coming year, <strong>and</strong> the funding for the Assistance Scheme for NeedyStudent Members will be increased, so th<strong>at</strong> more needy students willbenefit from the activities of these uniformed groups.Youth Hostels10. To meet the aspir<strong>at</strong>ions of some working youths who wish tolive away from home <strong>and</strong> give them an opportunity to accumul<strong>at</strong>e savingsfor future development, the Chief Executive announced in 2012 th<strong>at</strong> theGovernment would provide NGOs with the full capital cost fordeveloping hostels <strong>and</strong> associ<strong>at</strong>ed facilities under the Youth HostelScheme. <strong>The</strong> two projects in Sheung Wan <strong>and</strong> Tai Po respectively areprogressing well <strong>and</strong> are now preparing for pre-construction consultancystudies. We will further launch two new projects in Mongkok <strong>and</strong>Jordan respectively. Together, the four projects are expected to provideabout 1 000 rented hostel places for young people, the first b<strong>at</strong>ch ofwhich could be completed in 2016/17 the earliest.Culture <strong>and</strong> the Arts11. We endeavor to provide more cultural facilities in support ofthe development of culture <strong>and</strong> the arts in Hong Kong.12. Plans are in h<strong>and</strong> to undertake major renov<strong>at</strong>ion of the HongKong Museum of Art with a view to enhancing <strong>and</strong> exp<strong>and</strong>ing itsfacilities. A new gallery will be built for displaying the works of localartists. <strong>The</strong> Museum will enhance its collabor<strong>at</strong>ion with local artists,guest cur<strong>at</strong>ors <strong>and</strong> art partners to provide dynamic <strong>and</strong> cre<strong>at</strong>ive pl<strong>at</strong>formsfor Hong Kong art. After renov<strong>at</strong>ion, it will also display more art worksfrom its collections, cur<strong>at</strong>e major intern<strong>at</strong>ional art exhibitions on worldcultures, ranging from classical ones to contemporary ones, nurturedon<strong>at</strong>ion culture, <strong>and</strong> foster art educ<strong>at</strong>ion.13. With the development of the East Kowloon region, theGovernment is planning to build a cross district community culturalcentre (CDCCC) in Ngau Tau Kok with a 1 200-se<strong>at</strong> auditorium <strong>and</strong> a550-se<strong>at</strong> the<strong>at</strong>re. <strong>The</strong> CDCCC, which is suitable for staging variousperformances by district cultural groups <strong>and</strong> different arts organis<strong>at</strong>ions,will c<strong>at</strong>er for the needs of the community of East Kowloon <strong>and</strong> the artssector for cultural <strong>and</strong> performing arts programmes <strong>and</strong> rel<strong>at</strong>ed facilitiesas well as give new cultural impetus to East Kowloon.3


<strong>The</strong> <strong>Human</strong> <strong>Rights</strong> <strong>and</strong> <strong>Document<strong>at</strong>ion</strong> <strong>Centre</strong> <strong>at</strong> <strong>UNAM</strong>2007. 275 A third project, also made possible with KAF assistance, is on the Africanhuman rights protection system.<strong>The</strong> HRDC also works closely with the US Embassy in Windhoek. For example,the Embassy provides grants to conduct basic legal <strong>and</strong> human rights training inthe country. Through the French Mission for Cooper<strong>at</strong>ion <strong>and</strong> Cultural Affairs,the HRDC offers staff <strong>at</strong> the Office of the Ombudsman training in advocacy <strong>and</strong>investig<strong>at</strong>ion skills to enable them to deal with human rights <strong>and</strong> environmentalcomplaints. Apart from this, the HRDC <strong>and</strong> the Office of the Ombudsman 276have traditionally cooper<strong>at</strong>ed closely. Other assistance may come from recentdiscussions with the Spanish Ambassador to Namibia, which hold promise interms of prospective cooper<strong>at</strong>ion in the field of children’s rights <strong>and</strong> orphanagesin Namibia. Financial assistance from the Embassy of Finl<strong>and</strong> in Windhoek hasenabled the HRDC to engage in various projects on customary law in Namibia. 