>s and <strong>property</strong>.” There are two p<str<strong>on</strong>g>or</str<strong>on</strong>g>ti<strong>on</strong>s <strong>of</strong><strong>this</strong> subsecti<strong>on</strong> that require modificati<strong>on</strong>.First, “any lawful <strong>of</strong>ficer” should be modified to read “any sw<str<strong>on</strong>g>or</str<strong>on</strong>g>n law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficer <str<strong>on</strong>g>or</str<strong>on</strong>g> N<str<strong>on</strong>g>or</str<strong>on</strong>g>thCarolina licensed protective services <strong>of</strong>ficer” to ensure that there is no c<strong>on</strong>fusi<strong>on</strong> as to who the<str<strong>on</strong>g>or</str<strong>on</strong>g>dinance is intended to provide an exempti<strong>on</strong> to. This language will protect federal, state and locallaw enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficers as well as armed security guards licensed by N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina should theydischarge a firearm in the lawful perf<str<strong>on</strong>g>or</str<strong>on</strong>g>mance <strong>of</strong> their duties.Sec<strong>on</strong>d, the “…<str<strong>on</strong>g>or</str<strong>on</strong>g> by any pers<strong>on</strong> in the lawful defense <strong>of</strong> pers<strong>on</strong>s and <strong>property</strong>” language in <strong>this</strong>subsecti<strong>on</strong> should be modified to m<str<strong>on</strong>g>or</str<strong>on</strong>g>e clearly define the c<strong>on</strong>cept <strong>of</strong> “lawful defense <strong>of</strong> pers<strong>on</strong>s” – theacceptable c<strong>on</strong>diti<strong>on</strong>s under which a firearm may be discharged (i.e. when deadly f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce may beused) in the defense <strong>of</strong> a pers<strong>on</strong>. Any specific reference to the discharge <strong>of</strong> a firearm (i.e. the use <strong>of</strong>deadly f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce) to protect <strong>property</strong> should be stricken from the <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance as such acti<strong>on</strong> is unlawful andinc<strong>on</strong>sistent with the intent <strong>of</strong> such an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance.House Bill 650 (relevant secti<strong>on</strong>s are included in the addendum to <strong>this</strong> mem<str<strong>on</strong>g>or</str<strong>on</strong>g>andum) includes asignificant change to the language in NCGS by replacing §14-51.1 “Use <strong>of</strong> deadly physical f<str<strong>on</strong>g>or</str<strong>on</strong>g>ceagainst an intruder” and replacing it with §14-51.2 (“Home, w<str<strong>on</strong>g>or</str<strong>on</strong>g>kplace, and mot<str<strong>on</strong>g>or</str<strong>on</strong>g> vehicle protecti<strong>on</strong>;presumpti<strong>on</strong> <strong>of</strong> fear <strong>of</strong> death <str<strong>on</strong>g>or</str<strong>on</strong>g> serious bodily injury”), §14-51.3 (“Use <strong>of</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce in defense <strong>of</strong> pers<strong>on</strong>;relief from criminal <str<strong>on</strong>g>or</str<strong>on</strong>g> civil liability”) and §14-51.4 (“Justificati<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> defensive f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce not available”)which are relevant to <strong>this</strong> review (these secti<strong>on</strong>s are included in the addendum).In sh<str<strong>on</strong>g>or</str<strong>on</strong>g>t, the existing secti<strong>on</strong> (§14-51.1) establishes the right f<str<strong>on</strong>g>or</str<strong>on</strong>g> residents to use deadly f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce againstan intruder in a home and clarifies that a resident has no obligati<strong>on</strong> to retreat bef<str<strong>on</strong>g>or</str<strong>on</strong>g>e doing so. Therevisi<strong>on</strong>s significantly expand <strong>on</strong> <strong>this</strong> c<strong>on</strong>cept by including home, w<str<strong>on</strong>g>or</str<strong>on</strong>g>k and mot<str<strong>on</strong>g>or</str<strong>on</strong>g> vehicles as “places”to be protected, they add a significant amount <strong>of</strong> detail to defining the circumstances whereby deadlyf<str<strong>on</strong>g>or</str<strong>on</strong>g>ce is auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ized, they clarify issues related to liability if deadly f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce is used and they clarifysituati<strong>on</strong>s when the use <strong>of</strong> deadly f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce is specifically not permitted.Page 5Page 2 <strong>of</strong> 23


Recommended Revisi<strong>on</strong> to Town Firearms Ordinance September 2011It is our recommendati<strong>on</strong> that we amend Town Ordinance 18-1, sub-secti<strong>on</strong>s (a), (c) and (d) to readas follows (with changes shown):(a) It shall be unlawful f<str<strong>on</strong>g>or</str<strong>on</strong>g> any pers<strong>on</strong> to shoot <str<strong>on</strong>g>or</str<strong>on</strong>g> discharge within the c<str<strong>on</strong>g>or</str<strong>on</strong>g>p<str<strong>on</strong>g>or</str<strong>on</strong>g>ate limits <strong>of</strong> the<strong>town</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>on</strong> any <strong>town</strong>-owned <strong>property</strong> any gun, pistol <str<strong>on</strong>g>or</str<strong>on</strong>g> <str<strong>on</strong>g>other</str<strong>on</strong>g> firearm, <str<strong>on</strong>g>or</str<strong>on</strong>g> air rifle, pellet gun,BB gun, <str<strong>on</strong>g>or</str<strong>on</strong>g> similar device, by whatever name, f<str<strong>on</strong>g>or</str<strong>on</strong>g> throwing a metal projectile by use <strong>of</strong> springacti<strong>on</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> compressed air; provided, however, that <strong>this</strong> paragraph does not prohibit thedischarge <strong>of</strong> firearms by any law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficer in the discharge <strong>of</strong> his duty, includingthe shooting <strong>of</strong> birds, animals <str<strong>on</strong>g>or</str<strong>on</strong>g> reptiles as set f<str<strong>on</strong>g>or</str<strong>on</strong>g>th in secti<strong>on</strong> 3-13(b) and (c).(c) The provisi<strong>on</strong>s <strong>of</strong> <strong>this</strong> secti<strong>on</strong> shall not be c<strong>on</strong>strued to prohibit the discharge <strong>of</strong> firearmseither during the course <strong>of</strong> instructi<strong>on</strong> in their use by the police department <strong>of</strong> the <strong>town</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>on</strong>a firing range after inspecti<strong>on</strong> and approval <strong>of</strong> the use <strong>of</strong> such range by the chief Chief <strong>of</strong>police Police from the standpoint <strong>of</strong> public safety, <str<strong>on</strong>g>or</str<strong>on</strong>g> to the firing <strong>of</strong> firearms withoutprojectiles in <str<strong>on</strong>g>or</str<strong>on</strong>g>ganized educati<strong>on</strong>al, entertainment, instructi<strong>on</strong>al <str<strong>on</strong>g>or</str<strong>on</strong>g> cerem<strong>on</strong>ial events,sp<strong>on</strong>s<str<strong>on</strong>g>or</str<strong>on</strong>g>ed by the Garner Parks, and Recreati<strong>on</strong>s and Cultural Resources Department. Suchinspecti<strong>on</strong> and approval shall be evidenced by a written permit issued by the chief Chief <strong>of</strong>Police to the applicant, and the chief Chief shall impose any c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s up<strong>on</strong> theuse <strong>of</strong> such range deemed by him to be necessary and prudent with due regard to life,<strong>property</strong> and public safety. Chapter 14, Article 14(Burglary and Other Housebreakings).”These changes will address the c<strong>on</strong>cerns noted with the language <strong>of</strong> the existing <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance and willbring us into compliance with the upcoming changes to the NCGS.TOG Ordinance §18-2 (Weap<strong>on</strong>s prohibited <strong>on</strong> <strong>town</strong> <strong>property</strong>):In <str<strong>on</strong>g>or</str<strong>on</strong>g>der to clearly w<str<strong>on</strong>g>or</str<strong>on</strong>g>k through <strong>this</strong> discussi<strong>on</strong>, I feel it is imp<str<strong>on</strong>g>or</str<strong>on</strong>g>tant to provide some backgroundrelated to firearms law in N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina. As you are aware, the 2 nd Amendment to the United StatesC<strong>on</strong>stituti<strong>on</strong> guarantees citizens the right to bear arms. This c<strong>on</strong>cept is mirr<str<strong>on</strong>g>or</str<strong>on</strong>g>ed in the N<str<strong>on</strong>g>or</str<strong>on</strong>g>thCarolina C<strong>on</strong>stituti<strong>on</strong> in Article 1, Secti<strong>on</strong> 30 which establishes the right <strong>of</strong> citizens here to bear arms;however, it also states (paraphrasing) that there is no inherent right to carry <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> c<strong>on</strong>cealed andthat the state can regulate c<strong>on</strong>cealed carry. (The full secti<strong>on</strong> is included in the addendum).NCGS §14-409.40 (“Statewide unif<str<strong>on</strong>g>or</str<strong>on</strong>g>mity <strong>of</strong> local regulati<strong>on</strong>”) subsecti<strong>on</strong> (f) auth<str<strong>on</strong>g>or</str<strong>on</strong>g>izes municipalitiesauth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity “…including prohibiting the possessi<strong>on</strong> <strong>of</strong> firearms in public-owned buildings, <strong>on</strong> thegrounds <str<strong>on</strong>g>or</str<strong>on</strong>g> parking areas <strong>of</strong> those buildings, <str<strong>on</strong>g>or</str<strong>on</strong>g> in public parks <str<strong>on</strong>g>or</str<strong>on</strong>g> recreati<strong>on</strong> areas, except nothing in<strong>this</strong> subsecti<strong>on</strong> shall prohibit a pers<strong>on</strong> from st<str<strong>on</strong>g>or</str<strong>on</strong>g>ing a firearm within a mot<str<strong>on</strong>g>or</str<strong>on</strong>g> vehicle while the vehicleis <strong>on</strong> these grounds <str<strong>on</strong>g>or</str<strong>on</strong>g> areas.” This piece <strong>of</strong> legislati<strong>on</strong> is what allows the Town <strong>of</strong> Garner to be m<str<strong>on</strong>g>or</str<strong>on</strong>g>erestrictive than the N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina C<strong>on</strong>stituti<strong>on</strong> by restricting any possessi<strong>on</strong> <strong>of</strong> a firearm <strong>on</strong> theaf<str<strong>on</strong>g>or</str<strong>on</strong>g>ementi<strong>on</strong>ed Town properties.Page 6Page 3 <strong>of</strong> 23


Recommended Revisi<strong>on</strong> to Town Firearms Ordinance September 2011This auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity is restricted in terms <strong>of</strong> what is allowed by the N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina law regarding theissuance <strong>of</strong> permits to carry c<strong>on</strong>cealed handguns. NCGS §14-269 (“Carrying c<strong>on</strong>cealed <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>”)auth<str<strong>on</strong>g>or</str<strong>on</strong>g>izes individuals to carry a c<strong>on</strong>cealed handgun so l<strong>on</strong>g as the individual has a c<strong>on</strong>cealedhandgun permit issued by N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina <str<strong>on</strong>g>or</str<strong>on</strong>g> by an<str<strong>on</strong>g>other</str<strong>on</strong>g> state in acc<str<strong>on</strong>g>or</str<strong>on</strong>g>dance with NCGS 14-415.24(“Reciprocity; out-<strong>of</strong>-state handgun permits). There are some statewide restricti<strong>on</strong>s <strong>on</strong> the carrying <strong>of</strong>a c<strong>on</strong>cealed handgun by permit that are defined in NCGS §14-415.11 (“Permit to carry c<strong>on</strong>cealedhandgun; scope <strong>of</strong> permit”), but n<strong>on</strong>e <strong>of</strong> those apply to properties owned by municipalities.However, NCGS §14-415.23 (“Statewide unif<str<strong>on</strong>g>or</str<strong>on</strong>g>mity”) currently provides municipalities with theauth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity to “…adopt an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance to permit the posting <strong>of</strong> a prohibiti<strong>on</strong> against carrying a c<strong>on</strong>cealedhandgun, in acc<str<strong>on</strong>g>or</str<strong>on</strong>g>dance with NCGS §14-415.11(c), <strong>on</strong> local government buildings, their appurtenantpremises and parks.” (See below f<str<strong>on</strong>g>or</str<strong>on</strong>g> changes related to Town parks).Theref<str<strong>on</strong>g>or</str<strong>on</strong>g>e, the Town <strong>of</strong> Garner currently has the lawful ability to do the following:1) Prohibit the possessi<strong>on</strong> (i.e. open carry) <strong>of</strong> firearms in Town buildings and <strong>on</strong> the <strong>property</strong>where those buildings exist and/<str<strong>on</strong>g>or</str<strong>on</strong>g> in public parks and recreati<strong>on</strong> areas in acc<str<strong>on</strong>g>or</str<strong>on</strong>g>dance withNCGS §14-409.40.2) Prohibit the c<strong>on</strong>cealed carry <strong>of</strong> handguns in local government buildings, <strong>on</strong> their appurtenantpremises and in Town parks so l<strong>on</strong>g as an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance is in place establishing such restricti<strong>on</strong>s(which we have in §18-2 <strong>of</strong> the Town Ordinance).3) Prohibit the possessi<strong>on</strong> (i.e. open carry) <strong>of</strong> <str<strong>on</strong>g>other</str<strong>on</strong>g> “<str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>” (as defined in NCGS §14-269) inTown buildings and <strong>on</strong> the <strong>property</strong> where those buildings exist and/<str<strong>on</strong>g>or</str<strong>on</strong>g> in public parks andrecreati<strong>on</strong>s areas as there is no c<strong>on</strong>stituti<strong>on</strong>al <str<strong>on</strong>g>or</str<strong>on</strong>g> statut<str<strong>on</strong>g>or</str<strong>on</strong>g>y protecti<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> individuals