277Other projects with the Finnish are planned on the issue of clim<strong>at</strong>e change <strong>and</strong>renewable resource management.275 Case 2/2007 is th<strong>at</strong> of Mike Campbell v the Republic of Zimbabwe. Campbell first appealedagainst seizure of his property <strong>at</strong> the Zimbabwean Supreme Court in March 2007, but tookhis case to the SADC Tribunal after wh<strong>at</strong> his lawyers said was an “unreasonable delay” byZimbabwe’s highest court in dealing with the m<strong>at</strong>ter. In December 2008, the Namibia-basedTribunal barred President Robert Mugabe’s government from evicting Campbell from hisMount Carmel farm in Chegutu, pending a final ruling on the farmer’s main applic<strong>at</strong>ion:thus challenging the legality of the Harare administr<strong>at</strong>ion’s controversial programme toseize white-owned l<strong>and</strong> for redistribution to l<strong>and</strong>less blacks. Campbell requested the SADCTribunal to find Harare in breach of its oblig<strong>at</strong>ions as a member of the regional bloc afterit signed into law the Constitution of Zimbabwe Amendment No. 17 two years ago. <strong>The</strong>amendment allows Mugabe’s government to seize farml<strong>and</strong> without compens<strong>at</strong>ion, <strong>and</strong>bars courts from hearing appeals from dispossessed white farmers. <strong>The</strong> white farmer alsoasked the Tribunal to declare Zimbabwe’s l<strong>and</strong> reforms racist <strong>and</strong> illegal under the SADCTre<strong>at</strong>y, adding th<strong>at</strong> Article 6 of the Tre<strong>at</strong>y bars member st<strong>at</strong>es from discrimin<strong>at</strong>ing againstany person on the grounds of gender, religion, race, ethnic origin or culture.276 http://ombudsman.org.na; last accessed 10 March 2008.277 For example, the L<strong>and</strong> <strong>and</strong> Minority <strong>Rights</strong> Project focuses on the most pressing issue fortraditional authorities presently, namely l<strong>and</strong>. Both in southern Namibia <strong>and</strong> in the areaof Tsumkwe, traditional authorities feel thre<strong>at</strong>ened by the fact th<strong>at</strong> the Communal L<strong>and</strong>Boards are not sensitive to their needs <strong>and</strong> newcomers are being advantaged. Research onthe Communal L<strong>and</strong> Reform Act, 2002 (No. 5 of 2002) is conducted, focusing on the modusoper<strong>and</strong>i <strong>and</strong> the results of the Board’s actions, as well as the possible assistance th<strong>at</strong> theConvention on the <strong>Rights</strong> of Indigenous Minorities can give these communities should thegovernment decide to support the tre<strong>at</strong>y. Another project concerned with customary law isthe so-called Ascertainment Project. This project has the goal to collectively publish all theindividual customary laws of Namibia.137


<strong>The</strong> <strong>Human</strong> <strong>Rights</strong> <strong>and</strong> <strong>Document<strong>at</strong>ion</strong> <strong>Centre</strong> <strong>at</strong> <strong>UNAM</strong>Moreover, the UNESCO Chair is partnered with Biodiversity Transect Africa(BIOTA) Southern Africa, 278 which is mainly funded by the German FederalMinistry of Educ<strong>at</strong>ion <strong>and</strong> Research. 279 Interdisciplinary research projectsconcentr<strong>at</strong>e on environmental studies in Namibia <strong>and</strong> the western parts of SouthAfrica. 280University partnershipsApart from the above-mentioned UNITWIN partners with the UNESCOChair, <strong>UNAM</strong>’s HRDC <strong>and</strong> the Faculty of Law have numerous universitypartnerships <strong>at</strong> intern<strong>at</strong>ional level, amongst which are the University of Bremen(Germany), 281 the University of Stellenbosch (South Africa), 282 the School ofAfrican <strong>and</strong> Oriental Studies <strong>at</strong> the University of London (Engl<strong>and</strong>), 283 <strong>and</strong>Stanford University (USA). 