to carrysuch <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>.Note – there is no need to have an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance specifically addressing the carrying <strong>of</strong> c<strong>on</strong>cealed<str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> <str<strong>on</strong>g>other</str<strong>on</strong>g> than firearms as NCGS §14-269 prohibits such activity statewide.There are two areas <strong>of</strong> c<strong>on</strong>cern with §18-2 <strong>of</strong> the Town Ordinance: the current language <strong>on</strong> <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>versus firearms and the recent change in the NCGS regarding our auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity to prohibit c<strong>on</strong>cealedcarry <strong>of</strong> handguns in Town parks.The current <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance refers <strong>on</strong>ly to a prohibiti<strong>on</strong> <strong>on</strong> “possessing <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> as defined in G.S. in 14-269…” and does not speak specifically to firearms. NCGS §14-269 differentiates between“<str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>” and “firearms” in establishing rules f<str<strong>on</strong>g>or</str<strong>on</strong>g> c<strong>on</strong>cealed carry. Additi<strong>on</strong>ally, NCGS §14-415.23indicates that a “unit <strong>of</strong> local government may adopt an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance to permit the posting <strong>of</strong> aprohibiti<strong>on</strong> against carrying a c<strong>on</strong>cealed handgun…”Page 7Page 4 <strong>of</strong> 23


Recommended Revisi<strong>on</strong> to Town Firearms Ordinance September 2011With <strong>this</strong> in mind, §18-2 should be clarified to speak specifically to a prohibiti<strong>on</strong> <strong>on</strong> firearms and<str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> (as NCGS differentiates between the two), including prohibiting the c<strong>on</strong>cealed carry <strong>of</strong>handguns where we have the auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity to do so. It should also be clarified to not create a prohibiti<strong>on</strong>against the st<str<strong>on</strong>g>or</str<strong>on</strong>g>age <strong>of</strong> a firearm in a vehicle.The sec<strong>on</strong>d issue related to <strong>this</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance results from a change in the language <strong>of</strong> NCGS §14-415.23 that becomes law December 1, 2011. Where <strong>this</strong> secti<strong>on</strong> previously auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ized units <strong>of</strong> localgovernment to prohibit carrying c<strong>on</strong>cealed handguns <strong>on</strong> “local government buildings, theirappurtenant premises, and parks” the language has been modified to instead read “local governmentbuildings and their appurtenant premises” and “<strong>on</strong> municipal and county recreati<strong>on</strong>al facilities that arespecifically identified by the unit <strong>of</strong> local government.” The new law further describes “recreati<strong>on</strong>alfacilities” as “…<strong>on</strong>ly the following: a playground, an athletic field, a swimming pool, and an athleticfacility.”In attempting to determine how exactly to define these locati<strong>on</strong>s, we have spoken with Mr. Jeff Welty<strong>of</strong> the UNC School <strong>of</strong> Government and Police and Parks and Recreati<strong>on</strong> staff have attended awebinar <strong>on</strong> <strong>this</strong> topic hosted by Mr. Welty and Mr. Mike Waters, the Executive Direct<str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>of</strong> the N<str<strong>on</strong>g>or</str<strong>on</strong>g>thCarolina Recreati<strong>on</strong> and Park Associati<strong>on</strong>.The c<strong>on</strong>sensus at <strong>this</strong> time is that there is no specific definiti<strong>on</strong> and that any clarificati<strong>on</strong> will likelycome when the new law is challenged in court. However, it appears that the change in law doesremove the “blanket” auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity f<str<strong>on</strong>g>or</str<strong>on</strong>g> prohibiting c<strong>on</strong>cealed carry <strong>of</strong> handguns in all Town parks as wecurrently do.Theref<str<strong>on</strong>g>or</str<strong>on</strong>g>e, we can no l<strong>on</strong>ger have an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance that prohibits c<strong>on</strong>cealed carry <strong>of</strong> a handgun in Townparks; we can <strong>on</strong>ly prohibit c<strong>on</strong>cealed carry <strong>of</strong> a handgun (if we choose to) <strong>on</strong> playgrounds, athleticfields and in athletic facilities (we have no pools). If we choose to do so, we must also specificallydefine each <strong>of</strong> these locati<strong>on</strong>s in the Town Ordinance and signage will have to be placed acc<str<strong>on</strong>g>or</str<strong>on</strong>g>dingly.I have spoken with Mrs. Shaw and it is the preference <strong>of</strong> her staff that the Town c<strong>on</strong>tinues to maintainan <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance that restricts the carry <strong>of</strong> handguns and <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> in all parks facilities to the extent thatthe law will allow. We supp<str<strong>on</strong>g>or</str<strong>on</strong>g>t Mrs. Shaw and Parks and Rec staff in <strong>this</strong> regard and theref<str<strong>on</strong>g>or</str<strong>on</strong>g>erecommend that we amend the current <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance to prohibit the c<strong>on</strong>cealed carry <strong>of</strong> handguns asallowed by law.With the af<str<strong>on</strong>g>or</str<strong>on</strong>g>ementi<strong>on</strong>ed inf<str<strong>on</strong>g>or</str<strong>on</strong>g>mati<strong>on</strong> taken into c<strong>on</strong>siderati<strong>on</strong>, it is our recommendati<strong>on</strong> that §18-2 <strong>of</strong>the Town Ordinance be amended as follows:- The title <strong>of</strong> the <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance should be amended to add a specific reference to firearms.Page 8Page 5 <strong>of</strong> 23