284 With these partners, the HRDC aims to fosteracademic exchange towards excellence in research. Recently, the Munich Schoolof Philosophy 285 has drawn the HRDC’s <strong>at</strong>tention to a project on clim<strong>at</strong>e change<strong>and</strong> global poverty, which may lead to future cooper<strong>at</strong>ion. Moreover, recentdiscussions with the Finnish Embassy have led to the deliber<strong>at</strong>ion to exp<strong>and</strong> <strong>and</strong>elabor<strong>at</strong>e on partnerships in relevant fields with institutions of higher learningin Finl<strong>and</strong>.<strong>The</strong> <strong>Human</strong> <strong>Rights</strong> Forum of NamibiaIn February 2008, the Namibian <strong>Human</strong> <strong>Rights</strong> Forum was informally establishedby various key actors who endeavour to promote respect for human rights, therule of law, <strong>and</strong> democracy in Namibia. So far, the Forum consists of politicians,law professors, NGOs, legal practitioners, members of the Law Society, the AnticorruptionCommission, <strong>and</strong> the Office of the Ombudsman, amongst others. <strong>The</strong>Forum intends to monitor the human rights situ<strong>at</strong>ion in Namibia <strong>and</strong> the SADC278 http://www.biota-africa.org; last accessed 25 February 2008.279 Hinz, MO. 2005. <strong>The</strong> <strong>Human</strong> <strong>Rights</strong> <strong>and</strong> <strong>Document<strong>at</strong>ion</strong> <strong>Centre</strong> <strong>at</strong> <strong>UNAM</strong>region. Its objective is to promote human rights <strong>and</strong> protect the n<strong>at</strong>ionaldemocr<strong>at</strong>ic space by highlighting potential thre<strong>at</strong>s <strong>and</strong> abuses.<strong>The</strong> Forum recently requested the HRDC to investig<strong>at</strong>e the legal <strong>and</strong> socialconditions associ<strong>at</strong>ed with Police <strong>and</strong> holding cells in Namibia. <strong>The</strong> findingsof this report, coupled with those of the Ombudsman’s 2006 report on the samem<strong>at</strong>ter, 286 depicted th<strong>at</strong> holding cells throughout the country were continuouslybeset by poor sanitary conditions, overcrowding, insufficient food supplies,unsafe infrastructure, stagnant w<strong>at</strong>er, lack of access to medical care facilities<strong>and</strong> potable w<strong>at</strong>er, <strong>and</strong> insufficient b<strong>at</strong>hroom <strong>and</strong> shower facilities. 287Conclusion<strong>The</strong> HRDC is an active <strong>and</strong> important institution when it comes to safeguarding,upholding <strong>and</strong> encouraging respect for human rights, the rule of law <strong>and</strong>democracy in Namibia <strong>and</strong> southern Africa. <strong>The</strong> <strong>Centre</strong> provides advocacy,reviews the human rights situ<strong>at</strong>ion, <strong>and</strong> contributes to capacity-building in thefield of human rights law in Namibia. <strong>The</strong> HRDC’s UNESCO Chair contributessignificantly to scientific advancement through high-level research, teaching<strong>and</strong> networking. Highlights in its history include high degree of involvement bymembers of the <strong>Centre</strong> in research <strong>and</strong> community service, <strong>and</strong> the contributionthe <strong>Centre</strong> has made to legal educ<strong>at</strong>ion in respect of human rights in Namibi<strong>at</strong>hrough its academic programmes <strong>and</strong> project outputs. Members of the <strong>Centre</strong>also serve as consultants on human rights issues to a range of n<strong>at</strong>ional <strong>and</strong>intern<strong>at</strong>ional institutions. On a n<strong>at</strong>ional level, the HRDC cooper<strong>at</strong>es closelywith, amongst others, governmental <strong>and</strong> non-governmental organis<strong>at</strong>ions, legalpractitioners, members of the Law Society, the Anti-corruption Commission, theOffice of the Ombudsman. Intern<strong>at</strong>ionally, the HRDC aims to foster academicexchange towards excellence in research with various renowned institutions oftertiary educ<strong>at</strong>ion around the globe.286 Walters, JR. 2006.