Chapter 14, Article 14 (Burglary and Other Housebreakings).Secti<strong>on</strong> 18-2: Firearms and <str<strong>on</strong>g>other</str<strong>on</strong>g> <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> prohibited <strong>on</strong> <strong>town</strong> <strong>property</strong>.(a) Except as provided in subsecti<strong>on</strong> (g) below all pers<strong>on</strong>s are prohibited from possessing any firearm,including a handgun carried under the auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity <strong>of</strong> a lawful c<strong>on</strong>cealed handgun permit, in <strong>town</strong> ownedbuildings and their appurtenant premises, as defined herein.(b) Except as provided in subsecti<strong>on</strong> (g) below all pers<strong>on</strong>s are prohibited from possessing any firearm,unless carried c<strong>on</strong>cealed under the auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity <strong>of</strong> a lawful c<strong>on</strong>cealed handgun permit, in any <strong>town</strong> park.However, the excepti<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> c<strong>on</strong>cealed carry <strong>on</strong> a lawful c<strong>on</strong>cealed handgun permit does not apply tothose locati<strong>on</strong>s identified in subsecti<strong>on</strong> (c).(c) Except as provided in subsecti<strong>on</strong> (g) below all pers<strong>on</strong>s are prohibited from possessing any firearm,including a c<strong>on</strong>cealed handgun carried under the auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity <strong>of</strong> a lawful c<strong>on</strong>cealed handgun permit, atthe following <strong>town</strong> recreati<strong>on</strong>al facilities (i.e. athletic facilities, athletic fields and playgrounds) inacc<str<strong>on</strong>g>or</str<strong>on</strong>g>dance with G.S. 14-415.23:(1) The Avery Street recreati<strong>on</strong> facility located at 125 Avery Street;(2) The Avery Street recreati<strong>on</strong> center annex located at 201 Avery Street;(3) The athletic field and playground inside Avery Street Park located at 201 Avery Street;(4) The playground and soccer fields inside Centennial Park located at 1015 New Bethel ChurchRoad;(5) The playground and baseball field inside Creech Road Elementary School Park located at 300Creech Road;(6) The tennis courts located at 190 Creech Road;(7) The playground and baseball field inside Garner Recreati<strong>on</strong>al Park located at 221 East GarnerRoad;(8) The playground inside Greenbrier Park located at 613 Winterlochen Drive;(9) The playground inside Jaycee Park located at 1300 Vand<str<strong>on</strong>g>or</str<strong>on</strong>g>a Springs Road;(10) The playgrounds inside Lake Bens<strong>on</strong> Park located at 921 Buffaloe Road;Page 15Page 12 <strong>of</strong> 23


Recommended Revisi<strong>on</strong> to Town Firearms Ordinance September 2011(11) The baseball field, basketball court and playground inside Rand Mill Road park located at 608Rand Mill Road;(12) The baseball fields, multipurpose athletic field, playground and tennis courts inside South GarnerPark located at 1210 Poole Drive;(13) The football field located inside Thomps<strong>on</strong> Road Park located at 550 Thomps<strong>on</strong> Road; and(14) The playgrounds located inside White Deer Park located at 2400 Aversb<str<strong>on</strong>g>or</str<strong>on</strong>g>o Road.(d) Except as provided in subsecti<strong>on</strong> (g) below all pers<strong>on</strong>s are prohibited from possessing <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>,<str<strong>on</strong>g>other</str<strong>on</strong>g> than firearms, as defined in G.S. §14-269 in <strong>town</strong> owned buildings, their appurtenant premises,and in <strong>town</strong> parks and recreati<strong>on</strong>al facilities, as defined herein.(e) Nothing herein is intended to prohibit a pers<strong>on</strong> from st<str<strong>on</strong>g>or</str<strong>on</strong>g>ing a firearm within a mot<str<strong>on</strong>g>or</str<strong>on</strong>g> vehicle while thevehicle is <strong>on</strong> the af<str<strong>on</strong>g>or</str<strong>on</strong>g>ementi<strong>on</strong>ed properties in the <strong>town</strong>.(f) F<str<strong>on</strong>g>or</str<strong>on</strong>g> the purposes <strong>of</strong> <strong>this</strong> secti<strong>on</strong>, "buildings" is defined as set f<str<strong>on</strong>g>or</str<strong>on</strong>g>th in G.S. §14-54(c) as including anydwelling, dwelling house, uninhabited house, building under c<strong>on</strong>structi<strong>on</strong>, building within the curtilage<strong>of</strong> a dwelling house, and any <str<strong>on</strong>g>other</str<strong>on</strong>g> structure designed to house <str<strong>on</strong>g>or</str<strong>on</strong>g> secure within it any activity <str<strong>on</strong>g>or</str<strong>on</strong>g><strong>property</strong>.(g) This prohibiti<strong>on</strong> shall not apply to the following pers<strong>on</strong>s:(1) Officers and enlisted pers<strong>on</strong>nel <strong>of</strong> the armed f<str<strong>on</strong>g>or</str<strong>on</strong>g>ces <strong>of</strong> the United States when in discharge <strong>of</strong>their <strong>of</strong>ficial duties as such and acting under <str<strong>on</strong>g>or</str<strong>on</strong>g>ders requiring them to carry arms and <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>;(2) Civil <strong>of</strong>ficers <strong>of</strong> the United States while in the discharge <strong>of</strong> their <strong>of</strong>ficial duties;(3) Officers and soldiers <strong>of</strong> the militia and the nati<strong>on</strong>al guard when called into actual service;(4) Sw<str<strong>on</strong>g>or</str<strong>on</strong>g>n law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficers;(5) Town <strong>of</strong> Garner <str<strong>on</strong>g>or</str<strong>on</strong>g> Wake County animal c<strong>on</strong>trol <strong>of</strong>ficers.(6) Pers<strong>on</strong>s firing firearms without projectiles in <str<strong>on</strong>g>or</str<strong>on</strong>g>ganized educati<strong>on</strong>al, entertainment, instructi<strong>on</strong>al,<str<strong>on</strong>g>or</str<strong>on</strong>g> cerem<strong>on</strong>ial events sp<strong>on</strong>s<str<strong>on</strong>g>or</str<strong>on</strong>g>ed by the Garner Parks, Recreati<strong>on</strong> and Cultural ResourcesDepartment.(h) A c<strong>on</strong>spicuous notice shall be posted at each entrance to any <strong>property</strong> set f<str<strong>on</strong>g>or</str<strong>on</strong>g>th in (a), (b), <str<strong>on</strong>g>or</str<strong>on</strong>g> (c)above outlining the restricti<strong>on</strong>s prescribed in <strong>this</strong> secti<strong>on</strong>.(i) Any pers<strong>on</strong> in violati<strong>on</strong> <strong>of</strong> <strong>this</strong> secti<strong>on</strong> shall be guilty <strong>of</strong> a misdemean<str<strong>on</strong>g>or</str<strong>on</strong>g> and up<strong>on</strong> c<strong>on</strong>victi<strong>on</strong> shall befined five hundred dollars ($500.00) <str<strong>on</strong>g>or</str<strong>on</strong>g> impris<strong>on</strong>ed f<str<strong>on</strong>g>or</str<strong>on</strong>g> six (6) m<strong>on</strong>ths <str<strong>on</strong>g>or</str<strong>on</strong>g> both.(j) Firearms and <str<strong>on</strong>g>other</str<strong>on</strong>g> <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> possessed in violati<strong>on</strong> <strong>of</strong> <strong>this</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance are hereby declared to bec<strong>on</strong>traband. The chief <strong>of</strong> police <str<strong>on</strong>g>or</str<strong>on</strong>g> his designee shall dispose <strong>of</strong> such <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g> pursuant to applicablestate law.Page 16Page 13 <strong>of</strong> 23

Statewide unif<str<strong>on</strong>g>or</str<strong>on</strong>g>mity <strong>of</strong> local regulati<strong>on</strong>.(a) It is declared by the General Assembly that the regulati<strong>on</strong> <strong>of</strong> firearms is properly an issue <strong>of</strong> general,statewide c<strong>on</strong>cern, and that the entire field <strong>of</strong> regulati<strong>on</strong> <strong>of</strong> firearms is preempted from regulati<strong>on</strong> bylocal governments except as provided by <strong>this</strong> secti<strong>on</strong>.(a1) The General Assembly further declares that the lawful design, marketing, manufacture, distributi<strong>on</strong>,sale, <str<strong>on</strong>g>or</str<strong>on</strong>g> transfer <strong>of</strong> firearms <str<strong>on</strong>g>or</str<strong>on</strong>g> ammuniti<strong>on</strong> to the public is not an unreas<strong>on</strong>ably dangerous activity anddoes not c<strong>on</strong>stitute a nuisance per se and furtherm<str<strong>on</strong>g>or</str<strong>on</strong>g>e, that it is the unlawful use <strong>of</strong> firearms andammuniti<strong>on</strong>, rather than their lawful design, marketing, manufacture, distributi<strong>on</strong>, sale, <str<strong>on</strong>g>or</str<strong>on</strong>g> transfer thatis the proximate cause <strong>of</strong> injuries arising from their unlawful use. This subsecti<strong>on</strong> applies <strong>on</strong>ly tocauses <strong>of</strong> acti<strong>on</strong> brought under subsecti<strong>on</strong> (g) <strong>of</strong> <strong>this</strong> secti<strong>on</strong>.(b) Unless <str<strong>on</strong>g>other</str<strong>on</strong>g>wise permitted by statute, no county <str<strong>on</strong>g>or</str<strong>on</strong>g> municipality, by <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance, resoluti<strong>on</strong>, <str<strong>on</strong>g>or</str<strong>on</strong>g> <str<strong>on</strong>g>other</str<strong>on</strong>g>enactment, shall regulate in any manner the possessi<strong>on</strong>, ownership, st<str<strong>on</strong>g>or</str<strong>on</strong>g>age, transfer, sale,purchase, licensing, <str<strong>on</strong>g>or</str<strong>on</strong>g> registrati<strong>on</strong> <strong>of</strong> firearms, firearms ammuniti<strong>on</strong>, comp<strong>on</strong>ents <strong>of</strong> firearms, dealersin firearms, <str<strong>on</strong>g>or</str<strong>on</strong>g> dealers in handgun comp<strong>on</strong>ents <str<strong>on</strong>g>or</str<strong>on</strong>g> parts.(c) Notwithstanding subsecti<strong>on</strong> (b) <strong>of</strong> <strong>this</strong> secti<strong>on</strong>, a county <str<strong>on</strong>g>or</str<strong>on</strong>g> municipality, by z<strong>on</strong>ing <str<strong>on</strong>g>or</str<strong>on</strong>g> <str<strong>on</strong>g>other</str<strong>on</strong>g> <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance,may regulate <str<strong>on</strong>g>or</str<strong>on</strong>g> prohibit the sale <strong>of</strong> firearms at a locati<strong>on</strong> <strong>on</strong>ly if there is a lawful, general, similarregulati<strong>on</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> prohibiti<strong>on</strong> <strong>of</strong> commercial activities at that locati<strong>on</strong>. Nothing in <strong>this</strong> subsecti<strong>on</strong> shallrestrict the right <strong>of</strong> a county <str<strong>on</strong>g>or</str<strong>on</strong>g> municipality to adopt a general z<strong>on</strong>ing plan that prohibits anycommercial activity within a fixed distance <strong>of</strong> a school <str<strong>on</strong>g>or</str<strong>on</strong>g> <str<strong>on</strong>g>other</str<strong>on</strong>g> educati<strong>on</strong>al instituti<strong>on</strong> except with aspecial use permit issued f<str<strong>on</strong>g>or</str<strong>on</strong>g> a commercial activity found not to pose a danger to the health, safety, <str<strong>on</strong>g>or</str<strong>on</strong>g>general welfare <strong>of</strong> pers<strong>on</strong>s attending the school <str<strong>on</strong>g>or</str<strong>on</strong>g> educati<strong>on</strong>al instituti<strong>on</strong> within the fixed distance.(d) No county <str<strong>on</strong>g>or</str<strong>on</strong>g> municipality, by z<strong>on</strong>ing <str<strong>on</strong>g>or</str<strong>on</strong>g> <str<strong>on</strong>g>other</str<strong>on</strong>g> <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance, shall regulate in any manner firearms showswith regulati<strong>on</strong>s m<str<strong>on</strong>g>or</str<strong>on</strong>g>e stringent than those applying to shows <strong>of</strong> <str<strong>on</strong>g>other</str<strong>on</strong>g> types <strong>of</strong> items.(e) A county <str<strong>on</strong>g>or</str<strong>on</strong>g> municipality may regulate the transp<str<strong>on</strong>g>or</str<strong>on</strong>g>t, carrying, <str<strong>on</strong>g>or</str<strong>on</strong>g> possessi<strong>on</strong> <strong>of</strong> firearms by employees<strong>of</strong> the local unit <strong>of</strong> government in the course <strong>of</strong> their employment with that local unit <strong>of</strong> government.(f) Nothing c<strong>on</strong>tained in <strong>this</strong> secti<strong>on</strong> prohibits municipalities <str<strong>on</strong>g>or</str<strong>on</strong>g> counties from applicati<strong>on</strong> <strong>of</strong> their auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ityunder G.S. 153A-129, 160A-189, 14-269, 14-269.2, 14-269.3, 14-269.4, 14-277.2, 14-415.11,14-415.23, including prohibiting the possessi<strong>on</strong> <strong>of</strong> firearms in public-owned buildings, <strong>on</strong> the grounds<str<strong>on</strong>g>or</str<strong>on</strong>g> parking areas <strong>of</strong> those buildings, <str<strong>on</strong>g>or</str<strong>on</strong>g> in public parks <str<strong>on</strong>g>or</str<strong>on</strong>g> recreati<strong>on</strong> areas, except nothing in <strong>this</strong>subsecti<strong>on</strong> shall prohibit a pers<strong>on</strong> from st<str<strong>on</strong>g>or</str<strong>on</strong>g>ing a firearm within a mot<str<strong>on</strong>g>or</str<strong>on</strong>g> vehicle while the vehicle is <strong>on</strong>these grounds <str<strong>on</strong>g>or</str<strong>on</strong>g> areas. Nothing c<strong>on</strong>tained in <strong>this</strong> secti<strong>on</strong> prohibits municipalities <str<strong>on</strong>g>or</str<strong>on</strong>g> counties fromexercising powers provided by law in declared states <strong>of</strong> emergency under Article 36A <strong>of</strong> <strong>this</strong> Chapter.(g) The auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity to bring suit and the right to recover against any firearms <str<strong>on</strong>g>or</str<strong>on</strong>g> ammuniti<strong>on</strong> marketer,manufacturer, distribut<str<strong>on</strong>g>or</str<strong>on</strong>g>, dealer, seller, <str<strong>on</strong>g>or</str<strong>on</strong>g> trade associati<strong>on</strong> by <str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>on</strong> behalf <strong>of</strong> any governmental unit,created by <str<strong>on</strong>g>or</str<strong>on</strong>g> pursuant to an act <strong>of</strong> the General Assembly <str<strong>on</strong>g>or</str<strong>on</strong>g> the C<strong>on</strong>stituti<strong>on</strong>, <str<strong>on</strong>g>or</str<strong>on</strong>g> any department,agency, <str<strong>on</strong>g>or</str<strong>on</strong>g> auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ity there<strong>of</strong>, f<str<strong>on</strong>g>or</str<strong>on</strong>g> damages, abatement, injunctive relief, <str<strong>on</strong>g>or</str<strong>on</strong>g> any <str<strong>on</strong>g>other</str<strong>on</strong>g> remedy resultingfrom <str<strong>on</strong>g>or</str<strong>on</strong>g> relating to the lawful design, marketing, manufacture, distributi<strong>on</strong>, sale, <str<strong>on</strong>g>or</str<strong>on</strong>g> transfer <strong>of</strong> firearms<str<strong>on</strong>g>or</str<strong>on</strong>g> ammuniti<strong>on</strong> to the public is reserved exclusively to the State. Any acti<strong>on</strong> brought by the Statepursuant to <strong>this</strong> secti<strong>on</strong> shall be brought by the Att<str<strong>on</strong>g>or</str<strong>on</strong>g>ney General <strong>on</strong> behalf <strong>of</strong> the State. This secti<strong>on</strong>shall not prohibit a political subdivisi<strong>on</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> local governmental unit from bringing an acti<strong>on</strong> against afirearms <str<strong>on</strong>g>or</str<strong>on</strong>g> ammuniti<strong>on</strong> marketer, manufacturer, distribut<str<strong>on</strong>g>or</str<strong>on</strong>g>, dealer, seller, <str<strong>on</strong>g>or</str<strong>on</strong>g> trade associati<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g>breach <strong>of</strong> c<strong>on</strong>tract <str<strong>on</strong>g>or</str<strong>on</strong>g> warranty f<str<strong>on</strong>g>or</str<strong>on</strong>g> defect <strong>of</strong> materials <str<strong>on</strong>g>or</str<strong>on</strong>g> w<str<strong>on</strong>g>or</str<strong>on</strong>g>kmanship as to firearms <str<strong>on</strong>g>or</str<strong>on</strong>g> ammuniti<strong>on</strong>purchased by the political subdivisi<strong>on</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> local governmental unit. Permit to carry c<strong>on</strong>cealed handgun; scope <strong>of</strong> permit.(a) Any pers<strong>on</strong> who has a c<strong>on</strong>cealed handgun permit may carry a c<strong>on</strong>cealed handgun unless <str<strong>on</strong>g>other</str<strong>on</strong>g>wisespecifically prohibited by law. The pers<strong>on</strong> shall carry the permit together with valid identificati<strong>on</strong>whenever the pers<strong>on</strong> is carrying a c<strong>on</strong>cealed handgun, shall disclose to any law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficerthat the pers<strong>on</strong> holds a valid permit and is carrying a c<strong>on</strong>cealed handgun when approached <str<strong>on</strong>g>or</str<strong>on</strong>g>addressed by the <strong>of</strong>ficer, and shall display both the permit and the proper identificati<strong>on</strong> up<strong>on</strong> therequest <strong>of</strong> a law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficer. In additi<strong>on</strong> to these requirements, a military permittee whosepermit has expired during deployment may carry a c<strong>on</strong>cealed handgun during the 90 days followingthe end <strong>of</strong> deployment and bef<str<strong>on</strong>g>or</str<strong>on</strong>g>e the permit is renewed provided the permittee also displays pro<strong>of</strong> <strong>of</strong>deployment to any law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficer.(b) The sheriff shall issue a permit to carry a c<strong>on</strong>cealed handgun to a pers<strong>on</strong> who qualifies f<str<strong>on</strong>g>or</str<strong>on</strong>g> a permitunder G.S. 14-415.12. The permit shall be valid throughout the State f<str<strong>on</strong>g>or</str<strong>on</strong>g> a period <strong>of</strong> five years fromthe date <strong>of</strong> issuance.(c) A permit does not auth<str<strong>on</strong>g>or</str<strong>on</strong>g>ize a pers<strong>on</strong> to carry a c<strong>on</strong>cealed handgun in the areas prohibited by G.S.14-269.2, 14-269.3, 14-269.4, and 14-277.2, in an area prohibited by rule adopted under G.S.120-32.1, in any area prohibited by 18 U.S.C. § 922 <str<strong>on</strong>g>or</str<strong>on</strong>g> any <str<strong>on</strong>g>other</str<strong>on</strong>g> federal law, in a law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <str<strong>on</strong>g>or</str<strong>on</strong>g>c<str<strong>on</strong>g>or</str<strong>on</strong>g>recti<strong>on</strong>al facility, in a building housing <strong>on</strong>ly State <str<strong>on</strong>g>or</str<strong>on</strong>g> federal <strong>of</strong>fices, in an <strong>of</strong>fice <strong>of</strong> the State <str<strong>on</strong>g>or</str<strong>on</strong>g>federal government that is not located in a building exclusively occupied by the State <str<strong>on</strong>g>or</str<strong>on</strong>g> federalgovernment, a financial instituti<strong>on</strong>, <str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>on</strong> any <str<strong>on</strong>g>other</str<strong>on</strong>g> premises, except state-owned rest areas <str<strong>on</strong>g>or</str<strong>on</strong>g> stateownedrest stops al<strong>on</strong>g the highways, where notice that carrying a c<strong>on</strong>cealed handgun is prohibitedby the posting <strong>of</strong> a c<strong>on</strong>spicuous notice <str<strong>on</strong>g>or</str<strong>on</strong>g> statement by the pers<strong>on</strong> in legal possessi<strong>on</strong> <str<strong>on</strong>g>or</str<strong>on</strong>g> c<strong>on</strong>trol <strong>of</strong>the premises. It shall be unlawful f<str<strong>on</strong>g>or</str<strong>on</strong>g> a pers<strong>on</strong>, with <str<strong>on</strong>g>or</str<strong>on</strong>g> without a permit, to carry a c<strong>on</strong>cealed handgunwhile c<strong>on</strong>suming alcohol <str<strong>on</strong>g>or</str<strong>on</strong>g> at any time while the pers<strong>on</strong> has remaining in his body any alcohol <str<strong>on</strong>g>or</str<strong>on</strong>g> inhis blood a c<strong>on</strong>trolled substance previously c<strong>on</strong>sumed, but a pers<strong>on</strong> does not violate <strong>this</strong> c<strong>on</strong>diti<strong>on</strong> ifa c<strong>on</strong>trolled substance in his blood was lawfully obtained and taken in therapeutically appropriateamounts.(d) A pers<strong>on</strong> who is issued a permit shall notify the sheriff who issued the permit <strong>of</strong> any change in thepers<strong>on</strong>'s permanent address within 30 days after the change <strong>of</strong> address. If a permit is lost <str<strong>on</strong>g>or</str<strong>on</strong>g>destroyed, the pers<strong>on</strong> to whom the permit was issued shall notify the sheriff who issued the permit <strong>of</strong>the loss <str<strong>on</strong>g>or</str<strong>on</strong>g> destructi<strong>on</strong> <strong>of</strong> the permit. A pers<strong>on</strong> may obtain a duplicate permit by submitting to thesheriff a notarized statement that the permit was lost <str<strong>on</strong>g>or</str<strong>on</strong>g> destroyed and paying the required duplicatepermit fee. Statewide unif<str<strong>on</strong>g>or</str<strong>on</strong>g>mity.It is the intent <strong>of</strong> the General Assembly to prescribe a unif<str<strong>on</strong>g>or</str<strong>on</strong>g>m system f<str<strong>on</strong>g>or</str<strong>on</strong>g> the regulati<strong>on</strong> <strong>of</strong> legallycarrying a c<strong>on</strong>cealed handgun. To insure unif<str<strong>on</strong>g>or</str<strong>on</strong>g>mity, no political subdivisi<strong>on</strong>s, boards, <str<strong>on</strong>g>or</str<strong>on</strong>g> agencies <strong>of</strong> theState n<str<strong>on</strong>g>or</str<strong>on</strong>g> any county, city, municipality, municipal c<str<strong>on</strong>g>or</str<strong>on</strong>g>p<str<strong>on</strong>g>or</str<strong>on</strong>g>ati<strong>on</strong>, <strong>town</strong>, <strong>town</strong>ship, village, n<str<strong>on</strong>g>or</str<strong>on</strong>g> anydepartment <str<strong>on</strong>g>or</str<strong>on</strong>g> agency there<strong>of</strong>, may enact <str<strong>on</strong>g>or</str<strong>on</strong>g>dinances, rules, <str<strong>on</strong>g>or</str<strong>on</strong>g> regulati<strong>on</strong>s c<strong>on</strong>cerning legally carrying ac<strong>on</strong>cealed handgun. A unit <strong>of</strong> local government may adopt an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinance to permit the posting <strong>of</strong> aprohibiti<strong>on</strong> against carrying a c<strong>on</strong>cealed handgun, in acc<str<strong>on</strong>g>or</str<strong>on</strong>g>dance with G.S. 14-415.11(c), <strong>on</strong> localgovernment buildings, their appurtenant premises, and parks. The Department <strong>of</strong> Justice shall attempt to secure from each state permissi<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> N<str<strong>on</strong>g>or</str<strong>on</strong>g>thCarolina residents who hold a valid N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina c<strong>on</strong>cealed handgun permit to carry a c<strong>on</strong>cealedhandgun in that state, either <strong>on</strong> the basis <strong>of</strong> the N<str<strong>on</strong>g>or</str<strong>on</strong>g>th Carolina permit <str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>on</strong> the basis that the N<str<strong>on</strong>g>or</str<strong>on</strong>g>thCarolina permit is sufficient to permit the issuance <strong>of</strong> a similar license <str<strong>on</strong>g>or</str<strong>on</strong>g> permit by the <str<strong>on</strong>g>other</str<strong>on</strong>g> state.(2003-199, s. 1.)§ 14-269. Carrying c<strong>on</strong>cealed <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>.(a) It shall be unlawful f<str<strong>on</strong>g>or</str<strong>on</strong>g> any pers<strong>on</strong> willfully and intenti<strong>on</strong>ally to carry c<strong>on</strong>cealed about his pers<strong>on</strong> anybowie knife, dirk, dagger, slung shot, loaded cane, metallic knuckles, raz<str<strong>on</strong>g>or</str<strong>on</strong>g>, shurikin, stun gun, <str<strong>on</strong>g>or</str<strong>on</strong>g><str<strong>on</strong>g>other</str<strong>on</strong>g> deadly weap<strong>on</strong> <strong>of</strong> like kind, except when the pers<strong>on</strong> is <strong>on</strong> the pers<strong>on</strong>'s own premises.(a1) It shall be unlawful f<str<strong>on</strong>g>or</str<strong>on</strong>g> any pers<strong>on</strong> willfully and intenti<strong>on</strong>ally to carry c<strong>on</strong>cealed about his pers<strong>on</strong> anypistol <str<strong>on</strong>g>or</str<strong>on</strong>g> gun except in the following circumstances:(1) The pers<strong>on</strong> is <strong>on</strong> the pers<strong>on</strong>'s own premises.(2) The deadly weap<strong>on</strong> is a handgun, and the pers<strong>on</strong> has a c<strong>on</strong>cealed handgun permit issued inacc<str<strong>on</strong>g>or</str<strong>on</strong>g>dance with Article 54B <strong>of</strong> <strong>this</strong> Chapter <str<strong>on</strong>g>or</str<strong>on</strong>g> c<strong>on</strong>sidered valid under G.S. 14-415.24.(3) The deadly weap<strong>on</strong> is a handgun and the pers<strong>on</strong> is a military permittee as defined under G.S.14-415.10(2a) who provides to the law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficer pro<strong>of</strong> <strong>of</strong> deployment as required underG.S. 14-415.11(a).(b) This prohibiti<strong>on</strong> shall not apply to the following pers<strong>on</strong>s:(1) Officers and enlisted pers<strong>on</strong>nel <strong>of</strong> the armed f<str<strong>on</strong>g>or</str<strong>on</strong>g>ces <strong>of</strong> the United States when in discharge <strong>of</strong>their <strong>of</strong>ficial duties as such and acting under <str<strong>on</strong>g>or</str<strong>on</strong>g>ders requiring them to carry arms and <str<strong>on</strong>g>weap<strong>on</strong>s</str<strong>on</strong>g>;(2) Civil and law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficers <strong>of</strong> the United States;(3) Officers and soldiers <strong>of</strong> the militia and the Nati<strong>on</strong>al Guard when called into actual service;(4) Officers <strong>of</strong> the State, <str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>of</strong> any county, city, <strong>town</strong>, <str<strong>on</strong>g>or</str<strong>on</strong>g> company police agency charged with theexecuti<strong>on</strong> <strong>of</strong> the laws <strong>of</strong> the State, when acting in the discharge <strong>of</strong> their <strong>of</strong>ficial duties;(5) Sw<str<strong>on</strong>g>or</str<strong>on</strong>g>n law enf<str<strong>on</strong>g>or</str<strong>on</strong>g>cement <strong>of</strong>ficers, when <strong>of</strong>f-duty, provided that an <strong>of</strong>ficer does not carry ac<strong>on</strong>cealed weap<strong>on</strong> while c<strong>on</strong>suming alcohol <str<strong>on</strong>g>or</str<strong>on</strong>g> an unlawful c<strong>on</strong>trolled substance <str<strong>on</strong>g>or</str<strong>on</strong>g> while alcohol<str<strong>on</strong>g>or</str<strong>on</strong>g> an unlawful c<strong>on</strong>trolled substance remains in the <strong>of</strong>ficer's body.(b1) It is a defense to a prosecuti<strong>on</strong> under <strong>this</strong> secti<strong>on</strong> that:(1) The weap<strong>on</strong> was not a firearm;(2) The defendant was engaged in, <str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>on</strong> the way to <str<strong>on</strong>g>or</str<strong>on</strong>g> from, an activity in which he legitimately usedthe weap<strong>on</strong>;(3) The defendant possessed the weap<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> that legitimate use; and(4) The defendant did not use <str<strong>on</strong>g>or</str<strong>on</strong>g> attempt to use the weap<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> an illegal purpose. The burden <strong>of</strong>proving <strong>this</strong> defense is <strong>on</strong> the defendant.(b2) It is a defense to a prosecuti<strong>on</strong> under <strong>this</strong> secti<strong>on</strong> that:(1) The deadly weap<strong>on</strong> is a handgun;(2) The defendant is a military permittee as defined under G.S. 14-415.10(2a); and(3) The defendant provides to the court pro<strong>of</strong> <strong>of</strong> deployment as defined under G.S. 14-415.10(3a).(c) Any pers<strong>on</strong> violating the provisi<strong>on</strong>s <strong>of</strong> subsecti<strong>on</strong> (a) <strong>of</strong> <strong>this</strong> secti<strong>on</strong> shall be guilty <strong>of</strong> a Class 2misdemean<str<strong>on</strong>g>or</str<strong>on</strong>g>. Any pers<strong>on</strong> violating the provisi<strong>on</strong>s <strong>of</strong> subsecti<strong>on</strong> (a1) <strong>of</strong> <strong>this</strong> secti<strong>on</strong> shall be guilty <strong>of</strong> aClass 2 misdemean<str<strong>on</strong>g>or</str<strong>on</strong>g> f<str<strong>on</strong>g>or</str<strong>on</strong>g> the first <strong>of</strong>fense. A sec<strong>on</strong>d <str<strong>on</strong>g>or</str<strong>on</strong>g> subsequent <strong>of</strong>fense is punishable as a Class Ifel<strong>on</strong>y.(d) This secti<strong>on</strong> does not apply to an <str<strong>on</strong>g>or</str<strong>on</strong>g>dinary pocket knife carried in a closed positi<strong>on</strong>. pers<strong>on</strong> who uses defensive f<str<strong>on</strong>g>or</str<strong>on</strong>g>ce knew <str<strong>on</strong>g>or</str<strong>on</strong>g> had reas<strong>on</strong> to believe that an unlawful and f<str<strong>on</strong>g>or</str<strong>on</strong>g>cibleentry <str<strong>on</strong>g>or</str<strong>on</strong>g> unlawful and f<str<strong>on</strong>g>or</str<strong>on</strong>g>cible act was occurring <str<strong>on</strong>g>or</str<strong>on</strong>g> had occurred.(c) The presumpti<strong>on</strong> set This federal fundingis made available to CAMPO <strong>on</strong> an annual basis. The LAPP process follows the federal fiscalyear so that funding obligati<strong>on</strong> w<str<strong>on</strong>g>or</str<strong>on</strong>g>ks in a timely fashi<strong>on</strong>. CAMPO has identified threetransp<str<strong>on</strong>g>or</str<strong>on</strong>g>tati<strong>on</strong> modes f<str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>this</strong> program (roads, transit and bike/ped). CAMPO projects it willhave $10 milli<strong>on</strong> available f<str<strong>on</strong>g>or</str<strong>on</strong>g> FY 2013. The model investment mix f<str<strong>on</strong>g>or</str<strong>on</strong>g> the program is $6.5milli<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> roads, $1.5 milli<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> transit and $2 milli<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> bike/ped. In <str<strong>on</strong>g>or</str<strong>on</strong>g>der to be eligiblef<str<strong>on</strong>g>or</str<strong>on</strong>g> LAPP funding, a project must meet nine (9) criteria (see attached).The main points to understand with <strong>this</strong> program is that the project must meet all applicablefederal requirements and it must be locally administered with funds expended by a localunit <strong>of</strong> government with reimbursement based <strong>on</strong> a Locally Administered Project Agreementwith NCDOT (same procedure as the D<strong>on</strong> Miller Sidewalk Project). The LAPP process is acompetitive procedure where candidate projects are submitted to CAMPO f<str<strong>on</strong>g>or</str<strong>on</strong>g> evaluati<strong>on</strong> andreview acc<str<strong>on</strong>g>or</str<strong>on</strong>g>ding a rating system that was developed f<str<strong>on</strong>g>or</str<strong>on</strong>g> <strong>this</strong> program. CAMPO will completeits evaluati<strong>on</strong> <strong>of</strong> all applicati<strong>on</strong>s <strong>this</strong> fall and announce the projects that are funded inJanuary 2012.FindingsI met with the CAMPO staff last m<strong>on</strong>th to discuss the US 70/White Oak Projectand it’s potential f<str<strong>on</strong>g>or</str<strong>on</strong>g> LAPP funding. The resp<strong>on</strong>se was generally positive. I recommend thatGarner submit an applicati<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> LAPP funding <strong>of</strong> the US 70/White Oak Project to CAMPO. Apre-applicati<strong>on</strong> submittal is due <strong>on</strong> October 3 rd and the final applicati<strong>on</strong> must be submitted byOctober 31 st . Based <strong>on</strong> CAMPO rating criteria, I suggest we submit f<str<strong>on</strong>g>or</str<strong>on</strong>g> 50% funding <strong>of</strong> projectc<strong>on</strong>structi<strong>on</strong> costs ($2.6 milli<strong>on</strong>). The maximum local cost share you can receive sc<str<strong>on</strong>g>or</str<strong>on</strong>g>ingcredit from CAMPO is 50%. Under <strong>this</strong> proposal the Town would pay f<str<strong>on</strong>g>or</str<strong>on</strong>g> 50% <strong>of</strong> roadwayc<strong>on</strong>structi<strong>on</strong> costs and 100% <strong>of</strong> design and project management costs. If LAPP funding is approved by CAMPO, the Town must enter into an Agreement withNCDOT that spells out all <strong>of</strong> our resp<strong>on</strong>sibilities (including federal requirements).The Town, through its c<strong>on</strong>sultants, must manage project c<strong>on</strong>structi<strong>on</strong> and pay f<str<strong>on</strong>g>or</str<strong>on</strong>g> theroad improvements and then get reimbursement from the state. There is a great deal<strong>of</strong> rep<str<strong>on</strong>g>or</str<strong>on</strong>g>ting requirements and federal procedures that must be followed with LAPP.This tends to slow the entire process down usually resulting in additi<strong>on</strong>al dollars beingspent to meet project rep<str<strong>on</strong>g>or</str<strong>on</strong>g>ting requirements.2. Under <strong>this</strong> applicati<strong>on</strong> the Town <strong>of</strong> Garner is advising CAMPO the Town will fund thedesign w<str<strong>on</strong>g>or</str<strong>on</strong>g>k with its own dollars and have the project in positi<strong>on</strong> to get the federalc<strong>on</strong>structi<strong>on</strong> funding obligated by Oct/Nov 2012. This includes completi<strong>on</strong> <strong>of</strong> thefederal NEPA process, securing right-<strong>of</strong>-way acc<str<strong>on</strong>g>or</str<strong>on</strong>g>ding to federal requirements andobtaining applicable DOT permits. This is an aggressive schedule and will presentchallenges in <str<strong>on</strong>g>or</str<strong>on</strong>g>der to achieve it. I had c<strong>on</strong>versati<strong>on</strong>s with c<strong>on</strong>sultants who havew<str<strong>on</strong>g>or</str<strong>on</strong>g>ked <strong>on</strong> projects in the past with federal funding and they indicate <strong>this</strong> will be avery tight schedule. F<str<strong>on</strong>g>or</str<strong>on</strong>g> ourapplicati<strong>on</strong> to be competitive, we must realize benefits that exceed the total cost <strong>of</strong> the project.We are currently collecting data and evaluating the need f<str<strong>on</strong>g>or</str<strong>on</strong>g> outside resources to assist with thecompilati<strong>on</strong> and validati<strong>on</strong> <strong>of</strong> <strong>this</strong> analysis.While the final grant submissi<strong>on</strong> is not due until October 31, 2011 the pre-applicati<strong>on</strong> must becompleted by October 3, 2011. In <str<strong>on</strong>g>or</str<strong>on</strong>g>der to complete the pre-applicati<strong>on</strong>, I need guidance from theCouncil regarding the amount <strong>of</strong> n<strong>on</strong>-Federal matching dollars that will be committed by theTown <strong>of</strong> Garner.In evaluating your decisi<strong>on</strong> f<str<strong>on</strong>g>or</str<strong>on</strong>g> matching funds, please keep the following points in mind:The grant submissi<strong>on</strong> will meet the criteria f<str<strong>on</strong>g>or</str<strong>on</strong>g> a Rural Project, which does not require amatch; however matching funds increases the competitiveness <strong>of</strong> the applicati<strong>on</strong>.
